Ugggh...sorry you got an RFE, especially 3 pages worth. Can I ask what evidence you already sent with I-130? They should have more specific instructions on the form and post this detailed list on USCIS website or something. Not fair to just say "or anything else to prove the marriage is bona fide". Shouldn't matter if there's an age difference, previous divorce, or cultural differences! If you legally marry and go through the very complicated, legal (and expensive) process to bring your spouse over and are sworn to show financial support of that person until they become a citizen, then who are they to scrutinize! Do they forget how many people are here illegally??? sorry, this gets me peeved :angry:

I called USCIS and requested expedite. They emailed me later that day granting the request & giving instructions on where to fax/mail supporting documents. I faxed about 25 pages. I followed up with an email to the service center the next day. It took them several wks to respond with an approved expedite...3 more weeks for NOA2. Hope this helps & good luck with your surgery.

The ds3032 was added to the case file on friday 7/8...I checked auto response and it was there, but said to allow several weeks for next steps...I haven't heard of anyone elses fee invoice taking several weeks so was just wondering how long on average. OK, well obviously filing single doesn't have the "unmarried for tax purposes" rule that head of household has. When qualifying dependants are involved you are considered unmarried even when legally married if your spouse doesn't live with you more than 6mos/yr and you pay more than half of the expenses of the household. I understood this differently and I think a simple call to the irs would be your best bet. I filed head of household because I have dependants living with me which I support (my children) and I did Not include my non-resident alien spouse or his income on my tax returns since we've been married. I believe you have a choice according to irs.gov, but the first year you do decide to file taxes for her, you must file each subsequent year...check out this link & call them.

Looks good! I didn't even do a cover letter, nor did I send wedding photos or chat logs! I wouldn't recommend this to anyone on here, but for those of you who already sent your I130 and didn't provide a cover letter/checklist, don't panic...we still got an approved petition. I did include all the important documents and boarding passes from all of my flights over so they could atleast see that we have spent lots of time together. Good luck!

I wouldn't stress too much about co-mingling of finances yet. Unless you have lived in the same country as each other during any part of your marriage. From what I read all over the immigration forums during our wait for NOA2, the USCIS does realize that it is difficult to co-mingle finances with a spouse you have not lived in the same country as. I had nothing to show but a few receipts of phone bills of his that I paid with my credit card (and that's only because he has a better calling plan so always calls me. We share the bill) and a couple of wire transfers from bank accts. You being able to get a joint bank account is a huge success because my bank said NO! Not until he can sign in person. Depends on the circumstances how much co-mingling you need to show. Our petition was still approved.

I would send photocopies of everything because when you go through NVC you will have to send all the Original documents...send the original translations to the NVC when its time. If you are doing in-country consular processing than I think you have to bring all original documents (and a photocopy of each) to the Interview.

Check the box but attach an explaination of why you didn't file taxes for the previous years (date,case#,signed). Send your most recent return with all schedules/W2's. Send your paystubs/wage slips and any other proof of other income (if any). The joint sponsor should do the same but must make 125% of poverty guideline for total persons in household plus sponsored immigrant.

Welcome Hodder! I can only comment on a few things here...the child support he pays won't interfere. They don't even ask anything about his income/expenses, only what he plans to do in the states (unless his income will continue even after immigrating) Only your income & joint sponsor's income will matter. Question though...do you all file seperate income tax forms? Does anyone claim anyone else as a dependant? And yes, you can use the house as an asset. You might need a fair market appraisal or something to show what it's worth.
As far as facebook chats/skype whatever, just print out a few pages from the very start until now showing regular contact. Boarding passes or proof of spending time together might be more important. I didn't send much at all but will have my husband bring more to interview just in case. Hope this helps a little. :D

Carlos, the letter from employer is only needed if you do not have paystub/s. Do send atleast one of these items along with your transcripts.

Six months of pay stubs is a long outdated recommendation. Today, most pay stubs show year to date income and rate of pay. When they do, JUST ONE recent one is sufficient and actually is a better choice than an employer letter. No need for both.

No such thing as six months of W2. That's a once a year thing. A single pay stub showing employer name and year to date income is sufficient evidence of "current income". At least a complete copy of the 2011 tax return including W2 is required. If she has a good and steady job, no real need for any other tax returns but he affidavit does ask for information from the last three. That should be 09, 10 and 2011.

