K-1 Fiance(e) Visa Process & ProceduresFinal checklist before interview
Hi JakeyMatey,
How's it going? Funny I am in the same predicament as you but for different reasons of course.
I am filling out the forms & hope to mail them in the next 24 hours.
Did you not attach the passport photo's to form DS-156?
I'm not sure whether to send them in with the forms as the form instructs or to take them to the embassy for the interview as the instructions direct?
Or do we do both?
Good to know we're not alone,

USCIS Expedite Criteria

We have another memeber here that just put in for an expedite for his fiance in Pakistan for the same reasons. He hasn't heard yet.

You need to provide specific documentation that the beneficiary's life is directly and immediately at risk. What happens in the country in general is not specific enough to your case and does not prove that any direct risk exists. Good luck!

Thanks for the info! good.gif

I'm sorry I don't know the answer to your question but did want to tell you that I'm sorry your fiance is involved in the turmoil there. I'm also glad you have some internet access with them so that you can offer support. That's important in any LD relationship let along one which is torn apart by war. I don't believe anyone in Iraq has been given any fast track on visas. I don't know how that works. I guess you might try requesting for expedite? Can you fiance get to some other area where there is Embassy access to be interviewed? If the Embassy is closed there, I don't know how they could be doing any visa processing at all. If his/her life is in danger, perhaps they can expedite.

Hope he/she stays safe. rose.gif

I think expedited visas are given when the sponsor is going to war (as in a US soldier going to Iraq), not when the beneficiary is in danger. Also, if it came down to it, I think my fiance could make it to Yerevan, which is where the US embassy personnel are, I believe.

Does anyone know who I could contact in the US or Yerevan (?) for information?

My fiance is Georgian and in Tbilisi. crying.gif We just got the letter, saying the Vermont center has received our 129F. good.gif My question for anyone with experience in this: does a local war, in which the US politically supports the country of the beneficiary (for example, my fiance's country is Georgia, which the US has experessed support for) usually cause the US (either the US domestic portion or the US embassy portion) to be more sympathetic to the process and at least speed up approval? Obviously, I want to get him out of there as soon as possible. (I know the US embassy is closed until things are safe again.) Is anything being done to help existing visa applicants? Is there anything I can do (other than offer moral support via the internet)? unsure.gif

I've been reading about people's frustrations and anxieties. I want you all to know that even though we got a fast approval we don't take it for granted. We know how lucky we are and seriously wish the same for you. I remember how nervous I was while we were waiting for our NOA2 and how happy and relieved and excited I was when we got it. I can't imagine how people who've been waiting 100+ days feel. Just think about the feeling of elation you'll have when you finally get your NOA2.
This process can be horribly cruel sometimes and I know you're all decent people who just want to be with the one you love. I congratulate you all for doing this the proper way and I wish you all fast approvals. (L)

We got our NOA1 on July 31. And our NOA2 on August 23. That's only 23 days! I never thought it would be so fast. I figured we'd be waiting 3 months or more.

For all those people worried about the lack of activity for their cases....We never even got a touch. No touches, no RFE's, nothing. So don't worry about touches. They don't mean that much. One day I was about to leave for work. I thought I'd check my cases status before I went, hoping for some kind of change, anything at all. And there it was, simple, surprising..."This case has been approved."

To all those who are still waiting...good luck, have patience, and stay positive.

We were concerned about a prior J 1 visa affecting my DIL's K-3 application. It does not appear to have had any adverse effect through the USCIS process. The case is now at the Bangkok embassy, and we will know more later. It should not be a problem when she shows her old passport and any other papers that show she did not violate the terms of the visa.

Your fiancee absolutely did the right thing and the USCIS will recognize that. People go to America on all kinds of visas, meet US citizens and fall in love. In my case it was the VWP but for some its HB1s and other B2's. It really doesn't matter.

As long as you have been together in the last two years and can prove the relationship is legit then you are good to go. You will need to give a statement about how you met when you file and in there you can include the details of her visa, including the date she left the US.

Congratulations on finding VJ you just made your life 100 times easier smile.gif

Bex xxx

Edit - sadly there is no set time for any filer and trying to second guess USCIS can be a dangerous game. Check out the Immigration Timeline feature on the panel at the top of the page and you can view all the application times for petitions filed in India. You should also check out the regional forum as they will be able to give you a better idea of average processing times for Indian filers.

Thanks for the reply. And you're 1000% right about VJ making my life easier. You guys rock!

Thanks for the reply. I wish we had enough time before her visa expired for us to get married. A lot of things happened all of a sudden. So I guess we will have to go from end to end this tedious process. We are staying positive as this it is a learning process. Hopefully we will be able to help others with the shared knowledge that we are going to acquire while going through this whole process.

QUOTE (aleena @ Jun 18 2008, 12:16 PM) <{POST_SNAPBACK}>
There will be absolutely no interference with the K1 process if she departed the US when her visa expired.
It will actually help you as it will be easier for you to prove that you met in the last 2 years and have a bona fide relationship.
I strongly recommed that you send a copy of her passport and US visa with you paperwork as evidence of your relationship.

It would have been easier if you married while she was till on H1B... As far as i know that is a dual intent visa and she could have just done Adjutment of Status and got a green card...

Wow, that was quick,Thank you.

Yes, she did abide by all the rules. Do you happen to have an idea how long does it usually takes for a person in India to get a K1 visa?

QUOTE (ZeeNusah @ Jun 18 2008, 12:13 PM) <{POST_SNAPBACK}>
I don't think so. She left before her visa expired and complied by all the rules so she should be fine.

There are checks that are done on both petitioners and beneficiaries during the K1 process and the length of time it takes to complete the checks is dependent on many factors.

Welcome to VJ and good luck on your journey smile.gif

K-1 Fiance(e) Visa Process & ProceduresFilling for K1 for a person who had H1B previously
Hi, I just stumbled across this board while searching for an inquiry that I have, and I am so glad that I did. This seems like the best forum for immigration issues so I thought I should try to gather some info on my and my fiancé’s situation. Here is the issue:

My fiancé who was in the U.S on H1B (work) visa has left as her visa had expired. She left because she did not want to stay illegally in the U.S. even for a minute. Now my question be will it affect the amount of time it takes to process the K1 visa as I have heard that immigration officials launch an investigation to see if the person who is going to get the visa was ever in the U.S.A.

My fiancé: She is from India and was my co-worker for 3 years.

I really appreciate you taking time to explain to me with reference to this issue.

Thank you,

TK

When did you receive NOA1? I am wondering if I should do this though I have heard others were told that their senators/reps couldn't do anything until 6 months after their NOA1 date had passed. How did you contact Hillary's office, by email?

i contacted her back in June 6. by faxing the form they have posted on her website and a copy of my NOA and a letter explaining my concerns which i clearly stated that my main concern is the slow process at vermont. my Noa date is March 5.
