One more question related to this topic--

My husband is filling up a new I-864 according to the two jobs that is now working that will be submitted for the interview. His projected current annual individual income is $21,620. We can also show assets about $4000. Do we still need to worry about the joint sponsor because my cousin is being absolutely uncooperative so far(he is refusing to send me a copy of his AOS package for the interview citing privacy reasons. This means I will not have his 2009 taxes and I'm certain those will be asked for since our interview is in May and it wasn't submitted to NVC).

Yes, I will have my FIL's stuff as backup at the interview. I just am wary of changing joint sponsors at the last minute. I have no idea what the repercussions would be if that were to indeed happen. Would they automatically throw me into AP? Would they not accept it then and ask me to submit it through VFS(visa facilitating services through which documents are to be submitted 10-15 days before the interview)? Would they review it right then and there?

I honestly have no idea what happens in a situation like this. Any suggestions/ideas? I'm all ears. This is causing me far too much grief at the last minute.

From my understanding though, if the job is very recent (he started beginning March so he doesn't have too many paystubs but he will have an employment letter by the interview date) the consulate will often ask for the Joint Sponsor.

So in this case, I would like to have my FIL's documentation as a back-up in case it is required.

So what would you suggest we do in that case? Have 2 I864s prepared by my husband for the interview? One with just us 2 as the household and the other one as 3? Or does it not matter?

21g - This question gives you the option of including certainother non-dependent relatives who are living in your residenceas part of your household size. Such relatives may includeyour mother, father, sister, brother or adult children, if they areliving in your residence. However, the only reason to includethese family members in your household size is if you need toinclude their income when you calculate your householdincome for purposes of meeting the income requirement forthis form. To be considered, any relative indicated in thiscategory must sign and submit Form I-864A.

--From the I-864 instructions, it would seem that only household members whose incomes are been included to support the intending immigrant would be listed in the household size, irrespective of who actually physically resides there.

Am I reading this correctly? Please reply!

I have a question and my brain is just not working after a stressful night. Please bear with me.

Due to certain issues that will take too long to get into here at the moment, I will be changing my joint sponsor at the interview from my cousin to my FIL. Now as I understand it, he will fill an I-864A as my husband is currently living with his parents till I get there and we can get our own place. His mother doesn't work, so she has 0 income but his dad makes more than enough to cover around 30 people.

My husband will also be filling in a new I-864 as he as a new job and the income takes him over the required guidelines (but we'd like to keep the FIL as a backup since this new job is very recent). For his I-864, for number 21g--will he put 2 for BOTH his parents as household members (since they both reside in the same house) or just 1 for his father whose income he IS actually combining. FIL/MIL file taxes jointly but thanks to Pushbrk's earlier advice, we know what to do in that situation. His father will then sign the I-864A but not the mother as she is not listed?

Do I have this correct? Or can/should my FIL file a I-864 since he qualifies on his own? I'm just confused regarding the household size--what will my husband's be now--3, 4 ? on the new I864?

No, EP is where everything is sent electronically. Even the packets are scanned as PDFs.

Only China and Canada have that option, apparently.

The rest of us have to send it in via postal mail.

Germany doesn't have an EP option.

Irrespective of that, you NEED to give them your email addresses to start the process.

They will send you the AOS/DS3032 links in your email.

Pay attention, non-EP NVC noobs. Here's Christeen's time tested formula to get you through NVC in one piece alive:

Petitioner: Get NVC # + give operator your email IDs + receive AOS fee bill + pay 70$ online + wait to show paid + print cover sheet + send I-864 AOS with all documents and case # written on each page.

Beneficiary: Get NVC# + receive DS3032 + send DS3032+ DS3032 accepted + IV fee bill available to be paid + pay & wait to show paid + print IV cover sheet + mail DS230 package with all original/certified documents

= wait for case complete + wait for interview to be scheduled.

Suggestions:
1) Have the beneficiary mail SIGNED extra DS230s to you so that you have them handy in case something goes wrong. Or you get hit by a dreaded RFE.

2) If you just received your NOA2, THIS is the time to get your tax stuff and police certificates sorted out. Don't waste time on this.

3) Double check the PCC requirements in the regional forums as they are country specific.

4) Check the pinned STUPID RFEs thread in IR-1/CR-1 forum.

Currently the # of business days NVC is taking:
3-4 days for NVC to receive your case and assign a case #.
3-4 days to receive emailed links after case # has been assigned and email addresses been given to NVC operator.
1-2 days for the AOS bill to show as PAID.
1-3 days for DS3032 to be accepted.
1-2 days for IV bill to be PAID.
8-11 days for case complete after all your documents have been sent in.

Might be busy. Keep trying. Get through to the AVR. You will need your CIS receipt or NOA1 number. Type it in, it will read out your case number.

Then talk to an operator and give them your and your spouse's email address.

Yeah, thanks, I missed that line when I skimmed through it. Just saw it.

My joint sponsor has said that he doesn't want his wife to get involved in this. Probably doesn't want to extend any liability to his wife. So I was just wondering about what to do. I can't push the issue b/c he's been nice enough to agree to do this in the first place. It might be asked for at the interview right, not at the NVC stage?

IMO, should be fine. What pushbrk said makes sense. So I'll just go along with that. We'll see what happens, I guess.

I just realized there is a form called I864EZ.

1) This is for support ONLY through individual income?

2) Can a joint sponsor (living in a different household than the petitioner) fill this up?

3) If yes, and the joint sponsor is married and/or files taxes jointly with his wife, is a I864A still required even though his individual income is WAY above the required levels to cover his household?

We met in college in NY where we were doing our undergrads. We started dating in February 2008. He proposed right before graduation in March 2009 and I accepted because we didn't want to go our separate ways after graduation as is what happens with most college couples. I met his parents on two different occasions. We could've gotten married in the U.S. and filed for AOS as I was on a valid F1. However, I wanted him to meet my parents/family/friends before we tied the knot. So I came back to India and filed the notice for marriage and he came to India in August. His parents weren't able to come down because his father was in-between jobs and had a lot of interviews lined up and it wasn't possible for him to shell out a lot of money for his family to come to India at that point of time. We couldn't wait because as you may or may not know Indians are superstitious about wedding dates/days and they are marriage seasons and so on. We got married on the last auspicous date of the month. We decided to do it this way, get married in India first and then once I went back we'd have another wedding ceremony for his friends and family. And our college friends, of course. I have a picture with his parents when they came for graduation and they have both written separate sworn statements testifying to the legitimacy of our relationship and the details I just mentioned. I also have statements from our friends in college.

Now, given our history, what do you think? Should I get another joint sponsor? I might have another family friend (no relation) who probably would, if I asked him and my husband has met him as well. I find that most people are hesitant to become joint sponsors because they don't really understand that is not a big deal. Those who've gone through the process are much more willing to help, in my opinion.
