This is to help any folks who are filing through Mumbai consulate. The system they follow in Mumbai is to submit your documents to VFS (Visa Facilitation Service) anywhere between 7 to 10 working days before the actual interview.

My fiancee went to VFS Mumbai yesterday to submit the required documents for her March 5th interview. She arrived there at 7:30AM. There were 10 people ahead of her. At 8AM they opened the doors and she was called to a counter at 8:10AM. She said they have plenty of counters and are quite efficient.

She had all her papers neatly sorted and bound together as one package with an ACCO binder clip. The VFS girl asked her to hand over the documents one by one in the order she requested. She brought up my fiancee's case on her computer to determine what forms need to be submitted.

VFS accepted the following docs from my fiancee:
Copy of Appointment Letter
Courier Fees (Rs 365 cash)
Copy of Passport
4 Photos (carry at least 6 just in case)(they stick the photos on the appropriate forms for you)
DS-156 (2 copies - both copies signed & dated)
DS-156K (1 copy - do NOT sign)
DS-230 Part I & II (only Part I to be signed & dated)
Birth Certificate (original & copy - original will be returned on interview date)
Previous Marriage (copies of marriage cert + divorce decree)
Police Clearance Certificates (from Passport Office + Police Commissioners Office - both originals)
Affidavit of Support (along with supporting documentation like Naturalization Cert, 2006 1040, 2006 W2, Employment Letter, Bank Letter & Pay Stubs)
Medical Report

VFS asked her to bring the following on the day of interview:
Original Appointment Letter
Passport
K1 Visa Application Fee (Rs 5,240 DD)
VFS Receipt (contains list of docs submitted prior to interview)
Evidence of Relationship (phone logs/e-mails/letters/photos/boarding passes/petitioner's passport copy/receipts etc)
Originals of all documents that you have submitted

They then gave her the checklist/receipt for submitting the docs and paying the courier fee. She was out by 8:30AM.

I am in the same boat. I am a US citizen (but i was living and working in Bermuda then), wife's a British national. I obtained marriage visas from the British Embassy in April 2010, flew to UK to live in the local council district for 9 days, and gave my notice to get married. Next is to wait for a minimum of 15 days before i can sign the papers (and I was not required to remain in the country so returned back to Bermuda to continue working due to shortage of vacation days). Flew back to UK in august 2010 and completed the civil ceremony and I returned back to Bermuda end of August.

I tried initiating the application in Bermuda and was told im not allowed to, and could not get an answer on where to file in the US. So finally quit my job in Bermuda and returned back to US (fortunately had a job lined up in US by then)and then filed her CR1 in Jan 2011. You can see the rest in my timeline. Unfortunately we still have the wedding per the religious customs to be done, which is scheduled for july this year, so she's still living in the UK and we decided to wait out the time required to complete the process. Allows us means and time to gather fund for the "big fat Indian Wedding".

Really hoping that she has her visa's by end of July and can travel back to the US with me after the religious ceremonies and planned honeymoon.

Hello,
I'm new to the forum and looking for advice on a rather complicated moving situation.

My boyfriend and I live in France. I am American and he is French. We have been living together for the past year and I am now being sent back to the US (NYC) for my job. Luckily, my boyfriend has found work in Montreal so we can be a little closer together than if he were to stay in France.

We want to submit paperwork for a Fiance visa before he moves to Canada (appx October 1st). However, he will not have a permanent address until at least November since he will be in employee housing during the first month of employment.

My question is how do we handle his address in the documents/forms?

- Do we include his prior french address until the moment he has a new permanent Canadian address?
- Do we include his parent's permanent address so that any mail could get forwarded to him in Montreal?
- Should we do a kind of 'change of address' that would include his canadian employer's address instead of a personal address?

I would assume that the US would be interested to know that he has left France and began working in Canada, but i'm just not sure how they need to be informed.

The idea of getting an immigrant visa, or immigrating to the US, is to LIVE in the US. Not to use it as your summer/winter home!

Even as a LPR, you must maintain a certain amount of "continuous residency", and especially if you plan on going through the naturalization process.

If you stay outside of the US for 6 months or more, you can loose your continuous status. If you go outside of the US for more than one year, but less than two, you need a Re-Entry Permit. If you stay out for more than two years, you need to apply for a Permanent Residence Waiver Visa at the US Consulate.

Our goal is not to jet set between the US and another country, but to be together and be able to decide where we want to live. At this point, it's uncertain professionally where my boyfriend will end up and I'd just like to have the whole picture.

