Jeff, I know it is hard not to get wrapped around the axle on these things (jeez, I was just there myself!) but I wouldn't worry at all until Monday. Call every day to the NVC and check and if not there Monday ask for a supervisor. The first-line operators can only look at a computer monitor and tell you what it says. If you need someone to dig it's going to take someone a little further up the food chain.

Their system is not being updated on time, due to high flow of applications. NVC ( Not NYC) will issue a number and mail you a letter. My letter got here a week ago, nearly 3 weeks after we had NOA2. When I called to see if our application has left NVC to the consulate they had no record of our case number, and operator told me the same thing - read me your letter. Consulate in Russia was more user friendly , we got and email response within hours today with confirmation and assigned interview date. I hope this helps.

I have been calling and calling NVC myself, it seems they all have access to the same automated system , which seems to be done. I just emailed the consulate in Russia with my case Number asking to clarify if they have it , and they did:)We already have our interview date and NVC has/had no record of it at all.

I am not sure understand what you meant by "they all have access to the same automated system , which seems to be done". NYC have to issue you the case number. Any other way to find out?

I am fairly sure it was NVC because from everything I have read they don't keep those petitions at VSC once they are approved, they ship them out right away. Gary knows a lot about VSC because he has friends that work there and he said the same thing. I'm also pretty sure because of how fast it moved out of NVC once I was able to send them a request to search for it. I don't have to tell you how ###### this feels. You expect the wait at VSC but you're not prepared for a hold up at NVC. It really bothered me. hang in there, it WILL show up.

I think you just need to give it a couple more days, Jeff. It took me 8 calendar days to get from the CSC to the NVC and be checked into their system. And yes, when I called the first-line NVC operator was able to find my file and give me a KEV number.

On a less happy note, and I hope this doesn't happen to you(!), when I got the NOA 2 letter saying that the file had been forwarded from the CSC to the NVC it in actuality had not. For reasons that are still a mystery to me, the file was held for 3 more weeks at the CSC AFTER the date the NOA2 said it was sent to the NVC. Though I have inquired several times, I was never able to find out why the file was held. Fell on the floor? Lost? Dog ate it? All I know is that after 3 weeks of calling CSC and NVC (and my senator's office as well) I got a 1-line email saying that it had been forwarded on this (new) date 3 weeks after what the NOA2 said.

But try not think of such things!

Why does anyone even call these people? What she told you is completely wrong.

Your petition, and ALL petitions go to NVC. NONE, repeat, NONE are sent to consulates directly by USCIS...EVER. For ANY reason. USCIS sends your petition to NVC within 24 hours of approval (weekends excluded) NVC has your case before you get the notice it has been sent. Some of the notices say it has been forwarded to the consulate...it has...through NVC.

NVC HAS your case, the operator has no way to verify that. They are completely and totally useless. When NVC FINISHES your case they will send you a letter with the KEV number. By the time you get the letter, the case WILL be in Kiev. You will then wait 2-3 weeks until Kiev puts it in their system. THEN you can make an interview appointment.

NVC typically takes anywhere from 3 days to 8 weeks to process a petition.

Then why do they ask for receipt number on NOA2? It seems like so many useless people involved in this whole process; USCIS, NVC operators. No wonder they keep raising fees :)

I just called NVC to find out if they received my case. Operator asked me to read what it says on the NOA2 notice. "The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about vise issuance...." She told me this means my petition never made it to NYC center and was forwarded directly to consulate.
I thought once my case is approved USCIS sends it to NVC, they assign KEV # and forwards it to consulate.

Then you are one of the very rare instances mentioned above. It is not uncommon for NVC operators to say they "do not have the case" and in itself, that means nothing.

I wonder how do USCIS transfers the case to NVC, electronically or via actual mail?

Stop calling. You will not receive a viable answer.

NVC has your petition. It was sent to them by USCIS within 24 hours of your petition approval. They had it before you got your NOA2 in the mail. If it is in AP it will take 2-8 weeks. You will receive a letter with a KEV number when NVC is finished with it.


Hi Gary, if my case in in AP then my file at least it should be in their system. They keep telling me they don't have it.
Also, 8 weeks (I assume business weeks) seems kind of long since the NOA2 is valid only for 4 months (not business months).

I guess I don't understand the reasoning behind the advice NOT to do precisely as the email states they should do. Maybe you can explain it to me? I mean, they got to a supervisor who has now apparently told them how to fix it.

OP, in this email, did they give specific instructions for any Attention: or special address for this duplicate packet?? If not, I would try to email back to get that info, or get your congressperson/senator involved to make sure that THIS time it doesn't get lost.

Then, here is what I would do -

I would reconstruct the entire I-129f packet I mean, if you followed the guides here, you have a complete copy of the thing anyway. Just get some fresh signatures on there. Then, I would also create a "cover packet" which would include the following:

- Cover letter stating the situation, case number, and your instructions. Request waiver of fee and expedite due to USCIS error. Reference the remaining things in the "cover packet"
- Email with the instructions to send duplicate & admitting it's lost
- Photocopy of NOA1
- Photocopy of NOA2


What a headache! Hope it gets straightened out soon.


Oooh, I just noticed that you got a military expedite. Maybe there are some other resources available from the same source to help you sort this out? I'd try there as well..

