I did a waiver request too, and it worked.  It is a business letter on plain paper, signed by you (make sure they get your original inked signature).

 

In my case, neither one made it to the interview.  The first one was pre-IMBRA, where my fiance did not break up but instead gave me no choice but to end it.  She became hostile and uncooperative while in Moscow (she was there on my dime), where she was supposed to get her interview and medical but refused both without explanation.  After that she became uncommunicative.

 

The second one told me she changed her mind 3 days after NOA2 approval (thanks for nothing) after promising me many times that she would never ever do that to me.

 

I sent a waiver request showing that neither failure was my fault and in fact both were against my wishes and over my objection.

 

The waiver got approved without comment.

 

BTW you could have avoided the need for the waiver by pulling the plug on the second one before the NOA2.  You had four months to do that but sat on your hands while the NOA2 was issued.  Pre NOA2, these things do not count.

 

Just so you know, you will have to ask for 2 waivers, not one.  First is that this is your 3rd petition, second is that your second NOA2 came less than 2 years ago.

 

I did not have the 2 year problem as my second NOA2 was 2 years 5 months before my third filing.

They will usually want to see a sample of the text in the emails and chats.  If they are voluminous, like the 1000+ pages of Yahoo chat we had, then just pick out 50 pages or so.  I know 50 sounds like a lot, but I read about one CO who was presented with 10 pages and decided he wanted to see 50.  If he does not read them, that is fine; at least he can see before his eyes that the pages exist.

 

Skype of course does not result in transcripts, so for that I just listed the dates, times and number of minutes and totalled the minutes up for the CO in case he does not want to do the math.  It cames out to over 100 hours of chat in the last year alone.

 

If you were physically together a lot, then you must have a bunch of photos.  If you went to places like theater or resorts or anything else that you paid for, show him the receipts.  Bought her gifts?  Show photos of the gifts and the receipts.

 

In other words, show that you and she do things that people not in love don't normally do.

Nothing has changed.  You hand the immigration officer at POE the sealed envelope, show your visa, they take a thumbprint and your mug, and you are in.

 

BTW the delivery service is 2Go.  If you did not get the package yet you can track it on their website.  If they don't have it, then you should checck CEAC or ustravedocs as the embassy still has it.  Most of the visas are delivered by now, but if you don't have yours yet, the delay has been quite long.  You want to know what is going on.

For the embassy (not for the I129(f) I put in 50 pages.  Most people say 10 is enough and they use 10 and it works fine, but  I heard a few stories of those who brought only 10 and ran into trouble.  So I supplied Candy with 50.  Her interview is in 4 days.

 

BTW I have 1400 pages and attached a note to that effect to the 50 pages I submitted.

I assume you got her a K-1 visa.  Am I correct?  If that is so, it is CRITICAL that she be unmarried when she enters the United States.  She cannot marry anyone before that point, not even you.

 

Once she is here, you and she MUST marry within 90 days.  Failure to do that will result in deportation.  After that, apply for AOS (the proceeding that gets her the green card), EAD (so she can work) and AP (so she can leave the US and re-enter).  You file for all of these at once.

 

I have no specific advice on the SSN, but the other posters here seem to know that it is best to do that first.  I did read that you should wait 2 weeks after her arrival before you apply for one, otherwise certain records will not exist yet and will result in the SSN taking longer to get approved.

2ndmessiah is right that it is proof you met in the last 2 years, not evidence of continued relationship.  That proof is subjective but usually includes visa stamps and boarding passes to show actual travel ,photos of the two of you together, and receipts for things you did together like dinner at restaurant.

 

Is this the first marriage for each of you?  If not be sure to include a copy the relevant divorce decree.

 

I do not know the answer about the adoptive v bilogical parents issue.  Sorry.

The alien (Candian citizen) gets one single entry to the US under the K-1.  Once the K-1 is issued, the next entry is considered that one single entry regardless of the usual other ways Canadian citizens can enter the US.  If the ailen leaves before getting AP or Green Card, he can still get back in under the other ways Canadian citizens can get in, but not under the K-1.  That means all the K-1 benefits are gone, including right to live her and to apply for Green Card.

