I would think someone is confused - perhaps January was the NOA2/Approval Notice (from USCIS) and Feb.08 was the letter/notice from NVC. The US Citizen/Fiance should contact NVC to be certain the package has left.

Hi everyone. I am seeing some back and forth over November filers at CSC. I happen to be one of them. Filed at the California Service Center and received my NOA 1 on 11.12.09. No word since then, still in initial review. Anyone know what might be going on? Should I be worried that there has been radio silence since then? Anyones insight would be much appreciated. Thanks!



No insight to the USCIS madness....I'm just convinced it all rests upon which adjudicator's hands your petition falls in. I think we all really are at the mercy of the "human" element and individual work ethics. I was a federal employee in the Pentagon for 12 years and have seen first hand how the human element affects decisions when those decisions are based on indiviudal objectivity. Adjudicators can take however long they want and can practically ask for anything to consider their case complete. Almost no firm deadlines or rules to each adjudicator, just the "goal" of K1's in 5 months.

Man, I hope the November filers don't find out about these rapid NOA2's... Ever read their thread? They're tearing their hair out because some early December filers have gotten approved. If they see that a January filer received their NOA2 they'll lose their minds...

Yeah, I been following that one too. So far, most of the early approvals have been military expedites. I think this is a non expedited one (but possibly is ??), which is really going to make December/November (and so on)... people loose their minds. :wow:

One of the biggies I've seen to raise a red flag is admitting to the physician the abuse or use of illegal drugs at any time. It's my understanding that it could cause one to be denied a visa and or determined inadmissible to the US depending on the circumstances.



I've read in some instances where this causes delays.

I just put my parents' address. I'm pretty sure you can make address updates later on, and use the new address after the fiance enters and you apply for AOS.

Yes, I think it's best to have some type of address listed, even if it is your parents address. I think leaving it blank or TBD will raise some eyebrows at the embassy during interview. You can always change your address later.

Also check out this flowchart as it gives time estimates of each procedure. Be aware that you are asking the million dollar question. It can take 3-4 months or a year depending on multiple factors. Some people have applied for K1 in Oct 2009 and are still waiting for their NOA2 while some folks have filed in Nov 2009 and are Visa approved and in the US already. Prepare mentally for a long journey and be happy and thankful if you get it done in less time than planned.

Did you have to pay any money to join the site? Is the site's sole purpose matchmaking? It could qualify, but I'm not the expert here. If you met on a social network site like Facebook or Myspace that doesn't charge a fee and their main purpose is not matchmaking, then those are not considered IMB sites.

I have the exact same response date as you and I just got touched yesterday and I havent been touched or any action since Jan 17th. And you are from a western country ( your fiancee) mine is from Algeria and we all know what that will mean in terms of a delay ( NIGHTMARE) If its taking someone like you , young and both from western countries... egads .. what does this mean for someone like me dealing with a north african country. Then you get the vermont people whining about a 2 week delay when it takes a woman marrying a BRIT 92 days to get a NOA? Something is very very very wrong. They need to redistribute californias work load to vermont and redistribute the cases. ITs just not fair that one center gets things done in 20 days while the rest of us languish :crying:



Of course they will not redistribute the work load. I bet the people in vermont are loving life and doing 1 case each a week. :lol: :lol: They are government workers and we all know government workers do only what they have to. So they probably do not want to cases to keep their load light.

Hi everyone

I had a strange Case Status Information update by email today.

We were sent the IMBRA RFE earlier this week and my fiancee is signing it on Monday (she is returning home after visiting me in London), so our attorney will send that back to USCIS on Monday too.

I called the USCIS customer service line and they told me that our case had been approved, but that the IMBRA RFE was just holding up our case, much to our horror as our wedding is on November 17th 2006!

Today, I received the following by email:

"On July 7, 2006, the document we made based on the approval or registration of this case was mailed directly to the person to whom issued."

Given that we haven't sent back the RFE just yet, and that I know our case has been approved, then what on earth does that mean? Does anyone have any ideas?

Also, who wants to place bets on the likelyhood of our K1 going through?! Don't worry though, we have a back up plan if it looks unlikely but the K1 route is our preferred way of doing things.

When I called USCIS some time ago, I was told our application had actually been approved but was on hold because of the IMBRA process.

