Thanks for the advice after my bad attitude, I just was not prepared for a no answer, I guess I should have been less optimistic, but I also could not ignore her emotions that triggered me.

I knew the circumstance of her previous B1 Visitor and she had all supporting documents about that case with her and if the matter was a concern to the VO she was prepared to present artifacts about that case to the VO but he did not want to hear or take any of our standard evidence after he asked 3 questions and look aimlessly for 5 minutes before handing the white slip.

For whatever it is worth sent fax of a long letter I wrote to Guangzhou detailing her previous B1 case and how that should be a concern when I am her sponsor and all the evidence she tried to present for our case was not looked at. I did CC: my Congressman. I don’t expect anything action from this and expect my letter will be ignored.

Yes, planning to just marry in Chongqing 1st week of September. Sorry again to all.

I hope you are able to overcome this obstacle and be reunited soon.

If your divorce was just finalized, then at the time of filing you were clearly not free to marry.

That is enough reason to deny the K-1.

How many times have you met in person? How much evidence of relationship was provided? Any difference in age? Disparity in looks? Difference in educational/social backgrounds?

I know meeting while still not formally divorced is a red flag in Vietnam--could possibly be the same in China? I don't know.

This is simply my personal opinion, but I always recommend against providing money receipts as proof for K-1s. To me, it just looks odd. Remember, they are still your fiancee, not your wife.

Darnell should be able to help you out. He is very knowledgeable about China, as is VJ member Pushbrk.

And yes, please, don't play the 'race card' -- it is highly distasteful.

I'm not too well-versed with all things J-1, so do take this with a grain of salt.

--You will require a waiver to waive the 2 year home-residency requirement.

Is she still in the US? If so, she can go to the Chinese embassy in the US and ask for a No Objection Certificate--I think that's what it's called.

If she has returned to China, she will have to go about it from there.

No real point in filing for the K-1 unless she has the waiver -- otherwise, her visa will simply be denied.

(Maybe someone else can clarify if the waiver can be submitted at that point -- the visa denial?)

The 90 day is not for you to 'test out the relationship' -- when you sent in the petition you signed letters of intent that indicated that this relationship was going to culminate in marriage once the beneficiary entered the US.

No matter what others tell you - and there are plenty who will - the K-1 is simply not a "try it and see it how it goes" visa. Try telling that to a CO and see just how fast your visa is denied. The 90 days is for you to sort out the logistics of the wedding. It is solely for people who are absolutely committed and convinced that they are going to get married. Sounds like you're not really sure.

She is playing you like a fiddle. Pull the plug while you can.

You're not marrying some American blonde chick you met at the local bar or at a neighborhood ice-cream social.

You're seeking the permission of the U.S. government to let in a foreigner. From Macedonia. And you were once married to another woman from there. Who also came in on a K-1 visa.

Immigration is not a constitutionally protected right. It is a privilege accorded to you, as a USC, to have your SO live permanently in the US simply because you fell in love with them. Your SO, who, one day will probably become a USC as well. So yes, it is very much the concern and business of the US government to protect themselves from potential fraudsters and other threats to itself and its citizens.

Frankly, you're stuck between a rock and a hard place. I know what I'd do if I found out that the fiance I had been in a loving relationship for three years had been previously married and I was blissfully unware of that salient point. I also know what I'd do if a Consular Officer chose to reveal this very pertinent fact at a visa interview right before I was supposed to move across seas for a man I was supposedly in a sincere, committed relationship with.

The expiry date refers to the validity of the visa--that is, she could've used it to enter the US (for the first time) till December 8.

If she returns now without filing for AOS, you will have to marry her in Ukraine and file for the CR-1. That will take at least 8 months to process.

My interview was for less than three minutes and NOTHING was asked for. I even offered some pictures and phone-bills after my visa was approved but the CO didn't want to look at it. :( What a waste! I had compiled such a pretty wedding album and was hoping it would elicit at least an obligatory, "aw, what a cute couple you make!"

BUT that giant bag of paper-work weighing atleast 12 lbs in my hands gave me the confidence that I needed to NOT ####### my pants that morning.

But I did have a lot of copies of the marriage certificate, bank account statements, husband's passport copy, notarized affidavits, taxes, important stuff like an updated DS230, I864 etc.

While we don't know the details of your medical condition and how serious the extent of it is, the 'cultural' reason is simply not going to fly. I am a Hindu myself and nowhere in the religion is it absolutely forbidden to meet before marriage. I have attended countless Hindu weddings (including arranged marriages) and all of the couples had met each before the wedding ceremony. In fact, I remember being the 'chaperone' when my cousin was looking for a suitable wife and we were visiting the prospective brides at their homes. I was like, ten or twelve then, and it was mad awkward being shuffled into the room with the couple which would allow them half an hour or so to talk in (relative) privacy.

Like Penguin pointed out, while your family may be conservative and traditional, you would need documented proof that meeting prior to marriage is completely forbidden and not simply inappropriate in your family's eyes.

Withdraw the petition or it will just expire in four months, I think.

File for the I-130. As long as your relationship is bonafide and you have evidence of that, you shouldn't run into any other issues. Knock on wood.

The reason given for the denial makes sense. K-1 visas are for fiancees. She is no longer your fiancee, she is your wife, as per Indian marriage laws. USCIS will recognize any marriage as valid as long as it is legal in the country in which the marriage is performed.

It's not what they 'think' -- it's what is the law.

This should really be a pinned note on the South Asia forum. A religious ceremony, with or without registration, is a LEGAL marriage as far India is concered. REALLY. I swear. I spoke to three lawyers before I got married and started the process.

How did they figure it out, btw? An hour and a half interview sounds brutal. They must have known something was up. Did your wife slip up refer to you as her husband? Mine was barely three minutes and that was through Mumbai as well.

Any form of religious ceremony in India, for all intents and purposes, is a LEGAL marriage whether you register it or not. My aunt and uncle got married in 1985, they still don't have their marriage certificate. Not that it matters.

Sindoor, mangalsutra, saath phere -- no court in India would void that. You're married in the eyes of God, government, and society. Take your pick.

The Embassy has access to all sorts of information you wouldn't normally think they would. It's best not to try to hoodwink them and play by the rules.

Go ahead and file for the CR-1 visa. Start with the I-130 petition. Read the guides. Good luck!

According to your timeline, you've still not received your NOA2. Right now, you're looking at a 4-5 month wait at the USCIS to receive an approval of your 129F petition.

Mumbai is pretty quick, once the last packet has been logged you should receive an interview appointment within two to three weeks.

Right now you're looking at an October interview date.
