I think you're looking good actually. 

 

1. You have to list them as dependents IF you list them as dependents on your tax return.

2. Your assets should be more than enough.  If I remember correctly, they require that your assets be at least 5 times greater than the annual income requirement.  So let's say you had no dependents, your income requirement would be roughly $19,000.  And $300,000 is far more than 5 times greater than $19,000!

3.  Let's see if others agree with what I've said.  If so, then you won't have to tweak much at all!

But if you received your NOA1 on May 19th, and it still doesn't show up on the website, there's nothing to really worry about.  The website and reality are often not in sync.  But you could call USCIS and mention this to them and ask if they could get it fixed, so the website will accurately reflect your actual status.

Since most of our photos were in digital format on our hard drive, I just inserted a few photos per page in MS Word. I even added a catpion on each photo. Then I printed the pages on 8 1/2 x 11 pages so it fit nicely in the folder.

As an added note, I didn't like dealing with punching holes in everything or the look of the binders that held the punched papers, so I found at Staples a punchless binder. It had a clear cover and when the packet was complete, it looked quite neat, orderly, and slick!

Hi All,

 

Another bump in the road. My dad is co-sponsoring us and he is a citizen through naturalization but has been one for a very long time. He has a passport but lost his naturalization certificate because it was so long ago. Now on the i-134 it does ask for a certificate number. If I leave that blank and send a copy of his passport would that be enough. Passport proves citizenship as well. Otherwise its pain to try to find out his naturalization certificate number because he has to go to an infopass appointment.

Yeah I was january 31st so offically over the 5 month period. Im going to call both schumer and gillibrand see who is more responsive and ill let everyone know

From my experience, the way to place an official inquiry for both are:

 

For Gillibrand - You write your letter over the webform, and then they will email you the privacy release form which you can fax over. I called to make sure they got it. And after a few days I also got an email saying they got my information.

 

For Schumer - The only way is through postal mail. So you write your letter and include a privacy release form.

 

My congressperson was the one who successfully got my case worked on and approved. Gillibrands office sent me a letter afterwards that I was approved too.

USCIS approved the petition (NOA2) on May 22, and I received the hard copy letter a few days ago.  We just noticed that they misspelled my finacee's name.  Her name is Jesica, but they spelled it Jessica.  We verified our I-129F has the correct spelling of her name. It seems that whoever entered it into the systems at USCIS mis-spelled it. The case has been sent to NVC but not sure if they have received it yet. I just checked and it seems they mis-spelled it on the NOA1 as well but we didn't catch it then :(

What do we do? Will this cause any problems? Can this be fixed by the Embassay instead of NVC?  We are terrified of further delays in our case (already had an RFE from USCIS) but now we are worried that this will cause problems at the end....

call USCIS tell them ,they made a mistake. i think you can make a correction by them

One issue that came up was that we only have known each other 5 months. In this time i visited her in Hanoi for one week in December and finished my vacation in January and we spent another week in Ho Chi Minh City. So I have visited 2x's each time for 1 week. The lawyer said that was not enough?

 

First off, unless it has changed since my wife and I went through it 7 years ago, the only requirement is that you have met in person at least once in the past 2 years.  Technically, you could meet one day for 15 minutes, and you have satisfied the requirement.  You have spent a week together on 2 separate occasions.

 

So if the lawyer thinks that you have not spent enough time together, how is paying him $2,000 going to change that?  Lawyers are the biggest scam artists out there.

 

Another thing I would mention for you to think about is why is your fiancee so nervous and afraid to say something wrong.  In my experience (not only with immigration but with life), when people are afraid that they may say something wrong is because they are not being completely honest.  If you need to "think about" what to say, that's almost like you're telling a story.  You know what I mean...  why did she consult a lawyer in the first place?  Is this really a lawyer?  I know you don't want to hear this kind of stuff but when dealing with international relationships, you need to go into it with your eyes wide open, too many men (and women) have gotten burned by blind love.

You can travel however you may be subject to scrutiny. Travel under another visa status or the visa waiver program is not advised for K-1 fiancé/fiancée visa applicants prior to the approval of their K visa as they have already indicated their intention is to marry in the U.S.

 

 

So those 3 CBP officers are full of crapola.  They don't know the rules.  In their minds, it's a definite no way, not allowed, never... and this document shows that it is allowed under the right circumstances.

