I would say there is no doubt that photographs of you actually together will help your application. They are not vital as others have clearly been approved without them, but including them will help.

Just want to add that I don't intend to sound mean. I'm just not able to phrase things the way I want right now. I hope you know what I'm trying to say though. USCIS might just say that you can't be in a bona fide marriage at the same time you're starting a bona fide relationship with someone else. Unless you two met and were just friends until after the greencard was issued to your husband, they might not accept the situation.

Does that make sense?

Or am I just digging myself in deeper here?

Hello,

Does anyone have experience with petitioning for K-1 for fiance, after having already petitioned for green card for past husband?

I proposed this question a while back, but on the wrong forum. I have been married to an immigrant who obtained his green card in june of last year. (He was here on tourist visa originally when we met.) The marriage was pretty much over by the time of green card 4.5 years later (we were kind of young and stupid), but we didn't want to divorce until he got his residency. 6 months have passed and we plan to divorce by March (in my state, you must be legally separated for 6 months).

However, for the last year and half, I've been in love with my current fiance in Cuba. As soon as I divorce, I plan on submitting the K-1 fiance visa. I've spoken to several lawyers about this, and I think there shouldn't be a big problem, but I'm curious to know if anyone has experience with this. I guess it looks kind of shady - like I'm running a business here- but I'm NOT. And I'm frightened this may affect the success of the K-1 petition. We have plenty of proof.

Any opinions/advice/similar experiences out there?

I know this information has been covered bit by bit in the forum (I've explored a lot), but I just want to be sure I've got it all right. I've received the NOA2, and am awaiting noticias from the NVC.

This is how I think it'll all go down... Can someone confirm???

1. NVC will pass case on to US Interests Section. Will I have to submit the Affidavit of Support form and fee to NVC before it moves on? Do I need to submit anything to the NVC? I see contrasting reports on this.

2. Fiance will be informed and will pick up packet requesting the following forms: DS 156k, 157, DS 230 part 1 and 2, I-134, proof of my financial support, letters of intent to marry, and proof of ongoing relationship. Once this is complete, he'll call for an interview at Interest Section.

3. At interview, we'll pay either 121CUC or $131. (And I won't have any problems being there, however it is that I'm in Cuba???) Once approved, he'll return the next day for the visa.

4. Then he goes to Cuban Immigration for the carta blanca, pays 400CUC (is this correct?) for previously taken medical exam and 150CUC (correct?) for carta blanca. However, I read somewhere that the total cost at this point is $850 - which is correct?

5. Once carta blanca is received, they scope out his home and confiscate his things???? He lives with his mother, in her home. How will they differentiate what belongs to him and what belongs to her? Should he relocate things (like tv/dvd) to another house for awhile?

From all I had researched before beginning my K1 process was that the USCIS does not communicate these things to OFAC, where the Cuban embargo law technically lies. We're nearly to the interview, and I submitted lots of incriminating evidence as my proof of relationship, yet was still approved in the first steps of the process. I'll also be attending the interview, and from the feedback I've read on this forum, I won't be questioned as to why I'm there, either. If I experience differently, i'll be sure to post it after I get back (mid-november), but everything I've read here (and even consulted a lawyer) was that it should be ok.

Hey y'all,

Thought I would share... Something I'm just dealing with now, after expecting my fiance to come in a few more weeks, is a new change in Cuban immigration. Instead of visiting the Cuban's house to potentially confiscate their house and things, they're now requiring proof of ownership of the person's house. (In our case, it's his mom's house.) Which is great that the communists are learning efficiency, but still ridiculous in their procedures. Be careful, they're telling us this will take 30 days... at each office. So if your fiance has moved fairly recently, in our case the last 2 years, they're requiring the document for current and past residences and they'll only do one at a time. (i.e. he goes to the centrohabana office, where he used to live, and waits 30 days and then goes to the Playa office, current residence, and waits 30 days). If it sounds totally ridiculous, it's because it is. we'll see how much they might accept to shorten the time...

At immigration they also tried to convince him out of the whole thing, and then to get a temporary salida instead of permanent. Can't these people just let him go????

Let me know if you've dealt with this and/or have any ideas around it.

i suggest while waiting prepare the necessary docs like the i864 requirements ( tax transcripts from IRS usually mailed from 2-4weeks to save time), paystubs, certificate of employment, 2x2 picture ( 4pcs. at least ), birth certificate, marriage contract, nbi and police clearance so that when u get the forms all things are set and all u need to do is pay and sign upon receiving forms. so it wont delay your timeline. take it from me.. its a good thing inspite me having a lawyer, we are still consulting visajourney and this threads here are very helpful.

Do we need TAX TRANSCRIPTS? I thought 3 year W2's and 3 paystubs etc would be enough?


WHat is 'nbi' .............sory for all the questions. I just got my I-130 approved so I am trying to be as proactive as possible. If someone can outlien any other shortcuts or common mistakes duringteh NVC process, I would greatly appreciate it (or point to any other links)

addition i always call NVC at least twice a week for update using the touch tone You may contact NVC at (603) 334-0700 dial 1,1,1 until it prompts u to your old USCIS case no for example in my case WAC (4) then i dial my 10digit no then press the # and then 1 if its correct, the touch tone operator will give u feedback or updates for your inquiry..

you have to add the money up to meet the poverty requirement anyway
Bank statement is NOT a requirement of form I-864, bank statement is only needed if using it as an asset.

Keep in mind we are not talking TAKE-HOME pay, I-864 uses gross income BEFORE Tax, and Deductions. Most people in the USA make well above the povertyline.

