Well, I just got off with an extremely rude customer service person. I asked them why it has been a week and I still haven't gotten my RFE letter. They said I had to wait 15 days before they can do anything!!!!!!!!!!!!!!!!!!!!!!!! Can someone PLEASE tell me how long after their RFE email did they recieve the letter??????

Steph-

Fifteen days from TODAY of fifteen days from the date they issued it? If its from teh day it was issued, it probably just to make sure that you actually did recieve it. Mail at Christmas time, especially, can be a little slower than usual. But if its 15 days from today than I'm more than happy to join in your outrage and go girlwerewolf2xn.gif

This whole process sucks. I'm sorry you're stuck in it for even extra time. Mirla too.

Nah, it is 15 business days from the date they issued it which was December 5th. I just don't understand why they just can't $$##$ mail something without causing additional stress and unnecessary wait time. 15 days for mail! That is just ridiculous. It should take 3-4 days tops. I hate all of them. I really really hate them. crying.gif crying.gif crying.gif

Cuz they're lazy sods and stamps cost a WHOLE FORTY ONE CENTS. It shouldn't take that long tho.

I think we all sort of hate them. (can we all the way hate them when they ... eventually say yes? I dunno. maybe!!) devil.gif

Anybody else have experiences with getting staffers of your u.s. reps or senators to help? Mine fed me what uscis is feeding them that they are 'frontlogged' due to the price increase. So why are they skipping ahead then? Duh?
I told her july is getting approved mostly now and she listened and said she would mail me the result of her inquiry. But I have a bad feeling she'll write something brilliant like vsc is up to may 20 or that they are doing in order they receive!!
It's funny I emailed a few months ago about another issue with the case and they were eager to help even though I didn't need it, now it felt like I was somehow wrong to feel I'm overdue.
Oh well, guess I'll try the ombudsman's complaint form.
Can't fight city hall I guess, what a country mad.gif

Hey Dude is it just you and me left here unapproved and untouched.......like a virgin....hahahahahahahahahaha....that has been a long time.....hahaha...o.k. now I have sick humour......OMG....OMG....OMG.....what the he11 is this #######.......augh

HAHAHAHAHAHA! laughing.gif laughing.gif

I think Ric too? U know, at least before I got to 6 months I figured, oh well it will be over by 6 month commit time.
Now it's like open ended and there is no help even like from this staffer. It's like the twilight zone or '1984' with the VSC speak - you're in our commit timeframe even after 6 months cause we're processing only May 19 or was it April 22 even though website says 6 months and we are approving late july.
Hehe I should call them and tell them to 'go touch yourself!' devil.gif

I asked my congressional representative for assistance and his staffer returned me a nice letter that said it had been given to an officer the previous day. I had called a few days before, and they had told me it had been assigned to an officer (some unspecified time previously). I pointed this out to the staffer in my return email but recieved no response to that point. But the general idea was, its with an officer, you're just going to have to wait. They also let me know that if I haven't heard by THE NEW YEAR i was more than welcome to submit my query again. So, that was no help whatsoever.

One of my senator's website has posted the following:

Unfortunately, USCIS is experiencing a large influx of applications and is therefore
unable to respond immediately to our inquiries. Please allow 12 weeks for
processing. We will notify you by letter or telephone as soon as we receive
a response from USCIS. I thank you in advance for your patience and cooperation.

They also require that you present your plea via SNAIL MAIL (seriously not even a fax). jest.gif

I'm going to wait until 180 days before I go to my other senator. Maybe a presidential hopeful will think of constituent assistance a good motive at the polls?

Until I hear, or until 180 days I'm just going to continue taking my frustration out on kneeding bread and christmas music.

I wouldn't be so hard on T-Bone's fiancee. She could be just showing her frustration in particular ways. I would add that up to a cultural difference combined with her not understanding the process. I doubt she would actually care much about the delay if the relationship is truly failing.

On the otherhand, its never a good sign that she won't communicate. In a way, this long process has a way of weeding out relationships that are not on solid footing.

And families are very good about stressing people to the breaking point about things, especially if they're out of the information loop. Lord knows I'm ready to snap if my BOSS asks me one more time when I'm going to hear something... and dreading telling my nosy extended family all on Thursday that I still haven't heard. It's really disheartening, and frustrating.

I'm sure she's not just going to toss him aside, some people just don't communicate well when they're in a state.

Best of luck to you TBone.

