K-1 Fiance(e) Visa Process & ProceduresDo K1Visa Holders need to make any payment before their arrival to USA?

Your own country might charge you to leave, but no such charge by the US.  Once you get your visa you are fully paid until you file for AOS.

K-1 Fiance(e) Visa Process & ProceduresCan Length of Residence & Current Job Affect the K-1?

People change jobs and residences, and I don't see any probem with his as long as his aggregagte income over the last three years as well as his current income meet the minimum for support of you.

As for his mental health history, as long as he has had no legal matters in which this has been an issue, nobody is going to raise it.  So you should not either.  You will be the one checked by the doctor, not him.

Seriously, read the guides.  Nobody is blowiing you off; instead we are telling you that there is way too much you need to know that can be told to you in a few posts.

Read the guides and then come back here with specific questions after you do.

Good luck to you on your journey, and welcome to the place that has done so much for all of us.

A co-sponsor is the other route.  Each consulate has their own rules on it and some will not even allow it.  So check into it.

But a future job that is not generating a paycheck now will not cut it, nor will $10 G in liquid assets.

Can you get on the website or phone with your US bank and have them issue a bank check to Dept of Homeland Security and mail it to you?

Another thought:  Do you have an American Express card?  Call member services and see if they will issue a check and charge it to your AmEx account.  You can pick that up at any AmEx office local to you.

K-1 Fiance(e) Visa Process & Proceduresincome proof

The best proof is a tax transcript from the IRS since you can't tamper with that.

A 1040 is also accepted but only if you have a W-2 with it since it is too easy to get a blank 1040 form and fill in your own numbers.

And a letter froim your employer stating how long you worked there and your weekly/annual pay is helpful.

1.  Can't tell you now long mailing takes.  Or who wil lget it.  It varies like the wind.  So both of you wathc your mailboxes.

2/  Co-sponsor rules are  up to the individual consulare.  Most of them allow it but you have to follow thneir rules to make it fly.

3.  To work , you file an EAD along with your AOS.  Recently EAds have been taking 90 days or so.  Once you have that you can work.

K-1 Fiance(e) Visa Process & ProceduresK1 visa - Proof of having met

Photos are great and very helpful, but the technicla instructions to the adjudicators tell them that photos are seconddary evidence of having met and without primary evidence, you will not satisfy them.

So send your photos as they are great and convincing, but give them some primaruy evidence to hang their hat on.  Visa stamps will do nicely.  If she had to travel too, get travel evidence from her as well, like boarding pass or visa stamps.  Also if you bought thnigs while there, the register receipt showing what you bought and a photo of what you bought will help.  If you took her out to dinner, your credit card receipt showing that this dinner took place will be good, especially if you can match it to a photo of the two of you in the restaurant

Are you a gambler?  Willing to gamble the cost of the flight?  If so, go right ahead.  It is not like you are screwing up the visa by jumping the gun too fast on buying the ticket in advance.  The worst possible result is that you lose the cost of the plane ticket.  If you don't mind gambling that sum of money, go right ahead.

K-1 Fiance(e) Visa Process & ProceduresWanting to start a K1

I will not ask you the obvious question, namely are you serious about marriage at your age.  I assume you both got past that already.

Wait until June 30 before you file.  Under 18 brings up thorny issues like the US law that makes it a felony for a US citizen to travel to a foreign country to have sex with someone under 18.

Next is to read the guides in this website.  Most of your questions will be answered in them, and the few questions you have left will be more focused and much easier to answer.

The basic forms are downloads from the USCIS website, in addition to photocopies of certain things that you either get or already have (such as passports and birth certificates) and a few things you type up from scratch on your computer.  The guides will have all the specifics on that.

Yes you can visit, no problem.  But once you have your K-1, the next border crossing you make will be the one and only one you are allowed under the K-1, so don't leave the US any more after that until you have your Green Card or Advance Parole.

Does he have a job with regular income?  He will have to show enough on the books income to support you.  Make sure that is in place.

Good luck to the both of you.

And make sure to withdraw his old K-1.  Doesn't take much, just a notarized letter to the embassy advising them you are withdrawing it and plan to resubmit a new one.  Keeps things much simpler for the bureaucrats so they can close the old one cleanly.

