You both say if we are on top of things for the NVC, What more do we need for the NVC? Do you mean if our I 130 has all the correct documentation and fees?

Trojam227 - Did you find that the Embassy in London were speedy? Is there a long wait between having the medical and Interview? Also, How scary is the medical? I'm dreading it! I don't have any health problems or anything I'm just nervous about them, how can I put this? Poking around!!

Well, speedy compared to some other embassies, Yes. NVC sets up the interview for you and will send an email with some basic instructions. When you get Case Complete at NVC you should call for a Medical Exam at Knightsbridge. As far as being on top of things at NVC, just start collecting everything now. Here's some links to print & study, and remember that all of these documents sent to NVC are for you, the applicant. Not your husband, the petitioner...except the I864 Affidavit of Support which is his job.

Oh, and don't keep calling the embassy...costs too much money! All they really do is book & cancel appts. Soon, you (or your husband) can call and bug the NVC for free! You will know when your entire package is sent to london..nothing gets forwarded there until you have Case Complete at NVC.

If he filed taxes then you just need to order a transcript from the irs. He will also need atleast his most recent paystub showing year-to-date income on it, or a letter of employment. With his income, does your wife qualify? That's your ticket if she does..

Also, call uscis and find out how long you have to file the waiver since your visa was denied last october. I had heard that london tells people 90 days, but in reality it's longer than that..also tell them that you need more time to prepare the waiver and would like to keep your case open. Ask if they can extend it. It can't hurt to ask...you need to buy more time.

I mentioned the mis-rep because if you have convictions you can't use the VWP to come to the states...the officer who adjudicates your waiver will know this and can deny your waiver for mis-representation (of material facts). On the I-601 there is a long list of reasons for the waiver, so check off ALL things you think you might be inadmissible for. One waiver covers everything for one fee, otherwise if you fail to check something off you will have to file another waiver for that inadmissibility and pay another fee.

Your story is making me sad. Can your wife get an additional part-time job just until you are able to move over? Are the children both of yours? If not, does she get child support and did she show proof of that income? Do you pay tax on your internet businesses? If you can prove that your income will continue from those sources even after you immigrate to the states, you can add that income to your wife's. You can use assets in addition to income to meet the guidelines...so let's say she is $5000. short, you would need $15,000. in assets (3 times the difference) Assets can be yours & hers combined.

I am trying to brainstorm any ideas that might help...what a tough position to be in.

As far as starting over, you won't have to send another I130 and wait for that again, you would start at the NVC stage, so not so bad.

The I601 is complicated and takes a lot of time to prepare. Your wife has to show how she is suffering extreme hardship because you cannot live with her in the US. You will also have to show your rehabilitation, but since your conviction/s were so long ago that shouldn't be too hard to do. If your convictions weren't too serious, a good strong waiver can overcome the inadmissibility, maybe needing an attorney/solicitor's help, but it can be done.

First, concentrate on the financial stuff and then the waiver stuff. Maybe try to get your wife over there for a week first so you can spend some much needed time together. Don't give up hope just yet. :D

If you are planning on returning to your same address in september, why not just have your mail forwarded to your mom's address temporarily? You can fill out a form at the post office for that, instead of changing your address with uscis. You can still check the status online and if they do issue an RFE or NOA2 before you come back home, you can find out about it that way. The G-1145 usually works pretty well for most, so you should also get the emails/texts like jaejayC said.

No, the photocopies should be full size. You will send an Original & photocopy of all Civil documents (marriage cert, birth cert, divorce decree, police cert, court records, military records etc.) You will also send a Photocopy of your husband's passport biographical data page (the page with the picture & the passport#) You will also send 2 passport size photos.

If your husband has unmarried children under age 21, he may need to send original & photocopy of their birth cert. also (even if not immigrating with him) We had to do this.

The affidavit of support (I-864) and supporting documents, is a seperate package which will be asked for first.

You don't need your wife's passport or birth certificate photocopies for the I-130. When you get to the NVC stage they will ask for all the applicant's (your wife's) documents. Make sure to send only a photocopy of your marriage certificate with the I-130 because you will need to send the Original to the NVC.

Yes, the fee for the I-130 is still $420. The IV fee has changed, but you don't have to worry about paying that for a bit.

If your dad's income alone is enough to joint sponsor than you don't have to include your mom's income/info. Doesn't matter if they file jointly, as long as his W2's/1099's show proof of earnings over 125% of fed. pov. guidelines. Tell him to be careful filling out the forms though, he should only put income from his sources, not the figures on the tax return. If he needs your mom's income to qualify then she needs to do an I864a.

No don't bother including property if she exceeds fed pov level. More paperwork they don't need. Thank you for the well wishes but our case is more complicated than some and unfortunately won't have the fairy tale ending after interview...our journey will continue for another 6 mos or so. It's ok though, we have prepared for it. They say ignorance is bliss...I say not with immigration.

You would count only you and your husband.

Mom would count herself, her spouse, and sponsored immigrant (your husband) and anyone else she claims as a dependant.
(If she doesn't claim you, she doesn't include you.)

As far as residing abroad temporarily, this is what the instructions say:

B. You are living abroad temporarily. If you are not currently living in the United States, you must show that your trip abroad is temporary and that you have maintained your domicile in the United States. You can show this by providing proof of your voting record in the United States, proof of paying U.S. State or local taxes, proof of having property in the United States, proof of maintaining bank or investment accounts in the United States, or proof of having a permanent mailing address in the United States. Other proof could be evidence that you are a student studying abroad or that a foreign government has authorized a temporary stay.

I can't give you a definite answer on that situation, but maybe someone else here has experience with job changes while a petition is pending. All I can say is that I doubt US Immigration would frown upon a petitioner who accepts a job offer that is a higher paying salary and has more room for advancement within the company.

Waiter I think you should put an address of one of your relatives where your wife does NOT live and make sure your relatives sends her the packets. The embassy needs a address to send the mail, so you are better off giving a real address. But you have to make sure she gets the mail.

They gave my Fiance a time frame, at the time of his interview. The officer gave him a blue letter stating that AP was going to last 1-6 weeks. It has been 3 and a half months now. We have heard nothing as of yet. About a week ago my Fiance received an email from the embassy saying he was going to receive a call or call letter from their office soon. He hasn't received a call yet but we are waiting patiently. I told my Fiance to send them an email when he should expect the call. We got no reply from them yet. I wonder if they will even reply to us or just call him instead, insha' ALLAH they will call and tell him to pick up the visa....OH! That will be the day.... for all of us!!! Yes you are right. the more days go by, the faster i will be with my fiance. Same goes for everyone else in waiting. Also i heard that Visa's are being issued quickly in Islamabad. When i say quickly I mean left and right quickly. My mom just informed of that. Her two friend's son-in-law just got their visas issued last week. When i heard that my stomach knotted. Well I hope it is a go!! He received the 3.5 packet through a mail courier in Quetta, Pakistan. Also the officer did give my fiance a blue letter stating he is under AP, but they said nothing about Kabul. Well I am sure he will travel three times the distance as Kabul to get his visa so he can finally come home, we just hope that the call or call letter is a good one and they issue him a visa. Inshallah they will, and to all the members who are waiting patiently like I am...