K-1 Fiance(e) Visa Process & ProceduresFiling in I129 Question- where you intend to live
I have a hopefully simple question for you all.

I currently live with my parents, because the cost of living in my area is astronomical. We're currently saving to have a buffer for those 90 interim days, since its my understanding that he won't be able to work before the Adjustment of Status is completed, and a new Visa issued.

In any event, I wanted to know what I should put for Question 14: Where your alien fiance intends to live. We are planning on finding a flat upon his arrival in the area, but I couldn't tell you where NOW!

Is it going to matter that I'm listing what is basically my family home? My parents are willing to host us for a time, if necessary while he searches for work, but .. this sort of form seems like the sort that you don't assume things about.

So, and advice or clarification?

Thanks so much!

K-1 Fiance(e) Visa Process & ProceduresRecord of How you met
HI all-

I'm nearly ready to send off my I129F ! :)

I've written a fairly long record of how we met- a brief description of our introduction; but here's my question- we've met a LOT of times. In the last three years there's been about 12 visits back and forth. To fit ALL that on the page I was very brief with my descriptions, and entirely NOT personal.

I don't know I sort of feel like its not their business to know the personal bits of our life together, but if its required I could sprinkle some personal things into it I'm sure.

Currently it sort of reads like a laundry list, visited here, did this. that sort of thing. Is that going to be acceptable?

Thanks.

Hello, Everyone

Just wanted to let people know that we received an RFE for a copy of my BC. I wish USCIS would put this on their forms as documents to be included with the I129F Petition!!! So, for anyone out there just about to file...include the Beneficiary's BC just to be on the safe side. We received our NOA1 on 26th June 2007 and received the hard copy of the RFE on 16th November. So, it took almost five months for them to ask for this...GRRRRRR. Despite calling USCIS when our application was updated online to say we were getting an RFE they wouldn't tell us why this was being sent out...had to wait over a week for the hard copy.

Also just a quick note about visiting the USA once the Petition has been filed. I had no probelms at all when I arrived a few weeks ago. I had been a bit apprehensive after reading several posts on here...perhaps I was just lucky...who knows!

The waiting continues.....

Hi Everyone,

I have been looking at this forum for a bit now. My fiancee and I are about 75 days deep into waiting for NOA2fr our K1, My question is, I have noticed a few people mentioning writing letters to their senators and congressmen and I just wondered if this helped at all or what the point was? I had thought about it myself even though I wasnt sure if it would make any difference. Good Luck to everyone and I just have to say that it is awsome to have some place filled with people who have been or are going through this same long and ridculious process!!!!!!!!

Not everyone's journey is a smooth approval. Some people don't hear in six months, or recieve requests for documentation already provided, return information and wait months to hear back again. Letters to senators and congress people are to request help in getting service from USCIS, and some people write in support to press for change.

Hello everyone.

This is the first time I am reaching out to everone for their opinon, so I appreciate all of your comments.

I am currently waiting for my NOA 2. I did the RFE trick on 12/10 and received a touch on 12/11. I called back today to inquire about the touch and was told that my K1 is now being reviewed by an officer. The USCIS representative (who was very friendly) said that it will take up to 30 days before hearing an answer.

Does anyone know how long it typically takes for this review? I am hoping sooner than 30 days!!!

Thanks again!

I was told that two weeks ago. Still no touches.

So... i think its just lucky draw.

Ouch. What a time game. The sad thing is that there is not a whole lot that anyone can do unless it exceeds their "estimated processing times"! What I (and many others) wouldn't pay to expedite the K1! Just imagine the gold mine USCIS would have if the offered expedited K1's!!!

I get the impression they dont' much care if it exceeds them or not. I've exceed their six month estimate and when I called I was simply told to try again in two weeks, and check the website, don't call again, kthxbai.

I'm sure someone has mentioned it before, but did you try calling your congress representative? Or, are they saying 6 additional months from asking for the police report? Why did they ask for the police report? Was it a result of IMBRA? Sorry for the questions, I am just trying to learn more about what to expect... Thanks.

THe police report is part of packet three and takes 40 days to get back, so we filed for it early.
I asked my congressman to look into it and they sent me an email that said an officer had it, sit tight, call back in January if you still don't have it.

I think this is jsut because of the huge july influx- I think a lot of papers got shuffled and moved around and some June files are just lagging.