 

So while, you may or may not have had enough ties (like you said, they didn't even ask to see it), they should not have denied you simply on the fact that you have a k-1 pending.

 

This seems to be as subjective as tourist visas at the US embassy abroad.  It depends on who you get.  I know people who have gone multiple times with the same ties/proof and been denied some times and approved others.  It's pretty much crapshoot.

This should be a lesson to everybody involved in the visa process.  The lesson is that you should always expect bumps along the road, but the key is to leave ourselves some outs (time, money, etc.) to be able to get through it.

 

In this case, they probably should have waited longer before applying for a k-1 knowing that she had school to finish.

Thank you for the responces guys this really helps me to make sense of it all. I will plan to fly out to her asap and explore the K-1 process in more detail from here on out.

When i first looked at it i was confused as to why it stated the different types for fiancee's and spouses. It seemed crazy to me that there is a visa form to apply to enter the US and marry your partner for spouses. if you are already married and have a spouse then why do you need permission from the K1? I would have thought there was a different process for fiances and/or spouses but it seems like it's the same system right? 

 

There are different visas for fiancess (K-1) and spouses (CR-1).

 

Also, if you decide to come back while your fiancee visa is being processed and you are asked by immigration about the nature of your visit, definitely be honest.  Don't give up a lot of information, just answer their questions.  But be prepared for the possibility that you will be turned away and not admitted into the US.  It happens occassionally.  It depends on the immigration officer, but some may feel that you are trying to emigrate, and would not admit you.  But the fiancee visa is pretty quick.

No problem.  Just get your divorce and a certified copy of the decree in hand before you file the I-129f.  You will have to put it in with your I-129f submission.  And remember that courts sometimes take a few months to issue the paper divorce decree after the judge grants it, so plan accordingly.

There are many good reasons to get pregnant.  This is not one of them.

 

I am on my third trip through the K-1 mill, and one thing I have learned is that you can move heaven and earth easier than you can expedite a K-1.  Just go through all the steps carefully, one by one, and wait the time that you need to wait.  The system does work, but you need to give it the time to let it work.

 

Let him come here on the K-1, get all the legal stuff behind you, and then start planning your family.

Let's put it this way:  You don't know you have an eating disorder.  You think you might possibly have one, but unless someone with the proper medical license and medical expertise says you do, then from a legal standpoint you really have no way of knowing that you do.

 

If some doctor asks you specific questions about ED conduct, I would not lie to him since catching you on a lie can be big trouble, but if you are just asked the larger question of whether you have any such disorders, you can safely say no.  Until a doctor says you do, as far as you know you really don't.

 

Le's put it another way:  Suppose I have chronic headaches, a symptom of high blood pressure.  But no doctor or nurse ever checked my blood pressure.  I therefore do not know that I have high blood pressure and can safely say no.

So whatever boosters he thinks you should get pre AOS you need to get or you will be denied.

 

Once you have the green card and are free of legal restraints, you go see your own doctor for his advice on where to go from there.

Are we talking about proof to send along with USCIS I129(f) or docs for embassy interview?  For the former, a definite no, but the docs you prepare for them must have original inked signatures.

 

For the embassy interview, that is a bit murky, but generally speaking, any govt docs need to be official copies from the govt office that issues them.  Your own signature does not need to be notarized (I don't think), but I took no chances and did it anyway.  Cost a total of 10 minutes of my time.

 

Translations from foreign languages do not need to be notarized, but they need an original signed statement from the translator that he/she is competent to translate and did a true and correct translation.

 

And the translator cannot be the petitioner or beneficiary.   I found that one out since my last fiance was a professional English-Russian interpreter, well qualified to translate, but not for this since she is the beneficiary.

Definitely read the guides the other members cited here.  There is way too much you need to know for us to repeat all of it here.  Then if you have specific questions after reading the guides, this is the place to ask them.

 

Lawyers don;t come cheap, and unless you have a really tough case, there is nothing they do that you can't.  Doing this on your own is really not hard.  But one member here mentioned one advantage of a lawyer, that he will do a better job of getting the attention of embassy personnel simply because he is an immigration lawyer and you are just a pettioner.  If that one thing alone is worth his fee, then go for it.  But there is really nothing else he will do that you cannot do yourself.

