K-1 Fiance(e) Visa Process & Procedures2nd interview

I just read your timeline, you were very lucky God be the Glory!!!!!

Thank you!

Well most importantly go over questions about  your marriage, when and where you guys meet, date of marriage, family member name, kids birthday etc.... Common question about your relationship, above all that speak with the truth, if neither of you know something be honest and tell them you don't remember but don't guess. Take your pictures, albums, phone records, anything showing your relationship is on going..

I wish you the best of luck!

K-1 Fiance(e) Visa Process & ProceduresDominican Beneficiary

Has anyone noticed that the cases for Dominican Republic are being processed at a virtually NADA pace?? Is there something against this country?? I heard that it has a lot of fraud...but ranting33va.gif . This isn't fair!! My NOA1 was 10/22 and I think that Vermont is half way done with NOVEMBER?!?!?!? ####### is going on????? Can anyone shed some light on this Dominican situation?!

It's nothing personal on the country itself, The service center work at different speed, at one point VSC was the fastest, Then it was CSC. As far as the fraud goes in DR It's like that around world wide where they are issing a visa, thier are some country with a high fraud alert then other, but as long as you can show your proof of you bonafide relationship there shouldn't be much of an issue unless they see otherwise.

K-1 Fiance(e) Visa Process & Proceduresrefusal notice for my fiance

My fiance received a refusal notice under section 221 g. They are requesting my presence at the US Embassy in the Dominican Republic. Is this normal? I thought i was not required to attend! What are the chances of him receiving the visa after my attendance? Anyone know about this?

Your chances of getting a visa, are based on different types of options, one of them being you (the petitoner) your appearance the day of the interview. DR is one of the many embassy who required the petitioner to be present at the interview. Unless there is some kind of family emergency or other hardship where you can NOT attend and send your fiance with proof showing the reason (s) your couldn't appear, otherwise you MUST attend.

K-1 Fiance(e) Visa Process & Proceduresshould this be included

Me and my fiance have a set of twins together. Sjould I submit copies of thier birth cert in the I129 f application

Hey!

No don't include the childrens BC, just for the fact that the petition specifically wants copies of the PETITIONER ONLY! Now once your case has been approved and you have your interview date It would be recommandated to take the birth certificate with you to your cita as proof.

K-1 Fiance(e) Visa Process & ProceduresDidn't sign intent to marry statement

Hey everyone! So I'm nervous because I submitted the I129-f on October 24, 2013 I sent all proof and documents including satements of Intent to Marry. My fiance' sent me an original statement signed however I sent my intent to marry statement and I know I typed in my signature but I don't remember signing it. Does anyone know if I should expect an RFE? According to the processing time at VSC my application should be processed in the next few days but I am so worried about this statement. I would not want to delay the process I am so desperate to have him here already. I know ALL of you understand PLEASE HELP!!

Maybe you wont get a RFE, since you name is actually typing, As long as your are acknowledging that you are FREE and willing to marry within the 90 day then you are fine.

K-1 Fiance(e) Visa Process & ProceduresYes, you can visit!

Even when an inmigration lawyer told me not to travel, I have entered the country 3 times since we started the process. No further questions and I would say that even less question than the ussual were asked

Did you just tell them you were coming in on holiday or did they not even ask that?!
NYCGirl18Female02012-06-28 16:02:00
K-1 Fiance(e) Visa Process & ProceduresYes, you can visit!

I flew into JFK on May 6 of this month and it really made me question whether they see pending visa petitions. We had filed in January and were waiting for our NOA2 when I came to visit (we actually got approved while I was there) and the CO did not ask me anything. And if I say anything, I mean that. Only a "hi", then took and scanned my passport, stamped my Customs Declarations, took fingerprints of the 4 fingers of my right hand (no right thumb, no fingers of my left hand, no picture) and then shoved the passport back at me and said "bye, bye". Seriously, that's the only things he said and I was, of course, in shock...pleasantly, but I had expected him to ask something at least. So I dunno if he was just in a good mood or if they really can't see pending visa petitions...

The same thing happened to my boyfriend (who is from the UK and has been coming in and out of the country quite a bit this past year) the last time he flew into JFK!! They didn't ask him anything, they just stamped his passport and let him through!! Crazy. We were expecting him to get out his paperwork and everything, but nothing!

