Valeria picked her Visa today at the FED EX in Kharkov. The yellow sealed envelope she received to give to Homeland Security had a cut in the corner like it was cut with scissors. The FED-EX lady told her this is the way they come from the Embassy. Have any one else experienced this? The cut is not large enough to remove or add papers. Thanks...We are officially the "panic couple"

I guess it would be a lot quicker to pick up Visa at Kiev's Fedex office. 2-3 days?

NVC still have no case number for me. Spoke to immigration officer at USCIS, she told me I have to wait 90 days before I can me an inquiry. What a joke!!! Somehow I feel VCS didn't send my approved petition to NVC. So now I have to wait 90 days for USCIS to to anything about it. Approval Notice is valid only for 120 days. What happens then?

Oh, I see. Well i would contact the USCIS and get a tracking number or something. They say they sent it, then they need to prove it! Get a tracking number from them or talk to a supervisor. That's B.S. They need to tell you something.

Trust me I spoke to the supervisors, immigration officers at USCIS. They have no way to track it. I just received following email from nvcresearch

Dear Sir or Madam:

Please be advised that the National Visa Center (NVC) has received your inquiry and the attached I-797 Notice of Action - Approval Notice.
Unfortunately, we do not have record of receiving your approved petition. The NVC will contact U.S. Citizenship Immigration Service (USCIS), on your behalf, for information on the location of this petition.

Its hard to get in touch with them during the day. I called all morning one day and finally got through at 630pm that night. Once you get them on the phone, verify with them that they received your approved I-129f. Once they verify they have received it, get the NVC number from them. Also find out when the approved I-129f was forwarded to the Embassy.

That's the problem. NVC telling me they did not receive my approved I-129F and USCIS claim they sent it.

As it is my I-130 under F2A category. I doubt if Headquarter people would tell me the same 90 days thing that USCIS people told me couple weeks ago. But I think I will have to give a try. I appreciate your help JVF.

Sorry, I am not sure what is the process for I-130. In my case I knew it does not take 90 days to send approved petition from USCIS to NVC. After all NVC is not located on the different planet :)

I am still waiting for NVC to receive my case. I have been sending emails to TSC and bugging them. They say my case has not been sent to NVC, they have requested the file and will forward it once received. I donno how long it's gonna take. :(

Call the USCIS headquarters at (202)272-1899 and request to talk to the supervisor. They resolved my issue within

jojykhan out of curiosity. Were you able to speak to the supervisor at headquarters? How long did it take them to resolve your issue? This is what pissing me off. Why can't people at normal USCIS hotline provide us with the same service? Why do we have to hear this 90 day BS? I am really happy you are all good now. I know exactly how you felt. God willing things should be moving a lot quicker for you now.

I would like to say Thank You to you for providing the information you have. I was able to contact the at USCIS headquarters and they were able to contact vermont center. Vermont center sent out another NOA2 on Aug 18th. And today i called NVC and they said that they received the file today and will be sent to embassy within a week or so. If you had not pointed me to the right direction i do not know where i would have been right now. Finally some progress and file finally at NVC after such a long time.

JVF, I emailed my service center about my I-130 that didn't reach to NVC after 29 days of approval. One of the officer got back to me saying "He checked the system and my case has not been sent to NVC, he has requested my file and will send it to NVC once received"

I don't understand from where he has requested my file. Shouldn't it be at Service Center?

After NOA2, within 40 days I received a few emails from NVC. Those email stated ".
"Your inquiry has been received at the National Visa Center (NVC).

Personally, I don't think they contact USCIS. It's just "fu... off" email. I spoke to a few supervisors at NVC and they were surprised NVC contacts USCIS on your behave. Maybe they sent a request email to them, but at the end they receive same information you already know "we don't have it". NVC was not helpful at all on locating my petition.

One of the officer at USCIS also told me my case has not been sent to NVC. Of course not :), it's not at NVC.
Another officer told me my petition was forwarded to my local service center in New York (what???). I even made infopass appointment, but then canceled after another officer at USCIS told me this is not true.

