There are different procedures for different countries (a few are eligible for electronic processing) most are not, and everything has to be snail mailed. DCF filers would bring documents to interview, but most of us filing in the US have to send all originals & photocopies of each to NVC & then THEY forward it all to the interviewing embassy. The embassy website says "whatever documents you already submitted to NVC does not have to be brought to interview"..they are covering all filing scenarios on the website, you have to follow the guidelines specific to your husband's country. You are almost done so just send in what they want & be done with it!

Providing you don't get an RFE for incomplete/missing documents, you are at the last step before case complete. It's only about 2wks after you submit the IV package to get case complete normally (once you know they received the documents, you can call every day to check the status of your case) If your husband can hurry up & get the package out to you this week, you could possibly be done with NVC by mid July.

Brendavera, nobody here wants to upset you. We want to help inform you so you aren't blind going in. You have nearly a month to research what path your case might take, use it to your advantage. Answer every question honestly and directly. It will save you a lot of trouble later...trust me on that. I know people in your position who went in naive and came out asking & looking for all the answers wasting time by being angry & lashing out when they could have been putting together the best waiver possible.

So when you say that the Applicant refers to the petitioner, we're supposed to enter the same information on both G-325a's, which would be my USC husband's employment and addresses, not mine? I filled out my form thinking it was my addresses and employment that was being asked for. Looks like I need to fill it out again, and mail. Another week of waiting, but glad I found out before it was too late.


One G325A for USC & one G325A for spouse (intending immigrant). If you are filling the form for you, you put your info. He puts his info on his. Don't put his addresses/employer/SS# info on yours or vice versa.

El, you go and spend some time with your husband and try to get this off your mind for a little while. I know how gutting it is to get a denial at the embassy...we've been there. Just continue building your marriage as best you can from afar. Consider moving there for a bit if that's possible. I know I would drop everything over here and move to England if I could, but I have children, and they have a dad in the states...my conscience won't allow that. Take a breather and think later :)

For only 1 conviction you should be fine, but it can't hurt to get the MOC (memorandum of conviction) from the court where you were convicted. Just in case the interview officer wants to see how long ago & fine imposed. You can go to the court & order it or send a letter requesting it...no cost & takes about a week to get. My husband was lucky that they printed his while he waited...best of luck at london!

Yes, thanks, Vanessa&Tony. I have told you what I know, but she has yet to provide the details. She was convinced it was a dead-end. I had to guess my way to the offense. (I started with murder and worked my way down, until she said yes.)
But I have to get more details on this store theft. I think it will be ok, if it was shop-lifting. However, if she was an accessory to an armed robbery, that is going to be a problem. The shame of this episode in her life is great, but she will need to give me the details, so we don't further torture ourselves with our separation. Thanks, for the helpful link.

Theft is a crime involving moral turpitude. It can result in an automatic denial, but that doesn't necessarily mean that it will. There are exceptions when the inadmissibility doesn't apply:

1. If there was only one crime, and if it was committed before the alien was 18 years of age, and if it's been more than five years between the time the crime was committed and the time the alien applies for the visa, or

2. If there was only one crime, and the maximum possible penalty for the crime was 1 year in prison or less, and if the alien was sentenced to six months in prison or less.

Note that these are exception conditions and not waiver conditions. This means that if the alien meets the conditions for the exception then the alien is not inadmissible. They don't have to apply for a waiver.

Your fiancee will need the complete court records to present at her interview, in addition to the police certificate.

My girl, Sneza, and I are about to begin the long process of the K-1 application. But when I mentioned the Police Certificate as one of the requirements, she said we might have a problem. She admitted that she has a conviction for theft on her record, and that she served five days in jail for this. She swears, this is the only thing on her record.

She was immediately convinced that she was never going to get a K-1; she didn't talk to me for three days.

However, I am certain, that not all get denied for a misdemeanor in their youth (this was about six years ago). I am trying to assure her, that it will be ok if we provide all the court documentation. But in all honesty, I have no idea! Maybe she is right, and this is an automatic denial. We haven't yet filed the I-129F, which takes 5 months.