K-1 Fiance(e) Visa Process & ProceduresK1 Visa/Medical expiry date confusion

(Beneficiary here)

Medical exam was attended 2nd Aug. We found out expiry date from a computer printout that the CO (in Singapore) handed to me to verify details (he actually only said, please check your name/passport number/etc to make sure they are not input wrongly)

That means that my medical is only valid 4 months, and yes, we found that out at the embassy during the interview. This gives me roughly 2 months to pack up and leave the country.

Thanks for the reply!  really appreciate it.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa/Medical expiry date confusion

Welcome. There's no expiration on any of the medical paperwork that I can see, perhaps it is on documents sent directly to the embassy. See Jay-Kay's response in this same thread, I believe she answered the question on the variance.

Hi Dwinge,

Thanks for your reply post.  I checked your Interview experience post and I have a question regarding visa validity.  Maybe I'm confused.  In your responding post (above) you said you didn't see any expiration dates on medical paper.

However, In your previous post (http://www.visajourn...php?entry=12779) regarding interview/POE experience, you posted "I clarified the 2nd Nov expiry with him, he said I could get another medical to extend that deadline. @_@ Omg!! ".

So, did that mean:  you found out your expiration date of medical examination at Detroit?

Based on your previous post, seemed like you already knew your expiration date at Embassy.

I think i'm missing something here.

Don't take us the wrong way.  We just want to find out how many months does medical examination has.  I read through Jay-Kay's responds and normally it has 6 months, but based on your posts you have only 3 months.

Thanks!!!

K-1 Fiance(e) Visa Process & ProceduresK1 Visa/Medical expiry date confusion

Hi dwinge,
First of all, Congratulation for your approval and thanks for the interview experience in "Feedback and rating" section. I also confused for medical examination validity.
Even though medical examination could expire in 6 month, it seem like 3-4 months for other k1 applicant's experience at POE.
I don't know how they stated the date in the sealed envelope after approval. When did you take your medical examination and is there any expire date in medical result? Thanks.

I'm trying to figure out the length of time before the medical examination/ K1 Visa expires. I have found seemingly contradictory statements on the DOS website, I can not find any information regarding a 'length of time' for the medical exam and there is nothing to indicate expiration on the medical exam paperwork. On the DOS website is this:

"An immigrant visa is usually valid for up to six months from the date of issuance unless your medical examination validity expires sooner, which may make your visa valid for less than six months. You must arrive and apply for admission in the United States before the visa Expiration Date."

http://travel.state..../info_3743.html

However, on another page an apparent contradiction:

"With your visa, you can apply for a single admission at a U.S. port of entry within the validity of the visa, which will be a maximum of 6 months from the date of issuance."

http://travel.state....types_2994.html

Does anyone have knowledge of where to find the facts?

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

Hi all,

Another RFE filer here. We received our RFE hard copy today. It says:

"This office is unable to complete the processing of your petition without further information.  Please provide an original statement from the beneficiary establishing her INTENT TO MARRY you within 90 days of her admission to the United States.  You may also submit copies of any evidence she wishes to submit to establish her mutual intent to marry."

Do we need to submit additional document for any evidence along with "INTEND TO MARRY" letter? Any of you received same as our case??  All advice are greatly appreciated. Thanks.

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

Hi delreb1,

My RFE is same as yours. I'm DEC filer from Vermont (was transferred our case to Texas in May 2013) and just received the RFE (hard copy).  It says:

"This office is unable to complete the processing of your petition without further information.  Please provide an original statement from the beneficiary establishing her INTENT TO MARRY you within 90 days of her admission to the United States.  You may also submit copies of any evidence she wishes to submit to establish her mutual intent to marry."

I am beneficial here and my finance is USC. When he sent NOA1 , he signed only from his side in "Intent to marry letter" and sent. There was no signature from me . That might be what the RFE is asking for.

What I would like to know is whether you sent additional document along with requested doc ("Intent to marry letter") ? Thanks in advance for your help. All the best in the rest of your journey ! smile.png

My RFE was because I did not send in a letter of intent from my fiance, only one from me. I had hired one of these "I will help you and guide you every step of the way to your visa approval guys. Before I sent in the application, he had me email it to him to check for errors. I did and he wrote back that everything looked good. Then I got the RFE for no intent to mary letter and when I wrote him and asked him why he did not pick up on this, he said he never heard of the beneficiary being required to submit a letter of intent. That caused us a delay that should never have happened. He is the one that was the self professed expert. This guy took my money and when I would email him with a question, he would either ignore it, or answer me with a "smart ####" answer. Talked very nice to me until I paid him. If I had known what I know now I would never have hired anyone, especially this guy. I know that I could have done it without him. The guy I hired was ezvisa.com.

