So This what's up. When I found out the day of my interview, I went to my supervisor and ask him if I can have that day and day before off and I am schedule 3 days before and two days afterwards off. So all I need is those two days. The day of the interview and the day before. (I work 12 hour shift manufacturing, so you know long hours, less days). He said yes if I can get someone to come in to replace me. (because during the christmas and new year's holiday we can not request days off because the company shut down on the 24, 25,26 and 27.) So I was like cool. I booked my plane, reserved my hotel, reserved a rental and paid for my parking space at the airport. So I got ready to go to work today. I called my fiance to remind him I will see him in two weeks , just because I am excited. I get to work to come and find out the guy that is suppose to cover me those today got fired yesterday and my surpervisor said that I have to work. I asked around seeing if someone will cover me but nothing. So I can call out because he already know and plus it's my job that will be providing the income for my fiance and his kids and myself, I can not just not show up to the interview nor cancel. The worst of them all is that the interview is 10 days away. Can you schedule interviews and if yes, is my reason even a good reason for them to reschedule? How long do I have to wait this time if they do decide to rechudle. I waited so long now.


Hey, sorry that you are going througj this, but have you thought of keeping the date and just having your fiance go down on his own? I have heard in some cases that the petitioner has to be there but I have also heard/seen in some cases where the ben. Attend the interview on his/her own and takes all support documents, and explains to the IO the reason why petitioner was unable to attend the cita. In some case it has worked out well and in some cases they have resched. The interview so petitioner could be there. I would consider to speak with your fiance if he is comfortable of doing on his own. If not see if you can get it for a later date. I wish you nothing but the best and hope all works out well for you!

There isn't a specific time on when you should print them out, but it nice to start gathering up all your proof before hand and having everything organized for once your interview date comes along you won't have to be rushing. Cause if so far you have 70 pages now, it will be double from now to 3 month later. So just print out chat and put it in a folder.

If you just recieved your first notice of action, Congrats on that, You have a serveral months to go before receving the NOA2 (notice of action 2 which is the approved petition) so at the point all you can do is wait, read the guides and get familiarized with the forms and the next step.

Is that a good thing or bad. i checked online and it says "That on December 11th your was changed relating to your I129F, PETITION FOR FIANCE(E). So i called and they told me that my fiance has been assigned an AR number!!! Im so confused please help!!! Thanks in advance

Hi All,

I first wanted to introduce myself to everyone on here! My name is Eric and my fiance's name is Jessica! We just got engaged 2 weeks ago and decided to file for her K1 visa. So far we have all the paper work in order but I have one major question.

Evidence.- As evidence you can use, pictures of all the trips you have done to DR 10-12 PICTURES TO SEND IS GOOD

I work for an airline so I regularly fly to the Dominican Republic but I never saved any of my boarding passes. Will my passport copies be enough? There are a good 20 -25 stamps on there in the past 2 years all to the Dominican Republic to see her. - Copies of the passport stamps is fine, as it shows all trips given

Also we mainly talk via skype and whatsapp instant messaging... these conversations do not get recorded anywhere. Any recommendations on how to save our conversations? Should I screen record our skype and burn it to a DVD? Absolutely NO DVD, OR electronics are allow to send to USCIS nor take into the building the day of interview. NO SCAN DRIVES, DVDS NOR cameras

Any other advice that anyone who has done this can think of? In my personal options and from my research I have done, many are concern with the "evidence" of what to take people get overly whelmed most of the time they hardly don't look at any of it, Yes is good to be prepare but in my opinion I think what will determinant more the progress of your case will be how the couple handles the answering of the questions that are being asked. If it's a real relationship you should be able to answer basic questions of your partner. Other then that I think you are all set. The only advice I continue to give regarding this process is read, read, and prepare yourselves, be proactive, and review all documents twice even three time before mailing anything out.

We are hoping to have her here in August of 2013 for a wedding on the 17th!- Perfect! I've seen they have often asked if you have chosen a wedding date and where will it be done

No she will not need a passport in order for YOU to file the petition. But YES LATER on you will need it for the interview.