Here is what my attorney said (my fiancee lives in New Orleans):

They sent (beneficiary) a copy of the RFE to her address and it was returned. So they sent it to me (the attorney) and asked me to fill out a change of address form. But I am not going to do that because that is her correct address that needs to be on the form - she is just not getting mail there (because mail is still not working in New Orleans!). Since I get all the originals of all correspondence from Immigration this is not an issue. This has happened in many of my cases post-Katrina and this is how I have handled it without any problem.

This is quite a specific case but it might give further clues!

I did this in advance as it takes 40 days (and it did take 40 days in my case). Here is what I did.

1. Visited my local police station and asked for a subject search form (actually you can download these forms from most police websites in the UK)
2. Completed the form and took a cheque in person to the police station, payable to whoever is stated on the forms for 10 pounds.
3. Took sufficient ID with me (e.g. passport, drivers license) They take a copy of the ID and give the ID back to you, so all you lose is a tenner!

Wait wait wait

And then a letter pops through the post from, I think, New Scotland yard with a blue header stating that there is no record of you on their criminal databases (at least we hope so!).

Easy peasy

Hi 'russell'

Funnily enough I am marring someone in November from Louisiana (New Orleans) and I am from the UK. We applied for the K1 Visa in March (received NOA1 beginning of April) and we are still waiting for NOA2 having sent back the IMBRA RFE in July (acknowledged on the 10th).

We are marrying in November and have 500+ people invited to the wedding from all over the world so we cannot afford to miss this date. As you can imagine, the K1 process has caused us a huge amount of stress because of the timescales involved and in particular the IMBRA delay was a huge pain in the a***.

The fact of the matter is that you cannot speed up the process, you cannot lie about the situation because you risk screwing up your ability to so much as visit you loved one, and you cannot rely upon gossip you read here (with no disrepect to anyone) because every case is different (circumstances, location of beneficiary etc). There is no one attribute you can rely upon to estimate when you will be approved. I see approvals every day from those from countries I would class as less of an aly than the UK and who applied for K1 status after we did - I just know there is no rule to this process anymore, you simply have to wait, or shout a bit.

We don't even have an official approval yet so we are going down an alternative, perfectly legal route which I do not wish to disclose here but we are still hopeful that within 3 and a half months I can be in the country on our original K1 Visa petition which would give me the advantage of being able to naturalise in 3 years as opposed to 5.

I appreciate you do not want to do anything untoward and therefore I can only suggest the following.

- Email the London Consulate and enquire about your position. LondonConsular@state.gov, they are very good at responding and they might be able to assist.
- Contact the NVC to see where they are in processing your application (check out their website for email details etc).

Do everything you can this coming week to ascertain where you are before moving the wedding date. Believe me I know what a pain that can be. I for one have a lot of people who have already paid for flight tickets to the USA in preparation for the wedding and they had to do this to keep costs down etc. For us, moving the date is not an option so we have had to look around that. If you are not in a position to be able to apply for alternatives to the K1, as we are (and do research this), then look at ways your local consulate or your petitioners senator might be able to help. All I am saying is that you may achieve nothing, but you have NOTHING to lose by trying.

We allowed 8 months to process the K1 Visa based upon the information we knew at the time. I am sure we all know now that booking a wedding date in advance is not a good idea, but it is a catch 22. We had to invite a lot people, and had to arrange an awful lot and we did not want to start arranging everything AFTER I had arrived back in the USA as this would have meant we could not marry for a long time. Let's face it, we are in love and want to be together as soon as possible. I read one post which was very true, and that was if I were in jail I would get visitation rights! As a K1 beneficiary, I am banned from seeing my fiancee unless she spends a fortunate on a flight ticket to the UK and spends time here with me. This is unfair but unfortunately a fact of life we both have to deal with.

I for one am definately not travelling to the USA until I have been issued a Visa based on the honesty of information I have provided and upon acceptance from the USCIS, NVS and the London Consulate. It is simply not worth risking anything. I know the lady I want to marry and want to spend the rest of my life with, and we are prepared to wait as long as that may take. I understand this process is frustrating and I too check the USCIS website for updates daily (sometimes hourly!) and check my email for touches but at the end of the day we cannot change the way USCIS operates (huge protests or otherwise! This is a goverment organisation, come on!) and there is no way of acclerating anything other than trying to contact who you can - which I accept may not amount to anything, but why not try and explain your circumstances and see what happens?