Hi All,

After submitting to the Vermont Center in June 15th, we just got our NOA2 on Dec 4th. Almost 6 months. Now we're expecting the NVC to process quickly and then send the info to the US Embassy in Japan. Crazy, my fiance and I can't believe the process is actually moving.
We have two questions:
1) What is the average wait time from now (receiving the NOA2) to getting an interview appointment? Specifically, we're interested in what people have experience in Tokyo.
2) We've spotted errors in our applications, which we don't know for sure if they were corrected. Should we contact the NVC for this inquiry, or just bring our evidence and explanations to the interview at the US Embassy?
The errors were missing "Other Name" which is her birth certificate name from another country than where she currently lives. Also, there is a wrong "City of Birth" as Hong Kong is a country, city, and we think province as well.

Thanks!

I didn't add a lot of super smushy emails. I put in newsy emails mostly, emails that said we were excited about an upcoming visit, emails I'd sent when I was stuck at work and he was at home during a visit... They spoke to being comfortably together, even if they weren't saccharine sweet. I think you'll be okay. They can't expect everybody to be proclaiming their undying love in roses and sweet promises all the time!!

We had a one of those really cheesy pictures taken together at Niagara Falls where theysort of paste your picture in together? But, I figured it proved we were there together, they wouldn't produce anything like that anywhere else. And I had pictures of us together in Central Park when they had the bright orange Gates out. I figured that would be a time reference as well 'in the last two years.'

And all the usual stuff, intineraries, as many boarding passes as I could find (I lose them ALL THE TIME though)

It felt weird to do this, but when I printed out the emails that Pete had sent me, they all had comics at the bottom that I couldn't get out, because he sends me daily and weekly comic strips every weekday. biggrin.gif So, some lazy adjudicator is going to have funnies to read with our emails. wacko.gif

K-1 Fiance(e) Visa Process & ProceduresDiscussion with Congressman's Office regarding USCIS K-1, Processing timelines
QUOTE (tafeagans @ Jan 18 2008, 04:03 PM) <{POST_SNAPBACK}>
Hello everyone,

Recently, I had a conversation with my Congressman's office regarding the length of time many people are having to wait for their K-1 Visa's for their Fiancess. Interestingly, I was told congress had received a number of complaints about the delays. My congressman in particular has called the USCIS and was told in person and in writing that the majority of cases were being adjudicated from receipt in the mail to completion within six months. I informed them that this must not be true and that they should really ask for a more accurate report and/or evidence to support this. My congressman's office was also told the bulk load resulting for the recent price changes is now nearly stablized and they are heading back to getting the requests completed within their normal time of about 4 months. I explained that this could not be true again and requested they inquire further. My congressman's office agreed to call on my behalf the USCIS Monday to assertain what is happening with my expedite request and reverify the work load. Perhaps our congress does not really know the length it is taking. I was told if for some reson your Fiancees name hits some reference with the FBI it could take years for them to resolve this. Not good news. Just what I was told. Wonder what your congressman would tell you?

My congressman's office was no help whatsoever when I hit six months. She said, wait another month, and if you still haven't heard, then come back. I came back when I got to seven months, and she said that on average these cases really do take about A YEAR, and that USCIS was desperately underfunded(thought $455/petition and how many million petitions plus tax dollars... come on i can do the math there! yes i know it was 170 before but still that's quite a bit times a million) and that I should be patient, and wait ANOTHER month, because if I pushed too hard now they might ignore me later.

I cant' tell you how ridiculous and unhelpful this office has been. To be put off, over and over, and get no response unless I call her office and ask to to please reply, even when I have already emailed her...

I just wish my congreess person's office would think hard enough to go.. 'huh that is weird.'

I'd guess there is a 80+% chance your total wait will be between 7½ to 9½ months. All you can do is wait it out. Don't panic. Things will come, in time.

I'd like to make sure of one thing. Everybody in that topic who said that the wait should be 8 or 9 months, did you mean the total wait between I-129F is sent and the K-1 visa is received or did you mean the wait between I-129F is sent and USCIS approves the petition (NOA2 sent)?

It shouldn't be 8 months, but it CAN be eight months from NOA1 to NOA2.

I don't think I've seen people wait more than a year, and even then that's usually some issue with a background check, or paperwork going missing in the mail. I think you can reasonably expect to wait seven or eight months at the most.

Hey everyone,

I was just looking at my timeline and it now says the estimated time is till June 12th. However about one month ago it said May 28th, what may have created the change and how close of an estimate is this?

