K-1 Fiance(e) Visa Process & ProceduresPacket 3 confusion
QUOTE (Kathryn41 @ Aug 8 2009, 11:54 AM) <{POST_SNAPBACK}>
She will need the originals for the interview. If you want to hold on to the originals, then you will should probably consider flying over there to bring them to her for the interview and then flying them back home. I know it is tough to let the originals out of your possession - my now husband had difficulties with that too. It isn't so much not trusting your partner as not trusting the courier or mail system with these precious documents. Still, she will need to have the originals of any documents you submitted with the petition and the Affidavit of Support needs to have original documents so the Consular officials can verify they are not forgeries. Make and keep copies of everything you do send to your fiancee and make sure she has copies of everything you have submitted already. Send them by the most secure means you know regardless of the cost.

Oh, you don't send your passport - send your birth certificate - as proof of your US citizenship.

wait a minute- wait a minute...all i sent in for packet 3 was the ds-230 and the checklist. am i missing something here??!

K-1 Fiance(e) Visa Process & Proceduresare we screwed?
QUOTE (Penguin_ie @ Aug 30 2009, 06:37 AM) <{POST_SNAPBACK}>
At the time of the incident, was he "just" turned back, or was he given any piece of paper, and/or is there something stamped in his passport from that date? If so, what does it say?

he had to sit there for a long time answering questions and he vaguely recollects filling out some paperwork. but he was not given any paper and there is nothing stamped in his passport at all (i kind of wish they would stamp his passport when he crosses because it would've made that crazy question about how many times he's visited a whole lot easier)

QUOTE (canadian_wife @ Aug 30 2009, 08:07 AM) <{POST_SNAPBACK}>
To me, it sounds like he was denied entry. If it was me, I'd take ANY opportunity at the interview to point it out. It is understandable that you forgot such a minor incident 8 years ago, what is not understandable is tyring to cover up your mistake. They know he was denied entry (I was denied entry and at my interview they knew the date, what I said when I was there, who I was with, documentation I brought with me - they knew it all)

Just point out the error and you will be ok.

Good luck.

okay we will be certain to do that (i will be at the interview with him, so i will make certain it gets brought up as soon as is possible)
thanks!

There will definitely be a flag in the database that the Consulate Officer can see, and it will probably come up at his interview. Which Consulate are you with? Hopefully, he doesn't get the angry lady in Montreal. Make sure he lets them know that he had completely forgotten about it and he is truthful about everything. Also make sure he asks them to remove the flag to prevent any future problems he may have when crossing.

Good luck.

eeeeeeeeee.
"angry lady in montreal"? montreal is our consulate. oh man...

K-1 Fiance(e) Visa Process & Proceduresare we screwed?
okay guys, here's the deal we may have inadvertently lied on our k-1 paperwork.

the very first time my fiancee visited me (this was like, over 8 years ago) he was sent back at the border because the ins felt he didn't bring enough paper money with him to be in new york for a week (eventhough he had his bank card with him and he was staying with me, therefore not needing a whole lot of money anyhow).
he went home, went to the bank, pulled more money out and came to visit a day later without further incident.
he's never been denied at the border again.

on our paperwork we put he was never denied entrance to the u.s. because, frankly, we pretty much forgot about it because it was nothing to us.
is this going to come back to bite us?
really. really. worried... sad.gif

K-1 Fiance(e) Visa Process & Proceduresthe legalities of being a sponsor or co-sponsor
QUOTE (Anh map @ Nov 8 2009, 09:53 PM) <{POST_SNAPBACK}>
Hasn't he been concerned about this for a while now? Dad should refer to the I-134 instructions and the laws cited there. http://www.uscis.gov.../i-134instr.pdf

The I-134 is the weaker document and will be replaced / superceded by the I-864 at AOS.

First and foremost the government agency will pursue you, the petitioner, as the primary sponsor to collect anything. And that will only be if your fiance/spouse uses any means tested benefits (welfare, food stamps, and such). It has nothing to do with liability for criminal acts, debts, etc.

he has, but my family is very private with their income and my father doesn't like to sign any legally binding documents unless absolutely necessary. understandable.

i just started a job. i was/am disabled, but am working now. is there an income level for the AOS as there was for the k-1?

