Well I think I would wait it out. (And hold off on the April thing). There are October filers getting approvals so you probably are not too far off from hearing something....and God willing your explanation was enough to show you are not legally married.

I don't know if India recognizes a religious ceremony as legally binding. (I know Peru where my finance is from does not, it must be civil.) If you are not "legally married":

Wow. You may get a RFE to prove you are not legally married or you may get a denial, it really depends. Regardless, if you return for a legal marriage it would still void the finance Visa.

For your Interview they can be in Spanish. The embassy says English or the local language. In the future is when you will need the translations.

That NOA2 and RFE on the same day is the strangest thing I have heard. Did you call them to find out more? Really strange. I have no experience with the RFE but most people say it is only a slight delay...but the delay is for the NOA2 so I really have no idea...

As for being in Peru, the only issue I could see would be not being able to meet the income requirements for the affidavit of support. Now if you are retired or something like that that would not be an issue.

I do know of a gentleman from VJ that went to stay in Peru for a long part of the wait for his fiance's visa. He was retired so the income part was no problem...

As long as you are ok on the income side, and you intend to make your home in the US after Visa approval, I think all will be well.

We experienced he same with the online documents it is how the governemnt had designed them. I filled out the forms for Elias he verified them by a faxed copy and then I sent the originals to him for signature along with all of the other papers he needed for the interview.

As far as the checking account he is fine. He should have theletter (or letters if more than one bank) include the information from each account (date opened, amount available, and amount of total deposits for one year).

If OF-179 is what you are looking for online it is not available, just used the one in the packet. It will be fine,

You do not need to have the police records / birth certificate translated into English for the Embassy phase of the process at all. All of these materials can be in either English/Spanish.

The only thing that I have translated up until this point is our evidence materials (emails) for the initial submission to the Service Center for the K-1 (to go along with the I-129F). I also wrote in English next to all receipts for the evidence the basics of: item, date, etc.

That was it for translations!! I also wrote the "I can translate this" letter that Kid Brooklyn mentioned to go along with the I-129F packet, initial submission to the Service Center. Yes, I had this letter notarized.

I'm at the Embassy phase of this journey as of now. Maybe later for the American phase (AOS) of it you'll need translations?? I personally am worrying about this part of it later. I've got enough to do!



This is a good point. Depending on what step you are at you may or may not need translations. For filing with USICS, you do. For a K-1 Interview in Peru, you do not. For AOS, you do.... Just depends. Translations can be done by you as long as you certify to the acuracy and it is not specifically stated that a certified translator is needed.

mad.gif Sorry for another post but that really bugs me. I would be burning up the phone lines to everyone possible. Patience is great but doesn't mean you stop bugging them or checking. I called everyday for 10 days to the processing center after 3 months of waiting, I wrote to the Obudsman and called and sent emails to my congressmen. Maybe I was stupid for doing this but you know what, things happened rather quickly after that. She had her interview on Tuesday of this week and gets her VISA on April 1st. She will be here the following week. Since I called the Embassy ahead of time they emailed the packet 3 docs and interview letter in lieu of snail mailing them. Like I said they are very nice to deal with. Maybe the NVC does check cases for accuracy or something who knows. BUG THEM!! GOOD LUCK!! good.gif Don't give up and keep your chin up!!

wacko.gif Never heard of the NVC doing reviews. Only that is was a handling center to route petitions and applications. The NVC makes no decisions but is only the middle man in the shipping of documents. Thats what I was told when I called them. Mine went to Kazakhstan through the NVC. It was received and shipped to the Embassy the same day. Don't understand the hold up on yours. Sounds fishy to me. Have you tried calling the Embassy to see if they have it already? The Embassies are much more nice to deal with then the USCIS processing centers or NVC. Some will let you give them an email address and email you as soon as your docs arrive at the embassy. Call them anyway so they will be looking for it. Good luck and keep us in the loop with what happens. Take care. star_smile.gif

I agree........don't even try coming through the USA. They stopped the Tranist Without Visa Program. You have to have a visa to set one pinky toe in the US. There are many other countries where he can fly through without a visa. Have him check with a travel agent in his own country. That way they can plan his flight without issues and they know where and where he doesnt need a visa. I flew my girl to Barbados to meet me and it was wonderful. No visa required. Nice people and lots to do. Not to expensive either. Have fun on your trip together!!

