K-1 Fiance(e) Visa Process & ProceduresK1 is almost impoosible now???
QUOTE (hopeitworks @ Aug 1 2009, 06:15 AM) <{POST_SNAPBACK}>
My boyfriend asked a few lawyers in New York recently. All of them told him that K1 application is getting so difficult now, because there have been so many people went with fake intent to get married. The goverment is not buying most of the stories now. So it's almost impossible to get to america with a K1 visa.

Did anyone hear about this too? Could this be true?

A lot of people say this but if your situation is for real you should have no problem. The more communication and visits you have had during the courtship the better. I had friends and random people tell me that the K-1 was impossible to get and this was while I was waiting...it made me so sad. Yet my love is here and we are married and happy and starting to build a life together. The waiting is hard but once you are together it seems like nothing. Good Luck! We didn't use a lawyer.

Ok so I have a problem or well I don't know if it is a big problem.

We just filed for our I-129F. He has a foreign address. His residential address is not a reliable address so his postal address is different. Where does the USCIS send information. How do we know wat postal address to use so that he can get paperwork as well from the USCIS. How do I go about inquiring about address. When i receive the NOA, will i be receiving only or will he be receiving it too? I am really confused because in SAudi residential addresses are not very reliable. I don't want any of his paperwork or packages that he gets from the USCIS lost. IS there a number I can call to confirm what addres sthey can send information to him. Please Help me. Please.

It should all come to you the petitioner.

K-1 Fiance(e) Visa Process & ProceduresQuestions on Fiance Letter of Intent
I did not include a letter of intent in my packet and we had no problems with our application. I submitted a letter in the format of a timeline that told the story of how we met and fell in love. I did state that we wanted to start our life together. I considered this my evidence. I found VJ after I filed and had no problems following the guidelines from USCIS. I don't remember the request for a letter but maybe I interpreted the request differently. Thanks VJ for the help and support. What would we do with out you?

K-1 Fiance(e) Visa Process & ProceduresNever received the Fiance packet from the Consulate

My Fiance is living with me temporarily in the U.S. and is returning tomorrow to finish up the K-1 Visa process. She received the 3.5 packet over email, but never received the packet that was supposed to be mailed (to her parents house).

My question is does she need it? The 3.5 on the internet seems to have everything we need to go to the interview. Do we need anything that should have been mailed?

Thanks in advance.

We only received our packet via email. We never got anything by mail...we even picked up my Husbands visa in person. I would check with the embassy but everything seems to be on-line these days. Good Luck at your interview.

K-1 Fiance(e) Visa Process & ProceduresHow many years of evidence to provide?

Wot?

Don't worry. You hear all kinds of stories regarding the size of K-1 petitions. Some huge and some the bare minimum. Yours sounds fine....Good Luck!! Just make sure you have all that at the interview. The flight records sealed the deal for us and we had less than you.
winifredbeeFemaleNicaragua2010-02-15 11:56:00
K-1 Fiance(e) Visa Process & ProceduresPolice records?

You will need the police clearance when you go for your interview at the Embassy, so you can start collecting them while you're waiting for your NOA2. Yes, from every country you've lived since age of 16

Goodluck

Do you also need record of being single in Canada? I found that one to be a bit annoying.

My flight would be Manila to Nagoya,.. Nagoya to Narita,... Narita to Seattle which is my POE...

I'm flying with Delta air. My fiance is going to call them today about the luggage.

With this kind of connecting flights, Am i suppose to pick the luggage up at the POE?

I would think you would pick up your luggage in Seattle so that you get entry in the States through customs. Here is the link to the POE reviews: http://www.visajourn...attle&dfilter=0

You may have to do something in Narita...not sure. Be prepared for whatever.

I did a search for October 2009 k-1 and found this: http://www.visajourn...-1-visa-filers/
Looks pretty active. I still PM with a few people from our group and we have a page on Facebook: http://www.facebook....05522650&ref=ts
BTW: We were a 2008 October filer but we were in Vermont. We are about to celebrate our one year anniversary in the states.

K-1 Fiance(e) Visa Process & ProceduresHow much time for visa for fiancee
They say six months but it does vary. We were just over five months. I think it depends on the country too. I think Thailand has a lot of fraud cases so that could slow things down. VJ is very helpful during the waiting process. Join a thread of people that have filed the same time that you did...this saved my sanity. Good Luck!!

Sometimes your status on USCIS doesn't get updated. Just make sure you get your NOA2 hardcopy. You will need this for AOS. My status was updated but they never sent me my NOA2. I had to pester them to send me a copy. Good Luck!!

K-1 Fiance(e) Visa Process & ProceduresAge
I say be prepared for any type of question. Stand your ground. Our experience was positive but there was a women at the Nicaraguan Embassy that asked my husband and I a few personal and somewhat judgmental questions. For example: Why didn't you all in love with a girl in your community? How did you guys communicate?...once she saw all my flight tickets she changed her tune. Evidence is key. We have an age difference which may have been why she was so intense about her questions. My husband was a little shocked but handled her rudeness. Good Luck!

K-1 Fiance(e) Visa Process & Proceduresrejection of previous visa...
as long as there's enough evidence to support the case on the K1 interview in Turkey, she'll be fine. They can deny a K1 based on an earlier B1/B2 rejection. Also that was 3 years ago that's really good, clearly shows that she didn't apply for `that` tourist visa with the intention to immigrate to US.

K-1 Fiance(e) Visa Process & ProceduresLanguage Issues
Thanks, all of you, for your comments. My only enduring concern is about the fiancee letter. Maybe she should have signed it in both English and Thai, and/or added a statement testifying to the fact that she is fluent in both languages. My concern is that they might think that I wrote the letter for her and that she does not know what she signed. If anyone thinks this could become a significant problem, please make your case now while it is not too late to do something about it. I could ask her to send me another one right away. But I'd rather not bother with this unless there is a significant risk.

K-1 Fiance(e) Visa Process & ProceduresLanguage Issues
My fiancee just mailed to me her G-325 biographical statement and her fiancee letter of intent. She signed both in Thai, although she completed both in English. Is this acceptable? Also, on question 16 on the I-129F, she provided for me the required information in Thai, and I was able to cut and paste it into the document. Her signatures on the G-325 and fiancee letter, and my answer to question 16 on the I-129F, are the only non-roman lettering in the entire package. Do we need to have these documents certified by a translator? Please respond. Thanks in advance for this wonderful opportunity to receive free feedback and advice.

I am wondering why my fiance needs an exact copy of the entire I-129 Package that I prepared for her interview. Is she required to submit this to the US Consulate in Bangkok? Or will they already have a copy. I don't understand. Can someone please explain this. Thanks

K-1 Fiance(e) Visa Process & ProceduresNOA2 Approval has been sent today!
Hello everyone,

Things are moving much faster than I thought they would. NOA1 on September 29 and NOA2 on November 5. What do I do now? That is the question. I have read the guides, but just want to check some things out. I already sent a copy of the I-129F Package to my fiancee. It says that I should also send her my I-134 plus proof of our ongoing relationship. Do I send this just to her, or to the USCIS office in Vermont, as well?

Hi,

My thought is to return COPIES of EVERYTHING in Packet 3, including the proof of a fiance relationship and the completed medical exam forms. Then, she will carry in her original passport and birth certificate, etc. to the interview. Is that correct thinking? Please let me know. Thanks.

For the best result follow the P 3 instructions. Outside the embassy they will check to see if she has the correct documents. She will have to convince them that you decided to do it your way & all the docs are inside. This is not what they are accustomed to so anythng can happen at that point. They will not check to see what is going on.
She is expected to take the documents required & turn them in at the window to the right of the stairs prior to entry to the interior waiting area. The documents are checked & passed along to the staff inside. They assemble the file for the officers review prior to the interview.
Interfering in the document flow may have an unknow reaction to your case at different levels.

I think for P3 they want everything except the medical exam and proof of ongoing relationship. I had intended to give them copies of everything, and then have her bring in everything, as well as her original birth certificate and passport. But I could leave out the medical exam and the proof of ongoing relationship if including it could have negative consequences.

I do not think it is wise to mail them her original birth certificate and passport. These items should be carried in regardless of what the P 3 instructions say. Prior instructions asked for originals. The present instructions are ambiguous on this point.

Excuse me, I was not reading carefully. They want you to mail copies rather than originals of vital documents, such as passport. But you need to bring these originals to the interview. They say that it is not necessary to return the proof of relationship and the medical forms with package 3. OK, so we'll send them only what is necessary and carry the rest of it in. Thanks.

K-1 Fiance(e) Visa Process & ProceduresK1 applied for can I apply for a working visa while I wait and do I need to apply for a new driving license

I got married in Lake Tahoe because we did not want to wait forever, we wanted only a couple of friends at the ceremony and we didn't want to have a big party. All she needed was her passport. They issue the license and the certificate at the same time. You will not receive the actual certificate at the ceremony. It will be filed and mailed to you nd you should have it in about 2 weeks or so. The money we saved was better used on a couple of first class tickets to Honolulu!

Ha, I'll bet! :) Trust me, I'd rather have an amazing honeymoon too! I've never been one for a huge wedding anyway ... I'd probably just invite my parents (as witnesses) and then if they want to do something for a party later on (maybe after the visa comes through, LoL) I would let them. :) Basically, my boyfriend (who is British) and I have come to terms with the fact that if (and when) we do get married, we wouldn't be able to really have a wedding (which is why we've joked about Vegas a few times!) I've never been to Lake Tahoe, but based on the Google search I just did, it looks stunning.