You only NEED to send the most recent year's tax return (or irs transcript)with all W2's and schedules attached in order. You must also enter the figures for the 3 most recent tax years on line 25. Read what it says there..Sending copies of 2nd & 3rd most recent returns are Optional. The only other Mandatory things you must include is the aunt's Naturalization Certificate, 6 months worth of paystubs OR a letter from employer showing salary, length of employment etc. You Do Not Need to send both, that's up to you. Now that's it as far as what is required at Minimum. This is assuming the aunt will only be using earned income from work to meet fed poverty guidelines. Others on VJ have sent more than the required, but I didn't and no RFE on this packet. :)

Yes, your wife is your Immediate Relative. Waiting for NOA2 is long & hard because no action is taking place on your case until you are in the front of the line. The first time the USCIS actually picks it up, they are looking to approve it. If they need more evidence from you they will notify you. You have a couple more months to go before you will hear anything, but once you do, be ahead of the game because things will move MUCH faster through the NVC. Take these couple of months to study the NVC process and the medical/interview process and your wife just might be here for Christmas. :)

Attach an additional sheet of paper with the corrections, then have your wife do another one and hold onto it for later. I made the mistake of signing both mine & my husband's but no RFE. My husband has a corrected one to bring to interview just in case.

Oh, I assumed you just started the process! Well the NVC moves much quicker so do you have your DS3032 ready to email? and do you have the I864 done and all documents for the applicant? These are the things that will be asked of you once you have a NVC Case#. You might want to add your timeline to your signature so people here know where you are in the process...go to settings, profile, edit signature & type in the box then "save".

Hi Cathi, welcome! Apart from the obvious document photocopies USCIS asks for, I would also recommend sending bona fide marriage evidence. Most couples living apart send things to prove an ongoing relationship, not just proof you were married. Some chat logs, pics, phone bills, boarding passes, greeting cards & letters of affidavit from relatives/friends who have spent time with both of you together before, during & after the wedding. Take a sampler from when you first met until now. I failed to send pics & chats etc...had a heart attack for 4 months that we were going to get an RFE for not enough proof. Might be helpful and less to bring to interview. Good Luck! :)

That's why I said it is electronic filing for Canada. It is the intake person at the consulate who sees all the original documents. So my point was that if an employee at a consulate who can't see many UK divorce certs doesn't have a problem, then educating USCIS, as recommended, is the way to go if others have problems.


Yes Gad33, it is good to educate the USCIS/NVC whenever possible. I was actually commenting on the original poster's questions until I realized its from ages ago! She had an RFE for sending a b&w photocopy of a divorce decree to the NVC. People on VJ reading this need to know that you can't do that. Not unless you want to hold your case up. I would imagine, the original poster had her husband bring the original divorce decree to interview.

I thought NVC wanted all Original Documents (or certified copies) and photocopies of each. A color photocopy might pass through as a certified copy, but if you don't send the original, I would bring it to interview just in case...last thing you need is for the visa to get held up for that. Just a thought. :)

Just wanted to point out that her mom would not have to include her in her own household count unless the OP is actually her dependent. Simply living in the same house does not make you part of the household count for an affidavit of support.

I agree with grrrrreat on this. And yes, your mom will need to send a copy of birth cert/nat cert, along with paystub or letter of employment & 2011 Tax returns (and proof of any other income). I think you are confused because they file joint taxes but if your mom's income is 125% of poverty guideline(for all members of the household incl. you & sponsored immigrant)she doesn't need to have husband fill out the I864A.

I received text notification of my NOA2 while I was at work also (I was working the swing shift that day and it came about 45 minutes after I started work, made for quite a nice evening).


Yeah, it's a great feeling Ryan...and a great system they have in place. A shame it doesn't work for everyone. As far as the affidavits, just my 2 cents...I think it sounds & looks better if they are not all in the same format. We sent 2, and they were people that not only attended the wedding but have spent time with BOTH of us before & after the wedding as well.

He probably won't be asked to show any evidence. We just sent in three affidavits with the I-130 as we had none of the other things listed. I took a lot more to the interview but didn't even get to take it out of my bag. This seems pretty normal for London.

I sent a small book went I sent in my I-130. I couldn't believe how big it was when I saw it again at the interview. When I submit paper work now I just send the basics (tax returns, bank statements, car notes etc) but nothing in excess.


I didn't send much proof with my petition either, but now I am chewing my nails that husband will get the 3rd degree at interview. :unsure: he will not be happy with me when he gets the packet of stuff he needs to bring to the embassy..shhh

As WrightFamily said, "front loading" seems to be the trend. If you can, try to send some evidence from before & since the wedding as well. Keep in mind that you are basically proving that you did not go into marriage for the purpose of immigration. I know with some religions it isn't customary to have a courtship before marriage, but proof you met and spent time together before the actual wedding day would be helpful for your petition.
