IR-1 / CR-1 Spouse Visa Process & ProceduresReceived NVC Email with DS-3032, what next?

1. Since the AOS and IV are two completely separate tracks, it doesn't matter which you do first as neither impacts the other.

2. You can send it by email!

I highly suggest you click on the last two links in my signature and do some reading :)

As Saylin explained those are two separate trackes (bills) and each form follow there another, If you rec'd the AOS bill you can go ahead and pay the 88.00 fee if you have already send/email the DS3032 (choice of agent) you have nothing further to do at this point. Other then pay the fee and prepare the packet (AOS I-864, Tax transcript, employment letter, pay stubs (optional).

Once AOS show PAID give it a few days and you will receive the IV fee bill.

IR-1 / CR-1 Spouse Visa Process & ProceduresLAST NAMES

I HAVE A QUESTION I FILED ALL MY I-130 PAPER WORK WITH MY HUSBANDS LAST NAME BECAUSE OF COURSE WE ARE MARRIED BUT MY DOCUMENTS ALL SAY MY LAST NAME FROM BEFORE I WAS MARRIED FOR EXAMPLE IN THE I-130 I SIGNED ESCALONA BECAUSE THATS MY HUSBANDS LAST NAME AND WERE MARRIED BUT MY DOCUMENTS SUCH AS MY PASSPORT AND SSN ALL HAVE JORGE MY LAST NAME BEFORE MARRIAGE IS THIS GOING TO BE A PROBLEM?

Also please keep in mind that you DO NOT have take your husbands name if you don't want to. But as he other member stated try to update the rest of your documents to your married name so there won't be any confusion. As far as your passport goes, That is just other form of identification, So if you are in no rush HOLD OFF on getting another reissued. just make sure you have either you state ID or SSN# under the married named and leave your passport as is.

IR-1 / CR-1 Spouse Visa Process & ProceduresG-325a. Can I get signature of the foreign beneficiary scanned and email it to me?

Hi VJ community,

My wife is in India. Can I ask her to sign and email me a scanned copy of the form G-325a? Did anyone have any problems with this? I am applying for IR-1 / CR1 as a US citizen.

Also what should I write in "Can I get signature of the foreign beneficiary scanned and email it to me?" Should I write "Status as Permanent Resident" or "Other: I-130 form" ?

Thanks,
Gagan

I signed for my husband with my signature and it was accepted.

And I put "other with I-130"

IR-1 / CR-1 Spouse Visa Process & ProceduresHaving children a positive or negative?

Having a child together has little to no bearing on the outcome of your case. Having proof of an ongoing and legitimate relationship/marriage and showing that you will not become a financial burden to the US taxpayers is what really matters. According to your timeline, there is a two year gap between your marriage and your filing the I-130. You will want to make sure that you have proof of a bonafide relationship during this time. Good luck.

IR-1 / CR-1 Spouse Visa Process & Procedureshow to add foreign spouse to US citizen bank account?

Need help please. I went today to add my husband to my bank account. I was told last week all i needed was to have him sign a form and supply copy of his passport photo/info page to add him... today I take it to the bank, and now am informed he cant be added because he has no tax id number. I have read where others have added their foreign spouses, so I know its possible to do. Can someone please tell me what I need in order to add him, as the lady I spoke with at my bank (state employees credit union), admitted, she had never dealt with adding a non US citizen before, and after several phone calls to her supervisor, still didnt know, (nor did her supervisor!) but if I could find out for sure, so she would know what the process is, she will then confirm what I tell her, and help me add him. Seems I will be the first to do this at this location. My husband and I are at the "awaiting our NOA2 now". Thank you for any help anyone can give us in advance :)

I was able to add my husband with out any issue. I want to my bank, inquired about adding my non US citizen husband to my acct. they print a form that need this signature, mines, and a copy of a vaild unexpired ID or passport, at the time my husband didn't have his passport and I went with a copy of his ID, a letter showing proof of address or a bank letter from his country, and I took that to my bank and the rep. I sat in with the rep asked some basic question about my SO DOB country he lives in and he was added to my account successfully without any issued. He told me to wait until the following month so that I can see both our names appear on bank statement.

Good Luck Hope this helped!

Yes he needs it.
It's the only way he can work & file taxes.
It hasn't been that long since you crossed.
Wait about 3 weeks since POE and if you don't get it, go to a SS office and apply for one.
Ask them to look you up first to make sure you aren't in the system.

As the other member stated it hasn't been that longs since he made it to the states so just give it a few more weeks, I heard of other member who have gotten the green card first the the ssn and vase verse.

IR-1 / CR-1 Spouse Visa Process & ProceduresPaying someone to do cr-1 visa for me?

So I was wondering has anyone here ever used a company to do their cr-1 visa for them? I am feeling extremely overwhelmed with the whole process...I probably won't end up paying someone though.. What are your guys opinions on this?

I say save the money for the process you will need it, do some reading, get the hang of it and you will do just fine... Most of us here if not all of us have done so, and have made it thus far to the point of getting there visa approved. I wouldn't recommend a lawyer as they are human as well and will also make mistakes. in my opinion it's a waste of money, and sometime they lie about the progress of the case and when they actually send the document. On the other hand if you are a person who doesn't have the time but has the money go right ahead and let some else do the job for you. But other then that it's up to the person and there knowledge.