K-1 Fiance(e) Visa Process & Proceduresthe legalities of being a sponsor or co-sponsor
we are in the very final stages of our k-1 visa process and my father has some reservations about being co-sponsor- mainly being that if my fiance gets in any sort of trouble, the responsibility is on him.
he would like to know when his role as co-sponsor LEGALLY ends. does it end with AOS or something else?

this is terribly important and last minute so any help would be appreciated.
thank you in advance.

K-1 Fiance(e) Visa Process & ProceduresBack with news and updates!
Hi!

I am back with a few updates, one being that my daughter was born on April 11, she's finally here. We just send in our online application for her birth certificate. Now were moving on to the Visa stuff and her birth stuff in U.S. Because my fiance is a US born citizen she automatically becomes as well, do we fill out the counsular report of birth now/before or with the fiance application?

Do they allow you to stay with your fiance during the visa process. I haven't applied yet but will be once we return to the states in Aug. I am moving down with him in Aug, we both made the decision to not seperate anymore, we have a 3 month old daughter. Once we apply, will they allow me to stay with him during the process? or I have to stay in Canada?

In the section that asks for city and country of residence for her parents should she just put deceased or put in the city and country they lived in while they were alive? Thank you.

K-1 Fiance(e) Visa Process & ProceduresFORM DS-156K Question
Hi Everyone,
A quick question concerning the DS-156K form. There are certain documents that are required to accompany this form. One document is Evidence of Engagement to fiance(e). I have not bought her an engagement ring because I am saving money to bring her here. What constitutes evidence of engagement? An email saying I want to marry her? I'm a little confused about this. Thanks...

K-1 Fiance(e) Visa Process & ProceduresI Need Advice
Hi Everyone,
This is a sad day for me. I have been waiting 5 years for my fiancee to
come because she had to finish school. She sent me an email tonight saying that
she doesn't want to marry me and wants to stay in the Philippines. The K-1
visa process has gotten to the stage where the US Embassy has sent my
ex-fiancee a letter saying she can call and make an interview appointment.

My question:
Should I let the NOA2 expire (July/18/2010) or should I send USCIS a letter withdrawing
my K-1 petition?

petition has been officially withdrawn? Thank you...

Hi Everyone,
My fiancee's mother died when she was 1 month old. She never knew her father. She has no siblings.
It seems none of her relatives knew who the father was either. In the part where you need
to list the fathers information should I just put "unknown" for family name, first name, place of
birth etc? Or should I write "See attached statement" and explain why this section can't be filled
out? Thanks...

K-1 Fiance(e) Visa Process & ProceduresNeed Advice Please- 129F
Hi Everyone,
I filed a I-129F visa petition for my ex-fiancee last December 2009. Things did not work out and I sent a letter asking
that my petition be withdrawn to the NVC and US embassy in Manila in July of 2010. I received a letter from the US embassy in Manila saying that my petition was revoked. I have recently met a wonderful Filipina and want to petition for a Fiancee Visa for her.

In the instructions on filing out the I-129F it states:
"if you previously had a K-1 visa petition approved within two years prior to the
filing of this petition, you must apply for a waiver. To request a waiver
you must submit a written request with this petition accompanied by
documentation of your claim to the waiver."

My Question: I'm unsure of this written request they speak of. I will include a statement giving all the info (case number, beneficiary's name etc) of
my ex-fiancee and why I withdrew the petition and a copy of the letter the US embassy in Manila sent me saying my petition was revoked. Is
this sufficient or do I need to include something else? If I do need to submit a written request for a waiver, what do I say? Thanks....

Touch is not 100% accurate. I just received my NOA2 today--and my application hasn't been touched at all, excluding the 1 change-of-address I did over the phone. In fact, the status on the site says "Pending"--while I'm holding the "Approved" notice in my hands.

I filed in March, so hopefully you won't have to wait much longer... Good luck! smile.gif

Ohhh good to know that, I just check my status online and is the same Pending. I was worry it hasn't been touch in two months, but i think the average is three months and then I should start getting worry? It shouln't take more than 3 months right? unless is misplace or under something right? At least a RFE right?

a touch is a date change on your online status at uscis..

