Yeah, are you talking to a live person or just the automated system? My file was sent to the Embassy in like 21 days or something but, the whole time the automated system said that NVC hadn't received my case. It wasn't intil I talked to an operator on like July 10th the operator was like yes sir, we received your file on June 29th and are processing it. So, if I had never called I would have never known. My case was shipped to the Embassy on the 19th. I still haven't received anything in the mail or email about it being sent. Thank god I called. I even asked to speak to a supervisor just incase. it was sent the following day after I talked to a supervisor. I just told the supervisor hey, you operator can't tell me anything about why my case is taking over 20 days. The sup didnt give me any more info than the operator but, it shipped the next day after that.

Nope, not here....NVC received my approved petition on the 29 June but have not sent it to USEMB Malawi yet (9 July). They said the 4th of July weekend set them back.

Check dhl site. I saw a package being shipped out of NVC office to Malawi on July 7th.
I suggest you call the consulate on Monday to verify.

Here is how you can find out.
1. go to http://www.dhl.com/e..._reference.html
2. In Shipper´s Reference type "EXP 06 JUL 2010A" (without ")
3. Date range for shipment - From 06/07/2010 Date range for shipment - To 10/07/2010

Yes, it's taking NVC taking longer then usual to process NOA2. I have been calling them everyday since I received my hard copy. Some operators even say it might take up to 90 days. Here comes another wait... :(

Thanks everyone! I really hope all of you receive your approvals soon! The waiting game is so hard to play. I was physically with Brenda every day for 1 yr and 3 months. For the first time in my life I have felt real and true love and these last 71 days were extremely difficult! My grey hair count has doubled! I called Brenda in Malawi and they are 6 hrs ahead and she was asleep, don't think she fully grasped what I was saying lol. Now for wait part two, USEMB Malawi is small and not very busy so I'm hoping everything moves quickly from here. We have been struggling to get the police certificates from Uganda and South Africa. TIA (This Is Africa)! I guess from here I need to send her my financial paperwork and affidavit of support. I am asuming a scanned copy is ok. Any tips out there? I've also read some things about smoking pot and that even mentioning you smoked back in high school can hender things (which is crazy cus that was like 15 yrs ago). Any suggestions? Anything else I should be aware of after receiving NOA2?

You can call IRS and get your income tax transcripts for years of 2007,2008 and 2009. They will fax it you while you are on the phone with them.

I have been doing alot of praying that I did all my paperwork properly since I did it all myself without a lawyer. The date on my NOA1 was 4/8/2010. I received my text message today and got online to check my email as well. WE ARE APPROVED!!!! 6/18/2010. I can't wait to receive the NOA2 in the mail!! I am praying for the rest of the April filers. Well I should be excited my file was touched today. But no we got an RFE - lordy only knows why cause dang we were thorough.

So now we have to wait for the stupid thing in the mail before we know what it was!!

"On June 9, 2010, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail."

Ugh - not happy !!!

Not the end of the world. They will send you a document asking for what's missing and you send it back to them. Adds two weeks to the process at most. Not a big deal.

Keep your spirits high Vermont K-1's because VSC seems to be kicking some butt lately by getting approvals fast. :thumbs:

Notice that if you look at some of the past months where VSC seemed to be slower than CSC, you will see that VSC had many more apps to deal with than CSC. Of course, we can only see the difference in terms of VJ applicants. However, I assume that the VJ data might be a good sample of what is happening on a larger scale which includes both VJ and non-VJ people.

Maybe they finally felt sorry for us ;)

You are right some people might not be updating their timelines. One thing I know is, I am very happy with the speed at VSC, at least it is better i.e. faster than it was in Feb and other months. The last two weeks were very productive there in approving K1 visa.
I wonder how cases are assigned there, do you think by last name, region or by date received?

I think on first come, first serve basis. However, some immigration officers are slow, some faster on processing our files.

My current timeline states "Based on timeline data, your I129f may be adjudicated between July 12, 2010 and July 25, 2010*."

Which is only 6 weeks away but dang still seems like a long time lol.

It changes from time to time. It could increase or decrease. I guess it all dependence who has your file at USCIS. That's why NOA2s are not consistent. I hope, whoever was assisgned to process my file does not smoke or takes a lot of sick days ;)

I just did a count and so far only 23% (22/101) of March VSC filiers have received their NOA2.

