I noticed somebody asked a week or so ago if there was a list of all RFEs so people could look out for possible "boo-boos." So here we go!

My RFE reason was;
The forms we downloaded didn't tell us to add evidence of meeting in the past two years or frontal face photographs. Which is weird because we got them directly off the London Embassy site. So we got an RFE for basically the other half of what you're suppost to send origionally. We started the K-1 appliciation before we found this forum so we were kinda just going with the instructions as best as we could. We say if you're just starting the I-129F download it from VJ...they seem to have the right instructions....


 

Last year, when I applied for i-129f for my then-Fiance (now Husband!), I didn't include a statement that I intend to marry him. That delayed the process for 5 months! Yikes. Don't make the same mistake as I did... put it in .. even just one paragraph of 3 sentences!

Hi all, this is my situation: I am an italian citizen andI got denied a j1 visa in the past and because of that my ESTA got denied too. We filed the I-129 f in january and I would like to go visit my fiancee in the US while the k1 is pending. The problem is that I cant go to the US under the ESTA but I will have to apply for a tourist visa. Having a pending I-129F and prior ESTA and visa refusals, do you think I should try to schedule an interview at the embassy or should I just drop it and wait?

OK...finally heard from my dead beat lawyer about what my RFE is for and now I just feel like strangling him...turns out he did not include my G325 form with the 1-129f petition. I have to go to his office Sunday to sign a new one. Question is #######...I paid this guy already so don't suggest I "fire" him...but should I ask for a damn rebate? What a colossal waste of money...not to mention time. I am relieved it's not more relationship evidence but does this even mean they even went over the whole application or could they just have seen the form missing and stopped reviewing? I guess basically my next question is when you get a RFE is that all that is missing or can basically you get another RFE after you give them a missing form?

Thank you so much for your words of encouragement Severina and Gingerpants ...but here's the thing..I know it may not be for a request for more "primary" evidence...I just want answers as to procedure to be prepared just in case it is and know what the procedure is when any more evidence you can add is either more secondary evidence or get new primary evidence (since the initial K1 filing). Hope someone on here knows...as my lawyer..well I do not trust him as thus far I feel he misguided me ..plus I am sure he would love me to have to refile so he can make more money...he actually told me to stay away from the "misinformation" I find on the web and only trust him which makes me trust him even less...Truth is if I have to file again from scratch to make the "newer" evidence admissible...I would never take the K1 route again and instead go get married in his country and then file to bring him here.

BTW Severina I read your "story" and felt moved by it :wow: and wish you and your intended a speedy track on the K1 visa journey...specially since it took so many years to get to the point you are now at now but your right "love has no boarders" (L)

NEED SOME ADVICE
I am heart sick :crying:....after waiting till it was over 5 months and could ask why our file was never touched since the initial NOA1...I got a case update today via the website showing a RFE. My question is this...how long now till I receive the notice that tells us what the RFE is for? I am extremely upset about this. If it's a request for more evidence of having met within the past 2 years..I have nothing more to send them than what I already sent. Neither one of us have boarding passes directly into the others country since we always used Maine to fly in and out of (NB canada is way too expensive to fly in and out of) and we would drive over the boarder where they never would stamp either of our passports. The evidence we supplied was a bunch of credit card statements showing charges on our credit cards from our partners locale...hotel receipts and boarding passes to and from Maine...depending which one of us were visiting whom ..we never fly at same time(as when he came to me he'd drive into Maine and then board flight from Maine to NY...and I would fly into Maine he's meet me and drive me into Canada)...one of our hotel receipts has both names on it although most were either in my name or his... The rest of our proof was only "secondary" ..tons of pictures together..but none with time stamps (my camera doesnt have that feature)..and lots of phone records. What do I do if they ask for more primary evidence and I have no more to give them? I read here on the forums they do not accept evidence you have acquire since your initial filing..I just wondering if this ever happens that you just don't have anymore "old" evidence from prior to filing for K1 and what happens then.. so does that mean you would have to start all over again refile and pay again? I hope not because we are going broke on the expenses for our visits and what this whole k1visa will cost..not to mention the ton of extra time this would take. although I still don't know what the RFE is for ...I cant shake the feeling that I just dont have enough primary evidence.