There is no required time of having been in a relationship with some, all they want is that you guys have met at least ONCE in the 2 years prior to filing the I-129F petition in you case your are fine, You already have since each other face to face a couple of times. You can file you petition and gather you documents, cell phone bills, text msg, picture, boarding pass, emails etc... Most importantly go over the question that are shown on the K1 member who have filed in DR and have gotten approved you will have a general idea of the type of questions asked. You will be fine don't over analyze it.

Thank you so much all for your respond, advices and encouragement.

It is great to get advices from people that have gone through the process.

The only reason why I seemed worried is because my very well intentioned friends are all giving me the wrong advices and it gets me worried but now I am just happy :D

I've been told so many crazy things. Examples:
-I need to be living by my own before sending the petition- NOT TRUE
-I need to have a perfect credit report- LOL... PEOPLE ARE HILARIOUS

-It takes 3 years That was back in like 2000 and something that it was taking 2/3 years for the whole immigration process to come out. We are in a new era... LOL... Now is a total of 5/7months tops from start to finish.

They even once told me that they are not even giving out the K-1 visa anymore lol so just imagine me!! LOL NOT TRUE


Read the guides here keep expanding you mind as to how the process works exactly don't rush until you have read every detail and you have a general idea of what you will get yourself into, again READ READ READ the guides everyday you will learn something new, and get familiar with the forms, as this is also what cause delays on the process when thing are not done correctly. Make sure you understand the forms, As for the questions goes if click on portals Dominican Rep. Hi my VJ Friends.

Little by little I am starting to integrate myself with the forum. I've founded so helpful with all the information I find here. The more I learn, the more questions comes up.

My boyfriend and I have been dating for 6 months. Mutual friends introduced us to each other through the phone. We immedialtly hit it off and decided to become exclusive to each other since we didn't want to play any games. I was able to travel to DR 3 months after dating, in September and now we are marking our 6 months relationship. We are very happy, very in love. We are sure of ourselves and we are pretty serious about this.

We already started talking about engagement and we would like to start the process of the K-1 Visa as soon as we get engaged. I am thiking of traveling maybe 2 more time before we do that but my concern is the following:

I see that a lot of the couples here have been in a relationship for about 2years and so. By the time that we plan to submit the petition we are barely are going to have a year and because of my job, I can't travel a lot.

Would I be having enough evidence, as to pictures, of our relationship?

We talk every single days. Through the phone, through text messages, emails..
Any suggestions... We really don't want to be apart from each other for that long. Sorry for the long story but trying to give as much as details of my situation.

Is it neccessary to have the 1040 tax or can i just use the w2s ? I was able to ask my sister to be a backup co-sponsor and she agree in case the embassy said since i just started my new job they want a co-sponsor than we can have her information ready. Is it ok for my sister to just give me the w2s or she would need the tax forms too. Thanks again. One thing more does she need to give me a copy of her proof of citizenship because she said she cant find it? she doesnt have a passport either, will a driver's license or social security card be ok?



You would need the tax Transcript . As far as showing proof of citizenship she would need a passport or residence card.

I've got:
*Cover Letter (listing all the items in the packet

*Money Order to the US Department of Homeland Security for $340
*I-129f
*G325A with passport pics for both me and her
*Letters of intent, one for her, one for me
*Copy of Birth Certificate
*Copy of All Pages of Passport
*Evidence of having met in past two years
I'm just a little worried about evidence of having met in the past two years, but here's what I have
*Primary Evidence: Copy of all pages of my passport showing entry and exit stamps for my most recent trip (Aug 2012-Nov 2012), Bank Statements showing ATM Withdrawals in Phnom Penh as well as Ta Khmao (the city where she lives), Attendance records and grade reports on a bible study class we took together (rather unimpressive looking, but it's the only thing that has both our names), and a Certification of the part-time job I held in Phnom Penh from Sept thru November.
*Secondary Evidence: Photos (10) of us at several occasions (including our flashy engagement pics and our engagement ceremory), several of them are dated.
I don't have ANYTHING else I can possibly think of, especially something that has both her name and my name. Most things were done with cash there, it's just kind of how it is there.
+Evidence of continuing relationship (December's long-distance phone bill from REBTEL)

