My Fiance's interview was on April 13, 2009. It has been 3 and a half months since he has been in AP, I think he was one of the lucky ones after all. Although I heard ISL embassy is up and running and are clearing people who are under AP. Insha' ALLAH you will all get your visas in hand soon. Yes i was inquiring about DOS and had no idea about him getting the visa although I prayed day and night. One thing though, what is POE? Does my Fiaance have to go through that process? I have never heard of POE? Will he be able to get a ticket immediately and come to the US?

SALAAM TO ALL MEMBERS IN WAIT,

My Fiance has been in AP for 3 and a half months now. His interview was at the US Islamabad embassy and was approved for a visa but was put in AP. It has been so long. We have been apart for 16 months now, but he has been in AP for 3 and a half months. MY Fiance keeps sending the embassy emails asking for a status update but they keep replying pending. Several emails and 3 weeks later, they sent an email to my fiance saying that he will get a call or call letter from their office soon... it has been 1 week, but no call as of yet. Does anyone have any ideas on what we should do about this? I have heard about calling DOS but I'm not sure if I am allowed to do that and exactly which number to call?? I live in New York City, and my FIance lives in Afghanistan. PLEASE HELP US....I GREATLY APPRECIATE IT....AND GOOD LUCK TO ALL OF US...

hello and salaam alaykum everyone: MY fiance had his interview at the islamabad embassy April 13,2009 and was approved for visa but was told to wait for AP. they said 1-6 weeks but i know it wouldn't be that quick. IT has now been a week over 3 months and we have still heard nothing from them or the expected courier. They have my fiances passport with them in the islamabad embassy. I was just wondering how much longer was the process going to last. I thought since we are not married but only engaged the process would not take so long. I miss my fiance very much, there are no words to explain, as i am in the USA, so is there anything i can do to speed up the process? I have sent several emails to the embassy but they only reply saying the case is pending and under AP. I know there is a lot of AP to go through but my fiance does not have a common name that will send out a red flag nor is he much of age, 20 years to be exact. So please, I need ALL the help I can get. Please respond back to me.


P.S I am new to this and i hope everyone can see my message, if i am doing anything wrong please let me know. Thank you all so much for taking your time to read this and hopefully you can give me answers....THAnk you ALL!!!!

I'm not seeing hep shots in the chart for my age range. I'll definitely wait for the medical to have them determine what shots I need.

A doctor will tell you which ones. Also as an example, hepatitis B is mandatory in the us for kids and medical and hospital professionals and recommended for other at risk groups. if you are immigrating to the us it is mandatory


Yes, hep b is highly recommended and mandatory for some people in the US...but, for certain age catagories it is NOT mandatory for immigration purposes. It probably should be, but unless your wife is under 18, it really wasn't necessary for visa. This is the most recent schedule of vaccines I could find on USCIS website..maybe someone else can do better, but this is what panel physicians would have received and should be following (technically): See pages 7-10

Under the immigration laws of the United States, a foreign national who applies for an immigrant visa abroad, or who seeks to adjust status to a permanent resident while in the United States, is required to receive vaccinations to prevent the following diseases:

Rubella

Tetanus and Diphtheria Toxoids
Pertussis
Haemophilus influenzae type B
Hepatitis B
Any other vaccine-preventable diseases recommended by the Advisory Committee for Immunization Practices
so if you do not have a record of these vaccines, you will be required to retake some. my wife had to take 4 vaccines and hepatitis b requires 2 shots 6 weeks apart according to her doctor to prevent possible complications. and doc the treatment for tb is a 6 to 9 month regimen of pills.


Not all these vaccines are age appropriate, so No not everyone will need ALL these vaccines. It will depend on Age, and the 18-64yr old catagory does not need this amount. Just an example; Haemophilus Influenza B vaccine is not given to anyone over the age of 5yrs (kids in the US have 4 before age 5 normally). NO his regular GP did the blood test. He chose to have the titres done instead of getting shots, apart from Tdap which is a booster that we all are supposed to have every 10yrs. He knew he had MMR shot, and the chicken pox as a child...sure enough, his blood test showed immunity so he didn't have to repeat them.(i am a nurse so I knew this could be done instead) He hates jabs and deals better with blood draw?! :wacko:

I've been reading some posts from Jamaicans that say sometimes when you get the shots on your own within 4-8 weeks of the medical, it causes a problem and the panel physician re-schedule the medical - which of course effectively delays the whole process. That's why I want to find out the experiences of people here in Jamaica. As you've pointed out, if starting the shots on my own means saving money and time, then that's what I'll do. But I don't want to unnecessarily risk any delay in the processing of my case.


