IR-1 / CR-1 Spouse Visa Process & ProceduresPOlice REport - does it have to be translated

My husband is from DR we got the police report in spanish , do i need to translate that to send it with the DS 230 ?? anyone help !!

I DID NOT translate mines and it was accepted... Remember it clearly states "All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations and submitted to the NVC"

In other words since your police report is coming directly from DR and your are applying for the visa from that country you do NOT need to translated.

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE at NVC

Dear All,

I just spoke to NVC they are saying my co sponsor that is my uncle has to send for again I864 and he needs to sign and date it, he will have to do the form all over again but i just spoke to my uncle and he made sure that he signed and dated the form, what do u recommend should it be better to send the form again or should i speak to the supervisor at the NVC which one will be the quicker option please advice.

Did you make a copy of your pkt that you sent to them? If so double check that it was actually indeed sign and date see if they can accept that same copy of the original that was already provided. speaking to a supervisor will put you at other "20day" to take a look at the file, If it not hard to get a hold of your uncle just have him fill it out again print out the bar code cover sheet and mail it out again, don't delay waiting on a supervisor to review your file.

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Question

What I think and know, is that you have to tell the truth, no matter what. Lying or omitting facts when asked is material misrepresentation and can result in a denial and ban. Why would you want to risk that?

As mimolicious states the truth is the only way out of this on, regardless of the fact you guy will get questioned over the fact why he spend such a long time with out traveling, My suggestion speak with the TRUST, do NOT leave anything out. And be prepared to go full back with evidence as I hear Niagara is a hard consulate.

Your relationship maybe question yes... but again you have to proof to them of the ongoing of your relationship and when asked why so long he need to come clear. Don't risk it for lie... or "analyzing" what to tell them. Think about it... Good luck on your decision.

Just got my interview for march 1st. Does anyone have a list of the interview questions that are asked? I also would like to know if medical has to be picked up or is sent directly to the consulate?

Congratulations.... If you look at some of the CR1/IR1 member profiles you can read their reviews and the questions that have been asked.. As for the medical they will be sent directly to the consulate.

Good Luck!

IR-1 / CR-1 Spouse Visa Process & Proceduresoriginal/Certified

Hello, i have a question when they say that they need a document Original/Certified does this mean that it has to be "inextensa" as it's called in my country or is it something diffrent?

Also when my wife will go apply for her passport is it obligated for her to take her marriage certificate as well, so that way the passport says that she's married, or does this not make a diffrence...

When you get a birth certificate or marriage certified you will asked them to give you an "inextensa y legalizada"(certified).

As far as the passport goes, your wife is NOT obligated to take YOUR last name that is optional and a personal preference.. Now if YOU are the USC and have started the process and have filled out the form using your last name then it will be advisable to just continue using the married name as some confusions may come about with the document having different last names.

IR-1 / CR-1 Spouse Visa Process & ProceduresJust got medical done and getting ready to fly to DR for interview...

Yes I have the ripoff fee.. I mean Banco Popular fee in mind. Try and have him go asap. Reason is my wife went this morning and she was told that if she had waited and gone Monday or Tuesday she would have had to return to pick up the results instead of having them sent to the consulate directly.. To me this is important since its a pain in the butt going from Stgo to Sto Dgo just to pick up results.

I already have the pics and everything you said except the cedula with her married name since believe it or not the Junta Central has been out of plastics.. Can you believe that sh!t. I will be staying at the Jardines del Teatro so I will let you know how that goes although I will probably not sleep at all.

Thanks for throwing that in I was so confused about when should my husband had to go his medicals but lateky I have read that it has been taken a couple of days so the consulado to get the medicals so i will def. Have him go now whixh is approx. 3wks in advance.

@Mfranc68 you will take the 3 2x2, passport, cedula, and inteeview ltr they day of the medicals.

Hi everyone!! So unfortunately I could not make a payment online for my AOS fee bill but I do have the cover page. I was just wondering what was the fee bill that I have to send in with the payment. IR-1 / CR-1 Spouse Visa Process & ProceduresCivil documents to NVC already sent..then what do I bring to the interview at consulate?

Hi Everyone,

So what happens after one sends the civil documents to the NVC?

For example if I have already sent everything (all originals, translations etc. EVERYTHING an this is for my husband) to NVC is that what they sent to the consulate?

I'm confused because when I look at people's lists on here on what to bring to the consulate they all list all the civil documents again...so if the consulate already has them why would I bring them again?

Is it just in case the consulate lost them??

Anyone?

Thank you

Once you have sent out all the civil and supporting documents to NVC, they will review all document, say all goes well and you do NOT get a "checklist" you will wait a about 20 day(or sooner) to get a "case completed".

What you have been seening with regards to people taking the civil documents again the day of  interview is because it's been seen in some cases where they have lost of misplace the civil doc. So it's better safe then sorry... ( Once you get your interview pkt4 it will tell you exactly what they need from you) I was lucky that all supporting docments I sent were received, all I took the day of the cita was an updated papel de buena conducta.

