Sorry to say this but looks like you guys didn't prepare for this. Having both of your names on the deed is a MUST. Having joint credit cards/ checking accounts is a MUST. Anyhow, at this point, try to gather as much as you can. If you open a joint account now then it will look fake. I would suggest you get a lawyer and see if he/she can suggest something. I think its easy to add ur spouses name to the deed (no need to refinance)but just make sure with a lawyer if its okay to add it now or if it will look bad that u r doing it after getting the RFE. The USCIS wnats to see a lott of inter mingling of assets. They want to see that you trust each other with your money. Otherwise they won't be able to differentiate between a fake or a real marriage. Anyone who is in a fake marriage can get an apartment together (live as roommates) and take trips together and take lot of pictures. The only thing thats going to separate ur real marriage from a fake one is if they see that u trust each other with ur money.


Not to pour salt in your wound or anything Bearstory, but I completely agree with usagirl. Did you not research ahead when you started the immigration process? It clearly states that during the ROC process, you will have to show proof of sharing a residence and finances. The first thing I started doing (not only for paperwork reasons, but also to help my husband build up his credit in the States) was add his name to everything the moment he moved here.

I totally understand where you're coming from on the shared finances thing, so all we do is have a joint checking account for bills only. We tally up who owes what and deposit our halves into that account, then set up auto bill pay for all bills to come out of it. We still keep all other finances separate.

I posted this in the April filers thread, but thought it might be better to address the whole group.

 

I know I'm being extremely paranoid, but my husband had to travel out of the country on business for 3 weeks in Warsaw, Poland. He's re-entering in NYC with his expired green card and extension letter. I know most people do this without issue, and that those that run into problems tend to be in countries that don't often see this letter, but I'm super nervous about it!

 

I assume officials in NYC have seen this letter a billion times, but I can't help but worry about it. sad.png

 

I'm more worried about when he checks in for his flight home in Warsaw, that the airport employees won't understand the process. Does anyone know where this information is on the USCIS site? I thought it might be better if he also brought along a printout of the website stating the letter is all that was required of him by law to show his green card extension status.

Funny thing I check on Friday 8/02 on the USCIS website and it didn't have any updates regarding this.

Same here. No updates online whatsoever (it didn't even find our case number), but we got our ROC in just under 4 months without any issues.

Getting a biometrics letter doesn't mean you've avoided an RFE, right? Everyone gets a biometrics letter before they fully process their case, right? Just wishful thinking.

My check was pending and cashed yesterday but I have not received NOA1 or any form of communication from USCIS. Should I be worried?

 

Not at all. If you read the last few pages you'll see that some people received a NOA1 days before the check cleared (such as myself), while others see the check cleared days before getting the NOA1. I think it all depends on where you live and your bank. You should see something very, very soon! dancin5hr.gif

Oddly, the NOA1 date is 4/15, but according to post office tracking the CSC signed for it on 4/16. Also, my check hasn't yet cleared! Very strange, but we have it!

For the longest time, CSC was faster by 1 month, on averge from start to finish, than VSC; but I guess they slowed down... 

 

CSC has never been quicker for us. When we were going through the K-1 process it was insanely behind VSC. Now it's time for ROC and what do you know, CSC just arbitrarily stops working again. mad.gif

Hi everyone I am new here, I am just worry because I read your post and seems that everyone gets response fast from USCIS about removing conditions from green card. I sent my package april 15 or 16 I guess pretty much on time my green card expires july 18 so I made sure I have it done on time. Even the check is not clear yet. Please help me....thank you very much

 

If there's one thing you take away from this crazy process, it's that nothing is certain and everyone's case is different. All we do here is track one another and try to gain some semblance of a timeline while killing time together in the waiting room! No one has any idea or vague concept of what the government will do, particularly how fast they'll do it. You just have to sit back and wait, unfortunately....particularly if  you've filed at the California Service Center. They are notorious for being on their own clock.

 

Don't panic, I submitted our ROC packet on April 16th as well to the CSC and no cleared check or NOA1 here either. If you look at the timelines re-posted along the thread, you'll see many other people submitted their packets weeks before us without any luck, so we're still in line I'm afraid. My husband's GC expires at the end of June, but no need to worry. If you get to the point where you're a few days away from expiration just make an InfoPass appointment and you'll most likely get an extension stamp. Just read through the thread and all of your questions will be answered. Good luck!

No not yet.. It would be nice just to see the check cleared..
I have to fly out on the middle of June, and my GC expired 10th of May. I don't know if I should make an infopass appointment now or wait till May.


I would make the appointment just in case. It couldn't hurt, right? Worst case scenario they tell you to wait until May.

This is a very stupid question, but the NOA1 is issued automatically once receiving the application/cashing the check, right? The NOA1 automatically extends the GC while they process it. You get the letter before dealing with any potential RFEs, correct? So no matter what delays you might have to deal with, you at least have the 1 year extension letter for work and travel...

Nice! You're immigration twins! It's kind of funny, since I'm better at forms my husband sort of just lets me handle everything. He hasn't logged on here since he posted his embassy interview review back in 2011. :lol:

My temporary permanent resident card expires on Feb 2nd, 2013. At the rate in which we seem to be getting things done, I expect it will be mid January before it is actually mailed (we plan to send it overnight mail). I'm really scared that this won't get done in time, or that it's already too late. I'm stressed and worried and it's making me physically sick. Is it okay that my card expires as long as I actually did file before it expired? Could someone please give me good news? Thank you.

Instructions: If more than 30 days have elapsed since your NOA1 date and you have not received your biometrics appointment letter, you can call the NCSC (their number is on your NOA1) and put in service request to the service center which you filed (CSC or VSC) to find out the status of the biometrics appointment letter. Make sure to verify the home address and mailing address (if any) with them on the phone. You can also request to speak to an immigration officer (you may have to ask at least twice to be transferred) to get your CR I-89 receipt number, (it is the receipt number of the biometrics letter) so that you can track your case online.

A review of the electronic records indicates your appointment will be scheduled as soon as there is availability at your local Application Support Center (ASC). You will receive your new appointment notice confirming this date and time in the mail. Please follow the instructions on the notice.' bla-bla-bla

I think the key words here are "NEW Appointment Notice".

i have contacted the infoline on 07/14 and received an email (the same day to my surprise!!!) stating that due to backlog at ASC i have not gotten my appt letter yet and should get it as soon as there is something available.

i guess i will be waiting for soem time :whistle:
