This confuses me. Everyone seems to have a different story regarding their experience. When we went in they changed my name and then they had to send a message regarding my husbands change of name...he took my name as well. The lady helping us said once the name change is in they will send him his SSN. We did this in the 27th of May but we were told it could take up to a month to come. Our K-1 expires on the 25th of June and we just applied for AOS. Call headquarters and find out the truth maybe the person you dealt with did not know. K-1 visas seem to throw people for a loop. Typical untrained SS office clerks

Her status is NOT changed by getting married. If her I-94 is more than 14 days from expiring, then go get her card IN HER MAIDEN NAME. Do not try to change the name without and EAD or Green Card. Then file AOS in her married name (if she changes it) and go back and change her name with SS after you have the green card or EAD in hand. Ask for a supervisor if needed. K-1s are eligible for an SSN until 14 days before the I-94 expires but if you try to change names without status change if gums up the works.

If they say you need TWO forms of ID, you have them. Her passport is ONE, her K-1 is TWO.


Take your Marriage Cert. This seem to help us and it has all the name changes on it.

No. My Husband changed his name as well and he is the Non-USC. When we applied for the marriage license we change our names. So once we had the Certificate we were on our way. Then we applied for his SSN with the married name. Once you apply for AOS you use the married name as well. We have all our NOA's with his new name. So far it does not seem complicated. Good Luck!!

Once you are able to see your case on the USCIS website you will see a date next to the case #. They will update this every once in a while when they look at your case. While I was waiting for my K-1 to be approved we had no touches, it was approved and then an email. I am dealing with AOS now and they are touching my case a lot. So who knows. Good Luck!!

I am an attorney, and I used an excellent immigration attorney for my CR-1. I didn't have to do it, and probably could have handled the paperwork myself (and will do that for I-751). However, there was someone always there to answer my questions, I had no doubt that all the paperwork was done correctly and someone explained the process to me every step of the way (and I didn't once have to call that stupid service center line). When we got to the interview, it was just a paperwork festival, and not one question was asked. For me, it was worth the money. Plus, if anything had gone wrong, he would have represented me (for free) in the appeal process and etc. Finally, if he screwed up, he'd be responsible to fix it, which if you do it yourself and screw it up, the only thing you can do is screw it up worse trying to fix it, and once you have to get an attorney involved, its going to cost three times as much. This all presupposes the attorney you pick and pay is competent and etc., which in the end, you get what you pay for. Cheap is as cheap does...good luck!!!

Finally, looking at part of the staute - you have to parse out the intent - the language is "charge a fee" for the "service of matchmaking, dating, marriage, etc." - not "charge a fee" for "access to the site." You see the difference there is to make there? Match.com charges you a fee to access the site - they promise nothing - anything could happen and it depends on the contact you make with the other person - they may not answer you at all (and laugh at you too...ha). Some of these others (the ones I believe at which IMBR is directed) charge you a fee and guarantee you will meet others interested in dating/marriage, and you pay the fee to meet the people (or perhaps after you have a fiance or wife)...these are just my opinions, but I bet I am closer to the truth than further away; again, I would consult a good attorney (I can refer you to one if you like)...J

Of course I wold get a lawyers advice. However, I am thinking that stating that the primary purpose of the website is not to solicit international marriages. It is a website to meet people, not for the express purpose of arranging marriages between Americans and foreign nationals. I haven't even read the statute, so definitely don't count on what I am saying here, but to me, it has to be the sace they are trying to reach these internet sites that arrange marriages, not "dating" or "meeting" websites like "match.com" where anything could happen (including nothing at all). Further, how you "established" the relationship is they want evidence of that you met in person, why you met, what you did, how many times, how you talked about your developing relationship and all that stuff. They are looking to weed out the "we didn't meet, but decided to get married over the internet" people...Just my opinion...J

Don't give yourself a stroke Dean Dude. Your biggest problem is that you were in the Nebraska Service Center to start rather than Vermont or Cali. However, you're doing pretty well for having started over there from your timeline. Also, this new IMBR is a clusterf**k of major proportions so some of my lawyer friends tell me. A little pushing never hurt, so go for it. Just don't go overboard. It only takes one a**hole to spill a cup of coffee all over your file and/or for it to end up in the shredder, so my advice is be sweet as pie to these morons on the phone, then go bang your head on the wall to get the aggression out (or do it before the call, actually, that's better to put you on an even playing field with these schmucks)...anyway, stay cool...you'll get there eventually...

If she comes into the country on a tourist visa, and then all of a sudden you are engaged and filing for a K-1 2 months later, you are going to have a problem, period, because they are going to assume you intended to do this the whole time to skirt the K1 immigration laws. Your best best is to apply for K1 now, and just wait the wait without trying to get her in on a tourist visa for an "earlier" 60 days. If you're going to get her in on a tourist visa, you may as well just get married once she is here and adjust status, but you're going to have the same exact problem. Finally, a tourist visa isn't a sure thing either, and if they sniff out the fact that she's coming here to get married and deny the tourist visa, you are going to be even further behind time-wise AND you're going to have the problem that you applied for a tourist visa to get around the K1 timeline. Believe me when I tell you you're not the first (or the 10 millionth) that has had this "revelation." It's just a bad idea, period. I am not an immigration attorney, but I believe any good immigration attorney would tell you the same thing...ok, that's my 7 pesos...

Hello everyone; my fiance and I are new to the website and unfamiliar with this process, so please bear with me. Here is our situation: after meeting when he was visiting the US on a student visa from Colombia and dating for 8 months, we began a long-distance relationship that has lasted for 16. Now, after two years, we have decided to become engaged. Here's the problem, though: we would like to live together for a while before getting married, seeing as it's been over a year since we've lived in the same country. By "a while" I mean 6 months to a year. THe K1 visa only allows for three months after entering the country before getting married. What we're wondering is this: should he try for a J1 before a K1? If he does so, and is not approved, will the fact that he tried for one jeopardize his chances of being approved for a K1 visa? And finally, should he come to the United States on a J1 visa, how difficult would it be to change his status after we are married?

Any help you could give would be great, and good luck with your visas!!

OK, after reading the K-1 RFE master list I am completely freaking out, and here I thought I was all prepared. Here is what I was planning to send as evidence:

Primary Evidence:
E-mailed itinerary from my second trip to visit him
Boarding pass from my last trip to visit him
passport stamps from all 4 trips to visit him
Copy of credit card statement showing charges from Bogota last trip
Copy of bank statement showing atm withdrawals in Bogota last trip

Secondary Evidence:
10 personal emails from him to me spread out over two years
3 photographs -- 1 from when we first started dating in US, one from 2nd trip, one from last trip

Is this enough? Also, do copies of photographs have to be DUPLICATES, or can they just be color photocopies? And does the copy of my passport need to be in color? And finally, how much specificity are they looking for in the statement of how we met? I am unclear from the wording of the question whether it is meant to be a summary of our whole relationship, or simply a statement of our last meeting occurring within the past two years. If the former, how specific does it need to be? I am not the kind of person who remembers dates or obsessively saves things, so procuring this stuff has been a nightmare.

Any help much appreciated, as always.

And finally, does the notary have to fill out the document, or do I do that myself and simply sign it in their presence?

They have an impossible situation. It doesn't make anyone else's situation fortunate. Some certainly are. But generally, fortunate is a relative situation. Some people are fortunate. They marry one of the lucky races. Others are less fortunate. They have married a person from a country teeming with people who are on some unapproved list.

Take my situation for example. My wife is Chinese. We have been married almost 2 years. She can't even come for a visit. Now, say she had been Taiwanese. No visa required to come for a visit from Taiwan. Same race, same everything. But 100 miles of water and she is welcome to come for a visit. I wouldn't even ask for a immigrant visa if she was Taiwanese. I'd go there, she's come here. Life would be relatively normal. In/out, in/out ......

But because she's from one of THOSE countries, there is no visiting. And since she isn't a Mexican, she doesn't get the benefit of being from a super-special country either. We take it and like a Dickens novel ask "Please sir, I'd like some more."

Instead of looking on in dismay at others plight and saying but for the grace of God go I, we should instead demand the treatment our birthright as citizens of The United States of Mexico Jr. gives us.


Yes, your situation does indeed sound frustrating. Sorry to seem so ignorant, but what makes Mexico "super-special"? I thought it was actually more difficult for Mexicans to emigrate, because of the huge numbers trying to come illegally every year.

I am sure there must be many others in your situation. It must be difficult, for example, to be engaged to someone of a Muslim background in our current political situation.

Ironic (and appropriate) that you bring up _Oliver Twist_: Dickens was satirizing beauracracy and its policies, and in asking for more Oliver enraged the "powers that were" because he revealed just how ridiculous (not to mention inhumane) their philosophy really was.

The guides on this website suggest that the alien fiance bring the originals of things like photos, boarding passes, receipts, etc. with him / her to the consulate interview. Of course, perhaps this only applies if you did not include the originals in the petition. However, I don't think you should risk sending the originals in case your service center loses something. You and your fiance are probably much better guardians of those materials than your service center :yes:

Finally, I'm about ready to file my I-129F. Here is what I have, please let me know if I've missed anything.

-G-325A - 4 signed copies of each from me and my fiancee
-2" x 2" passport photos attached to the G-325A
-My birthcertificate
-Letters certifying intent to marry
-Letter signed by translator certifying the accuracy of the included Japanese documents
-additional attachment to question 18B - proof of having met in person in the last 2 years.
-Primary evidence: Passport stamps, boarding passes, ID and bills showing that we share an apartment
-Photos

OK, now I have a couple questions. I'm paying by Money Order and there is an area for an address. I filled in the Pay to: Department of Homeland Security and left the address blank. Should I write in the address fot the NSC where I'm sending the packet or leave it blank? Also, when copying our passports to show exit/entry stamps, I didn't copy every page. My fiancees passport has 32 blank pages and it semed ridiculous to copy them. Do you think that will cause a problem.

I would appreciate any last minute tips if you have any.

My fiance needs a translation of his German police certificate. Since he works as a German-Spanish translator, I'm just wondering: could he do this himself? Or would that appear suspect to the embassy? All the packet says is that he needs non-Spanish/English documents translated into one of the two languages by a "qualified translator." Looking for members who have had to obtain a German police certificate (certificate of good conduct is the term in Germany, I believe). How long did it take, from the time you filed your request with the issuing office, to the time you received the certificate? The reason I'm wondering is because my fiance, who lives in Colombia, spent a year in Germany and is therefore required to get one. It seems like a lonnnggg process: the issuing office does not accept faxes -- they do everything via snail mail. I'm just hoping to get a general idea of what the processing time is like.

Yes, like you I cannot wipe the smile off my face! I don't know how long this permagrin will last, but it is the best feeling in the world!

Good Luck with the next step- for me- it will be challenging. He has an enormous amount of work to do for the Ankara Embassy, and unfortunately, the downside of this early approval, is that I can not be with him for the interview. My understanding is that the NOA2 expires in three months (June 15), and I do not arrive in Turkey until the 20th.


Will you be able to be present for the interview?


Yes, my fiance also has a lot of work to do for the embassy in Bogota. They require some very strange things. But I'm estimating his interview will be in May, all going well. Since I'm a student and that's about when my semester ends, I am planning to fly there for his interview, and to help him get everything in order. Sorry you can't be there for yours :( But I'm sure that, with this website to help you, things will go smoothly regardless.
