This is for the original poster: I mailed an original certified copy of my birth certificate to my fiance for her interview, but the officer never asked for it! I guess it depends on the embassy/officer!



Same here, I mailed my original birth certificate to my girl to have at the interview, and the CO never asked for it. She had a ton of other original documents that he never asked for as well, better safe than sorry. You should always have originals available at the interview just in case they get asked for... :thumbs:

I agree with TBoneTX's assessment. In the OP's case, it isn't required for the petitioner to be present, and probably wouldn't make much difference if she was there. However, there are many consulates where it can make a significant difference, and a few where it is essential. Since other people will read this thread for guidance, and since this issue is dependent on the specific consulate, it's important that any advice should be qualified accordingly. Coralie's statement is probably correct for over 90% of the consulates. Anyone should verify whether their fiancee will be interviewing at one of the remaining consulates before assuming that it is also correct for them. The regional forums are a good place to seek answers to consulate specific questions.

I didn't take pics but ours looked very similar to Ken n Kate's and we had the tabs on the bottoms because we had to ACCO fasteners on top. Ours was about 40 pages of love and joy!! :blush:

Also FYI...it's no longer called INS...now it's called USCIS.

The initial petiton (I-129F) does not require any sort of proof of an ongoing relationship -just proof that the two of you have met in person in the last two years - cell phone bills do not proove that you've met, only that you've spoken on the phone...

Best proof of having met in person is passport stamps, boarding pases from airline tickets, ATM receipts, hotel receipts and of course a few photos of the two of you together.

Phone records are a good tool for prooving the ongoing relationship, which is required at the interview stage when you will be filing for the k-1 visa. Other proofs of ongoig relationship are letters, emails, cat logs, boarding passes from flights of subsecquent trips your fiancee takes to come and see you as well as more photographs.

I recommedn that you and your fiancee read the k-01 guide. This will prove an excellent resource for the both of you and you can use it as a "checklist" to make sure your I-129F petition is complete- this will reduce your chances of receiving an RFE from USCIS.

I was under the impression that some documentation from the sealed envelope would be given to my fiancee upon entry which would be required for her later adjustment of status, but such was not the case. Am I mistaken about this or will some extra action be required on my part?



I believe they keep everything in that envelope. They open it when you arrive at your port of entry, but far as I know they don't give you anything from it. But yes, it all goes back to USCIS and will be used for your AOS.

I think more than the process which will help her obtain a green card,permit to work and permit to travel to meet her family faster, she is just emotionally a litle jittery about it,now that the interview is close by and things really are happening.

You should try to support her and convince her that all that will be surely possible with time.I think she just needs assurance(like most of us foreign fiances believe me).

I hope a little loving help will give her the much needed courage to do the move to a new country. (F)



I agree. There's so much emotions going on for her. She is leaving everything she knows behind and putting her life and trust in you. It's a big step for anyone to move to a foreign country and not be able to travel home or work. Try to comfort and support her and she'll need much more love and assurance than normal. My girl went through a very "difficult" phase a few days after passing her interview. It finally hit home that she was going to leave her family and friends. Best advice is to try and support her best you can and assure her that she will always be loved and respected.

Sounds a bit complicated and that you've probably done the right thing in seeking a lawyer's advice. Most cases here do not need the legal services involved.

The many travel stamps on you passport should be irrelevant as has already been said. You could easily say it was related to business travel. It really shouldn't affect the decision.

As far as the K1 cancellations and such; that's more of the issue for experts like lawyers to deal with and at the CO/NVC level is probably handled case-by-case. I would imagine that you will have a little bit of a longer review time than normal, just because the background has more stories than the norm. The tourist visa denial is probably nothing to be too concerned about.

Could you be a little more specific? What do you mean your "fiance was sponsor of ex girlfriend, which is now illegal"? Your fiance is the US citizen petitioner? What exactly happened with the previous petition? What do you mean "she just used him"?

What exactly was denied, and by whom? Was it the petition? Was it the visa? Was it denied by USCIS? Was it denied by the consulate? NVC doesn't usually deny anything unless something nasty came up in a background check.

Unless we know exactly why it was denied then we can't tell you what steps (if any) you can take to address it.



