If you are concerned, is there a way that you can request another copy from the state? You can order them online and pay with a credit card.
The only birth certificate my mother ever got after my birth was a wallet size plastic card and I sent that in with no problems whatsoever. So who knows....

I recently sent in my wife's ds-230.

I basically filled it out on the computer and printed it then sent it to her to get it signed.

I wrote all my information in the field that asks "were you assisted in completing this form"....

is this okay? will she be questioned about it during the interview?

also, for the languages question i entered Arabic & English.... she has been taking english classes for a few years now, she isn't fluent
but she can read and write very well. will this be an issue during the interview?

That's exactly what I did regarding the DS230 and it was fine. As for the interview, she will be interviewed in the language that you communicate with her. This will attest to your validity of your relationship. My husband had proof of all of our conversations in French, thus this was the language he was interviewed in.

October 25 I mailed a single packet with two I-130's all requested document for each application along with two checks. One for each application. These are for my wife's children. Since then I have only received one MSC receipt number and the USICS has only cashed one check.
Is this normal or is something abnormal ??

for 'filing' the I-130, no, not affect the filing at all. 

 

your income is evaluated on interview day at a US Embassy/Consulate Immigrant Visa Unit, so if you are just now filing the I-130 petition, 

then you have some time to sort things out with the IRS.

In Jamaica its somewhat normal up to 25 yrs older for men

its not a red-flag, unless the other way around...ok so payments

are being made...be aware its not an overnite thing, time, money

and patience is what you need, start working on a co-sponsor if U R

under the poverty line, and proofs of on-going relationship

Yes, you being 23 years older than your wife IS a red flag. It just means you have to provide more evidence of an on-going relationship, visits, chats, phone recoreds, pictures etc. to overcome it. As far as paying the IRS I am not an expert but I would think as long as you're paying and have filed your taxes it would be a minor bump in th road. Will you be having a co-signer?

I'm not sure if I will have to use one (co-signer), age is just a number I love her and she loves me dearly however I only go there once per year because of my job. I take care of her financially, we mostly talk through APPs like whatsapp viber Skype vonage because its cheaper or free, will that cost a problem???? thanks for ur eye opener

This is not correct. Immediate relative petitions do not permit more than one beneficiary, so two petitions would be required for a US citizen petitioning a spouse and step-child, or a natural child who has no claim to US citizenship.

Migrating while pregnant

Q: My mother filed an immigrant petition for me and my family. We just had our interview at the United States Embassy and the visas were approved. I'm about seven months' pregnant, and I would rather not travel until after my baby is born. What are my options?

A: If you are a pregnant woman coming for an immigrant visa interview at the US Embassy, it is important to disclose this information to the medical doctor during your required medical exam, and to the interviewing consular officer.

The officer will be able to give you the best options for you to travel with your baby, depending on the child's due date. If your visa is approved and you migrate to the US and give birth to your child there, the child will automatically become a US citizen.

If you are closer to your due date and cannot travel, however, you will still be able to take the child to the US without adding him or her to the filing.

If you have been issued an immigrant visa and your child is born after the visa issue date but before the visa expires, the baby is not required to have a separate immigrant visa of its own. Your child must have a valid passport from his or her country of nationality, and the birth certificate stating you are the parent. You can take your child with you when you migrate to the US, and present these documents at the port of entry with the rest of your family's immigration packets.

If you have recently given birth to a child but have not yet had your interview at the Embassy, your baby will need to be added to the current petition in order for him or her to travel with you and immigrate to the US. You will also need to bring documents for the child, such as the completed DS-230 application form, birth certificate, and medical exam, to the visa interview.

Huh? No it won't. Your wife will be approved/denied regardless of the baby, based on the merits of the application you sent in.

 

she got pregnant next month when I was in JA, and I filed from MAY, I know it wont affect the approval but after it gets approved and it come to the time for her to do her medical??? someone told me today they will dump every and tell me to refile after the baby is born, am confuse

Okay, I think this is the route for us.
I understand we'll have to be there for 6 months before we can file our DCF, we'll have to make sure we get into a good gig so as the time can fly.