If including pay stubs, 6 months is considered to be over-kill, just a few recent ones are fine.

according to the attorney assisting us you can also get ssa statement for additional assistance.

we just got finally finished sending the i864 and ds230 forms sent to the attorney. due to lack of financial support we have accomplised co-sponsors federal tax (2004-2007) employer letter, paystubs, etc.
sponsor - no single tax due to low income ; waited for ssa statement (no earnings ) too.

now the issue kicks in. will this be a problem my father who is my co-sponsor earns rough estimate of $50,000/year is this enough evidence

that i wont be a public charge to united states? any other options thanks again. wish me luck ill have my biopsy surgery done because of the big lump mass found on my left b*east.

scheduled on friday 03.14.08 will this be a hindrance too during medical need help and enlightment. helpsmilie.gif

Lawyers can make cases complicated. My lawyer has delayed my case by 6 months already. He had my husband submit the final paperwork for the NVC. My husband paid $100 to ship here, took a month to get here. When I put the paper work together to send to the NVC the lawyer never requested the DS230 form. He has made so many mistakes on my case. I agree with Lurking.......my lawyer also delayed my process by about a month due to a delay in sending my payment in...urggggg!!! they mean well, but they'll never take it as urgently as you will. Now your case may need some professional expertise....up to how you see and feel about it.

Dont get too worried, the RFE might take 2 weeks to be updated in the system, maybe more. It has to get there first then get sorted out in the mail room, then routed to the agent, and then for the agent to pick it up and make sure it is the missing evidence required. Give it just a little more time, and from now on to put your mind at ease about these things have your lawyer send in your documents in a manner that provides you with delivery time and day. You will atleast know that it got there ok. your almost done and if you have to wait a few more weeks atleast you know its only a few more weeks. good.gif

rfe missing pic already sent still no response from NVC, im getting worried about the last update of my ds23o rfe was of 3/28/2008 and we received the rfe notice last 4/14, right there and then since we called the nvc operator and sent an email i made sure what was missing ahead so i can prepare. now when we received the notice that same day the attoney mail in our missing rfe and after calling NVC after 6 days of waiting still the response has not changed. STATING WE REVIEW YOUR DOCUMENTS AND WE FOUND MISSING ...WE MAILED THE LETTER ON 3/28/2008 im getting worried about it, and im praying that we can finish the case before the end of the month so if possible we can still get on MAY interview.. i need enlighten or any help regarding this matter , is highly appreciated thanks

It depends on the consulate. Typically 1 to 2 months ! Chennai U.S consulate is the most crowded in the world. Some time back there were 500+ applicants per day. Chennai normally takes 1.5 to 2 months time after NVC case complete.

thats what happened to me and i dont want that to happen to you so make sure you follow nvc guidelines for the visa photos write ur beneficiary's full name, route (example: k1, cr1), and then the case no. star_smile.gif

uscis approve - u will received i797 notice of action
noa approval2 - uscis approved your i-130 route
uscis sent ur petition to nvc and u may call after a week or 2 (bussiness days ) 603 334-0700). ( press 1,1 and 1 and key in ur uscis case for example wac its press 4 and then the 13 digit no. so u can be advise about ur MANILA CASE usually it will be MNL2008******
NVC request petitioner to pay fee bill and ds23o forms
when they received payment, they will send the actual i864 forms ( make sure to ready ur w2s, cert of employment, pay stubs within the past 3 years prior to the petition so thats 2005,2006,2007 u may call now IRS to request one for tax transcripts)
nvc receives the i864 and pass the poverty guideline they will send the ds230 checklist
make sure to ready your wife/husbands NSO BIRTH certificated, marriage contract, nbi clearance, and police clearnace, visa photos with white background 6-10 pcs at least make sure to write the full name, the visa type, case no
after further review case complete

doc verification is only applicable for philippines however it it better not to undergo this because that means your case is in administrative review sometimes it might take a month or 3...

Hi Dennishiella, usually NVC generates DS 230 on Mondays (mine was Apr/21), so I asked my husband to keep calling NVC to get a date from them since we would be using JSC to generate our barcode coversheet and they confirmed it as Apr 21. I was sure that it would be a Monday date since I had read many posts in here mentioning that they generate DS 230 on Mondays and they did so. Keep calling them untill you get a date from them, they will let you know for sure! good.gif

Usually NVC schedule interviews second and third week of the following month.

try to email nvc just follow the nvc email format procedure and thats how i get my schedule and since you were able to finish case this month you will be schedule roughly 1st or 2nd week of the next month which is july =) good luck and congratulations. kicking.gif

in my case when i got the packets from nvc even just the scan email ..they would accept it tell the guards its a scanned copy..sent via email..show them passport ..bring the 2x2 white background photos with u (2 on the first day) 3 on the 2nd day..better bring extra just to be sure...
if jean has xray done last 6months ago she can bring that..=) thats it ..if she has operation done before i brought with me some medical certificates, for the chicken pox vaccine just show jean chicken pox scar..medical is very easy dont wory i suggest go there early when i went there at 6am im already at queue 75...bring the medical fee (convert it to peso so most likely bring 10,000 ( that includes her transpo fee and food )=)

the paperworks seems like an rfe..because she did not ask the evidences during the interview...so the releasing officer hand me the pink slip with the white paper slip that states if u completed this forms/docs pls submit to window __-.. at the back of my head i already have the paperworks with me so i guess..dont need to go back just to submit the docs..so after the releasing of docs..the releasing officer kept my passport (handed him the rfe docs that the consulate was asking before leaving the premise of usem) asked me to pay the delivery fee...( im just so anxious if theres anyone here in visajourney experiencing payment of delivery fee without a visa on a passport)am clueless...am i denied?any help is highly appreciated thanks