K-1 Fiance(e) Visa Process & ProceduresK1 applied for can I apply for a working visa while I wait and do I need to apply for a new driving license

I know some people who got married in Vegas because it is easier and you don't have to wait. Same goes for Lake Tahoe. It is not the foreign national that applies for CR-1, so it is up to the US citizen to get the ball rolling. Once you have the original marriage certificate you can send in the papers.

Right, I knew that it's the US Citizen that applies for the visa, I guess with all the talk of visas with my boyfriend, I just never actually thought about Vegas before as an option! (crazy, right?) If we decided to get married that way (and then apply for the CR-1 as opposed to wait and apply for the K-1) ... all he would need is his passport? Or is there any other documents / paperwork that needs to be completed beforehand for the person who is not the USC? And I'm assuming they'd give us the marriage certificate right then and there?

Has anyone else gotten married in Vegas?! This may be becoming more and more of an option ... :)

Viva Las Vegas!

Speaking of LV ... has anyone actually gotten married to their foreign significant other there? How does it work? All they would need is their passport still, right? And then how soon after would they need to leave the country so they can apply for their CR-1 visa? Just curious .... :innocent:

The sentence I bolded in the comment reply: Start collecting the documents for the evidence of relationship you'll need for the interview. Photos, print out some emails, phone records. Easier now to start keeping records so you don't have to do it all in a rush at the end.

K-1 Fiance(e) Visa Process & ProceduresK 1 Visa interview country

She can arrange to interview wherever she has legal status. Since she has PR status in SG she should be able to contact the US embassy/consulate in Myanmar and get her case transferred to SG, assuming the SG consulate/embassy has an appropriate visa section.

Once she gets approval, she can arrive in the US from anywhere in the world, as long as she hits a US Point of Entry before the expiry date on her visa. Nobody in the US will care.

When you fill out the paperwork for the K-1 you will put her address and legal residence as Singapore and that is where they will send her case for the interview. Include a copy of residence permit/residence visa or whatever is giving her legal status in Singapore in your packet. You can also add in your cover letter (if you do one) that the beneficiary is living in Singapore and would like to have the interview there but most likely that is not necessary.

After she has her visa she has typically 6 months to use it. Prior to that she can go wherever she wants, no one will be keeping tabs on her.

Good luck.

Thanks HeatDeath and beejay for all answers. That really helped with our questions. We have other questions.
We have been planning our wedding a while ago and I really want my girl to enjoy the ceremony. So, If we do ceremony (without signing any marriage agreement) do you guys think it could effect the K1 approval?

Thanks for all helping!!!

K-1 Fiance(e) Visa Process & ProceduresK 1 Visa interview country
Hi All,
We have a big question regarding visa interview country. My fieancee and I have decided to apply the K 1 visa. I'm US citizen and she is from Myanmar who currently lives and works in SG with PR status. Here are our questions.

1. Can she setups her interview in SG through US Embassy or she's to go back to Myanmar and setups the interview there?

Here are other questions in condition that if she's got approval K 1 visa through US Embassy in SG:
1. Does she has to come straight from SG?
2. Can she go back to Myanmar(to unload her unnecessary things) and come to US from Myanmar?
Can someone share some knowledge/experience in our dilemmas? She would like to go back to Myanmar and come from there, but we worried about the US Immigration might raise "red flag" on this action.

All answers/thoughts would be really appreciate!!!!!

Best Regards,
Simon

K-1 Fiance(e) Visa Process & ProceduresNeed Advise which route to follow... K1 or K3 or other

Hello Ali, I am not sure exactly what it is you're asking but I'll give you my opinion on which I think is the best route.

If you are already married in Mexico then I would suggest going the CR1 route. The K1 and CR1 are taking pretty much the same time give or take a month or two.
However, with the CR1 once you enter the country you will automatically be able to work and travel freely. You wont with the K1.
You can totally forget about the K3 it pretty obsolete these days as the CR1 does the exact same thing and it cost less.

Hope I was able to help....God bless you on your journey!

Thank you Dimples. You read it right. I was looking to choose between the CR1 or the K1. (I have heard of married couples in Mexico applying for K1 because it is slightly faster).

Wish me luck here we go!!

K-1 Fiance(e) Visa Process & ProceduresNeed Advise which route to follow... K1 or K3 or other
Hello board,
First, I want to thank in advance anyone who takes the time to read my quick story. I am new to this forum. Like most people here, I want to be with my significant other and we are seeking the best route. We recently married civilly in Mexico in order to get married in the Church.

About me: I am an American Citizen living in New York City. However, my residence is in Delaware. I am on this board seeking advice and other souls in my situation... I am on this board because of Ali my significant other. Ali lives in Mexico, and I want to get her here so we can live together.

I have heard of people getting married in Mexico, however still sucessfully applying for K1 visa? Is this a good idea for us?
We will need to get married in the Church as we a both deeply religious. From the notes in the Comparison page, I think IR1 might be better if we are married.
