But look before you leap.  Don't apply for one you will get in 10 days that is good for two months 4 months before your interview.  The math does not add up.

Don't jump on it too fast.  Some of these have expiration dates.  It depends on the police department you apply to so you have to ask them what it is.  If it expires before your interview it will not be good any more.

 

Also helps to ask the police dept what they will accept as proof.  Just because their website says X does not mean they won't accept Y.

 

My fiance had to get COC from Hong Kong police whose website said they needed to see instruction letter issued by embassy.  It turned out they accepted NVC instruction letter just fine.  So if you have a substitute, email them and ask if it will be accepted.  In our case it saved us a lot of time and trouble.

It is possible to be ordered by a court to do something without being convicted.  For example a jiudge can order you to attend anger management class and once you finish it you come back to court and the case gets dismissed in consideration.

The exam center wil make appropriate adjustments for the xray to not harm the baby.  They do that all the time.

 

If you are the father and the USC, the baby is also a USC.  File for a CRBA and do it as soon as the baby is born; otherwise the lack of the CRBA may delay your fiance from coming here when she gets her K-1.  No need for visa for the baby once you have CRBA.

 

DNA test is no problem.  All of you submit blood at a lab where you are located and they take it from there.

Either one can prepare the documents.  Does not matter.  Just make sure what needs to be signed gets signed by whoever has to sign it.

 

Things like emails, chat logs, photos, do not need anyone to sign.

 

For photos, put the date the photo was taken and the city and country it was taken in on the photo.  You can write it in felt marker on the back.  I imported my photos into Word and typed that info at the bottom of the photo.  Looked a little more professional that way.

I don't have specific knowledge on Nigeria as each consulate has its own rules.  But  I do know that loan money or your willingness to borrow to support him will not help.  You need either income in your name, assets in your name or both.  Failing that you need a co-sponsor in accordance with Nigeria consulate's rules.

Age difference is small and should not get anyone's attention.

 

Your prior marriage will not matter if and only if the divorce is final and signed off on by a judge.  Can't file the I-129(f) without it, otheriwise you will get at least an RFE and at most a denial.  So get that in order first.

 

Your medical inability to work should not matter.  The USC is expected to support you, not the other way around.  As long as your medical issue is not a Class A illness it wil not stop you at the medical exam either.

 

If you did not stay past the expiratoin date on your visa, you did not overstay.

 

As for the genuine relationship, there are no objective tests.  It is all subjective.  I think there is enough here to pass muster.  But that is only my opinion.

The US Civil Surgeon and the panel doctor at the medical clinic in his country of origin follow the same set of criteria in deciding what vaccines he needs.  Judgment does come into play, so it may vary by a vaccine or two, but they are largely the same.

 

The cost, however, is not the same.  Much cheaper in his country of origin, and maybe even free.  The side effects are not terrible and go away usually in 2 to 3 days, and they protect him from illnesses that might kill him if he is ever exposed to them.  So there is really not much to lose by getting them anyway.

The big drawback of the POE not being your destination is that you have to claim your bags, go through customs inspection and recheck them.  If your stop is non-POE they can check your bags right through.  Much more convenient.

 

I live in New York and can tell you there is no problem using JFK as your POE.  The line can get a bit long sometimes, but they know what they are doing and will get you through with little or no pain.

That's not unusual.  A religious marriage in the US is a legal marriage too.

 

I will not touch your religion question.  You do whatever your religious convictions say you need to do, and that is for nobody to judge or question.

 

The bottom line is that the CR-1 will take longer, but you will be married sooner.  It is for you to decide what is more important, being together sooner or being married sooner.

Many people do not understand that photos alone will not do it.  I can put myself on the moon with Photoshop, but that does not mean I was there.  Plane tickets, hotel receipts, receipts for meals and other things you bought there, passport stamps, that is what they really want to see (in addition to the photos).

Ok, so here are my thoughts from what you wrote:
 
This is not a battle.  The US is not hell bent on denying as many visa's as possible.  There is a process and a set of standards you need to meet, but these are easily done if you follow the instructions and ask for help when needed.
 
I'm not sure what you mean by a financial support document.  If you need a sponsor, there are specific forms which need to filed by the sponsor. You can;t just include a letter from someone say ya, I'll help this guy financially. If you meet the 125% requirement, don;t complicate things be sending un-needed and un-requested documents.
 
The I-129f is not about your relationship.  You only need proof you actually met in person in the previous two years, you have the financial resources to support the beneficiary, and there are no legal obstacles.  Most likely they will not even look at your reams of skype logs. You will have an opporunity to express your undying love at the Consulate stage.
 
The best evidence you can provide at this point is photos of the two of you together doing everyday things.  Include the Visa stamps form your passport, airline tickets. Anything that would show you in her country within the last two years.
 
I am not a big believer in front loading at this stage. Give them what they ask for. Anything extra just makes a mess.  (Neatness counts.)
 
If she is filling out her forms locally, make sure she is using the PDF viewer and typing in the info rather then hand writing. (neatness counts)
 
I have no inside information about the process, and others think front loading is a good idea.  I think it does not help you.

What he says about front-loading though, disregard that. He didn't go through Guayaquil, and those of that have gone through and survived Guayaquil, know better. You should front-load your petition, not an all-inclusive description of your relationship, but rather some items that span your relationship.

Guayaquil will be the post at which she'll interview, Quito doesn't do K1's or spousal visas. There have been instances where people have scanned signatures, some have taken, others have not. Your choice, but if you ask me, original all the way.

We said we would be married in New York, but then also did not specifically state that it was legal in New York or provide their laws. I think you're looking good actually. 

 

1. You have to list them as dependents IF you list them as dependents on your tax return.

2. Your assets should be more than enough.  If I remember correctly, they require that your assets be at least 5 times greater than the annual income requirement.  So let's say you had no dependents, your income requirement would be roughly $19,000.  And $300,000 is far more than 5 times greater than $19,000!

3.  Let's see if others agree with what I've said.  If so, then you won't have to tweak much at all!