Good Luck on what ever you decide to do.

Quick question... How many bank statements should I submitt? Also do all our utility bills have to have both of our names on them? I receieved an RFE that i have to sent as much things as I have to show our bona fide marriage.

One bank statement with both your names should be find, If showing bona fide marriage then yes utility bill would have to be under both names, if you have copy of cell phone records showing calls, credit cards with both name, lease, these are some things you can add as well.

IR-1 / CR-1 Spouse Visa Process & Procedureslast question...I promise I 130 form

Under Info. about YOU (that's me-petitioner)...there are 1-14b questions. Then in section C it's "Information about your relative" with 1-16 questions...One would think ALL those questions in 1-16 would pertain to HIM (my foreign spouse), howver, question 15 asks "PRESENT EMPLOYER_____" Now, is that asking for my SPOUSES present employer, or MINE??? Because question 13 asks "Has your relative ever been in the USA?" which is a question to me, yet in HIS section. This is so confusing my head is going to explode. They could've made it a little bit more clear!

Can ANYONE shed some light on this? Employer? Mine or his?

#15 His employment info. if applicable
YOUR ARE THE PETITIONER so the question HAS YOUR RELATIVE EVER BEEN IN THE USA is self explanatory yes/no??? Has your husband ever been to the states?

IR-1 / CR-1 Spouse Visa Process & ProceduresNo word from NVC

Hi VJ friends. We got our petition approval on November 26, 2012. We have a lawyer working with us. I wouldnt want to ask him any more questions as he has been busy preparing for our documents. We've completed all the forms and everything is ready for sending to the NVC. We are just waiting now.

My question is, will the petitioner (my husband) receive a notice from the NVC to inform us that they've received our docs from the USCIS? (for sure by now they have them) Or do NVC always contact the authorize agent directly? Lawyer said on Nov 27 that we shall receive our invoice in the next 30 days. Well, its only been 16 working days.

The reason am asking (although confident that lawyer has been doing a great job) is that I've been seeing timeline updates of VJers when NVC receives their packet. Another concern of mine is the case number. Do we need to know ? :bonk: or let the lawyer handle everything. Thank you friends for enlightening me on this.

Maybe am just having mixed emotions, a lil nervous and excited, as I know things will speed up now that we have everything ready.

You more then welcome, I didn't wait the 30 day I was lucky enough to get both case number and IIN number days later of them getting my file, I believe its a personal choice! Good luck and God bless you as well!

IR-1 / CR-1 Spouse Visa Process & ProceduresNo word from NVC
NVC will NOT contact the petitioner as he (YOUR HUSBAND) assigned a Choice of Agent (Lawyer) your lawyer will rec'd all the documents and he will advise you of the next step.

As for the timeline most of us if not all of us have been working on this process ourselves with the help of VJ and their guides, So that is probably the reason why you see the change in timelines. As for the case number YOUR husband ( the petitioner) can call himself to NVC and provide them with the information on you case and asked them to give him his CASE NUMBER AND IIN (invoice identification number). You don't need you lawyer for this, But it good to have as you guys can check if a AOS fee or IV fee has been generated.

Nervous, excited, mix emotions are all part of the process... :) You guy will be ok!!

Good luck on the rest of your journey!

and there are medical fees as well

These amounts are incorrect

NVC IV FEE IS $230

AOS-$88

and there will be a new charge of $165 that will take effect as of FEB 2013(so if your interview is after Feb 1, 2013 you will have to pay this fee for green card)

IR-1 / CR-1 Spouse Visa Process & ProceduresEvidence of bona fide marriage/relationship. Is it ok to send more after sending I-130 packet?

We got married last Nov 11 and sent out I-130 packet last Dec 11. I included photos of us during my last 2 visits in the philippines, wedding invitations, 3rd party affidavits, passport stamps, and some of the greeting cards I sent to my wife. I have 2 questions:

1. Are the evidences above enough? Is there a possibility that the consular officer will deny us during interview because there's not enough evidence?

2. If I want to send more evidence right now (right now my case is at National Benefits Center, "Initial Review"), how and when should I send more evidence? Or should I just wait until interview and just bring more evidence on the interview? I'll try to collect more evidence like skype call logs, chat logs, etc...

Seem like you have more then enough to get you petition approved, depending on you country of consulate if is a "tough" one you front load as you did. Take more evidence the day of the interview is always a plus as they will ask for more.

IR-1 / CR-1 Spouse Visa Process & ProceduresPOlice REport - does it have to be translated

this is for the interview stage, not the USCIS stage. Many people have been sent RFEs because documents were NOT translated, and in many consulates at the interview stage, they want copies of the documents in English and in the native language. For instance in Amman, we were REQUIRED to bring both Arabic with English translations to the interview.

A translation does not invalidate anything, it is merely a copy of the original document in English

SHE CLEARLY STATES IT TO SUBMIT WITH HER DS230... MEANING SHE IS AT THE NVC STAGE NOT USCIS!

I DID NOT translate mines and it was accepted... Remember it clearly states "All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations and submitted to the NVC"

In other words since your police report is coming directly from DR and your are applying for the visa from that country you do NOT need to translated.