The nice thing about being an English teacher is that you can choose your next contract and country:
Perhaps a country that has an International Immigration Office, such as South Korea, China, Mexico or Peru. *Thanks for the list, hikergirl :thumbs:

Does anyone see a problem with this:

1) Find a job now in (for example) Peru that would begin in June-August. Get work contracts signed and plane tickets booked.
2) Enter the US in May on a tourist visa, with contracts and plain tickets to prove I have no intention to file for immigration in the US.
3) Get married and celebrate like these dancing fools here :dance: :dance:
4) Go to work my contract in (for example) Peru.
5) After living there for 6 month, file my DFC, get my visa
6) Finish contract, return to America and start a new life.

Have I missed something? Is there a fatal flaw to this plan?
My fiancee is already cranky that we can't just go to America now, so I don't want to head in this direction unless it could work out... :blush:

Otherwise, the best route sounds like KDH/hikergirl 's plan to get hitched in America on a tourist visa, with evidence of a new contract in Japan thereafter.
File I-130 for CR1 visa, work and live in Japan until the process is completed, then come into America with my visa.
How would I go about booking the interview in Tokyo, instead of Montreal?

Now: We have our wedding planned for mid May, I have family flying a long way to be there. They've already bought tickets and all.
It would be fine if it wasn't so much a wedding as a celebration, we aren't planning to do it too traditionally anyways.. :innocent:

So what is the smartest, least damnable route to take?
A) Get married in Japan. Fly to America for a celebration, with documents proving I will be returning to Asia for another contract as an English teacher. File for DFC during this new contract.
B) Remain engaged, fly to America and throw a celebration without actually marrying. Return to Asia and then get married and file for DFC.
C) Get married ASAP, file for DFC now. Stay in Japan until we get our visa, cross our fingers that 11 weeks is enough time. I've read that it can take 2-12 weeks for the DFC process around here.
D) You tell me.. Any bright ideas, even if you have to PM them to me :whistle:

Hiya,

I'm a Canadian citizen, engaged to an American.
We've been living together in Asia for the past 4 years,
and we feel it's finally time to settle into a home and plant some seeds.
We wish to live in New Orleans, her hometown, and plan to be married there this May.

Looking over our visa options, it looks like I could:

A) Arrive on a tourist visa, get married in the US, then apply for citizenship in country.
B) Fly home to Canada, apply for the fiance visa, and fly down once that is approved.
C) Get married in Japan, arrive in the US, and apply for citizenship.

I'm aware that option B will take 4-8 months to be approved, so it won't make the May date...

My question is: Is it better to arrive in US and hope for a tourist visa entry* or should we get married here in Japan** and arrive in America with a marriage certificate but no visas?

*I've heard that it can be problematic to enter America on a tourist visa if you have intention to be married during that visit. Can anyone give me their thoughts about this?
**We won't have time to file for Direct Consular Filing in Japan.

Good afternoon,

This is my first post, and I have a question for y'all.

I am an Australian citizen currently living and working in the US under an E-3 visa (set to expire March 2014). I will be marrying my US Citizen fiancee in March, 2013. I plan to file for a CR-1 shortly after getting married. My fiance is doing a short semester in Australia for her university degree, and I plan to briefly travel with her to Australia, returning to the US after approximately 10 days, in May, 2013.

I understand that there are issues with living and working in the US under an E-3 visa, and travelling while an CR-1 application is in progress.

Will there be an issue if I submit our application for my CR-1 in March (immediately after we get married), and we then travel to Australia in May? Or should we delay submitting the CR-1 application until I return to the US after the short trip to Australia?

We are eager to get the application process started ASAP, but do not want to risk issues with getting back into the US under my E-3, as this would not be great from an employment standpoint. However, would it be considered disingenuous to not file our CR-1 application until May (approximately 2 months after we get married)?

I appreciate any suggestions or advice y'all could give me.

Can you do a civil ceremony just to get the paperwork rolling and then do a ceremony with family and friends later?