Sorry that you are going through such a thing, I myself work with lawyer and I know how fishy things can be. So I totally understand where you are heading.... After all I as well consider having this process done with a lawyer but after months and months of research I came down to the conclusion a lawyer is a waste of money and time, after joining this site a my small know legal of the process and my background of paralegal work, I figure if you can read, write, and follow instruction you can do this process on your own. And that is what I did... This site has been very helpful to me as well as the member's

In my opinion if you already have your interview date, I would go to your lawyer and get a complete copy of your file and match up the info. that he filled in on the forms, and I would just finish the process myself. As you stated you have read over the site and instruction and what do next, If you have a copy of packet 4 I would go ahead and scan/fax a copy of it to your wife, with that she can go and get her medicals done at least 1 wk before the interview. You can fill out all the forms for her and once at the interview all she would need to do is sign off of them. .

As for a her getting approved that is just something basic on your relationship and the question that will be asked the date of the interview. Only you two have control over that not you lawyer, he only played the role of filling in you forms submitting them and collect your funds.

is it okay to have plans before the visa petition interview? Like buying ticket, because it is cheaper if we book ahead of time, right?

It has been seen in many case where people have actually went ahead and purchase a ticket months even week before there interview... Is it a smart thing to do? I don't think so.... But if you're a "Risk taker" who will do it anyways, If you have the funds to spend by all means, other wise it clearly states, " Please do not make any travel arrangement until you have your visas at hand. Once you have been interviewed and approved for an immigrant visa, collection of the immigrant visa will be within one week from the day it has been approved"

The one he has he had to pay 400 pesos to get but that was when he got his passport a few years back. Hello everyone, I am so excited. Our interview is in less than a week Jan. 23. My fiance just went and had his medical done, we have police cert., all forms printed and signed, pictures, passport, etc. I have one question about the birth certificate in the DR. Once you get the extracto de acta de nacimiento from the JCE does it expire? My fiance got his a few years ago and he is sure it expired. I know normally birth cert. don't expire but this is the DR. I guess I am just getting a little nervous now and quadruple checking everything. I don't want to have any delays that were on my part.


FYI don't get the extracto you actually need the "INEXTENZA" acta de nacimento, Although in some case it has been accepted as extracto, But from what I was told Inextenza is what normally used when it's referring to traveling process. Now the cert. doesn't not expired but it's good to have it current because when it's legalized and they stamp it on the back with the signature they also put a date on it I believe is the issued date, so they date your went to take it out. So normally within 6month is fine. Again is DR we talking about....

I wish you the best of luck your will do just fine, you seem to have everything under control just have an extra pair of eyes look over everything just in case you miss something. Other then that "SU VISA ASIDO APROVADA".... lol... Bring him home girl!!! :dance::thumbs:

First welcome to the site you came to the right place!

I'm not sure if you are aware but K1 is a fiance visa, therefore you can't plan to be married. Now if you are planning on getting married to your now boyfriend you need to look into CR1 (marriage visa), Their is no long the K3 (CR1/IR1) route. As for you filing another petition for someone else this will NOT be a problem but do expect to get questioned the day of the interview as if you had ever filed for someone in the past.

My only suggestions will be read, do your homework on this site, asks lots of questions. This is a very helpful site you will find most if not all of your answers to your question on here, make sure you have all the supporting documents you will need to file the paper works accordingly and promptly. One thing I don't understand , and something that maybe in the back of the CO's mind, you guys live together in the DR, you have a child together, your child even went to school in the DR, you intend to marry.......but you didn't. You file for a finance visa. Why didn't you get married in the DR and file a CR-1 or even a DCF? This might be considered a red flag..........


Technically this will NOT be consider a "RED FLAG" not everyone wants to get married in DR for different reason, secondly NOT everyone knows about DCF and the requirements that need to be meant for DCF, Lastly it is clear that what's on the CO's mind is not the fact that she doesn't have an income because that isn't the issue here, the question came about because of all her traveling, In my opinion there are people who have saving money, unemployment, credits or even family willing to help with some $$ so you can travel, It's clear that its the logic that if I gave birth I add the father to the BC and that is what blew off the CO to send them to fraud unit, So what's really going on in her head is if this is the father and that is his child why isn't his name on it? That right there can be a "red flag" but she explain why he wasn't and also provided the supporting documents to show he was added, BUT that it would take sometime! all states and laws are different.

Its clear that the CO problem isn't the income, But the fact that the childs father is not on the BC and has probably doubts and that why DNA was requested. As for them not even considering asking question of there relationship is not necessary as she had traveled plenty of times, is currently living out there with her kids, and has them in school, so what more proof then that to the CO that the relationship is ongoing?

Ok so we had our interview today. Everything was going well until they asked my fiance to sign the form and print my name. He made the mistake of saying out loud that he always gets confused with how to spell my last name. So the CO got kind of huffy and started to take the form back and was like how long have you been together and you don't know her last name. He was like no I know her last name and he said it I just get mixed up sometimes about the spelling because I never write her last name. So we get past that and are back on track. So she then starts to ask me questions, she asks me how many times I have been divorced and I tell her. She then ask do I have any other children as our daughter was with us. I tell her yes I also have two sons. So then she asks me about my job and I tell her that I am not working right now as I have been in the DR with my fiance. As she is looking at my passport she is like you travel back and forth alot, were do you work at. And I stated again I am not currently working and that is why I am able to do so but for the most part I have been staying in the DR and traveling to the US when possible. She then says I mean there is nothing wrong with that I mean I am just curious as to how you are paying for this, are you using credit cards or something. I said sometimes or my mom pays for it. So then she says ok, now I need to speak with him. So she then asks him some of the same questions she asked me. Then when she asked him how many children do I have he told her 3. So she then states she just told me she has 2, and he corrected her and was like you asked her how many other children she has and she said two sons and we have a daughter so that makes 3. She said ok and asked the names and ages. She then asked him were I worked and he told her that I use to work at the hospital and when she asked which one he was like I don't know the name. So I said to her I have not worked there since 2 months into us dating so no I did not talk about it much, so no I am sure he would not remember as I am no longer there. She then starts to asks more questions about our daughter and why his name was not on the birth certificate and I explained that because he was not there and we are not married I could not put his name on it but we have since filed for it to be added with the affidavit of parentage. Now he is starting to get nervous so I am telling him to just calm down and listen to what she is asking him, and she tells him to give me our daughter and for me to wait outside so she can finish talking to him. When he came out he said the only other question she asked him was did he help pay for my trips since I was back and forth so often and he said no. We go back and sit down and wait. We are then called to the fraud prevention unit. A nice gentleman takes my fiance into the room, but before he closes the door he asked me was this our daughter and I stated. He asks me about the birth certificate and I tell him the same information and show him the copies of the notarized affidavit and he is like ok that is fine. My fiance is only in the room for a minute and when he comes out he said the entire time the gentleman is talking with the CO that sent us to him and is asking her what is the problem why did she send us to him, we have a child together and the fact that he missed a letter in my last name is not reason to send us to him, and if she did not feel that this was really our child together then we could have a DNA test done right then and there. He then asked my fiance if he would agree to that and he was like yes and the gentleman said ok we can do this right here and now and be done with it. He never asked to speak with me and just sent us out to wait. About 10 mins later the CO calls us back to here window and gives us a green slip with is passport and was like someone would call him with information on what may need to be brought back and that maybe I might have our daughters BC with his name on it at that time as well. But that she needed to look at our case file a little bit more so she was putting us in AP. The green slip that she gave us stated that another interview date would be send to my email address, the other thing that was checked was 221(g) and that we are in AP. I would also like to add that as we were sitting there waiting through all of this and to go to window 13 we seen that this particular CO was sending just about everyone to the fraud unit (the reason we knew this was because we had been called to rm 13 so we knew what it was when they were calling other people we watched come from her window). So VJ what do you think? I have faith that we will be approved I am just a little upset at the not knowing and more waiting. :crying:


Hey sorry that you guys were put through this but, in my personal opinion I don't think it should be a problem from what you state to her the issue wasn't about him spelling you last name wrong cause we are all human and we do make mistake, I think the fact of the matter to her is why if that is his daughter is name isn't on the BC?? My question is was your daughter born in the states or in DR? Did you take the papers that you filed for his name to get added? I believe that if you can fix this issue of adding his name to the birth cert ASAP your cause would be approved. What made her question you guys more was the fact that she was trying to change him in a mix up about how many kids you have. It doesn't sound that bad... All true BUT

Here are the facts of the case:

1. He has no employment
2. He has no written promise of being re-hired to present
3. He has an income from unemployment that is limited in term.