Having had problems with document copies instead of original. Original signatures on any document is important. Take my advice. Give original documents only. It will save you alot of time, questions and headaches. Make sure anything that has to be a certified copy is a true certified copy. Don't play games with it. Sometimes UPS is cheaper than FedX and they deliver like clockwork too. Good luck and play it straight all the way!! smile.gif Things will work out much better. Take care.

Anytime your last updated date changes it means your case was scanned or handled somehow. Might mean something might not but at least it moved. smile.gif) It doesn't say touched, that is a VJ term people use for a change in the last updated date. If the date changes even though it still says case pending. Your case has been touched. Its that simple. Yes you will receive an email saying your case has been updated. Don't go blind like the rest of us watching a date that doesn't move. Just wait for the emails. Ciao!

Birth certificates for you the benificiary must be original or certified copies. Divorce decree if any need to be original or certified copies. Yes I-134 Affidavit of Support after NOA2 has to be notorized which any bank can do for you. Better to be safe than sorry. I lost a little bit of time having to resend certified or notorized copies when the others were rejected. Most things like letters of intent and the like only have to be signed originals. Good luck. Hi GJen, there is no fee involved. If you go to the main page here http://www.uscis.gov/portal/site/uscis. On the right side there is a check case status box. You can enter your number there. I believe it will also allow you to register yourself on the following page. You can sign up for email updates also, although I have not received any after subscribing. I do not know if any of the others have. Hope this helps a little.

Pay attention, non-EP NVC noobs. Here's Christeen's time tested formula to get you through NVC in one piece alive:
Petitioner: Get NVC # + give operator your email IDs + receive AOS fee bill + pay 70$ online + wait to show paid + print cover sheet + send I-864 AOS with all documents and case # written on each page.

Beneficiary: Get NVC# + receive DS3032 + send DS3032+ DS3032 accepted + IV fee bill available to be paid + pay & wait to show paid + print IV cover sheet + mail DS230 package with all original/certified documents

= wait for case complete + wait for interview to be scheduled.

Suggestions:
1) Have the beneficiary mail SIGNED extra DS230s to you so that you have them handy in case something goes wrong. Or you get hit by a dreaded RFE.
2) If you just received your NOA2, THIS is the time to get your tax stuff and police certificates sorted out. Don't waste time on this.
3) Double check the PCC requirements in the regional forums as they are country specific.
4) Check the pinned STUPID RFEs thread in IR-1/CR-1 forum before sending in your packages.
5) Mail your DS230 package to your USC spouse as soon as you get your NOA2. That way he/she can overnight it to NVC as soon as the IV bill clears.
6) Get your taxes, employment letter, paystubs, PCCs, civil documents etc. while you wait for the NOA2.

Currently the # of business days NVC is taking:

3-4 days for NVC to receive your case and assign a case #.
3-4 days to receive emailed links after case # has been assigned and email addresses been given to NVC operator.
1-2 days for the AOS bill to show as PAID.
1-3 days for DS3032 to be accepted.
1-2 days for IV bill to be PAID.
8-10 days for case complete after all your documents have been sent in.

Folks--please make sure your official VJ timelines are up to date. Remember this is our only source of predictions. Thankyou!

Regarding the AOS package:

First thing, I would recommend is that you print out the I-864 form and read the instructions about 2 times. Mark out the relevant portions and ask any questions you might have after that. I would suggest you read the guides for a comprehensive idea about how the AOS packet will comprise.

Recommended AOS package:

I-864 Coversheet (with barcode) for payment of $70
Form I-864 (signed and dated)
2009 Federal Tax Return/W2 and 1099s or IRS tax transcript.
2008 Federal Tax Return and W2 and 1099s or IRS tax transcript.

Remember, the USC petitioner will file a I-864 regardless of income. If your joint sponsor lives in the same household as the petitioner, then they will use I-864A. If they live in a separate residence, then they will fill in another I-864.
For your joint sponsor you will need proof of their citizenship/residency. For household member, you will need proof of relationship and proof of same household/residence.

Hi guys,

I seem to remember reading that I do NOT need to include a copy of the birth certificate or passport for the I-864A? Or is that not true...I looked over the instructions but couldn't find the answer...

You will need to provide proof of same household (tax return is enough proof, I also used DL's as they had the same address on it) and proof of relationship between the household member (your grandmother) and the sponsor (your grandfather) which can be done with a copy of the marriage certificate. I used a BC since it was a parent/child relationship. I also used a copy of my joint sponsor's US passport copy but yes, that is not required.