K-1 Fiance(e) Visa Process & ProceduresWhy are the people here so RUDE??? :(

I do embrace MY differences. This has nothing to do with what I stated though. Human beings can be rude or helpful. Rudeness is not exclusive to Americans and certainly doesn't make us stand out as "special".

Not at all, actually I wasn't JUST talking about rudeness, now that I think about it, I wouldn't say we were more or less rude than anyone else (excluding things like road rage - we own that one - oh and that whole "foreign policy thing", but come on, we ARE different. Come on, I know you want to agree. I know you do, just a little.

What probably happened is someone clicked the 'report' button to the side and bottom of your post/topic. It usually only takes one click to get the mods' attention. Feel free to click it for any post you feel is inappropriate, and they will review it.

Umm...no..how about sticking with "yes there are members on this board that are flat out harsh and negative." Has nothing to do with being American. Thanks for not generalizing us. :)

Oh cmon, I grew up in Kansas from a mixed couple (just like barak!). I am as American as anyone could possibly be, but even I know that Americans are different. I learned that the second I took my first international trip. after the 5th or 6th, I was absolutely convinced. We are definitely "special". and thats cool. Im still USA till I die, even if I move to France. My fiance always teases me about my "American sense of humor". Embrace our differences. Just like you have embraced your fiancee's.

K-1 Fiance(e) Visa Process & ProceduresDS-156 - Signature date format
So my gifted attorney signed the DS-156 form at line 40 and used the wrong date format. The form specifically indicates that the format should be dd-mmm-yyyy. He used d/mm/yyyy.

I am probably nitpicking, but just to be sure, I ask - Is this a problem?

I know that we insist on doing just about everything in the US differently than the rest of the world (d/m/y as opposed to m/d/y) but I really want to be careful to avoid ANY mistakes or problems that could mess this up.

Like a couple of crazy people, we have scheduled the wedding 3 weeks after our interview date. (When we were making the arrangements, we thought we would have plenty of time to spare, but unfortunately that turned out not to be the case)

I would have moved the date but it's a big affair. And now I am rambling.........

So - dates: Does it really matter?

K-1 Fiance(e) Visa Process & ProceduresK1 Proof of ongoing relationship
Hi VJers,
Not sure if this has been asked before, so apologies if already answered somewhere else.

I'm waiting on VSC for NOA2 (188 days and counting), but I want to be as ready as possible for the next phase of the process. My fiancee and I have had a relationship for the past 2 years, I travel to Colombia every 4-5 months (so 3 times at year) and I have all the passport stamps and travel itineraries (don't have the actual tickets nor hotel receipts since we stayed in our own apartment).

I can't prove ongoing (daily) communications since I installed a US-based phone at her home in Colombia (something like Magic Jack), so all the communications will show a US phone number. Will that and not having the actual ticket stubs be a problem?

Thanks for all the help.

I know she will need DS-156, DS-156K and DS230 in duplicate for all of these, but what about her son? He's 5 years old and is coming with us...what forms do I need to fill out for him?

K-1 Fiance(e) Visa Process & ProceduresQuestion on DS-230 for K2
I'm filling all the forms for my fiancee (K1)and my soon to be step-son (K2).

On the biographical data questions 19-23 asks for the father's name and info. Her mother and I obviously know the name of the sperm donor  , but his name doesn't appear anywhere and the birth certificate doesn't have a father listed. My fiancee's son calls me dad since I'm the only one he's known since I met her mother when he was 2 and is now 5.

My question:
Do I just leave that section blank? Do I enter N/A?, Do I enter "NONE RECORDED IN BIRTH CERTIFICATE"? or Do I enter his name?

Thanks kindly....BTW THANKS for all the help!!!

Thank you all.....I think I'm just a bit frustrated with the process. Why do we have to engineer such a convoluted way of doing things in the first place!!!!

And to top it off; I emailed ivbogota this morning with my BGT# and wrote that NVC had already sent the visa to them last week.

K-1 Fiance(e) Visa Process & ProceduresProof of Termination of Previous Marriage
My VJ Peeps,

I'm packing my bags to head down to Bogota for my fiancee interview next Monday (YAYYY!!!) and while putting together all the documentation (killing a few trees in the process) I noticed the embassy asks for "certified photocopies of final divorce decrees". What does that mean?