While there is nothing that disqualifies unemployment insurance as income, there is also no requirement for the consulate to accept it. His level of unemployment income easily qualifies for 2 people, probably 3. But they can simply reject the income. I am sure some consulates would accpet it and some would not.

Your last year's income will not matter, UNLESS the consulate wants it to matter. The good (and bad) thing about this is that there ARE NO rules the consulate HAS TO follow. Each one makes their own and the consulate is ONLY required to be satisfied your fiancee will not become a public charge. All the poverty guidelines and sich come from the I-864 used for the Adjustment of Status. There are no guidelines for the I-134. NONE. It is common on VJ to ASSUME that the consulates use the I-864 guidelines as theri guidelines for the I-134. I am sure some do, amybe even many do. But there is no requirement to do so and even if they "do" there is no requirement to do so for every case. Consulates have incredibly wide latitude on this matter.

This could go two ways...

"The guy made $45,000 last year and has good skills and experience and will probably get employment soon. APPROVED"

OR

"the guy has no job and no co-sponsor...DENIED"

Bottom line...if I had ONLY unemployment at the time of the interview, I would bring in a co-sponsor.

That co-sponsor is on the hook ONLY until you submit an I-864 for the Adjustment of Status and for THAT, the unemployment IS counted as income.


:thumbs: very will said. Also just to add to this that at time they will also ask for a bank letter to see how much funds you have put away in the account that can be added as an extra income. So as stated it can go BOTH ways!

If you are receiving unemployment that is consider an income. You need to look at the proverty guidelines here the link http://www.uscis.gov...form/i-864p.pdf you don't make enough you will need a co-sponsor. Something your should start looking into now just in case you don't get your job back from now to your approval.

Yes if it's a consent coming from an Attorney yes I would go ahead and translate.

That is something that no one can answer at this point for you.. You would need to wait until they send you the RFE to see EXACTLY what they are looking for.

other option check over you pkt and see if you left something out!

Congratulations on your NOA2.... Give it a couple of day before calling NVC (NATIONAL VISA CENTER 603-334-0700) they will be able to provide you with your case # and they will also be able to let you know when your interview will be set up for.

As Mr. Tee explain the only delay that can be done is those that going through marriage visa, where you can take hold of as far as sending in paper works, since we have to pay the fees first. K1.

So unfortunately in your case you can't delay the process, You can try to reach out to the Embassy and see if they can reschedule, but please be advised by doing so your a running a risk since DR is a very high busy Embassy and it can probably take your a few month to even get a new date.

Now my personal advise to you is, you have learn that you can NOT go empty handed to the interview, you have a lot of people on her who have went through the K1 route recently just read there reviews, and the question that have been asked, most importantly complete all the required forms, have the correct payment amounts that are need the day of the cita, and take ANY AND ALL EVIDENCES that you both may have in some case the consular doesn't even look at them like in my case but I still took it anyways, better safe then sorry. As far as you have filing a petition in the past others have done it and have gotten APPROVED successfully just make sure you speak with the true and explain to them the situation and that you was unprepared etc....

Sorry dis dumb gallaxy must have posted multiple times. He wad born in yamasa n we went to yhe fairia in sdq n got it l eagalized but dis ldy is dtressin we go to da canceleria for his bc n my divorce

 

You can take it to the canceleria, But if he got it legalized you have nothing to worry about. The problem with the canceleria is that if he isn't found in the foil book, and/or register is will be an issued, cause that's where everything is kept.

Common question about your relationship, above all that speak with the truth, if neither of you know something be honest and tell them you don't remember but don't guess. Take your pictures, albums, phone records, anything showing your relationship is on going..