I'm with Jim on this, we don't have enough information to determine what happened here. If the petitioner sponsored a previous K1 and that relationship didn't work out, then he should have notified ICE or USCIS that he was not intending to marry that individual and moved on with his life. If she stayed or left the country is not his problem any longer, it now becomes a USICS problem with her status. I know there other experts here who have a better answer on the 134, but as I understand, from my previous experience with ICE, the I-134 is not a document that is enforceable as far as a fiancial sponsorship document like the I-865. The 134 is used to determine whether or not the petitioner can adquately provide for the beneficiary and that the beneficiary will not become a public charge on the US system. The I-134 is not even a signatured document.

A 2nd K1 even 3rd K1 for the same Petitioner is not an issue with USICS (unless there's a VAWA in the file) and usually is not decided at the NVC level. A waiver can be requested during the initial K1 Petition process for additional K1 sponsorship if the petitioner had previously sponsored a K1 within two previous prior to applying for another one. It may have been that the background check at NVC turned up a previous sponsorship, however that should have also been discovered during the initial petition process at USCIS. Again, we don't have specifics, so this all is just speculation.

If there was reason for a denial at the NVC level, then it is likely something that popped up during the FBI Name Check or the other background checks that are done at NVC. And still, it is rare for a denial at NVC level, usually you get Additional Processing for issues in the background check. Something is missing here.

That can be the clincher in some consulates, as they tend to apply double standards when older women are petitioning younger men and run them through a bit more scrutinuzed process. But I see this is not the OP's case.

OP: You guys don't have huge age difference. It's best, as someone else mentioned, to read embassy reviews for your country and see what experiences others have had.

CAT NAZ, he wouldn't apply for a K1 is she's already here in the US. He would have applied for an Adjustment of Status, IF they got married. No need to apply for a Visa to "enter" the USA if she's already here. A K1 Visa is only to enter the USA for marriage to the petioner. So again, you have to ask yourself if you know the complete story? You may find the answer isn't the one you want to hear.

-Did you fill out Visa forms for your K1 Visa application?
-Did you physically see a denial letter from NVC?
-Did you see any evidence of your Visa application being accepted by USCIS? A Notice of Action letter?

I have been through a very bad K1 Visa last year and am recovering from someone using me to enter the US. I'm not being mean, just you need to make sure you know what's going on, for your own sake.

CAT NAZ: the more experienced folks here are confused by what is happening as your boyfriend's story does not seem to fit normal operations for how Visas and such are processed. NVC usually does NOT do any denying of K1 Petitions sent from USCIS, the NVC is a mainly a stopping point where they perform further investigations on petitioner's/beneficiary's background before forwarding it to the respective Embassy. Usually the NVC turn around time is about a week. IF a problem in the FBI Name Check comes up (usual problems occur when you have 10 people with the same name and one may be a criminal), then you go into Additional Processing where they verify the name check issue against other data available. IF it becomes an issue missed by USCIS, such as an unreported previous K1, then the petition is returned to USCIS with the additional information for a decision. IF your boyfriend sent the petition properly (you said he has a lawyer), he would have needed to use his Social Security Number on the main document. That number is used by all government agencies to track US citizen activity. Based on that number being in the USCIS database, during the initial USCIS investigation phase, it would immediately have shown that he had sponsored a previous K1 and then USCIS would sent him a Request for Additional Evidence during the first few months of processing. I'm not saying it didn't happen at NVC, but the chances are VERY small that this is happening in the way it's being described to you by your boyfriend. Something is still missing.

Questions that you may or may not have an accurate answer from your boyfriend are:

-Have you personally seen the letter of denial from NVC?? Did your boyfriend just tell you this on the phone?
-Have you personally talked to your boyfriend's lawyer?
-Did you see any K1 Petition paper work before it was submitted? There's tons of forms that are submitted and you are required to complete a few forms as well. Do you recall completing a form number 325, or do you recall doing a letter of intent to marry?

I'm not trying to be mean, but there are some issues in this story that don't make sense. If your boyfriend sponsored a previous K1 Visa, and that beneficiary left him and became illegal, then it becomes a USCIS problem (NOT his problem) as long as he reported the issue and he's not wanted for illegal actions regarding that K1. I know from personal experience because I had a K1 disappear on me and I discussed this with USCIS adjudicators and they said so long as I followed procedure (notified ICE) then it becomes their problem regarding the illegal alien. If your boyfriend sponsored a K1 and she took off, at the most you should have received is a request for additional evidence during the K1 petition phase at the USCIS Service Center, not at the NVC level. It you want to have your boyfriend come on VJ and tell us what happened, maybe we could figure out the problem. I don't want to say this, but it sounds like,,,, if your boyfriend has been saying this has been in NVC for a year, then there may be something else going on that you're not being told.

i dont think your fiance is allowed to go with you inside the embassy premises in Manila on your interview date. only those who have an appointment are allowed to enter. i could be wrong but its good that you check as early as now.

but like most reply posts here, the burden is proving your relationship is genuine. so get lots of evidence to proof that your relationship is true.