So goof luck and just be prepared you just never no what they may ask for....

IR-1 / CR-1 Spouse Visa Process & ProceduresSpousal Visa Journey began in January

Hello Everyone!

I have been using VJ for quite some time now and have been following "quietly".  I figured I better get on here and start posting!  LOL  This site has been wonderful and I expect it to help me keep my sanity through this whole process.  I married my husband in the Domincan Republic 12/13/12.  I just took my 8 year old son with me and we had a "courthouse ceremony" with us and a couple of his friends.  We plan to have a ceremony in the United States when he returns.

I look forward to getting to know some of you throughout this journey!

One question I can think of right off the bat is the email I received that they received my I-130 paperwork says it went to the National Benefit Center.... is this how I can check on an average wait time for certain centers before I should expect the NOA2 acceptance?  I thought it would go to a location, such as Vermont or Texas?

Have a great day!

Welcome and congrats!  The NBC is just another service centering, "helping" to process I-130'S they have been process applications farely quickly, So your pretty lucky to have had your get sent there, as suppose to the other centers that have been take over 6 months for processing.

Much luck on your journey and you indeed came to the right place., for help and guidances...

IR-1 / CR-1 Spouse Visa Process & ProceduresNewbie filling I-130 and doing the package.

Hi I have several questions.

I will fill the form I-130 and I'm confused. I do not know if I have to fill out one for my wife and her son. If I have to fill them separately, what documents should I have?
She did not marry the father of the baby, do I need to present evidence that there was no marriage?
How is the process of translating the documents?

Thanks in advance.

Felipe Quinones

You will have to submit two separate petitions, one for her and one for the child.

You do NOT need to submitted no evidence of no marriage, because you guys are already married... so that mean she was free and able to marry.

The process of the translation works as follow (you or someone else) must certify that s/he is competent to translate the foreign language into English, and that the translation is accurate to the best of his or her abilities. The certification should include the person?s name, address, signature and date of translation.

Good luck!

Make sure you ready the guides on how to prepare you package.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS 230 - documents needed and affidavit support

Hey, I hoping I can get some guidance. I have 3 mths since my I-130 has been accepted. I understand within the next month or so I'll be asked for the affidavit support. I have requested 3 years worth of transcripts for the IRS. Would these transcripts be enough to submit with the affidavit or will I need a employer letter or/and paystubs?

Secondly, I'm going to go see my husband within the next week smile.png. In regards to the DS 230 form what documents from my husband will I need from to bring back with me? Since hopefully my next trip will be for the interview (fingers crossed) I want to make sure I get all the needed documents from this trip from my husband to help this whole process run smoothly, thanks!

It is NOT mandatory to send out all 3 year worth, this is optional but you will need to send out the (2012). (I sent in all 3yrs) same thing goes with the employment verification letter and paystub, NOT mandatory but optional ( I sent in both in my package).

See below for what you will need from your husband.

  • Copy of biographical page of beneficiary?s passport
  • Police Report (Papel de buena conducta)
  • Birth Certificate (Inextenza y Legalizado; Certificated & Legalized)
  • Marriage Certificate (Inextenza y Legalizado)
  • Two-2x2 photos
  • Sign and completed DS230 PT 1
  • Unsigned DS230PT

You do NOT need to take the BC nor the MC cert again, if you already provide them with it at the NVC stage (but if you wish you can take it again), as well as the petition, you can take all documents perviously sumbitting but not a must.

Beside taking the Police cert. you will also need to take to them the recepit you get once you have paid the impuestos fees at any banco popular.

Any other document you should take should be, any and all document showing proof of relationship, pictures, phone records, borading pass etc...

Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresWill CO give (USC) you get more of a hassle having a child with spouse (beneficiary) at time of interview??

Hello everyone!
Well my husband and I have a beautiful 2 month old baby girl together and I have 2 other childeren(same dad) from a previous relationship that I ended 4 1/2 years ago (for the best) and my husband loves them dearly. So ok my question is will at time of Interview will the CO give us more of a hard time? I have been reading interview reviews but have not been able to find anything that could help. If anyone has a similar situation or any kind of help would be greatly appreciated. Thank you all so much in advance! smile.png

It shouldn't be a problem, Your kids are from a past relationship... But I do recommand that your husband know your other childrens, names, birthdays, ages, etc... At time they will ask the husband or vese versa this questions, and how is there relationship with the child.

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp before filing I-130

Good evening to all!

helpsmilie.gif

I am a 22 year old Dominican US Citizen who recently married my girlfriend of 3 years on December of 2012 in the Dominican Republic. She is also 22 years of age. I love my wife and I am trying to bring her over to the USA to start a life together. I have the following questions:

1. Will our age cause any difficulty in the process? NO

2. What counts as Evidence of a bona fide Marriage? Things in common ie; bank acct., phone records showing income and out going calls, emails, chats, mainly how much you guys know about each other.