It's just averageing together the data its currently been given so for example if Molly & Bob took 8 months and had just entered their NOA2 data in suddenly your date will be longer. If three weeks later Matt & Jennifer enter their data and they got an NOA2 in four months, the date will be moved forward anywhere between a few days, and a week or two depending on the size of the sample. It's simple averages.

Mine says my adjudication date is October 28, 2007. I'm still waiting. Don't count on your projected timeline to be accurate. Everybody is different. The best advice I can give you is to find something to keep you busy.

Hello everyone!

I have been reading threads/posts from people here regarding K1 Visa and found out that most of the applicants who applied in July 2007 and some are later than that and already have an interview date at the embassy or atleast some of them got their papers at the NVC already?! My fiance' hired a lawyer to work on our papers since he is a real busy man. Our petition got at the USCIS on July 19th, 2007 and received a receipt on July 26th and case is still pending in 7 months. Although Im aware of USCIS advisory on processing times but I think 7 months to be pending is just too much :-((((. Am I alone waiting this long? Is anybody out there has been waiting this long too?

Thank you for anyone who shares their timelines!!!

I got my NOA1 dated 6/9/07 and I'm still waiting on VSC. I've tried my congressperson- who insists that it takes a year to get an NOA2, I asked my senator for help but she insists that it takes 6-8 weeks to get an answer from USCIS even though my congressperson gets a call back in under two days, filing an inquiry once I was outside of processing dates, and nothing seems to have helped speed anything along. At all.

You can try these things, some people do get real results. Some people don't.

Best of luck.

This morning I overslept, and one of the first things I thought was...

USCIS just doesn't understand my need for a reliable alarm person to shove me out of bed.

Maybe tomorrow. Or whenever.

I know this is hard for everyone that has had to wait soo much. RIC I cant believe yours has gone so late as well as Loras, and some others....My thoughts are with u

Thanks. It's okay. I'm .. i'm not going to say I'm content to wait, but I'm okay with it. (which totally doesn't mean that I'm not checking my status every few hours!) I'm pretty sure the only way the system is going to help me is if I just wait for it to get to me. My congressman was no help whatsoever and promised no additional help until January. I could ask Hilary to sic a minion on them, but I'm fairly sure that'd get me the same result. 'It's with an officer. you'll hear in a few weeks at least'

So I will wait. Just like waiting from visit to visit. One day at a time on the bad days, one week a time when things are going well. And Pete's gathered his documents that prove he's going to go home, and he'll be here in two weeks. We will get approved, one day or another.

If it goes a week or two out of six months then I'll reconsider my stance on waiting, but .. Byron was approved at like 181 days. Maybe I will be too.

I really thought it was bizarre that that's what I thought when I thought it though. Not, oh ####### what happened to my alarm, or oh no! where's the phone to call in and let them know I'd be there as soon as I could-- no. USCIS doesn't know I need my alarm Pete. My brain boggles sometimes. blink.gif

I'm glad you FINALLY got yours- especially since you have so much time on the other side of the approval. (and hey at least we don't have the NVC wait times like CSC. Small favors right?!)

So, yeah, we do that and by the time we get an answer our petition is no good because we have surpassed the 90 days. Thinking I should cancel and just go through the K3...at least we would be married.

Hi Jamie. I am not sure I understand - what is the 90 day period you are referring to? What is its significance?

I am seriously considering cancelling as well. Might be time for me to move to England.

Thanks.

Hang in there...you are almost there....has to be anytime now...they are getting to close to the 180 day mark for you...call your congressman for an update if you haven't already...

I wrote my congressman and one of his minions underlings assistants said it was with an officer. That was last Thursday, I believe. They also said don't call back until after the new year. I might ask my senator if I make it to 180 days. We'll see. I'm annoyed and frustrated, but Pete's very calm, and it helps.

BUT........WE CAN DO THIS. In the GRAND scheme of things...5 years from now..will this wait matter? Will it make an impact on our lives? Its hard for now..but stay focused on the future...the GOAL....keep THAT in our sights....

What are some future goals you have with your SO's??? Lets share some FUTURE things...

We can make it, guys. smile.gif And, it won't matter in five years. We'll just be extremely grateful for what we have. I feel like a lot of people take their relationships for granted, but we had to work and strive for ours, and maybe we'll be less hesitant to forget what is good and wonderful when things get hard.

FUTURE!
I'd like to have enough money to go back to school part time, when I can. I love to cook, and when I'm at my most crazy and stressed I love to bake. There's something calming about the process. There's been a surplus of cookies and bread in my house the last two weeks! I hope to have my own bakery someday and sell bread and fairy cakes. (Pete thinks this is great because I make him junk food and milk-free ice cream.)

