We still have about nine months before we have to file to remove conditions..... :whistle: But I was just wondering.....

Since we were approved through Cali without an interview (and those "cases" are now starting to file to remove conditions) -- are you only providing "evidence" from the time the GC was issued (as they ask for) -- OR -- are you also including "evidence" prior to that date (i.e., wedding photos, invitations, vacations, etc.) things that you would have provided at the initial interview if you had one?

It's not silly at all.

Most aliens that marry for fraudulent interests and to gain immigration benefit would, if smart and methodical, await the removal of conditions before ending the marriage and going their separate ways, literally and figuratively (even if they never resided together). Why would they take a chance at being discovered in the waiver process, if they were headed toward the proverbial finish line with the consenting USC?

If what you are asserting were true, then USCIS would be approving each and every one of them. Not all marriage-based cases that involve fraud, either outright fraud committed by consenting parties or unilateral fraud, where the USC is none the wiser, are discovered at the AOS stage, you know. Believe me, I can attest to that.

How do you know so much about immigration fraud and how it's discovered? :whistle:

Copies of Joint tax returns: I simply didn't make enough to file jointly (I'm a sub)

You're supposed to file MARRIED, even if you file SEPARATELY.

If you "didn't make enough", I can't see why on earth you would file "married separately"
when filing "married jointly" gives you a better deduction.

Anyway, if you filed "married separately", submit both yours and your wife's tax returns
with an explanation of why you filed separately.

Appealing from outside USA would be impossible. If the I-751 is denied, while you are abroad, you have no status and you will not be able to return.

I'm curious because I have heard conflicting information that states nobody gets a 10 year green card without an interview (especially if they didn't get an interview for their 2 year card)

Not true -- there were LOTS of people who had waited more than 2 years for their AOS interview
and were eventually transferred to CSC, approved without an interview and given 10 year cards.

Stokes interview is when the husband and wife are interviewed separately and asked the same questions to see if they give the same answers.

I have heard of Stokes interviews for AOS couples but have not read of anyone going through it for I-751. Not to say that it doesn't happen.

I read up on it and now strongly believe that Jasman was talking out of his Jass
trying to scare the OP.

A Stokes interview is conducted before a green card is issued at the AOS stage,
never at removal of conditions.

Please take a look at my timeline, USCIS did not send me any approval after my wife took a biometrics. After my wife took a biometrics, all we have to do was waiting and waiting and this morning I just get a notice email said the card is ordered and it will send to me within 30 days. It will be 10 yrs green card and we do not have any AOS interview.

Many people here got transferred to CSC and had their I-485's approved without an interview,
and I was just wondering if you were one of us. We're still trying to figure out whether or not
those who didn't have an interview at the AOS stage are necessarily going to have one at
removal of conditions.