Yes, I was discussing this very possibility with my fiancee last night. We still don't have all the documents completely ready (the wedding is scheduled for three months from now, after all), and she seemed to indicate that even a civil ceremony will take at least a few weeks to schedule; she's a lawyer so I trust her knowledge ;)

The only potential hiccup is that we're having a religious Greek Orthodox marriage and they tend not to like it if you've already had a civil ceremony, in fact they asked us about it when we booked the church. But these are clearly unusual circumstances.

Filing for AOS (Adjustment of Status) within the US can only occur if you both got married within the US and neither of you were planning on it before getting to the US. What you're suggesting (travelling to the US after being married and then applying for AOS) is immigration fraud.


Well I certainly didn't mean to suggest fraud! I understand the problem, that's why I asked the question, but it all seems so Catch-22 to me. You're allowed to adjust your status, even if you're already married, but you're not allowed to have intended in the past to enter the U.S. with the intent to adjust your status. :blink:

If you guys get married (which I would suggest - I personally have found it simpler than the K-1 process), she won't be able to stay with you in the US the entire time, because she'll have to attend the interview in her home country and there are several documents that she'll need from her home country. Also, although she can get in on VWP, be prepared for her to be denied entry at the POE. This won't have any effect on her I-130 process, if it does happen, but even if she is allowed in, I wouldn't recommend her staying for more than a month or so at a time. If you are eligible for DCF, I'd recommend that, but remember that you absolutely must be married before starting the process, and although DCF is fast, I doubt it would be completely finished and ready to go in less than two months. Good luck on whatever you decide to do!

This doesn't seem possible judging from what you've said, but just in case, is it possible to file an I-485 together with an I-130 during her stay under the VWP? The instructions at USCIS seem to indicate that it is. But the whole thing is so confusing and ambiguous...

Hi, so, first-timer here with a lot of questions.

First, my situation: I am an American citizen. My fiancee is a Greek citizen. Our wedding has been planned for this coming June 15th since last year. I have been living in Greece on a student visa for the past year. In August, I will be starting a doctoral program in the U.S.

Our plan was to travel together from Greece to the U.S. in the summer. But I guess we were a bit... nonchalant about looking into the immigration situation; now we're in the initial stages of a freakout. Lesson learned.

Basically, the k1 visa doesn't look like an option. Her big extended Greek family is expecting a wedding, we've been planning a wedding, all the deposits are paid etc. But (as far as I can tell) you cannot file an I-130 without already being married; we won't be married until June; and we need to be in the States in August.

In short, I'm very concerned about her ability to stay in the U.S. Technically she can enter through the Visa Waiver Program, however from what I understand she would have to leave and re-enter before changing her immigration status. Is there any way she can stay in the United States while we wait for the paperwork to clear?

I've begun looking into Direct Consular Filing (which may be an option since I'm legally a resident of Greece) but I'm really at a loss. Can anyone help? Thanks a million in advance.

Prepare him now for how it REALLY is here in the United States....People can be cruel especially to Muslims and it may take alot of time for him to find a good job.....Make him feel needed and reassure him things will always get better....Keep in touch with his family and friends as much as possible....Get arab channels for him to watch or introduce him to youtube...He can watch all his arab shows there for free.....He will get arabic speaking crazy if he doesnt speak/hear it everyday!LOL Independence is a BIG issue with Arab men....Great advice about busses, cars, maps, etc....Start him with all the basic information he needs: address, phone numbers, emergency contacts, etc.....Make sure you get him a driver's education book to read our road rules, this will help him when he can get a DL here......Show him your local Mosque and be sure you make time in your schedule so that he can attend on Fridays... As time goes you will get to know him much better.....with his new adjustment there will always be some spats....just remember to put yourself in his shoes first ....calm down...and then deal with the issue at hand....he doesnt realize how much the move will actually effect him, but it Will get easier....BE SURE to show him how to establish credit and keep it good...this is very important.

I could go on and on as Im sure we all could, each man is different but they are also very much alike !

What documents?



We had to send her a copy of the online application, along with our income documents as we will be supporting her (I-134). I also included an invitation letter for her and for the Embassy. If I can be of any help, please let me know.