I have my original divorce decree signed by a judge and stamped by the courts. I have a photocopy of that. Is that enough? Or do I need to get that copy notarized?

Thank you all!

K-1 Fiance(e) Visa Process & ProceduresAge gap - Education level difference K1
Age and education made no difference in my case. My future wife (28 days before our wedding!!!) is 12 years younger and never finished HS. She has been in the US now since November and will start her English classes tomorrow and will GED during the summer. Neither CIS, Embassy in Colombia nor CBP Officer at the airport didn't question any of it.

Hi all,

Me and my fiance are patiently waiting for our NOA2 hoping all will go well. However I am a huge worrier and keep reading up on stuff that could potentially go wrong so I don't pass out at the interview if something does (I am joking but you get the idea).
So...our situation is as follows - he is 8 years younger than me (people can't tell though so I am hoping our pictures will be helpful) so gap 1 and also he never finished high school while I got my Masters degree. Is this really a huge deal ? I mean we love each other, I never cared about his educational level - he is the smartest person I have ever met but having read stuff on here ...it seems that this could potentially be a problem ? I am going crazy - it is not like there is much we can do about age gap or educational gap - not like he can quickly get a university degree just to satisfy the requirements. Would us providing affidavits from his parents and my parents to the effect that they approve of our relationship and know about it would make any difference ?

I know we did not even get our NOA2 and I was fine until I started reading about potential issues ....again. So now I am worried ...again !

thanks for any input

K-1 Fiance(e) Visa Process & ProceduresTHESE TWO THINGS ARE IMPORTANT FOR ANYBODY CONSIDERING K1 VISA!! MUST READ
First, the K1 is for a fiance(e) visa, so there's no spouse yet. Second, why get married as soon as fiance(e) arrives? The K1 visa gives the couple 90 days to get married, so this notion that you have to marry as soon as the fiance(e) enters the US is nonsense. Also, if you want to have some type of ceremony and have it done the right way, you'll need that 90 days.

One last thing, if you are going to post using all caps (shouting) and using demeaning language at least try to use proper spelling and grammar. Why is THAT so hard for some people to understand!

GET MARRIED AS SOON AS SPOUSE ARRIVES IN USA!!!! I DO NOT UNDERSTAND WHY THIS IS SO HARD FOR PEOPLE TO COMPREHEND!

K-1 Fiance(e) Visa Process & ProceduresClueless...K1 or? Help pls...
welcome to VJ.

This site is very helpful, where most if not all of your question could be answered. Before starting the process you should familiarize yourself with the forums if you are looking into the K-1 visa, If you go to the tab forums there you will find the step and guides to help you with the process.

As for your questions

If YOU the petitioner do not work you should find a co-sponsor who does work.

As far as employment goes as long as you are in the poverty incomes guide line and have financial resources and your tax return transcripts.

Requirements pictures, cell phone bills, boarding passes, hotel stay, stamped passport entry, chat logs, emails, anything showing proof of your relationship and as you mentioned above you moved over there which shows you spend X amount of time living out there with him...

Again if you familiarize yourself, with the site you can check out other profiles, of people who have done the K-visa in the Dominican Rep. and how there interview where held and question that where asked to the couples.

Here are some links to help you better understand the process.

Good Luck on your Journey

K-1 Fiance(e) Visa Process & ProceduresHelp with filling out K1 visa forms Please

Hi Everyone,

My fiancée and I are in the process of putting the final touches on our K1 visa application. We feel that we have covered all the bases. However, we just wanted to get some clarification on a few application questions if possible.

1) Does the birth certificate need to be an original or a notarized copy or can it just be a photocopy?
Copy of BC is fine DO NOT send any originals to the USCIS.

2) In Q10 in the I-129F petition the US citizen was acquired through birth in the US. Do we really leave the rest of Q10 blank after checking the birth in the US box?
check off what applies to the USC leave the rest blank!
3) We do not have an Alien registration number. Do we need this and if so how would we obtain one?

you can put N/A because you don't have an alien registration number.

We know these questions are probably really basic but we just wanted to cover all bases before we submit our application. We would hate for the process to take longer just because we filled out a question incorrectly.

Thank you so much for your time.

DavidI

Well first congratulations to you, my suggestion would be to find out with the airline to see how much they will charge to change you flight to a later date, give it a few Weeks until you your case number and iin number, case spending money back to back is no joke, and I'm not sure if you're taking time off from work.