Pete and I just want to have time together, without having to worry about the end of the week when we have to say goodbye. Have kids in a few years. Haul them back to ballet and karate and soccer practice.

He's totally worth this stress, and the wait, without a doubt.

Any takers on proofing the following letter to my representative? I have a small mean streak and I'm afraid that certain sections may come of a little less respectful than I'd like.

Ms. Eagan-

Thank you for your swift response to my query. I'm replying once again in hopes that Mr. Hinchey will hear the voices of the many applicants waiting to bring their loved ones to the US that are fighting with the issues currently plaguing the USCIS. I thank you for your work on my behalf.

When I called on Monday they had said that the crate containing my petition was in the hands of an adjudicator as well- not yesterday as they told you. Their standard stock answers for all and sundry are not acceptable. This is a service that we as American citizens pay for. Like all monetary transactions the customer pays for goods and/or services rendered. We petitioners pay this fee to USCIS in return for their time, effort, the cost of background checks, and labor costs, within a timeframe of six months. I am not the only person who is within days of this six month deadline.
ETC.

Thanks.

crying.gif crying.gif crying.gif Simply beautiful...you captured everything. One suggestion..not sure what you think of it..but in mentioning that you belong to a group...I'd mention the SIZE of this group as over 30,000 strong. (although not all are k applicaants...our membership base is not small...and CAN influence much if all pulled together)...just a thought??? THis is an amazing letter..may I plagerize it?? For my officials to??

I revised based on your suggestion:

It has become apparent to many that the Vermont Service Center has been grossly mismanaged. I belong to a forum of petitioners that meet online to help each other throughout the immigration process. These petitioners represent those filing for all forms of family visa, and is currently about 30,000 members strong. We understand that we are only a very small sampling of a much larger set of petitions, however we are fairly representative of filers across the United States and beneficiaries around the globe.

And you and anyone on VJ are welcome to adjust this to fit their situation and representatives.

It has become apparent to many that the Vermont Service Center has been grossly mismanaged. I belong to a forum of K1 petitioners that meet online to help each other throughout the immigration process.. We understand that we are only a very small sampling of a much larger set of petitions, however we are fairly representative of filers across the United States and beneficiaries around the globe. Fellow filers struggle with lost RFE's, RFEs asking for documentation originally mailed with the petition, customer service representatives refusing to help, repeated requests to wait 30, 60, 90 days before asking for additional help. One filer was recently told her file was found amongst a pile of misplaced applications. About a third of our July filers have already recieved their approvals, while filers from April, May, and early June wait with growing apprehension that they have simply been forgotten. These delays represent plans and weddings postponed, loved ones seperated for months at a time because entry during the K1 process is so strongly discouraged.

I understand that there is very little, if anything that can be done in my case at present however, I hope that Representative Hinchey will hear the larger message that I hope I have conveyed in this letter, and will join those seeking to reform and better the immigration process. USCIS may have hundreds of thousands of petitions, but to the petitioners these are our hopes and dreams for our futures.

Once again thank you for your assistance, and your time.

Respectfully,

ETC.

Thanks.

This is pretty common. 'First come, first serve' seems to be a term they like to toss around, but it really doesn't mean anything.

Im sure it is...but we still would like to have a thread to gather to vent, find support...if you are looking to offer support you are more than welcome...I see you are completed pretty much...Congratulations...but I really intended this to be for those June filers still waiting that want and need support.

Here I am!!!! I looked at my NOA1 again last night. I needed to bring it into work today so I can fax it to my senator. My recieved date is actually 6/18, not 6/20 (not that it really matters anymore). I am going to update my timeline. I bet our cases are together!!

I asked my congressman to look into my case, and got a positive but unhopeful reply. It is currently with an adjudicator. It may take a week or a month to be processed. VSC states it is within current working goals. Don't write back until the New Year.

I really don't want to go to Christmas and have to tell my nosy family I STILL don't know. *sigh*

HI, but 6 months would end on the 9th of December for you, why should you wait until the New Year? Thanks

I got the impression that the person that called parroted to me what VSC Customer Service told her. I knew that it was with an adjudicator, but the person I spoke to at VSC Customer Service several days ago said the same thing. It didn't go to someone yesterday, if they had it on Monday. I might try and email the ombudsman if I don't see anything by the 10th.