Really? That's a shame...if you have documentation that you've had the shots, it shouldn't matter where or when you get them. Did you call the visa medical facility where you will be going to ask about this?

At your age you should only need Tdap, MMR & Varicella. The Varicella vaccine is not available in some countries, so check on that. My husband had a blood test (titres) done for proof of immunity to Measles/Mumps/Rubella & Varicella (instead of re-doing shots), and only received the Tdap vaccine at his local doctor. You can have vaccines done by the panel physician but they charge quite a bit usually. If you can get some for free at your regular doc. I recommend saving yourself some money. Their are other optional vaccines but most are recommended for ill, elderly, or children.

Doesn't seem right for some to wait significantly longer at the same service center. Does it have to do with background checks taking longer in certain countries? I don't get it...it should automatically be first come first served, unless there is extreme circumstances.

If you call USCIS customer service with an inqury about your case they call it a "service request". People might have to do this if their petition is beyond expected processing times, or to expedite a case, or if they got an approved petition but it's been over 90 days and NVC hasn't received the case yet..these are just a few examples. If USCIS doesn't resolve the problem within 15 days I think, you can put in an email service request to the individual service centers (such as VSC or CSC).

Hi Nina..my husband was denied a visitor's visa in 2009 and the reason they gave was a crime involving "moral turpitude". However, we aren't sure which conviction the officer was referring to because he has several "stupid things" on his police record from when he was a young rebel. We think its one offence labeled "grievous bodily harm" in the UK but not sure what that translates into US law. It was a fist fight but my husband accidently broke a guys jaw. I spoke with an immigration attorney after the denial and he said that the officer may have felt that multiple convictions is moral turpitude (not having good moral character) not necessarily a particular offence. He also stated that it is entirely up to the officer who interviews if a visa will be issued and it depends on the type of visa applying for if there are any options such as an I601 waiver. So in our case the officer may have felt that "grievous bodily harm" was intent to cause serious injury, but did he know or was he planning on the guys jaw breaking? No...it was self defense because the other guy threw the first punch. Moral Turpitude is a shady term that has no clear definition because from what I have read, it is only used for US Immigration purposes, and although they follow the INA laws it is really an opinion...in my opinion anyway! lol...good luck

I have done some research & none make my husband(the beneficiary) ineligible to file a waiver from what I can comprehend..he was denied entry on a visitor's visa in Nov 2009 for a crime involving moral turpitude but they didn't say which conviction that was...we think its the offence labeled "grievous bodily harm". He was in a fight & broke the guys jaw with his fist. The rest were assault(pub fights). All happened in the 1980's apart from a DUI in 1993. No drugs, sex, gangs, weapons or domestic violence. I (the petitioner) have no arrest history.

Get it anyway..better to be prepared in case they ask for it. I called her majesty's court where my husbands records are and they said it only takes a week to get a MOC. For a caution you should go to the police dept that issued it..i think. London embassy loves to question ACPO's so we've learned. You shouldn't have any problem getting a visa with only 1 caution though. Best of luck @ interview

Take a breath and try to think positive. My husband was denied a visa 1 1/2 yrs ago before we got married so we knew our wedding had to be in his country. I asked for special permission to take a month off from work to abide by the laws of his country and luckily my employer was understanding. You can plan a lovely wedding with your family & friends and then have a renewing of the vows in the US later with your fiances family. An immigration attorney once told me that the US looks at the CR1 in a whole different light because after all, if they deny you, they are denying a US Citizen family unity. Sticking together and showing the officer you are determined to overcome these obstacles might show them how commited you are to each other for the next interview. Just keep constant contact & try to co-mingle your finances in the meantime. Chin Up!

What is the i601 for? Who needs or may use this?