* Note on "Last Updated" date:
Your case may have a new "Last Updated" date and you may receive an Email Notification of your case being updated, without the status of the case changing. This is due to internal USCIS processing being performed on your Case. This will be reflected in the "Last Updated" date, but may not result in a different status message.

that is their polite way of saying it could be anything.

Thanks Kim. I haven't even notice. I'm going to check that next time.

Some stories are just "interesting" to read. A long distance relationship is not a recomendation too often given...but it happens when true love exists like so many at visa journey...But looking for a second or a third that is just asking for trouble. I think love happens when it happens, mysteriously and many times as a surprise. One does not look for love it comes as a gift when two soul mates meet no matter the circumstances or events. I know is not an answer to his question but it can be of used for a little thought.

Chazzie,

Thank you, I finally had a chance to sit down and gather my package. I am in the process of filling out the I-129 form. I find it difficult to fix the address on those small lines, is it okay if I abbreviate the address?

- Letter certifying intent to marry (Petitioner and Beneficiary)
- Proof of having met in person in the past two years (passport stamps, tickets, purchase receipts, engagement ring receipt, boarding pass, money remitances, pictures. etc)

These are all u need to assemble your I129F package, the rest like I134 , and Tax transcripts will be needed later, so dont be confused.
Good luck!

K-1 Fiance(e) Visa Process & ProceduresConfused On Documents!!

Ok first. You need to read the guide

http://www.visajourn...content/k1guide

http://www.visajourn.../content/k1tips

When you begin to file, you need to get the forms that are needed to Petition for your fiance(e). Follow the steps from the guide. Once you mail your packet of document you will receive a letter from USCIS informing you that you the received your application to marry your non-US. Citizen partner.
The first form you need is I-129f and G-325a (they will need to original for you and fiance(e) and copies). These are the only forms you need if you just starting the process. The other forms are for a later date (months away). You will need to send other things as well, like evidence, letters, photos etc proving your relationship. Just follow the guide I sent you for the K1. If you have any questions. I will happy to help you...this forum has helped me and many others like you get through this process. So don't worry about getting a lawyer (unless you need one for a specific reason).

I would like to thank you for replying to my post. I read the guide carefully and gather the majority of the information that it requests for me to gather. Now my question are the only forms i send off first the I-129 and the g-325a along with all the other things said on the guide? Once again thank you at this point am trying to do this process as soon as possible. if it possible can you help me along with this process- Jennifer

K-1 Fiance(e) Visa Process & ProceduresConfused On Documents!!
Hello,

I just started my process with the K-1 Visa, I am trying to to do this process on my own without no legal help since hiring a lawyer is so expensive these days. I have obtained all the documents needed in order to apply for the K-1 Visa but I have a feeling I am missing something. I did seek legal help with a lawyer he was nice enough to provide me with some advice but was unable to go into details because he did not take my case. So far the documents listed below is what I have obtain using this site as my guide. The site doesn't explain who details information goes on which form, so I was wondering if anyone is kind enough to guide me in the right direction or correct me if anything i have included is incorrect

Here are the documents I have obtained and filled out

1. I-129 form (includes both of our information)
2. G-325 (fiance info, 2 copies)
3. G-325 (us citizen info, 1 copy)
4. I-134 ( I have 2 sponsors)
5. Letter stating we are free to marry (2 letters one for each)
6. D-156 (confused on who's info should be included Mine or Fiancee's)
7. D-156K (confused on who's info should be included Mine or Fiancee's)
8. I have all the other documents requested as well just am unsure of what is sent off along with the forms

Now here the issue I have everything filled out expect the D-156 and D-156K I Don't Know what information goes on each form, whether is the US Citizen info on these forms or the Fiance info.
When something doesn't apply to you do you leave it blank or write n/a? Can anyone provide me with complete details on what the package should include and what is needed from me as the U.S citizen.

Times are rough for me to spent money on a lawyer, when we have useful websites, I searched all the forms and was unable to find a clear answer. I am trying to accomplish this on my own with the help of anyone that is willing to provide me with advice on this matter. Can anyone help me please!!
email me missjennie193@msn.com or reply to this post

Thank You