I can only hope that your interview pops up soon (send a mature email to that address above, it may help) and I wish you and your fiancee all the best.

Let me make this as clear as I can! :)

The L1A is designed, in my case, to allow me to open up a new office for my business in the USA (which I have, plus bank accounts, tax ID, new LLC company etc) and work in the USA. Believe me, I wouldn't have invested in office space and a new company were this not the case! Nightmare! I have even had to source staff.

My purpose for the Visa is to expand my operations into the USA, not to marry.

Now, on the side, it just so happens that my fiancee lives in the USA and we are getting married in November! The L1A Visa carrys no 'intent' issues with travelling to the USA with the intention of getting married, I guess because I have already demonstrated to the USCIS that I have commitment to get a company running there. and that it is for my business purposes that I need the L1A, which I do.

The L1A application process is complicated and required significant evidence to support my application, I had to show proof of my UK operations and proof that we had set up office space etc in the USA. We were as thorough as possible and employed an attorney to ensure the USCIS had everything they need.

The other advantage of the L1A is that after we marry, we can go anywhere on our honeymoon without the need for advance parole. I can also apply for AOS as usual.

I am just rather fortunate that I had intended to expand into the USA before having met my fiancee. We initially went for the K1 route because of the lower costs and because of the 3 year naturalization advantage, and I was at first prepared to hold fire on my expansion into the USA because of this. But in the end the L1A turned out to be the best route for us, and my business.

The disadvantage is I now have to wait 5 years to naturalize, but I am quite prepared to wait 5 years for that.

Hi everyone

I guess I shouldn't strictly speaking write this here, but I just got approval on my L1A which I ended up filing in desperation because the K1 was not going to go through in time for our wedding.

The L1A was filed, quite genuinely, because I am expanding my business into the USA and it was approved in 10 days. I appreciate I am very lucky to be in a position to do this and I understand the frustrating in waiting for the K1, believe me!

We applied for our K1 back in March/April and still had not had an approval. Our attorney recommended I do the L1A because I was to run a business in the USA anyway, and it turned out to be the better option for us in the end. It wasn't cheap, but for a 10 day approval you can't argue given the stress the K1 has caused us (all!).

I just wanted to share the good news and wanted to wish everyone else the very best of luck with their K1 journey.

We were approved on the 15th August, but due to changes in my career circumstances I am off to the embassy next week for an L1A Interview instead so my attorney had sent a cancellation about the K1 on the same day. We hadn't expected the approval and had been waiting since March!

Why take the risk? Go and take some proper photographs and ensure they meet the USCIS requirements.

There is no point in cutting corners with your K1 Visa. Get everything as complete and thorough as you can. You'll only end up worrying for weeks otherwise. If they do reject your photos, you'll have wasted weeks.

Too many visits on a Visa Waiver are frowned upon. If you do it too many times, a disgruntled immigration officer *could* deny entry.

I entered 3 times on my Visa Waiver. On the last time I did it, they asked a lot of questions and I opted to stop my visits until I had the K1 Visa in hand, just to be on the safe side. Once you are turned away on a Visa Waiver, I believe you lose that right for a long time (i.e. to enter on Visa Waiver again), which could cause problems with the K1 application.

But every case is different. The difficulty in answering this question is that there are really no hard and fast rules surrounding re-entry over and over. It really is at the discretion of the immigration officer as to what she/he does.

We solved the problem by my fiance visiting me in the UK instead and we never missed a holiday! We just didn't want to risk anything given our firm wedding date.

I too had a minor speeding offence on my record when I applied but my attorney advised me I did not have to report it. I didn't and nothing came of it as expected.

Also, when applying for my police report (I did it from two counties I lived in) it did not show up either.

Inidentally, my license is now clean, but that doesn't matter now I live in the USA! Your clean insurance and driving history mean nothing in the USA - he he! Sometimes it feels like being born again...!

Many people have done it successfully. Everyone else didn't want to take the 'risk'.

I personally did not visit my fiance during the Visa waiting process because of the fact that there are no hard and fast rules at immigration when entering the USA. If the immigration officer doesn't like the look of you, you can be sent back to your point of origin. I simply didn't want to risk it.

Theoretically if you come with sufficient evidence to show you have ties and reasons to go back to your home country, you should be ok, but don't quote me on that! If your fiance has visited the USA a few times on a Visa waiver, that will throw up red flags too. The last time I visited on a waiver, I was questioned quite a bit because I had visited 3 times in a year. They didn't send me to 2nd line, but it was still quite intimidating seeing as though I wasn't actually doing anything wrong.

