Entering the U.S. on a B-2 with the prior intent of marriage and staying via AOS is visa fraud as you're attempting to circumvent the laws in place.

However, she can come on a B-2, get married, stay for the duration of the visa. You can file for a CR-1 the day after your marriage. Chances are in 6 months, your petition will be approved and you might even be through NVC if you're quick about it so you'll only have to be apart for a month or two as she will have to return to her home country to interview.

I have a question--I, the Indian beneficiary, received some gold jewellery from my parents and other guests as wedding gifts as is often the custom in India. Could I use them as assets? Has anyone done this before? Of course, I'll get it weighed, valued, certified etc. and express it in terms of USD. It'll be around $8,000. I mean gold is as good as liquid cash and only appreciates in value. Just wondering if anyone had any thoughts on this?

I would just like to present the strongest financial case possible and contribute to our AOS.

P.S.: My husband is currently earning $21,620 and we have about $3000 in our bank accounts (2 person household). We should be good for the interview, right?

Doesn't matter who pays. My husband was the agent but I still paid that particular bill.

The DS230 is to be filled out by the beneficiary which is why it is laid out as such.

The IV bill is generated once the DS3032 is accepted.

There is no "process." You pay the bills. It takes 1-2 days to clear. A cover sheet becomes available to be printed once the payment clears. That cover sheet is to be printed.

I think in your case getting married in this case and filing for a CR-1 is probably the best route.

Your K-1 wasn't denied for lack of bonafide relationship -- it was denied because they felt you didn't fully understand the purpose of a K-1 and therefore, were misusing it. That you weren't fully committed to getting married and your intent to get married would rest on several OTHER contingent factors. If you DO get married, then, well, that removes the cause of the denial.

While it seems unfair to you and your initial reasoning sounds very logical, I can see why the Consulate did what they did. The K-1 is for people who are absolutely ready and committed to getting married, have no other issues to sort out and are going to use the 90 days to plan the wedding. Your answer, while rational, made it seem like you weren't really sure about getting married. You first wanted him to meet your family, kids, get their approval, and depending on that, would decide whether to marry or not. However, no idea why they took THIS long to issue that decision. Should've saved you the heartbreak earlier. You might have been done with a CR-1 in these 8 months.

This is an interesting case and should be referred to ANYTIME makes light of the K-1 and tries to imply that it is okay to use it as a "trial or a test-drive visa."

If her passport is less than 6 months old, then I believe you don't need a PCC from the regional passport office that issued the passport in the first place.

A PCC from the local/district PS is mandatory.

I got the latter first. Took me 3 weeks in Calcutta and then submitted it to the RPO, got my second PCC in a week.

You will need a police clearance certificate. For Mumbai, I'm given to understand you may present it at the interview.

You're good on the PCC from the RPO if the passport was issued less than 6 months ago.