 

Yes they may want DNA tests to prove paternity, but so what?  You, the baby and your fiance submit blood samples. you pay about $300 or so for the fee, and it is done.  Compared to the cost and inconvenience of the whole process, that is just a minor nuisance.

 

One red flag you may have here is income.  You, the US citizen, will have to show enough income and/or assets to support the three of you.  Sure your fiance will want to work when he is here, but it takes some time to set that up legally after his arrival.  So they will look to your income and assets to support all three, and it had better be enough.  The guides will give you more information on that.

That is not exactly true.  I was with Pui when she did her medical and the hospital supplied all the forms.  When she had her interview she did not get the visa right away because the forms used at the hospital had expired.  The lady that had her interview just after Pui also had expired medical forms and she had used the other hospital that was listed on Embassy's website for Bangkok, so it was 2 different hositals with expired forms.  After Pui had her interview I had her go back to the hospital the same with the documents the embassy gave her the new documents and then had her go back to the embassy to turn in the documents and then they said the visa will be issued and for to come back and pickup the visa.  The other lady Pui met that day had to do the same thing and was granted her visa as well.

 

In other words the hospital screwed up.  I suppose this is not the first hospital to ever do this.

 

But how are we supposed to know when they do this without finding out the hard way since everything is sealed?

Have you checked the Canadian board for specific info on how the medical is done there?

 

I see you are from a Western nation which adds credence to my theory that non Western locations are flagged for the extra STD scrutiny.

 

Regardless of what is or is not examined, the fact remains that your objective is to pass it.  And if you are healthy and drug free, you will.

Right, but this is not something you prepare for.  That form is for doctors and you will never see it.  So how does knowing the name of the form help you prepare?

 

This is something that doesn't concern you, and I mean that in the nicest way possible.  Let them do what they do, you don't need to know what form they use.  Fill your mind with other information that you can control :)

 

Sometimes they take a peek to make sure that you are a woman but I haven't heard of anyone do a full pelvic exam.  Good luck.

 

I never say never without knowing all the rules of all the State Department approved medical centers in all the world, nor would I ever want to be burdened with that much knowledge.  That is why I suggest each VJ member check the rules of the one medical center of interest to him or her, the one they wil be using.

 

I did not mean to suggest that St. Luke's in Manila does a full pevlic exam, nor do I see why any center would, but again without knowing each and every one I will never say never.  What the doctor does in St. Luke's is a visual inspection for irrgularities that might indicate the presence of an STD.  Bloold and urine tests, as I understand, are not 100% effective in detecting STDs, and whatever the percentage may be is not high enough for St. Luke's liking.

 

Perhaps in a Western nation where infection with an STD is not as much of concern as in an Asian nation, they may be satisfied with blood testing only.  This is an example of what I wrote about how the exam is tailored to the concerns of that particular part of the world.

I was told that it is form I693 but then somebody said that was for the AOS not the K1, so I wanted to know which form the physician uses just to be prepared. Also I wanted to know if there is a gyn exam because some people say they did and others say they didn't even have to undress (only upper body for the x-ray), so I was wondering about that.

 

Nobody really pays attention to the form used because you dont even see the form.  The K-1 doctor seals it in an envelope and you briung it sealed to the embassy.

 

Do they examine your genitals?  I have heard varying reports, as you seem to have heard.  It seems to depend n the specific medical center.  The one I focused on for obvious reasons is St. Luke's Medical Exentsion Center in the Philippines.  There they do examine genitals but for your privacy assign you a doctor the same sex as you.  For the specifics on your country I suggest you look in the regional forums in this board.

 

As I understand it, what they examine is driven by the prevaelnce of that particular illness in your country.

I didn't have to fill anything out - just sign (and I used the doctor's pen for that). The physician I did the medical with filled out two forms, one with the details of the vaccination history, and one where she added details when appropriate (for example, she wrote about the time my oldest child was hospitalized for pneumonia as well as the medication she takes for her asthma) and where she crossed off boxes for Yes or No as she asked questions about my medical history.

 

Glad it went so well for you.  But each medical center has its own rules, it is always good to have your own pen if you are called upon to fill out a form.

Just be prepared for the possibliity that the panel physician might refer you to their own psychiatrist for their own evaluation.  If you are confident you will pass the eval, no problem, but it might delay you a bit.