I may, of course, have been over cautious, but went with my attorneys advice and decided not to travel during our K1 process. This was emotionally difficult because I missed my fiance (now wife!) a lot!

I've heard people for and against this argument. I don't think its about scaring you, I just think you need to consider the risks involved, and consider that professional attorneys have on many occasion simply said - don't even bother risking it.

Instead, my fiance came to visit me in the UK and we had an equally great time together!

I think we paid about $2,000 for our attorney. We did this because we wanted to make absolutely sure we had the forms correct. One mistake and they'll generate a request for information and you're delayed a while.

That said, there is absolutely no reason why you should use an attorney (other than peace of mind) if you are capable of completing the forms yourself, which aren't all that difficult. There is plenty of information on this website to show you how to do it and plenty of couples willing to help you with their experiencing of answering particular questions.

We have spent so much money of attorneys now it is ridiculous - and we keep using them for peace of mind. So far no hiccups, but we could have done it ourselves too.

Bear this in mind, when applied for AOS, I went to visit the attorney. We paid $2,500 for the priviledge of using them, and found out that they just type your information into computer and it automatically spits out the completed forms. They completed all the work in about 4 hours maximum. I was quite horrified. Then they had the cheek to send me a bill for $5 to cover postage!

I won't be using an attorney going forward, I will just make sure I give myself enough time to complete the forms properly, but when we had a wedding date fixed in stone, we wanted to take every precaution possible.

I also applied for an L1A and submitting about an inch half thick stack of paperwork, again the attorney did very little. They checked it over, slapped a cut and paste cover letter on it and posted it off. Most of it isn't rocket science, it really isn't.

Like others say in this posting, if you haven't got any strange circumstances and you feel confident enough, then why not put that $2,000 in your pocket and do it yourself?

Alternatively, you might be able to pay less if you ask an attorney just to check over it before you send it, rather than compiling it all for you. Just make sure you get all of the latest forms from the USCIS or Visa Journey website, don't rely on forms you find elsewhere on the site.

Our K1 took almost 6 months, so their current timescales are not unusual. Many people I used to chat to on here had to wait much longer too. It really depends on your circumstances, filing location etc. There is so much going on behind the scenes that we cannot see - frustrating I know, but you just have to learn to live with the system and put up with it. I learnt to be patient by going through the K1 and L1A process!

This may be a foolish question but I am just wondering if it will possible for my fiance to travel outside the country during the period immediately after we are married. Other than the legal wedding ceremony, what else would have to take place before he is permitted to travel?


We asked the same question too. We went to San Francisco and then to Maui. Maui/Hawaii is in the USA and is a fantastic destination to go to. We were originally going to get married on a K1 Visa, hence why we booked this trip.

In the end I came in on an L1A Visa due to a work commitment and we could therefore have travelled anywhere we wished (and we went on a cruise to Mexico without a problem) but we still had a fantastic time in Maui and would recommend it as a Honeymoon destination.

My advance parole took a few months to come through, so the USA honeymoon was our best option and I'm glad we did it.

We celebrated our first wedding anniversary this weekend!

When I moved the USA I had the opposite situation, but which might be beneficial to you. When I applied for a mortgage here, I found that my UK credit history was null and void over here. I had a very good credit history in the UK, but even though Equifax (for example) are an international company, they have different records and different credit scoring methodologies in the UK and the USA.

I therefore had to start from scratch, opened credit card accounts, got a cell phone etc and move my UK accounts to the USA. I will have to wait quite a while to get the score I want, but so far so good, I have a healthy and clean USA credit file.

My reason for mentioning this is that you *might* find your credit history have to start from scratch when you live in the USA. Once you get a SSN and start to get credit you should be able to get a good credit file.

Please don't quote me on this because I don't know this for sure, but I certainly felt like being born again when I came to the USA to live smile.gif Its a little frustrating but at the end of the day its a different culture/country and people are identified by their SSN (differently to the UK system) so it kind of makes sense why it is all disjointed.

I am not sure if significant credit problems are reported internationally though.

I would say there is no doubt that photographs of you actually together will help your application. They are not vital as others have clearly been approved without them, but including them will help.

We included about 6 photographs of us at various different locations and added captions to each.
