I was denied twice.

I had already given up almost everything I had in Canada and I couldn't show strong enough ties.

It didn't affect getting my visa- I told the guy who interviewed me that I was denied twice because of lack of ties. He giggled, rolled his eyes and said "Yup, that happens often."

When I got mine done in Canada- I had to specify 2x2 photos. Our passport photos in Canada are a different size than 2x2. The guy who took mine had previously worked in the US and knew exactly what I needed.

Not mounted generally means not attached to anything.

I brought my previous Marriage Certificate along with my Divorce Certificate to Vancouver. I went and paid to get a full size Marriage Certificate from the Registry office because I only had the wallet size one.

I also brought my husbands previous marriage and divorce certificates.

Also- you being in Calgary will mean that your case will go to Vancouver. The Vancouver Consulate is much quicker than Montreal with getting in for an Interview.

5 months is definitely an extreme amount of time not to cash the cheque. I sent in my AOS right before the price increase,and it took them 5 weeks to cash the cheque- I thought that was quite a long period of time compared to how long it took them to cash the cheques for our I 130 and out I 824.

I would consider canceling that cheque and resubmitting a new package.

I indicated both. For the Have you ever been refused entry to the US question- I answered yes and wrote the reasons why on a separate page and attached it to the application.

For the "Have you ever been refused a Visa"- I answered Yes and when it said "What type of Visa?" I wrote B2. It seemed logical to me to answer yes to that one. I was never told at the Interview that I answered it wrong.

I was asked about the denials at the interview and told him- lack of ties to Canada. He said it happens often and moved on to the next question.

I got my Visa.

Technically B2 is a Visa. Tourist Visa.

I had no problem at the Interview- many people do get denied because of lack of ties.

I have wondered the same thing about the G 325's. We have had to include 4 copies each time we filed for anything. I have learned to just do what they ask for and not question the logic behind it. smile.gif

As far as the A# goes- I didn't get an A# until I got the approved I-129 for my K3 Visa. Just put N/A if they ask for it and you don't have one.

I tried to get a copy from Chana's office- they said no. Good Luck with those b!tches at the desk. I asked the Customs guy at POE (Edmonton airport) if he would make a copy, he said no.

Getting pass the Foriegn Consulate will be more difficult. I am not sugar coating it, two past marriages will present difficulties for you.


I am not aware of any documented evidence that would indicate that two previous marriages are going to be hugely problematic unless they were foreign marriages that you previously applied for visas ....


I agree, something like that may be a red flag to them. Otherwise, as long as you have proof of both Divorces and that you are free to re marry, I don't see why that would be an issue.

I was denied twice- but in Canada, we clear U.S. Customs before we get on the plane so I wasn't stuck in the airport waiting for the next flight back to my home Country. Both times I was credited for the airline tickets and had 1 year to use them (it wasn't the full amount but it was worth something)

It also makes a big difference where you live in Canada- there are 2 consulates that handle K visa's- Montreal and Vancouver. Vancouver is much quicker to get in for an interview. Montreal you can be looking at several months to get in for the interview alone- and that is after the approval and processing.

Montreal is the only consulate that handles the CR1 visa.

Edit to add- just noticed your fiance is from Edmonton. Vancouver will be his Consulate. Good news!

When he comes in on a K1 visa, you have to get married within 90 days and then file for AOS- adjustment of status, EAD- employment Authorization and the AP- Advanced parole. It usually takes a few months for EAD. Mine was slow- it took 5.

Or you can get married and do the CR1 process- he will receive a 2 year Greencard and be able to work upon entry to the US.

This process is not easy one nor a quick one.

Also- we have a Canadian forum you may want to check out- you will get more info on timelines and what is involved with the process going through Canada.

OK, I understand. You are right, B2 is a visa. The way I see it, is that you were not denied a visa, you were denied entry. But its good that you were completely honest about denied entries too.

I also wanted to ask you.. Do you need a B-2 if you are a canadian citizen? I thought you guys did not need a tourist visa to come to the U. S.?

All Canadian Airports have U.S. Customs so we clear Customs before we get on the plane. You wait in line, go up to one of the kiosks, give him the declaration card you have to fill out, the customs guy asks a few questions and stamps your passport with a B2 stamp and off you go.

Some people have had no problems traveling back and forth while processing. She will probably be asked to prove ties to Canada- mortgage or rent payments, letter from employer, bank statements, etc.

I wouldn't advise her to pack up and move everything to Texas until she has that Visa, or stay longer than she is legally allowed to on B2 status.

If you click on the "guides" button at the top of the page it gives you step by step information. It is a great start because there is so much to know about this process.

K1 is a fiance visa- once granted- she can enter the US, have 90 days to marry and then you can proceed with filing for AOS-Adjustment of status. With AOS comes the Greencard. There are 2 consulates in Canada that handle K visas- Montreal and Vancouver. If she lives closer to Vancouver- it is the norm that her file will go there and she will be interviewed there. The bonus for this is that Vancouver processes much faster than Montreal and can shave several months off your waiting time.

If you get married and then start the process- you would file for a CR1 visa. Montreal is the only consulate that handles CR1/IR1.

I haven't given you a whole lot of information because the guides will explain much of the process.

Just be prepared- immigration is a long and frustrating road. But it is worth it in the end.

We have all been through it and are always willing to help and support each other.

I have to say I was lucky- once we filed for our K3 (it took us several months to make the decision to file for it) it was 5 months start to finish. I also had the advantage that I was closer to Vancouver so my case went there.

It was 3.5 months to get the approval at CSC, 1 month until package 3 was in my mailbox and then it was a whirlwind to get everything ready for my Interview in Vancouver. I was expecting a month wait for the interview but I got in 9 days after I faxed back my checklist.

I would suggest you read the guide for K1...Click on Guides located at the top of your VisaJourney screen....search for K1(click K1), and follow the guide.((This would require you to get married here in the USA))

Generally your Fiance would file the petition here in USA, while your in your country...you wouldnt be able to travel to the USA during this process...you would have to wait until you recieve the K1 Visa, after that you can come to the USA and you have 90 days to marry your Fiance....once your married you have to adjust your status.

If you wish to marry in Canada you might look up K3 or Cr-1 Visa's...this would be a Spousal visa vs. Fiance visa.

Maybe you can find other Canadian's on VisaJourney to better help your specific case. Good Luck !

My only suggestion for the K1 Approval notice is to request a copy from the department of homeland security. In the future I would at least make copies of everything!

You have gotten some great advice here but it seems to me that you are still a little confused.

Here is something to make the process easy on you:

If you marry in Korea you will return to the US alone and apply for a CR1 Spousal Visa.

For any visa you will need a sponsor (USC) that makes enough money to support their household and your wife.

or

You can file for a K1 fiance' visa as long as you have been to visit her within the last 2 years.

The guides for all your choices are very helpful if you read them carefully. Try to get to the basics first.