I am not sure what the f... is going on there, but every time you talk to someone at USCIS they give you different information. Aren't they looking at the same information on their computer?

I think he send an inquiry to Service Center. Did he provide you with Referral ID?
If this service request was expedited then you should received reply from VSC.Ncscfollowup@dhs.gov within 5-10 business days, if not within 20 days.

Don't want to make things up. I am not sure how this works.

In my case, I think, whoever I spoke to at headquarters followed the paper trail of the petition and found it was put in the wrong out tray or something. You just need to find that person who will care enough to do this.
Don't give up hope. It can't hurt to write and call as many people as possible.

I have this number at work. I will post it tomorrow morning.

USCIS will instruct you to send duplicate copy once immigration officer submits second inquiry to Service Center.
After first inquiry their email will simply state that USCIS sent your petition to NVC and you should contact them.

I think you need to call DOS number and ask to speak with an officer and explain him the situation.

Calling DOS does not help. I called DOS many times. Officers tell you what they see on the screen. In this case someone at Service Center has to physically look for the file and if retrieve it from archives.

As of Aug 17 i still do not know where my file is. I have contacted my senator i have contacted USCIS and NVC many times infact every day. I have sent email to all NVC links as well as USCIS links. But still No clue. Me and my finance are really stressed out. In fact so much that we are now fighting everyday because of this. If anyone can help me and guide me which route should i take i will really appricate it. I dont want to refile my case but is that my only option left???

I am sorry to hear that. I know exactly what you are going through. After 40 days of waiting and calling senators, congressman, USCIS and NVC I gave up and sent duplicate copy to USCIS, as instructed in their email. I waited a week after they received my copy and called USCIS. After Immigration officer at USCIS told me they will get back to me within 90 days (what???) I called USCIS headquarters at Washington DC and demanded to talk to the supervisor. Supervisor at headquarters was very nice and understandable. She promised to find out what is going on and call me back in a few hours. A few hours later she called back and told me my original petition was found. Within 2 days it was in NVC.

Who did you contact and how long did it take NVC to get back to you? NVC responded to me via email a week ago that they will contact USCIS on my behave.

However, USCIS already told me they don't have my file and to reconstruct my petition.

Hi jojykhan. Welcome to the club. In the past month I spoke to about 10 different immigration officers at USCIS, several supervisors at NVC. REceived numeros emails from USCIS (some suggest to contact NVC, some reconstruct my petition) and NVC (promising to follow up with USCIS). At this point I suggest you contact your congressman or senator and pray to God they have experienced people dealing with immigration. Don't listen to immigration officers at USCIS. They will only make you even more upset. NVC definitely don't have your file, talking to them will not help. I think our petitions were archived at USCIS without sending to NVC first. But that's just a speculation. God knows where they right now. I don't think reconstructing your petition without seeking help from your congressman or sentator is the right thing to do at this point. USCIS will not do anything until 90 days passed since our approval. Good luck my friend. Let me know if you hear anything. I will also keep you up to date if anything comes up. Just stay calm. I know exactly what you are going through right now.

Day 54 of waiting and no touches or nothing.............

Vermont was on the roll back in July. Some even got approved in less then a month. Mine took 62 days. Looks like they are slowing down a bit, but don't worry everyone sooner or later get their turn. If they didn't misplace my petition after the approval for about 40 days my fiancee would be here already :(

My fiancee got her visa approved yesterday.
The process was extremely quit and easy. In at 9:00am and out around 10:30am.
Officer was nice and friendly. She asked my fiancee a few questions; How we met, where do I work, what does she know about my parents and if she ever spoke to them. Then she told her "congradulations, your visa has been approved"

I am starting to believe they moved our paper at the bottom of the pile and I also think they dont go by months. I thought they work on them by month ? But I am starting not to believe this anymore since people in May and June already got approved.

Contact your senator or congressman. They tend to get things moving. You don't have to waste too much time on this. Just find their web site and fill out privacy release form.