For my fellow RFE recipients... when you got the physical letter from the USCIS, did anyone else receive this comment?

"From the date this office receives your resubmission, a minimum of 14 days will be required to process your form. If you have not heard from us within 60 days, you may contact the USCIS...."

Just wondering what the min of 14 days is all about, especially considering that many people talk about getting the app approved within a few days after submitting the info needed for the RFE.

Unless you commit a crime, or get yourself in trouble with the law, you can live in the US your whole life with very little effort, and without being deported.

re-interview with new medical (if clean)
approved. When over a certain amount
is when an I601 waiver is required
when a 221G is given at interview to file the waiver.

This is my understanding as well, which is why it seems strange to get hit so badly for one experimental use.

 

Maybe you should consider an appeal, but I would consult with an immigration lawyer first.

They can dismiss one single use as youthful experimentation if it happened long ago and only happened once.  The key is CAN.  THey don't have to.

 

Applies only to pot.  Hard drugs, one single use and you are done.

Then read the requirements here.  They are pretty simple, and a lot easier for the petitioner to pass than for the beneficiary to pass.  Many things that will knock the beneficiary out of the box, like one single drug bust, will not touch the petitioner.  So read the requirements and judge for yourself.

File now.  It takes time to wind its way through the system.  You will have plenty of time to collect evidence of a good relationship.  All you need right now is photos of the two of you together.  BTW save all paper generated by the times you are together, e.g. plane tickets, boarding passes, hotel and restaurant receipts, things you buy for each other.  Send copies of the travel evidence in when you file, as photos alone won't be enough (too easy to photoshop yourself into a picture of her).

If you want to get married in Canada as soon as possible and the amount of time it takes before she can live here is secondary, go CR-1

 

With CR-1 you can marry any time you want, and you can file for the CR-1 as soon as the next business day. 

 

While the CR-1 is pending she can enter and exit the United States the same as she does now.  She just can't live or work here until the CR-1 is in her pocket.

You do not need the original I-797.  Do hang onto it though and keep it in a safe place as you will need to file copies of it at various times in the future.

 

Evidence of a genuine relationshop is filed at the embassy the day of your interview.  There is such a thing as too much.  If you have 100 good pages of such evidence, you don't want to bury them in 1000 pages of mediocre evidence.  Just cherry pick the best pages.  Remember someone has to read that stuff and will not read 1000 pages,

Are you home right now or in some other country (like your fiance's country for example)?  If you are in a different country, the banks may be thinking some crime ring stole your credit card number and are using it to steal your money.

Typically 2 to 3 weeks after you file is when you get it.  If you have not already done so, sign up for email notifications because they come a lot faster.

 

An RFE comes when someone spots a mistake.  That can happen at any time.  Most of the time it is no time for panic or worry as most RFEs are for simple mistakes that you just fix and mail right back to them.

The exact vaccines you will need are determined by the panel physician who does your exam.  Let him or her do their work.  They do this one thing all day long and are quite good at it.  Most of you will end up needing 2 to 4 shots.

 

The exam and vaccines often do more for you than just get you cleared for immigration.  The vaccines protect you against diseases that can potentially kill you, and the exam sometimes detects illnesses that would have killed you had you not found out about them.  My wife did the whole thing already, and it was no big deal.

 

As a K-1 you are entitled to wait until you arrive in the US to get your vaccines, but that is not a good idea simply because of cost.  In your native country, the cost of these things is much lower than in the US.  Besides you can get them done along with your exam and not have to worry about them any more.

 

Most people sail through the exam with no problems, but if they find illness, consider it a good thing it was found so now you can get cured.

Two weeks is the average if there is such a thing.  But it has taken as little as three days and as long as three months, even when there are no issues or any logical reason why some should go so fast or take so long.  If you are at T+2 weeks, it should be any day now.