 

Bottom line:  Once the K-1 is issued and the Canadian enters the US, figure on that being the last US entry until he gets his AP or Green Card.

You can fill it out but she has to be the one to push the "File" button.  You can save it then email her the file, then she can load it and push "File".  I have heard of cases where the USC got away with pushing the "File" button but you are not supposed to, and if they detect it (IP address perhaps), you have problems.

 

If she is really all thumbs with the computer, you can use remote control software like Team Viewer to set it up for her and get the button ready to push, but she has to push it.

First of all, did the NOA2 on the last one come in during the last 2 years?  If so you have 2 choices:

 

1.  Run the clock out on the 2 years before filing for your K-1

 

2.  Request a waiver when you file you r K-1.

 

As the petitioner he has the right to withdraw it any time until the visa is granted, and it never was granted.  So he can still withdraw it.  But first he needs to see if there is anything to withdraw.  He (not you) needs to email the consulate where the prior was filed and see if they still have it open.  Don't depend on USCIS for this because once they issue the NOA2 they keep it open forever.  Go to the consulate.  If i t is still open, he needs to send a notarized letter to them advising them that he is withdrawing his petition.  It takes a few months to get procecsed, but the last step is that USCIS will send him a letter that they have closed their file because the petitioner requested a withdrawl.

 

How do I know this?  Been there and done that.  I had 2 priors.  The first one I withdrew because my fiance already had my affidavit of support and was in a position to get the visa and then come here and abuse it.  In the sceond one, my fiance never alpplied for the K-1, so the embassy just closed the file.  USCIS to this day shows that one as open.

 

Neither one came up during my fiance #3's interview, which happened 2 days ago.

I take it you are the father.  The baby is a US citizen.  No visa required.  The medical facility is quite good at modifying the medical exam for a pregnant woman, as they do that all the time.  But based on the timeline you presented here, the birth will probably occur by the time the medical exam comes anyway.

There is no reason to it, I wouldn't worry, if you get an RFE just send more stuff.

 

No pictures?  I sent visa stamps, boarding passes and pictures, and it flew just fine.

 

Just so everyone is clear, you do not need proof of a relationship at I129(f) time.  You do however need that at interview time.

 

All you need at I129(f) time is proof that you met once in the last 2 years.

It could if you don't get it straightened out.  They are supposed to take the brown envelope but not the chest xray or the vaccination record.  The original vaccination record is already inside.  The loose one is your copy.

I traveled to her county and we met in a city 2 hours from where she lived. She took a taxi to the city but paid cash. She doesn't have any "proof" from receipts or visa stamps or anything because she already lived in the country. I paid for everything and submitted all the receipts, hotel bills, etc. The only proof we were together were photos. I was advised that affidavits (notarized) of our actual meeting would address the RFE. I hope that is indeed the case.

 

My Candy is from the Philippines too as you can see.  And I did not have hotel receipts as her parents were kind enough to let me stay in their house.  What did it for me were the pictures of us together, boarding passes for me on the planes, and the visa stamp.  I did not just point to the stamp with an arrow.  I blew it up on the computer and sent them a full page size print of the visa stamp.  I did not include any affidavits.

I received a very similar RFE. They needed more proof that we actually met in person, even though we submitted pictures of both of us together. I flew to her country and she took a taxi from her city to where we met. I paid for everything that visit and we didn't have any receipts with both of our names.  She paid cash for the taxi as well.

 

The issue is that aside from photos, we really don't have any other proof we were there together. The hotel took a copy of her passport, but since it has been more than 30 days, they purged it. We didn't know we needed all this before we filed. Anyway, we ended up sending in more photos, with a few landmarks (but really only one that stood out), as well as affidavits that we met in person. Hopefully that will suffice.

 

Photos are considered secondary evidence.  In other words, if photos are all you have, you don't have enough.  Remember those Photoshop pictures of a boy walking on the moon?  You can Photoshop yourself into her arms without much trouble.

 

What about your visa stamp?  There is one on your passport they gave when you went there.  Did she travel too?  Get her visa stamp.  Receipts for restaurant checks?  Did you pay for restaurant or hotel with your credit card?  What about receipts for gifts you bought her?  Stubs from airline boarding passes.