3. What is more or less the TOTAL amount in expenses throughout the process. 420+(petition)230(visa fee)+88(AOS-Affidavit of support) plus, the other expensive for the benificiary (Birth cert. passport, police report, medical, exams, You are looking roughly at about $2,000)

4. Will i need to go out there for the interview/What is the interview like? It is RECOMMAND and MANDATORY that the petitioner be present the day of

5. How long does the process take on average? Lately things have been moving pretty quietly, but normal it can be anywhere from 5-8months BUT again things have been moving very FAST so it can be less like it can be more.

6. How long do i have to be working for Affidavit of Support? You will have to show the last 3yrs of you having flied taxes, other wise you will have to show for the most recent and current year. The AOS will go by the household income. please Ref. to this link. http://www.uscis.gov...form/i-864p.pdf

7. What am I to look forward to or expect? You will be looking for either a speedy or slow process, a bit stressful if you don't educate yourself as far as how this process all works, It is best that you READ ALL the guides, instrctions, and ask as many question before starting the process, any little mistake can delay the process and hold you off  from moving along. READ READ READ, and ask questions. other then that gather all your documents, and it should be a smooth ride.

Sorry for the bombardment of questions and thanks in advance!

I have a question.  When submitting phone logs, is it possible to print just the page that has my husbands phone number on it.  Or do I have to submit the entire bill.  rose.gif I have sprint and each bill is between 13 and 19 pages.

What I did was highlight  the outgoing and incoming calls, with all the call history, you don't need to submit all 13-19 pages, 2 pages should be enough.

IR-1 / CR-1 Spouse Visa Process & ProceduresHusband has CR1 Visa...What does he need to start working?

Hello,

My husband just arrived to the states on Weds, Nov 27th.  He is ready to start working right away.  Will his visa be sufficient since he is here on a CR1 visa or does he have to wait to apply for jobs and work until he receives his SS Card/Greencard?  I'm a little confused on what comes next and I know he doesn't want to sit at home long.

Thank you in advance for your help!

Congratulation, He will need his SS# card, and he will need Green card as well. Since he doesn't have the green card yet, he can use the temporany I751 stamp on his passport, as proof.

hi all,

just thinking ahead of time.. i know i have to put in an i-864, but then i saw stuff about an i-134 which sounds similar? what is this? is this in place of an i-864 or is this another form which needs to be filled out later?

i am creating a new post as i cannot find any info on the difference between the two...

If I remember correctly I used the I-134 for the K-1 interview and the I-864 for AOS. So my answer would be it depends on what you are filing. They are both forms regarding evidence of support.

IR-1 / CR-1 Spouse Visa Process & ProceduresCarry-on Pets to USA
I too brought a pet overseas. Our kitten Mini was about three months old at the time and they barely checked her. I think they are more uptight about animals from countries with a high rate of rabies. I had her certificate of health and vaccination records but they did not even look at them at our POE. They were so busy admiring how cute she was they barely scanned my bags. Everyone has a different experience but I am glad I did it. It was 150.00 for her to fly as a carry-on with me but the Vet bills were reasonable. Good Luck...I hope Toby can come.

IR-1 / CR-1 Spouse Visa Process & ProceduresTranslating Immigration documents from Spanish to English
I hereby declare that I am competent to translate from [the foreign language] into English. I further certify that the attached English translation is a true, complete and accurate translation of the document attached in the [foreign language] language.

With all due respect to the other poster, when you add "to the best of my knowledge and belief" you are leaving something on the table. These people are always looking for a reason to throw a document back or reject it, and that kind of "hedge" language is a hook. If you're competent to translate, you should be able to say "true, complete and accurate" without the hedging...I used the language above, and it was fine. I somewhat agree with the other poster that in the case of any doubt, use a certified translation (although this can be expensive)....good luck!!!!

Check with the embassy to see what statement they require. Some embassies require a CERTIFIED TRANSLATION which is different than just writing the statement above. Also, there are "magic words" (words in the statement that are from the USCIS site and I don't have the ones I used on this computer) and tomorrow I'll post them.

It doesn't cost you anything to leave the K3 process moving along with CR-1. If you get to the point later where the CR-1 is close to approval, then you just abandon the K3 process - you don't have to do anything.

IR-1 / CR-1 Spouse Visa Process & ProceduresIs there anyone here FROM NY who has a spouse here via a CR-1 Visa?
Hi all,

I can see how someone reading this thread might be confused into wondering if a foreign marriage is accepted in New York State. So just to reiterate, a marriage that is valid in the foreign country in which is was performed is recognized as valid in New York State (with a few exceptions I believe, like if the person was underage...) I was married in Cuba and it has never been questioned here, in any circumstance.

There was an interesting case I read about recently in fact that highlights this. There was a lesbian couple from Rochester, NY who were legally married in Canada. ( I believe that both are US Citizens and residents.) They went to court in NY State when one's employer tried to deny the other spousal benefits. The court affirmed that a marriage that is legal in Canada must be recognized as legal in New York State. Congratulations to the happily married couple! Now I hope that will soon apply to gay and lesbian US citizens who want to marry and bring their spouses to the US, and experience the same hopes and joys as many of the rest of us on this forum. Onwards!