An I601 is an application for Waiver of Grounds of Inadmissability. Some people are ineligible for a Visa to the US and will be denied at interview if so, but some are eligible to complete a waiver packet (and pay a fee) to ask for an exception.

Yes they can look at your Facebook page as if it were you looking at it. I've heard many people talk about interviewers having their page up looking at it when they sat down. No joke. Keep your Facebook and any digital media clean. Good rule in general honestly.

You prove extreme hardship showing why you can't live in Colombia!!!! you can say because you have a great business in the USA and you won't be able to have the same quality of life and business in Colombia, show and prove the criminality in Colombia is high, different language,family ties in the US,lack of employment in Colombia, tell them that you plan to have children and you want your kids grow up having the same opportunities you had in the USA, show and proof the health system in Colombia sucks.Hardship is not just about being sick or having someone sick in your family, you can argue about high crime rate in Colombia, lack of jobs in Colombia, language barrier,poor health system there, financially dependent on the USA,old parents, about the ties with your family and community etc...

Sandranj has some very good ideas for your hardship letter here. If using facts & statistics of a country can help show why you cannot reside there, than you do it. It's not about insult here, it's about getting a waiver approved.

If a sincere effort was made for rehabilitation what kind of time frame would we be looking at? I'm willing to spend the money on a decent attorney / psychologist to make this happen. I honestly don't know how long is long enough for being considered rehabilitated. I only know 15yrs or more for CIMT can be considered a good thing. Definitely ask a lawyer what they think and to give you some examples of good ways you can prove rehabilitation. Counseling, psychologist/therapist, a regular job (and get an employer letter saying how she is a valued employee..something to that effect) Counseling through the church would probably be a great thing because a letter from a clergyman saying "she is a good moral citizen and member of the church, and how he feels certain she would never engage in prostitution again" can be a good piece of rehab. See if she can volunteer at some sort of official agency...then after a little while, get a letter from them. It seems you will have a hard time proving extreme hardship to you though? If you haven't already, you should join immigrate2us.net. Its not an easy task putting a waiver together. I hope you can work something out.

In August of 2011 I met a girl working in prostitution. Although not a normal place to fall in love we have. We have maintained a constant relationship via facebook, email and I've visited her so far 1 time in her home country in South America.

We truly love each other and want to make this happen. She went home to her home country in December of 2011. She has gotten "real" job and left prostitution behind. I've been supplementing her income. On my visit to her home country of I met her 2 children and her family. Things went really well.

Although she has no criminal conviction her passport history will put her into a place that someone from her country doesn't travel to except to engage in prostitution. We don't want to lie to US Government so telling the truth about how / when we met is the only way to go forward.

Since she is technically banned for 10 years from the last date of her prostitution we need to get an i601 waiver or i212 waiver. What chance do you think we would have to get this approved?

Helpful background information. I'm self employed (family business), I have no medical issues. I've never been married before. I'm an active member in my community

She has 2 previous marriages including one where she moved to Europe.

I would love to know any ideas or suggestions? Overall what chance do you think the US Government would allow this?



I know with prostitution waivers, it's very important to show rehabilitation, along with extreme hardship to the USC. The more time that passes since she stoped engaging in prostitution, the better for your case. Extreme hardship comes in different forms, and does not necessarily have to be You with the medical problem, or urgent matter. For example: You care for your elderly father who has a heart condition, diabetes, liver disease etc. Without your help taking care of him and bringing him to doctor appts, cooking meals for him, bathing him etc. his condition would be grave. Of course you have to back this up with proof. If you consult with an attorney they should be able to tell you have a chance at a waiver.

Simple assault/Common assault are Not found to be CIMT...unfortunately I think every other type are. If it involved a weapon of any kind then almost definitely yes, a CIMT. Facts of the crime, the conviction and the actual sentence imposed can usually give the IO an idea of how serious the assault was and whether it involved moral turpitude. (this is based on what an Immi attorney told me & my own research) If you haven't read this article yet, it will give you a better idea:

This OP was approved back in 2006. Processing time for the I601 is currently 6-9 mos. but some are adjudicated faster depending on the embassy, and if they have an approved expedite. If the US lock-box filing goes into effect, the USCIS predicts it will possibly speed things up.