That's very little. Some people might not be updating their time lines here.

I know that Alabama for example has a "you may not marry for X months" clause in their divorce proceedings (I think it's 90 days). The only reason I know that is cause another member married his spouse (USC from Alabama) after entering on a visitors visa but it was getting close to his I-94 expiry date so they went to another state to "ignore" the 90 day rule (she had recently divorced so they could marry). The immigrants AOS was rejected because she wasn't "free to marry" in the state they were living in.

That should still be fine, since it takes about 4-6 months before the interview actually scheduled.

Historically, not much, other than a USCIS person handled your file. I personally believe that any touches mean something positive, but most VJ'ers would disagree. It really depends on how long your case has been pending.

I filed my petition 3 days after my divorce was final, just got my NOA2 yesterday (91 days). You won't have a problem with that particular issue.

I'd be surprised if it comes up. The USCIS is mainly interested in determining the legitimacy of your current relationship, not the circumstances surrounding the termination of your prior relationship. If it comes up at all, just explain your situation honestly.

If it makes you feel better, when I met my current wife, I was still married (in the process of divorce). I had concerns that the USCIS would compare dates and note that fact and that it'd be an issue -- but nothing came of it.

You should be fine.

there was a 6 month clause in my divorce. you should check your divorce decree maybe. K1 requires you both to be free to marry.

Hi cranehand, Not sure I understand why would I have 6 month clause in my divorce. My divorce decree has the date of my official divorce (same as the court date), then after about 3 weeks I sent the petition.

USCIS Transitions the Intake Function to Lockbox Network for Several Benefit Requests
May 25th, 2010


WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) today announced that it will be transitioning the intake function of several more forms from the Service Centers to its Lockbox network. By centralizing form and fee intake to a Lockbox environment, USCIS will improve consistency and integrity in the intake process.

The forms scheduled for the transition:

– I-817, Application for Family Unity Benefits (If filing under section 301 of the Immigration Act of 1990);
– I-526, Immigrant Petition by Alien Entrepreneur ;
– I-539, Application to Extend/Change Nonimmigrant Status (Only those filed separately from the I-129);
– I-129F, Petition for Alien Fiance ;
– I-140, Immigrant Petition for Alien Worker.

The transition will start mid-May with the Service Centers forwarding applications to the USCIS Dallas and Phoenix Lockbox facilities for processing. In June, USCIS will post the revised filing instructions, update the web page for each form, and announce the address change with a USCIS Update.

Throughout the transition period and up to the point where USCIS formally announces the new filing addresses, customers with concerns should contact the National Customer Service Center at 1-800-375-5283.

The only non-immigrant category affecting anyone on this site is the K visas. CR and IR visas are immigrant visas and are not affected by the fee increase (they are already $400 though)

I heard USCIS is going to focus on student and work visas, so they can get people in before Fall 2010 semester starts. That makes sense why processing time went up on USCIS site went up from 5 to 6 months :(

New filers are saying the same thing filers were saying back when I filed - "I can't believe they're raising the rates again. Jeez. Even though I just took three international vacations... I can't stand paying a few hundred more dollars so our federal government can run one of their departments in a fiscally-responsible manner."

And just for the record... my wife filed her naturalization papers a few weeks ago. The fees are what the fees are. If you know they're going to go up, file quickly!

Also, keep in mind you're arguing local vs. federal. I'm a HUGE advocate of the federal government doing ONLY what the federal government is supposed to do. Nothing more, nothing less. In our case here on VJ, we fall under the regulation of interstate trade and for that, the federal government should have a hand in it. USCIS is doing what they're supposed to do and that's raise fees to cover expenses. That's what you do at home, right? Sounds like that's what your township is doing!

And, for the record, I would care about your township if you traded with my township. Or if your township's defense was threatened. Other than that... handle it yourselves.

A matter of fact I took more then 3 international flights in the past 6 months, some were just for the weekend (can't take so many vacation days). I miss my love so much I willing to pay over 1000 for a ticket just to see her for a day or so. Money is not an issue here and a few hundred dollars will not make me poorer or richer. I was not talking about my property. It was just an example. By the way, my state has the highest taxes in the country and I am not b!ching about. You know why? The quality of life. It's worth every penny.