Hi all,
My boyfriend is moving to Canada in order to be closer to me while we submit our K-1 visa.

There is potential that we may decide to live in Canada after our marriage since professionally it's more interesting for him. Do we need to wait until he's gone through all the adjustment of status before we could move out of the US?

I'm not so worried about how Canada would manage the visa, but what this would mean for the later return to the US. Would we have to file for another spousal visa and start over again?

Any thoughts would be helpful.

Hi all,
I'm confused on where the DS-156/DS-156K/DS-157/DS-158/DS-230 forms come into the initial submission for the K1.

In the Example Forms section, the cover letter example doesn't specify that the package contains these forms. However they are all available for download (even though some have expired).

In the USCIS guide for the I-129F, they don't seem to mention these forms as part of the initial package either.

Thanks in advance for helping me to clarify what gets sent where!

Hi all,
I submitted this in the embassy discussion, but didn't hear back so i thought i would see if anyone here had any experience....Has any tried to request going through another embassy other than the one that is located in your fiance's home country?

My fiance will be working abroad in Canada and i don't know if it's possible to list the embassy in Canada or the Consulate General in Quebec as the place where he would have his interview. It would obviously be more convenient for him to be able to go through the embassy in Canada than to fly back to France for an intervew. I know there's still a long time before we should be thinking about an interview, but i'm just curious

In the I-129F form in Part B question #20, it seems like you can list another embassy outside of the country of citizenship for the fiance. It's up to the post to decide if they'll accept the application. Has anyone tried this? Is it worth asking to change or will they most likely make my fiance go through his previous country of residence France (country of citizenship) for the interview?

Thanks! Thanks to all. Yeah, I probably am freaking out a little bit. I was just kind of wondering how everyone did theirs. I ended up doing a combo of the suggestions and papercliped my baggie to the section for which the photos coincide. I have a section for each of our visits, each with several photos.

I had to put the package aside! I just have to reprint 2 things at work tomorrow and then will mail it off. I think i had gotten to the point of obsession with my double, triple and quadruple checking of everything! wacko.gif

Hi! I've been looking on here for a month or two, and I am finally making a post because I can't seem to find the answer to my question.

I have everything together for my original submission I-129F package for K1 visa, which I plan to mail off tomorrow.

I'm just stuck on how to present my photos...

I've labeled them all on the back of each photo with names, dates and locations. Should I put all of them in 1 plastic baggie? Should I buy photo sleeves? Should I paper clip them?

Please let me know how you included your photos in your package.

Not asking for someone to do the research for him. (1) If my fiance (the beneficiary) was at university from 2000-2004 and had part-time employment during that time (e.g. waiter, cabana boy, beach deck chair attendant), should he list for example "Student - October 2000 - July 2004" and also the dates of each of those part-time employment even though they will overlap with the "Student" listing?

(2) Should he even list those types of jobs (he also worked as bartender, chef, bus boys - some for only a month or so and he doesn't know if he can find the addresses)?

Congratulations! We just got our NOA2 approval today also from VSC! Was just thinking that the VSC office may have all gone on vacation and then there it is. My fiance and I just flew to Texas to visit my parents tonight and we were just going to bed but now have to pop open a bottle of wine to celebrate!

Im kinda confuse now because you said the amount of money we have to send is 420 dollars, but i just read this in the embassy webpage.....The application fees to process the immigrant visa applications and fiancee visas, K visas, decreased worldwide. Effective Friday April 13, 2012 the fee to process the immigrant visa applications decreased from US$330 to US$230 and the fees for Fiancee visas (K) decreased from US$350 to US$240. The fiancee applications needs to pay, the day of the interview, the non-refundable fee of US$80 at window # 12 of the Consular Section.is that real?

One thing lead to the other.... That's why we provide you with the I-130 guide to read.... What you just mention above is the FEE for the VISA, the 420.00 is the fee for the petition itself. which you can find by going to USCIS.gov Please read thoroughly through the guides as this process can be confusing and overwhelming at the same time, any little error can get your petition reject if YOU don't send the correct fee amount and you will delay your process

But to simply answer your questions if YOU the PETITIONER is filing for an I-130 YES you must submitted a MONEY ORDER or CHECK in the amount of $420.00 US Dollars

YOU will also have to submit PROOF on a BONA FIDE MARRIAGE ie; Marriage Certificated, picture, joint bank accounts(if any) pictures etc.... Please make sure to read the guide so you can have a better understanding....