Since you received your NOA2 according to your timeline, did you call NVC to see where it is? Once USCIS approves it it goes off to NVC. Call them, speak to a live person and don't hang up until they find it

Don't file a duplicate petition until you get this straightened out

I have a same situation. My petition was approved almost a month ago. I spoke to about 10 different immigration officers at USCIS, call NVC and talk to operators every day. Nothing... USCIS told me it could take up to 60 days for NVC to receive my petition. I agree with you about filling duplicate petition, however if my petition is lost I will have no chance but to do that. I will wait a few more weeks, maybe my petition magically appear in NVC.

Just when you think you are awaiting your packet 3 and interview you chase your application and receive this email:

I have the same situation. I received NOA2 almost a month ago. USCIS claims that NVC have my petition, NVC claims they don't. I received same email from USCIS to file duplicate petition. I think we should wait a little before reconstructing our petition. I contacted senator's office. Let's see how that goes.

I know it takes several days for NVC to receive my file. I have been calling them every day, since I received NOA2 and talking to operators. A few times I spoke to the supervisors. They told me if they don't have my case they can't help. I suspect VSC simply forgot to send it. NVC asked me to email them with the copy of my NOA2. I did, a week ago, but I haven't heard from them ever since. This is really sucks. USCIS will not help you until 90 days passed since NOA2.

It's been 24 days since we received our NOA2, however NVC still doesn't have my case number. I have been told by NVC operators and supervisors my file hasn't arrived from VSC and when I call USCIS, immigration officer tells me it does take some time for them to send my case to NVC and I have to wait at least 90 days before they will make an inquiry. Hey JVF congrats man ! Things are moving smoothly now for you.

Today it has been 14 business days of my NOA2 but NVC still doesn't have my case. I called USCIS this afternoon and asked them to make a service request they simply denied it and told I can not inquire about my case until 90 days, I asked for immigration officer. Even immigration officer repeatedly told me I must wait 90 days.
I am still waiting to hear from NVCresearch. JVF, how long did it take on yours to hear from NVCResearch?

I am also from NYC and I doubt they have also sent my petition to NY field office before sending it to NVC. Don't you think so JVC?

"90 days" statement is not true, not for I-129F. This petition is only valid for 4 month. I guess it depends what officers picks up the phone. Some are nice, some obnoxious. I used to call USCIS 2-3 times a week. Some officers would not even take my receipt number to check the status. I had 3 service requests with USCIS and 2 with NVC.
Here is the thing with USCIS service requests. First one will tell you your petition has been sent to NVC and you should contact them. All others will simply suggest to submit duplicate copy. After speaking to several immigration officers at USCIS I realized they have no way to locate your petition and no direct contact with Service Center (only via email). They simply tell you what they see in their computers. Forwarding petitions to New York is BS. New York doesn't process K1 visas.
NVCresearch got back to me 2 weeks after I sent them email with attached NOA2. Email said they can't locate my petition in NVC and they will contact UCSIS on my behave. That was the only reply I received from them. Others were auto-replies.
2 senator offices and congressman I contacted were little to no help. They did contact USCIS and NVC on my behave, but at the end they supported the idea of resending duplicate copy to USCIS.
The only real help I received was after contacting USCIS headquarters at Washington DC. I have their number at work. I will send it to you on Monday.

The bottom line, it takes a few business days after NOA2 for USCIS to send your petition to NVC
and a day or so for NVC to process it. If it's longer then that, something went wrong.
No way they can lose 5 lbs of paperwork. I agree with Dodi it's probably "under the coffee cup on the desk of the person on vacation". I got to tell you hon, that person took hell of a vacation... 40 days :)

I was told the same thing when mine was received there and they sent it on to London the very next day. Don't sweat it yet! You'll have time to sweat while waiting for your P3 to be sent and your forms to be logged back in when you've sent them back.

Additional Processing is just their term for "Sticking it in an envelope" half the time. Apparently they needed to dress up the procedure with technical terms. :blink:

Thanks. Actually in Ukraine you don't need to wait for physical P3. As soon consulate receives the petition and it's in their system you can schedule the interview over the phone. P3 can be fetched from consulate web site and 156 form submitted online

Is it the same as Administrative Processing (AP) or since they just received my petition yesterday they need a few more days to process it and send it to consulate?

Did you notice it just took 2 days for NVC to receive your case after USCIS sent it (per your timeline)

I am going to wait another week to hear back from NVCResearch. If I don't hear anything from NVC until next week then I am gonna have to contact my congressman. Today is the 16th business days of my I-130 approval from USCIS.

Are you saying that you called USCIS headquarter at Washington DC?

Don't wait, contact your congressman or senator now. Once they send inquiry to USCIS it will take a few weeks for them to receive an answer from their congressional liason at the USCIS
As I understand, USCIS sends your petition to NVC within 24 hours after the approval. If NVC doesn't have your case within 15 days in their system your petition is still at USCIS. I suspect the reason why this happens is that USCIS either archived without sending first or adjuster putted in the wrong tray and it's just laying there.

You should contact your senator(s) and congressmen. In my case they were useless, but I heard some are actually really good on resolving issues like this.
Calling USCIS headquarter at Washington got things moving. They found my original petition within a few hours. Sending duplicate copy (per USCIS instructions) was a waste of time :(
I guess it's too early to get excited, since NVC still don't have my petition, but at least I can see on the USCIS status page they sent me a new Approval Notice.