USC's are allowed to go into the embassy with US passport. In Manila they also usually let the Petitioner hang around for the interview.

The overstay doesn't matter at all. Don't worry about that. The denials would only matter depending on the reason for the denial. I suspect he was denied because he didn't show enough ties to Australia and they suspected "immigration intent". A K1, while being a non-immigrant visa, is for immigration purposes so being denied a visitor visa because they thought he wanted to move to the US is redundant in terms of the K1 because that's it's whole purpose! Trust me when i say a denial of a visitor visa on those grounds will NOT affect him.

Whether he is approved the visa or not of course relys on your relationship and proving that you have a strong and ongoing relationship. Australia is a low-fraud consulate and while there may have been denials there, I haven't seen any in my time here on VJ.

This process seems so daunting and complicated, but with this site and people like you, it is seeming less scary. Did you do all the legwork yourself? Do you think there's any stock in me hiring a lawyer over here in the US? Reading this site makes me think I should save my money and use this as a very informative resource.

My fiance and I have been together for 5 years and met in New Orleans right before Hurricane Katrina. We've spent our time flip-flopping countries to be together and are looking forward to settling in one place and not having to worry when a tourist visa expires, etc. I'm not worried about proving our relationship at all, but was scared about his overstay and denial. My Aussie fiance and I are getting ready to apply for the K-1 and are worried about an overstay of 1 day from 2006. He tried entering Canada, but because the woman he was doing a ride-share with was denied, he was too. He left the next day (one day past his expiry date) for the Bahamas.

In 2007 he applied for and was granted a one-year tourist visa. He received another year-long visa in 2009. He was just denied another year-long visa this March.

Keeping all this in mind, what are the chances that he'll be denied entry as my fiance? Should we get married in Oz and have him immigrate as my spouse?

I'm a US citizen and spent a year living with my fiance in Australia. I was there on a tourist visa. On my G-325A, should I list the address of my boyfriend's apartment as one of my previous addresses? Or should I just list my family's address at home, where I resided before and after my trip, because it is my permanent address?

This also goes for my fiancee who has lived with me in the states at two different addresses over the last five years.

I am already claiming unemployment due to travel during these travel periods in the employment question on the form.

I'm not quite sure what to put. Suggestions? Thanks!

My fiance and I have lived together in each others apartments for the last 5 years while on tourist visas, usually at 6 month intervals. We listed these foreign residences in our G325A because both our names were on leases, and decided it looked good towards proving a bona fide relationship, etc. Depending on if you were in a home or hotel/hostel, I would list or not list respectively. Hope this helps. BTW I only just got mu NOA1, so don't know how effective my listings were... Good luck!!!

Just to be clear, I am not worried about my fiance or anyone at the USCIS doing anything negative with my account number or social security number. This is not why I asked the question. If I was worried about my fiance's honesty would I really be marrying him? And if I was worried about USCIS having my information, well that would just be silly, in my opinion, since they are part of the U.S. government who already has access to any info they want about me. But, sending off my bank balances and account information, along with my tax returns etc,etc,etc, that makes me very nervous. I was told by DHL that they would not send to Cuba when I called some months ago. I'll try again.



Hi, First of all, I would never send anything by mail to Cuba!!! I always find someone who's going to Cuba and have them take things with them. It's very common practice, everyone knows you can't trust the mail.

But more importantly, Girl, you need to go to Cuba and be there for the interview and that solves your problem of mail. It's not worth all the trouble and expense and time you've just put into this process to have your fiance be denied at the interview. It's not worth the risk. I didn't have the money or time, but as every other VJer with Cuban fiances advised me, I made it happen and I'm soooo glad I did. It's a huge testament to the validity of your relationship that you attend the interview. At the Interest Section, K1-ers with fiances present are the last to be interviewed, so we saw and heard the interviews of everyone that came before us, and those fiances or even spouses who were alone really had a tough time and I saw many were denied. Again, it's just not worth it. So, stop worrying about mail and get yourself there for the interview. You'll be glad you did. Good luck!!