 

Just don't think there is a problem because most of the time if it takes 3 to 4 weeks, there is no problem; it is just one of those unexplainable ones that took longer for no apparent reason.

 

I suggest you look in the Philippines forum, as there are many people who were interviewed right around your time.  That will give you a better idea of how long it is taking recently.

 

Ours took 13 calendar days, but that was back in June.  Lots of things can happen in four months.

I guess I should have been more exacting.  It isn't scars in general on the arm, it is cutting scars.  My wife has a scar on her wrist from a surgery, the doctors do recognize the differences in scars.

 

My wfie's scar was from cutting; it was an accident with a food preparation knife while she was cleaning it.

I kind of do agree with Harpa about how your fiance telling them how much she loves and trusts you was strange. i am not trying to insult you or your fiance here at all, but i do think that the CO might of found that weird and suspicious. I mean, he wasn't even asking bout that, he asked about something else and she answered and then added up the parts about loving you and trusting you, and not just once but a few times. However I do not think that was the main reason she got denied. It's hard to tell and all we can do is assume or guess but the best guess would be the part about your families, yeah..

 

I don't think they would deny somebody simply because they went on a bit about how much they loved the person.  From reading Maxzim's detailed description of the interview, it seems to me that maybe they had already made up their mind before they questioned her.  They made her wait for 4 hours while tons of other people went through.  She was the last one they called up and his face went from smiley to serious when she got there.  Sounds like he already knew he was going to have to deliver bad news to her.

Not sure about Other. I know 221g is usually when docs are needed.

 

I don't know if you've seen this page or not but these are all the grounds for denial under 221g.  I would suggest going through it with a fine tooth comb and see if you can find anything that looks like it may relate to you all.  Although in reading what you've said so far I can't find anything that looks close.  But you would know better than I! 

 

Here is the list of 221(g) grounds for denial. 

(1) Health-related grounds.
(2) Criminal and related grounds.
(3) Security and related grounds.
(4) Public charge.
(5) Labor certification and qualifications for certain immigrants.
(6) Illegal entrants and immigration violators.
(7) Documentation requirements.
(8) Ineligible for citizenship.
    (A) In general.-Any immigrant who is permanently ineligible to citizenship is inadmissible.
    (B) Draft evaders.
(9) ALIENS PREVIOUSLY REMOVED.
(10) MISCELLANEOUS. -
     (A) Practicing polygamists.
     (B) Guardian required to accompany helpless alien.
     © International child abduction.
     (D) UNLAWFUL VOTERS
     (E) Former citizens who renounced citizenship to avoid taxation.

One of the most benign reasons on this list could be that her passport isn't valid for more than 6 months from now.  I can't see any reason why they wouldn't tell you that - but that is one of the reasons on the list.  So go through the list with a fine tooth comb and see if you can figure out which of this reasons it could have been.

WOW!  That's awesome!  Such great news and what a great end to a scary story!!!  I read about your denial just before my fiancee was to go in for her interview.  Your story really spooked us!  Because we figured if it could happen to you guys, it could happen to us.  Because I couldn't discern a single possible reason why they would have denied you!  So I'm so glad it turned out this way and so happy for you both.  Did you ever find out why you were denied in the first place?  (If you've already said here, sorry I haven't read every post yet).

Ladies your spouces can take the email you receive to do the medical right now it's costing about 320 due to flu shot. The email is enough do not wait for packet 4 to get to beneficiary. For most that I know and myself it was never sent. Good luck and read the most current interview experiences as you get ready for your big day .

How does one have an appeal dismissed and a decision upheld if there was never a decision made or an appeal filed?

 

I think that's what the OP and other members are trying to figure out.

 

In my opinion, they confused your case with somebody else.  Make an Info-pass appt and clear this up.

Not at all.  In fact it should help the interview because one of the things you need to establish is a genuine relationship.  What better thing to show than shopping for your marital home together in the US?  Give her copies of the docs generated by the real estate agent to show at the interview.
