K-1 Fiance(e) Visa Process & Procedurestwo questions about K-1
Actually, your emotional relationship/ties means nothing to them. They want hard proof for "bonafide evidence" such as joint bank accounts, pictures, joint taxes, life insurance, boarding passes and passport stamps. Try crying at the interview and waxing eloquent about how much you love your husband, and see how much they care and if you can melt their cold hardened heart. For example, plenty of arranged marriages from India get approved. There's nothing emotional there, not yet, at least, no "hunny bunny" and "sweetums." Presumably there's not much talking/chatting/emailing before the marriage.

And also PLEASE, husband/wife are NOT terms of endearment. Where do people get this idea from? They are legal terms which specify a very particular relationship. For example, when I talk, I call a lot of my friends "honey," "sweetheart" or "darling." Needless to say, I don't refer to my friends as my "husband."

Anyway, OP: At this point there's not much you CAN do considering it's already been sent in. Wait and watch and be prepared at the interview, assuming your petition IS approved. Good luck. :)

K-1 Fiance(e) Visa Process & Procedurestwo questions about K-1
The difference between a term of endearment such as "honey" and "cupcake" and a legal term such as "wife" or "husband" is QUITE obvious.

I certainly didn't call my boyfriend my fiance until he became one and I didn't call him my husband until he actually was.

How old is your grandma? Embassies are not fond of elderly, sickly, unemployed joint sponsors, generally. Although you might not have a problem in Italy, check out the regional forums.

Probably ask him how he feels about moving to the US, how he feels about your fiance, what he thinks of your relationship. Basic stuff, nothing to sweat.

I had a B2 interview at 12 and a F-1 at 18.

K-1 Fiance(e) Visa Process & Proceduresits been 3weeks..
Hola. Our NOA1 too was taking forever. First our check was showing as pending in the bank account and then it disappeared without the money being taken out. My husband called them and they said there was some problem regarding some of the apps and they would issue us the NOA1 receipt that week. When two weeks passed, we called them and requested to speak to a supervisor. We then found out then that some USCIS drone had cancelled our petition for incorrect filing EVEN THOUGH IT HAD GONE TO THE CORRECT CHICAGO LOCKBOX. After a lot of yelling, they issued us the NOA1 in one day. So don't wait to lose a month like we did right at the beginning. Call, be polite but firm and don't take NO for an answer.

K-1 Fiance(e) Visa Process & ProceduresMarrying your girlfriend while she is in the States on Tourist Visa

I had to wait, you should wait as well. That's just mean spirited, plain and simple.

Actually, no, that's just the law. It's fine if there was no intent but in this case, they (or at least he is) are thinking about it and he's been made aware of what his actions might entail. If they decide to go through with it, then that's their problem.

Is it done? Yes, of course. Is it legal? Not quite and you know it as well, Bob. You can marry but you can't stay/adjust your status if you had prior intent. And sounds like they have it. If it was that okay to do it, why would anyone from the WVP countries go through the K-1/CR-1 etc? They'd have to be completely out of their minds.

OP, I wish you all the best to you and your intending. :)

K-1 Fiance(e) Visa Process & ProceduresMarrying your girlfriend while she is in the States on Tourist Visa
Marrying while on B2/VWP is not illegal. However, entering with the prior intent of marrying and staying via adjustment of status is visa fraud as you're attempting to circumvent proper immigration laws in place.

Thanks for everyone that keeps replying.
thanks Yoko, Tiger, dbears,CBR,and Derekj.
For some time I have tried to fight with the ideas, and one of you might have hit on a point that I was trying to hide, but all of you struck home, you all made me realize some of my faults of speaking without thinking, look at my post woo hoo good one Jerome, but the most recent point was one of you said maybe it wasn't true love, and that i should find true love and not "the idea" of love. About 5 months back, all was good, we were in a video chat, and all at once she looked at me and started to cry, and the chat ended. I asked and asked what was wrong, and it took time for her to talk, and she could never explain what was wrong, but just that "it didn't feel right" such as now. But even before this happened, I had my doubts, about her being able to leave for America, and when I sit back and think it was that we only had 10 days together, and almost 2 years of writing and she simply got scared, but maybe I can simply move on because I know that all we had was 10 days of fun with only "the idea" of what we were about to do, but I do believe that I want to find true love, and that I might not have had it with Iryna, and that she never had it with me. It was a very fast relationship from hello how are you one week to I love you the next. I promise all of you I am taking my time, and that I am using my past to help me with my future. Heck before I went there my friends worried, and did not want me to get hurt, I kept saying "don't worry, if it doesn't work out I had one hell of a vacation!" Maybe I was trying to fool myself, but even if it was not true love then, I know deep down inside I do want love, after all who doesn't? I have had my fair share of bad relationships, heck my ex wife is in prison, please don't ask about that... This time I know what I am getting into, or at least I am fooling myself into thinking I do, but I know that time heals all wounds, and eventually you will find the one that god wants you to find. I can just say that I do believe I am on the right path, and trust me if you all read the first letter I sent to Sheirmane, you would know that when she did reply I was amazed, I did not hold punches, and I was a bit of a ####, but I was true and honest, and she was the same with me. We might wait for my trip, I have time, maybe April, maybe July, maybe never. Any way, what ever happens, before we even talk about marriage, we will talk about why we want this, and why we love each other, because I do not want to make it harder for anyone, and I don't want to go through the visa process again, but I will do what ever it takes to find true love. I write to Sheirmane as a friend, and my intentions are good and honest, we have both fear, and mistrust, and we have talked we are going to take it day by day, and in 6 months who knows.
thanks again for all that read, and all that reply, and do not worry, I am the idiot that posted without thinking, maybe I wont make the same mistake again.
thanks again!!
Jerome