I responded to you on some other thread, but just to reiterate that it's not really an issue with USCIS how you got to Cuba. I've gone 6 times through the Bahamas (If you need a good Bahamian travel agent's name, PM me) and provided all the proof I could about that, with no questions asked.... or actually, they did ask why I was there, and I said vacation- which is a bit obvious that it's not under OFAC license, and no one cares.

you mentioned something about Canada- just to clarify- don't ever go to Cuba through Canada. Canada hands over those travel records to the US government and people do get issued OFAC fines because of it. (for good info on traveling to cuba and tips on how to avoid problems, check out lonely planet's travel forum on Cuba, and their FAQs.)

I've traveled to Cuba under Bush and Obama, and things are definitely a bit more lax now. In fact, I got 'caught' my last time coming back through customs (forgot to make the 2nd entry stamp more hidden in my passport). What someone said previously here is true, never lie to immigration or customs. But you have the most gracious right to be silent and not incriminate yourself, which is what I did. The Customs agent asked me a few things (me, silent), searched my bag, and told me it's still not legal to travel to Cuba, then let me go. If that's how they're treating it on the front lines, you shouldn't really be worried about paper pushers in USCIS who just want to get through the stack of petitions on their desk so that they can go home at the end of the day.

The Consular officer will look for the line titled "total income" on your transcript. What you're failing to do is look for that line and see that it matches line 22.

Tax transcripts don't "use" anything. They simply show all the relevant line items. The line item that matches line 22 on the 1040 form says "Total Income". Find it, look at it and compare it to line 22. Yes, AGI will match line 37 but that's not the line the Consular officer is looking for.



You are just some kind of "Mr Know it ALL" aren't you??? You think I can't look on a frickin form and find "Total Income"??? Geez sorry.... we aren't so "intelligent" as you!!! I've been reading VJ for over a year and YOU seem to ALWAYS think you have the answer for EVERY thing....even when IT"S WRONG!! Just because YOUR transcript has Total Income doesn't mean EVERYONE's has it.....did that EVER cross you mind?? NO...instantly, you think your right and I must not be able to read!!! You wonder why this response seems terse..it's because I don't appreciate someone "talking down" to me like I can't read English on a form. And I know quite a bit about taxes, yet I have to hear from you telling me I can't read and I must NOT be looking at the right numbers!! If I can, I 'll scan this in and post, JUST for you!!

Well, this is what I did and suggest you do. Compare line 22 on your actual 1040 to the line titled total income on your transcript and see if the number isn't the same. I think you'll find that it is. Don't confuse "revenue" or anything else with "total income". There's a line on both the 1040 and the transcript called "total income" and on my tax returns and transcripts they match.

For an I-864, you use total income for the three tax years asked for. The recent tax year figure may or may not be the right number for "current income" for employed people but it SHOULD BE for self-employed.



I'm not confusing it at all. This isn't rocket science. My tax transcripts, all for the last 3 years, do not have Total income from lines 22 of the 1040. My Tax transcripts are using line Line 37 on the 1040 which is AGI. Not sure why they chose AGI, but I'm looking at em right now... For me, since I have a much higher income than the average Joe, the AGI minus $20K is not an issue in meeting the guidelines. But at this point, I am still deciding whether to even use my transcripts, since I have past check stubs, W2s, 1040s for the past 3 yrs, letter from employer, etc., that all state my true "total income."

The main point I was getting at was that if I were making say, a salary that was near the 125% mark in total income, and the IRS sends me a transcript with the lower AGI numbers (like they did to me), hows the CO to know if I'm making below poverty or not? I would have to explain the whole business of deductions, and total income and have proof that I actually made more than the tax transcript is stating.

Line 22 equals "total income" on the transcript, just as it is titled total income on the 1040.


I am 100% sure that my tax transcript is NOT total income and would more than happy to show you W2s and past earnings statements vs tax transcript. The Tax transcript number is about $20 K less than my total salary income number from my W2s and from my paychecks. Tax transcript (I am reading right now) says "Adjusted Gross Income"....then next line is "Taxable income"...the AGI on my Tax Transcript is nearly $20K less than my Total Gross Income.

Tax Transcript uses line 37 which is actually AGI...I just check on IRS site.
