When Mel filled out the I 824, he was allowed to make 2 choices of which US Consulates the file would go to. He chose Calgary and Vancouver. I don't think the Calgary office handles very much of this kind of thing. Which is too bad, it is fairly close. I am in Edmonton. So I really have no idea at this point where my file will go. I only know my Interview will be in Montreal.

My husband went for a Consult with an Immigration Lawyer in Louisiana. The Laywer said there wasn't much he could do for us, right now it is just a waiting game. He was the one who told Mel to file that. He also never said anything about the I 485. I was wondering for a while if we were supposed to file one, but I know now that we won't do the I 485 until after I am in The US.

We filed that after my I 130 was approved. At least now I have found the site that is actually giving me the answers I have been looking for. Everyone here and been amazing! Thank you!!!! :thumbs:

Ok here is my situation: I am Canadian and am married an American. We got married in the US. We send in the I 130 form. I came to Canada for a visit and was denied re-entry (Yes, I know now that was a huge mistake coming to Canada) Anyway, my I 130 is approved and my husband sent in a form (I 184 I think) so that my case will be sent to the US Consulate in Canada. My question is what we do next? I am unsure if we have to file an 1 485 or if I just wait to find out about getting my Biometrics done, and wait until I can make my appointment in Montreal for my Visa. This process has been so confusing to us. What are the best steps to take to be back with my husband in the US? My husband went to an Immigration Lawyer in the US, the lawyer said nothing about I 485, he said at this point it is just a wait. Any advise is appreciated, Thank you!

I read the link about the I 824. Thanks. I tried phoning the NVC and the US Consulate in Montreal about it. No body knows anyhing about anything. Consulates tell you to phone NVC. NVC tells you to phone USCIS. I can't phone the 1 800 number to USCIS from Canada. Because my case is not yet at NVC or a US Consulate, there is no way I can get any clear answers on anything. I need a drink. :P

We didn't file an I 485. We didn't know we could at the time. I did phone the NVC, they do not have my case.

My Canadian address is on the I 130. But we did say I was at the US address when we filed it. My husband has copies of everything in the US.

This all got so confusing and frustrating so fast. If I knew that my case is actually moving somewhere, and I knew where and when that was or will be, I'd feel a little more settled about things. Neither of the forms have been touched in a while. The I 130 hasn't been touched since it was approved, and the I 824 hasn't been touched since they sent the notice they had recieved it.

I was in the US when we filed the I 130. Me now being in Canada compicates things. Mel consulted with an Immigration Attorney. It was the Lawyer who told Mel we need to file the I 824 to move my case to a US Consulate here in Canada.

What makes me mad is that we have to wait for an approval on the I 824. It won't be automatic, they see the form and know "ok, we have to move this case" and they do. Right now this I 824 is sitting at the California Service Center and who knows when it will be touched, approved, or anything done with it. We are at a standstill.

We have no idea what will happen next and when.

I have been looking at some of the timelines of I 129F. They seem to be fairly quick.

We have an approved I 130. I am now in Canada, which messes up our situation and makes it more complicated. We filed an I 824 so that my case will, at some point be transferred to a US Consulate in Canada.

The dates on the I 824 are looking to be about 6 months. I know it's hard to go by the dates on the USCIS site. Then my case will have to go to NVC and then to a Consulate here in Canada.

What if we file the I 129F? If it can get me to the US faster, can we finish the CR1 process there? Is it too late? Is it not worth it?

I know going back with my CR1 would be very nice, but so would getting back to my Husband.

Any advice you have is welcome! Thanks!

Great! I didn't want to phone Mel to tell him to cancel the cheque. haha.

Which ever route comes through faster, we'll jump on it. If I go back to the US and on the K3 and do have to still go to Montreal for the CR1, then that's the way it will have to be. If we can finish the process in the US, that would be great. At this point we will do whatever we have to do.

I just heard from a friend on this board that it may be the case that you can't file an I 129F if you have an approved I 130. I can't find any info on it and there is no way to call USCIS over the weekend or Holiday.

Our I 130 is at a standstill right now. We are waiting for our I 824 to go through so my case will be sent to Canada.

We sent the I 129F last night, hoping this route will be quicker and allow me back to the US.

Anyone out there know? :help:

I'm worrying about that now. Mels house was passed down from his Grandparents. My name will never be on it. We can open a joint Bank Account together, I hope that will be enough. I am on his Medical Insurance and I will be added to the car insurance. I guess we will just have to wait and see what happens. We can get Affadavits from many people though.

The I 824 is a pain. We sent ours in November and it has never even been touched yet. I don't understand why it can take up to 6 months to move a file. We have pretty much given up the CR1 route and are hoping the K3 goes faster for us.

Yes. Aussiewench is right. I was in the US when we first filed. I came home to have a visit and was denied re-entry.

Back then we didn't know much at all about this whole process. We did have a few people say to file a K3 and others who said not to because the I 130 will be faster. ??? We were getting conflicting advice from everyone- which made it even harder.

It wasn't until I found VJ that I was finally getting all the info and advice we really needed.

Finding out the I 824 can take about 6 months to process is what made us file for K3. Plus with a K3- I am assuming I will go out of Vancouver for that, which is faster that Montreal.

We filed for the K3 Visa after we had sent the I 824 to have the 1 130 sent to the NVC. There has been no touch on the I 824 since November.

Will the K3 still go through? I have heard that the processing center will hold on to I 130 petitions if you file a K3.

Now that we have a K3 filed, I would prefer to take that route. I don't know if the I 824 will mess that up at all.

Any ideas?

I have been denied twice. I was honest at the border and I will be honest at the Interview. I'm not too worried it.

The first time I didn't have a return ticket and the second time I brought all I could, but they still felt I didn't have enough ties to Canada.

It says on the sheet that the Border guy gave me that I will not be allowed into the US unless I have my Visa.

We filed an I 824 to have my I 130 sent to the NVC- in my case- I left the US when I wasn't supposed to and had to go through the Visa process in Canada. We filed the I 824 in November, paid the $200. It just got approved a week ago. 9 months. It was knowing that the I 824 was at least a 6 month waiting time is what made us file for a K3.

I am back in the US now with a K3- my K3 took 5 months start to finish. The K3 path was worth it for us. Yes I have to go through EAD and AOS, but I am here with my husband and it is worth it.

We filed for my K3 after the I 130 was approved.

I guess the reason my K3 went though was because we had to file an I 824 for the I 130 to be sent to the NVC. Knowing that the I 824 alone could take 6 months was the reason we filed K3.

That stupid I 824 was finally approved after I was back in the US with a K3.

I know this is hard but be patient- at least with CR 1- you will get your conditional greencard and not have to worry about AOS.

You don't want to mention marriage at Customs- you'll probably get pulled into secondary and go through a heck of a time.

Time wise- there won't be a huge difference between a K3 Visa and a CR1/IR1 Visa since you will be out of Montreal. Most will probably tell you just to stay on the I 130 (CR1/IR1) path and not bother with the I 129F.

I understand the fact 2 Doctors told you you don't need it. Civil surgeons generally aren't very up to date on constantly changing immigration policies- they don't care if you get your visa or not. All they care about is getting you in and out as fast as possible and the wad of cash you are giving them.

In this case- do you trust the Doctor or USCIS Immigration policy?

I brought a little of everything (large family) Cologne, Leather or Snake Skin Purse (for Mom), Perfume, Necklace (gold-women), necklace (silver-men), NY hat/cap, Nike hat/cap, Leather Gloves, Nice Shirts(name brand), Coloring books with colors (kids), Ipod, Leather Wallet, Gold jewelry for the women is always nice (rings/bracelets). I tried to think of things that would be nice for them (maybe too expensive there but reasonable here). They will simply like the fact that you thought of them. Enjoy your trip and remember to document well in preparation. Good Luck!

No she only has an American Passport. We have decided to continue with K1 and if that fails for any reason then I will return to Egypt, Marry him and begin another journey. FOR NOW.....we pray that our K1 goes with out a hitch :-)InshaAllah.