My question is: Will we be wasting our time if we try to proceed? Will she just get denied at the end interview for spending 5 days in jail? I hope someone can tell me, so we don't waste money and time. Thanks in advance. (I am a newbie, but I did look around on the boards before posting this)

My fiance is coming over to the states on Thursday, entering with the K1 visa. His old visa waiver (ESTA) has expired since his last visit, but he doesn't need it anyway as he now has his K1 visa. Correct?

Good job! I thought we would get an email when case was complete also, but decided to call and see if they ever received my RFE response pkg and they said "yes, and your case was complete on 3/13". This was on 3/23..cut down my emotional wait time by 10 days! :lol:

Yes, you don't need to bring any of that stuff. In your case, all you'd bring to the interview is the following:

-passport
-interview letter (first page that states the beneficiary's name, place of interview, date of interview)
-medical results (if not sent directly by panel physician)
-2 passport photos (used for the green card)
-2011 tax information as it'll be after the April 17th tax deadline

Proof of relationship is optional, but highly recommended. Don't know how hard Spain is.





Saylin, my interview checklist looks exactly like this...so you are saying 2011 tax returns need to be brought to interview? And as far as passport photos, if we sent 2 to NVC do we need 2 more for interview?

Wow...not having enough chat sessions seems an extreme reason for a denial. Real sorry to hear that. It sounds like the interview officer isn't up on modern times of people meeting on the internet and forming a long distance relationship! It is so hard to prove a bona-fide marriage when you live in different countries...seems like common sense to me. Don't give up on getting another interview. I'm a bit worried now myself..with the invention of Skype & cheap international calling plans who prefers to text/chat anymore!!??

I followed the instructions literally and only sent the required docs. apart from 2 letters of affidavit from family who witnessed the ceremony, boarding passes from visits since wedding & phone bills. From what I have read on USCIS website in the instructions for I864 affidavit of support, you would put your wife as the Principal Immigrant and then list your step children on the same form as long as they will be immigrating with your wife or within 6 mos. of your wife entering the country. It doesn't look like you need seperate forms for each. As far as household size, I know you have to include any persons you support whether they live in your household or not...that includes your immigrating wife & her children. So if you live alone, have no other relatives that you support, and its just you, your wife & her 2 children then your household size would be 4. Hope this helps! Best of luck

Did you have any income in 2010 & file a tax return for yourself? If not, then you will have to provide a letter of explanation stating that you were not required to file a tax return because you were a student for all of 2010 and had no or too little income to report. You would still be the petitioner on I864 but would include your parent/s in household size in Part 5, 21-g. Then you will need to complete an I864a for each of your parents & have them sign it (and of course provide proof of their income). So their income, along with your income (if any) becomes Total Household Income. They would only need to be a joint-sponsor if you lived in seperate households. Make sure you can prove domicile in the US too..read the instructions thoroughly on the I864 because you are a student living abroad. It's confusing, I know...but just take your time to read through all of the instructions. Best of luck

I have seen that some of you have expedited your petition & NVC process...I sent I130 already. Is it too late to request expediting on our case? I am having a serious medical issue going on with one of my children that is affecting my job, my finances, my other 2 children...I really need my husband here to help ASAP and because we will likely have to go through the waiver process as well, any process we can speed up at this point is necessary. I don't know what constitutes an emergency in the eyes of the USCIS...any help is apreciated.

Why not email the NVC and ask what to do...all originals get sent to the embassy so maybe if you send a new signed form with an explanation to NVC, they could process it ahead of time so it doesn't cause delays with the visa. Just a thought..

I checked out the NHS (national health services) website and it looks like MMR, Td/IPV & Varicella are available. Tdap is not mentioned anywhere so i assume not available. MMR & Td are free on National Health...Varicella is free for certain high risk patients (others may have to pay). Not mentioned on the embassy website is whether Titres (blood test proving immunity) can be accepted for people who cannot get a copy of childhood vaccines or proof of having the disease already...all these would show up in specific blood tests. That would be a question for london embassy or Knightsbridge I guess...for people who are squeemish about shots (such as someone I married =)

I worked it out according to the vaccine schedule and it looks like ages 18-64yrs only require proof of MMR & Tdap (adacel). Children of course need a whole bunch & over 65 also need a flu shot. Does anyone know if all medical records from GP have to be brought to Knightsbridge doc?