Also dont use the old forms, as they have been updated.  Go to USCIS website and download new forms.

K-1 Fiance(e) Visa Process & ProceduresEnding of a relationship, now what?

Been there, done that.  No NOA2 yet?  Send the letter to the USCIS office you have been assigned to.  You have an absolute right to withdraw your petition any time before the visa is issued, so your letter is to politely explain to them that you are exercising that right.

Get your signature notarized.  They need to see it is you and not somebody else.

It will take a couple of months for this to be finalized so be patient.

K-1 Fiance(e) Visa Process & ProceduresCan I file for I-129F if I am only 17?

Under 18 opens up some thorny cans of worms, not the least of which is the Federal law which makes it a felony to travel to another nation to have sex with someone under 18.

I am no expiert on this, but with this sort of thing, satisfying the marriage laws of the state you live in is not enough.  You have the feds to satisfy, not to mention the laws of the country your fiance will be moving out of.

There is no categorical exlcusion for those under 18.  But you must obey the laws of her country, of your state and of the Federal government.  One of those laws says it is illegal to travel to a foreign nation to have sex with someone under 18.

How soon does she turn 18?  You would make your life a lot easier if you waited until then.

First of all there is no problem at all with another meeting in a third country where you can both legally go.  In fact it will help you with the interview because it will generate another set of photos to show the interviewer.

As for possible NVC mail, optimally you should have a friend or relative monitor your mailbox and contact you if something shows up so you can respond to it timely.

K-1 Fiance(e) Visa Process & ProceduresTo Lawyer or Not To Lawyer?

I knew absolutely nothing about the fiance visa process before all this started for us.  I spent two or three weeks off and on searching the internet for info.  Found this site, found their I-129F guide and followed that to a T.  I have an attorney friend who said he'd be happy to look it over at no charge.  When I took it to him he said it was amazing how perfect it was!  He said, "how did you know how to do it?"  I told him, VJ!

Putting the actual petition together - I probably spent about eight hours total over three days.  Most of that time was spent figuring out how to organize a Word file so I could have the entire document with all attachments in one file.  Then problems with the printer took up more of the time.  The actual process of filling out the forms probably took about an hour and a half.  30 minutes to actually fill them out and an hour carefully reading the instructions from VJ over and over again to make sure I was doing it right.

I did interview a few immigration attorneys during this process... and they all turned me off so badly.  They all told me scary stories of what would happen if I did it myself.  But like you my case is very simple and straight forward.  No complications.  No divorces, no prior petitions, no nothing.  I would say definitely do it yourself if you have the time and want to save the bucks.

My take on attorneys is that they charge the least they can to stay competitive - usually around $2,000.  And for that, they plan to do the least amount of work possible.  I get the feeling that for that price they'll fill out the forms (only after you give them all the information - which is most of the work right there - so you still have to do most of the work).  They mail the form in (which you can easily do yourself!), and they let you know as your case progresses.  BUT, if you have any need for more of their time than that - for instance you need 30 minutes of their time to ask a few more questions - I'm sure they would conveniently be in court every time you call or they would charge you more.  It's definitely a racket.

Plus, the lawyers I interviewed - literally knew less than I did about certain aspects of my case.  They had a general idea, but I knew the specifics as they related to my case - because it was my case and I took the time to learn about every aspect of it. It was all very easy to do.

I came across that same dilemma when I was filling out my forms.  I opted to go with the instructions on the form.  So I left them blank.  However, I can't tell you for sure if that method was effective as I haven't gotten my NOA2 yet.  But it seemed to make more sense to follow the instructions on the sheet.

K-1 Fiance(e) Visa Process & ProceduresDenied - Need Advice

Presenting a DR birth certificate knowing that he was actually born in Venezuela? Sounds very much like misrepresentation. Definitely get a good immigration lawyer - hopefully someone on here will have suggestions.

It's not a misrepresentation.  I have a friend who was in a similar situation.  She was born in Canada.  She was adopted by American parents when she was 3 years old.  When she got here they promptly issued her an American birth certificate.  When she first tried to apply for a passport some 20 years later, she had the exact thing happen. They told her they didn't have her original Canadian birth certificate and they needed it before they could issue her passport.  She eventually got it to them and when she did they issued the passport.