I don't think its NOA1 cause in his signature line he states he rec'd NOA1 20 July 2012 - NOA1 Received (via email) and seem like they are filing aboard which could possible mean that it is indeed the NOA2 as he also mention they are forwarding the case to NVC. I would just double check with USCIS call and confirm this information. And once done you can go ahead and provide them with your email address....

I would suggest to hold of on the name change unless is different then the one used on the petition and her passport... It can be very confusing at this stage, so if you used her maiden name in the petition and all her other documents are in her maiden name continue to use that name. As for the dependent yes you must add them on there as they depend on your income....

Sorry to here about your wife's medical situation, BUT I don't think for this type of case you will qualified for an expedite request. By all means you can try and see if you have luck, But I doubt it... I read a post on here where a person had his wife with cancer and requested for an expedite and it was denied... Unless it an extremely big hardship deal life threatening dying, (god forbid)situation you will need sufficient proof to back up everything that's going on for your wife. But like i said give it a shot and see... Good Luck on everything....

The DS-3032 is the choice of address and agent , He will fill out the form or the (Petitioner) can fill it out themselves and appoint him/herself as the Choice of agent and Address. You will also need form DS-230 Have the beneficiary sign PT one and DO NOT sign PT Two... Make sure to have the supporting documents you will once you hit the NVC stages which are original Birth Cert. Marriage Cert. and a copy of the Biographic page of his passport.

You can find these form if you go on to www.state.gov

You don't have to wait you have everything you need. Make sure you supply her with the beneficiary email address and send the DS3032 from beneficiary email!

i sure don't need to "sugarcoat" anything. But things happen in life. POINT BLANK. if whatever reason she needs food stamp or help from the "government" that is on her. Now if she feel like she has an issue with her income the only solution for her at this point is to get the cosponsor and call it a day. She will find a way to make it about her business to support her dependent.

Sometime one must put themselves in other shoes to understand the reason why situation come about. Especially if you have a FAMILY to take care of.

okk. Let me make it more clear. I make enough money. I have a good job i just have foodstamps cause of my son (i dont know how i qualified cuase my annual income is 32,000) and i read on the website that if i had foodstamps i would have to repay all of it back before it can be approve. Iam over the poverty level but for 2009 my annual income was $21,000. that falls a bit under the poverty level. are they going to look at the past years or just look at the current one 2012 and 2011? and aslo a read that my assets are counted towards my income so if i send in a bank letter maybe the 2009 under the poverty line wont matter.. :/



Just make sure to include a CURRENT pay stub for this year, and your employment letter stating your current income. And as the prior member state if you feel like you don't make enough find a cosponsor.

The question is how are you going to support your spouse when you can't even support yourself?



This is a stereotypical comment..... Just cause she rec'd food stamp doesn't mean she can't take care of herself.

On other note if SHE is the USC that hasn't nothing to do with NVC she is not a PUBLIC CHARGE to this country. the issue can arise if and when she adds her SO, who is the immigrant in the case and will be consider a public charge.

Your next step will be to email DS3032 (CHOICE OF AGENT) From the Beneficiary email address here is the template.

They should have given you IIN (Invoice Identification Number) With they you will log on to the payment portal(CEAC.STATE.GOV) to see if the first fee payment has been generated once they have received and accepted your DS3032 which take more or less about 1wk. Regarding the interview itself, do i need to ensure to bring all of the original civil docs being that NVC already does have them according to the checklist I received today?
I just want to ensure that we have got everything covered! Your input would be greatly appreciated!

(As we all know DR can be a little out of order sometimes, you can take original but you can also just take the copy of the package you created for (uscis, NVC) which has copies of the supporting document already provided. The consulate show return your original docs back to you the day of the interview, so don't leave the cita without them! Other then that of course just take your proof on your ongoing marriage, picture, letter, wedding album etc..... just be prepared with all the necessary. Good Luck!

Where do you stand at this point? When did you file your petition? Did you rec'd NOA1? You probably received a REF. and you must wait until you get the hard copy so you can know exactly what they are looking for..... What did you submit in you package?

1. Since the AOS and IV are two completely separate tracks, it doesn't matter which you do first as neither impacts the other.

2. You can send it by email!

As Saylin explained those are two separate trackes (bills) and each form follow there another, If you rec'd the AOS bill you can go ahead and pay the 88.00 fee if you have already send/email the DS3032 (choice of agent) you have nothing further to do at this point. Other then pay the fee and prepare the packet (AOS I-864, Tax transcript, employment letter, pay stubs (optional).

Once AOS show PAID give it a few days and you will receive the IV fee bill.
