K-1 Fiance(e) Visa Process & ProceduresConfused On Documents!!
Hello,


I just started my process with the K-1 Visa, I am trying to to do this process on my own without no legal help since hiring a lawyer is so expensive these days. I have obtained all the documents needed in order to apply for the K-1 Visa but I have a feeling I am missing something. I did seek legal help with a lawyer he was nice enough to provide me with some advice but was unable to go into details because he did not take my case. So far the documents listed below is what I have obtain using this site as my guide. The site doesn't explain who details information goes on which form, so I was wondering if anyone is kind enough to guide me in the right direction or correct me if anything i have included is incorrect

Here are the documents I have obtained and filled out

1. I-129 form (includes both of our information)
2. G-325 (fiance info, 2 copies)
3. G-325 (us citizen info, 1 copy)
4. I-134 ( I have 2 sponsors)
5. Letter stating we are free to marry (2 letters one for each)
6. D-156 (confused on who's info should be included Mine or Fiancee's)
7. D-156K (confused on who's info should be included Mine or Fiancee's)
8. I have all the other documents requested as well just am unsure of what is sent off along with the forms

Now here the issue I have everything filled out expect the D-156 and D-156K I Don't Know what information goes on each form, whether is the US Citizen info on these forms or the Fiance info.
When something doesn't apply to you do you leave it blank or write n/a? Can anyone provide me with complete details on what the package should include and what is needed from me as the U.S citizen.

Times are rough for me to spent money on a lawyer, when we have useful websites, I searched all the forms and was unable to find a clear answer. I am trying to accomplish this on my own with the help of anyone that is willing to provide me with advice on this matter. Can anyone help me please!!

Hey VJ Member

I am filling out the G-325A form for the k-1 visa, there is one filled out for me and one for my fiancee.
Now they ask for our parents information first, what happens in the case where the parents are no longer alive do we include them still?

The next question you are ask current husband or wife, former husband or wife?], What exactly do we write there. Are they asking if we have a current/former spouse or the current/former spouse of our parents?

The address don't completely fit on this form should i attached a extra page writing the complete spelling of address?

Finally, I had read that the fees for the K-1 visa had be decreased, is it now $350 or is it still the $455 (US Currency)

As long as you don't file the paperwork to make you legally wed in that country, there shouldnt be an issue. I wouldnt get her to bring any pictures of it to the interview and makes sure she doesnt call you her husband or they will think you have married and make you start over on a K3.

Hello All,

I was hoping you fine folks could help out with something that I'm newly concerned about. I'm a US citizen and my fiancee is an Australian citizen and we've already submitted the petition for the K1 visa at the VSC (we waited a lot longer than we should have). We have already planned a wedding in Australia in November and I highly doubt that the K-1 visa for my fiancee would be granted by then. We're also planning an additional reception here in the US for my friends and family.

What concerns me is that, technically, we would already be married in Australia by the time my fiancee would be called in for the interview at the consulate there. Is this something I need to worry about? The original plan was to file for the K1 in advance, obtain the visa, have a ceremony in Australia for her family and friends, and then come back to the US for a court marriage and another reception for my family and friends.

Any advice would be greatly appreciated. Much thanks!

Hello All,

We're preparing all of the documents necessary for the packet 3 phase since our I-129F petition has just left the NVC.

I noticed on the Sydney consulate website that they require a "long form" birth certificate with the names of the parents on there. My fiancee only has a short form birth certificate with just her name, date, and location of birth (no names of parents on there). The problem is that my fiancee was not born in Australia and her family have maintained no ties to her country of birth, and so we would be unable to obtain a long-form birth certificate.

Do you think that this will be a problem with the embassy, and if so, what have others provided as alternative documentation?

I am a U.S. citizen and my boyfriend is Canadian. After knowing eachother for 9 years and dating on and off for all this time we finally feel like we're in a position for him to move here permanently! I have two questions...

We've been reading up on the rules, guides, tips etc...But we are still confused about how to go about things and in which order. Which is why we are considering hiring an immigration lawyer.
Have any of you used a lawyer? Can anyone in NYC recommend a lawyer who won't take us for a ride?


Also, while we are considering a k1 visa- we have also been looking into workers visas as well as a performers visa (my boyfriend is a musician).
We want this so badly and are worried the slightest screw up on our part might impede us being together. We just don't want to be apart anymore.
Any advice would be greatly appreciated!

In the biographical information forms there are 4 identical copies. I believe it says to fill out all 4, but does anyone know why the reason is for this? Just curious...


Also, if you had an alien registration number- would you know it? I'm so confused. I know this paperwork seems pretty self explanatory, but I just want to make certain everything is absolutely correct.

thank you so much for those links. you know, i've been here for a while (as a lurker and poster) and i've read the guides and faqs several times, but somehow it's more heartening to read it directly. so this was appreciated. i often read that people have been missing their fiance/es and it's been so long since they've seen them and the wait is so long. perhaps these people live further away and it's just not possible, but i do tend to worry. you never know when policies are going to change in this tentative world of the people who have to go through this process. i read this is asked on a daily basis, so i apologize.

my fiance was laid off from his job a while back and since he is from a small town there has been very little opportunity for him to be employed. the odd job here and there. he will have a job secured mid-summer, but nothing at the moment.
how will this affect our visits when i mail our I-129F? how will he be able to convince border guards (should he be asked) that he has NO intention of illegal immigration? once we mail the I-129F do they type our information in their computer?
do they know at the border who has/is applying?

I know there needs to be an interview. do they schedule that for you? Is it directly after getting your NoA2?

my fiancee just crossed yesterday, but there is a big problem. when he was crossing they asked him all the usual stuff "what he was going for" "how we met" but then they asked "are you engaged?" and the blockhead said "NO" for some reason.
after i told him (under the advice of everybody here) he musn't EVER lie to a border guard.

Hello everyone. I'm going positively insane! For some reason it's WORSE when you file and it's WORSE knowing you have 4 months to wait. Kind of like waiting for water to boil.
...But you all know this.

I filed in august and we have not been touched yet. I'm assuming this is not unusual, but it would be really REALLY nice to know our case has been at least LOOKED at!

My questions are (and I'm sorry for all the blathering):

Do people usually get touched after a certain amount of time, or could it happen it any time?

Do the people at the border have a record of our NOA1 in their computer?
I'm curious.

Your situation is identical to my best friends situation on their visa. I am no expert but what I can say is how things went for her. She was unemployed and a full-time student. She filled out the I-134 form for herself and then had her mother only co-sponsor for them. Her fiance did not have work at that time either. Everything went totally fine and they have been married for 2 years now. If you search around you can find alot of what other people have done. I am having to get a co-sponsor myself because of my student status. Good luck.