I know it now sounds like I am trying to make me believe that what I am doing is the right thing to do, or that I am asking for your blessing, maybe I am, maybe not, I really don't know for sure either, all of your replies struck a chord in me, but I am going to continue the path that I have chosen, and I am sure god will guide me the rest of the way, and please ad your replies, I read them all

Jerome,

From reading through post 1 to now my mind has bounced a million places. I can easily identify with every post on this thread and opinions can change. In the end, we come to VJ for a sense of support. I hope you get that. Not all will agree with me or with others or your decisions. I can understand why you say maybe you are seeking a blessing, most of us like to do what is right in the eyes of others. But sometimes we must do we know is right for us. There is some very good advise listed above, I am a firm believer in the counsel of many (just make sure the counsel is wise and not rooted in anger or heat of the moment words). Take a little time to think about everything that has happened in the last week or so.

Looking at some of the responses here the word that comes up the most for people trying to imagine themselves in the same situation is devestated. I know I would be too. I would be many other things as well, offended, hurt, angry. At least initially. Those things are common at the end of a relationship. So common there is a word for the actions many people take, rebound.

I hope for great things for you Jerome. But please, as others have cautioned take time for you. God bless...

Sam

Yes, everyone is different and books should not be judged by the cover. What shocked me was the quickness you moved from engaged to, "Oh what the fuk, NEXT!" In came off worse than buying a used car.

Let me share a bit of my story. In 2005, my fiancée changed her mind right before the interview. This was after an almost two year relationship. She flat out told me, "I can't do it." She even made the suggestion, "Maybe you should find different woman." But, rather than give up and holler NEXT! I examined the situation. I flew to her at my nearest convenience. I discovered a woman very frightened. Scared of such a big move and lacking needed support from her family. I found a woman very much in love with me but requiring more time to do this right. A woman that never meant those words, "Find another". A woman concerned I would not understand her life situation. I told her, it's okay. It will be all right. Rather than give up, I saw a challenge. I asked her to tell me how I could help. She only said, "TIME". After a year more, I decided to take a more aggressive approach. I chose to give up everything here and live with her in Russia. We used that period to be a true family and not the typical visiting tourist that many can only do. I lived with her like a Russian. I even managed to fool many who never suspected me as being an American. After another year, we both decided that life would be better in America than struggling to live in Russia. Thus, I returned and, began her paperwork for the second time. Now she completely looks forward to arriving here and has full support of her family. I gave everyone time to know me and witness our love at work. She has had too many men in her life that wanted too much too soon and gave up on her. She wants a man for life and another short term superficial individual. Fighting for her, if you will, was exactly what she wanted.

I don't know your exact situation and we are all different. For me, quitting was never an acceptable option.

What an impressive love you have. That type of fighting for love will honor your marriage in a way that many only dream of. I wish you both a long happy marriage!!!!!

I look at it this way....if each person here (and imagine how many other filers there are) called once..."just once", would there be anyone left at USCIS to use the rubber stamps? Or would they all be on the phones?

I have so many questions about this whole process I dont even know where to start .... I read one thing, think I have it down. Then I read something else and Im confused again.

I miss my baby so much, and Im so afraid that were gonna get turned down... The stamps on his passport are kinda faded and you can hardly read them.!! He dosnt have copies of his plane tickets to the US (where we met) or Canada (where we met up again last summer)

The only proof that I have is a Bus Ticket from Omaha NE to Toronto Canada.... But I live in Dallas (we drove to Omaha to visit family before I went to Toronto to meet up with him) ... so even that looks shady...

We do have some pictures together (4) and e-mails and phone records (which are from "Vonage" telephone service, so it looks like someone just typed them out....

Geesh. This is the hardest thing I have ever been thru !!!!! I feel like Crying every single day

Thanks for any responses
Patti

Well the pictures are helpful. It would be hard to say you haven't met....as long as you can put one of you in the same place as the other in the last two years...you should be okay. At this point you have less to prove that you will for the interview...just remember to save everything between now and then.....Best of luck.

Looking at your timeline, you could be receiving your K-1 approval any day now!
Are you willing to give up all that progress for a ceremony?
To me the most important thing is getting to be together as soon as possible.

Seems like your options would be:

1. finish getting the K-1 visa, have a quick ceremony in the US, apply for AP, then go back to the UK for a formal ceremony

2. forget the K-1, get married in the UK, start from scratch waiting all over again for a K-3 (!)

3. If UK does not recognize a religious type ceremony as a legal civil marriage (not sure on UK but my fiance is from Peru and only civil mariages are legal) you would be okay as your LEGAL fiance would still be coming to the US for marriage....

Best of Luck!

First make sure that a ceremony in the country you had it in was not legally binding.

Secondly, don't include any pictures from or even bring up the ceremony. They wont ask about it, and as long as it wasn't legally binding, its not really any of their business to begin with.

I agree with not including the info as it would likely be confusing/possibly troublesome. Of course if by some strange event they asked...(highly highly unlikely) don't be dishonest blush.gif

And as you probably know this type of ceremony is not legally recognized in Peru....

Good luck on your process! And keep us posted

K-1 Fiance(e) Visa Process & ProceduresPassport name
QUOTE (junglejao @ Feb 11 2008, 10:08 AM) <{POST_SNAPBACK}>
My fiance has to get a new passport, and I am trying to figure out exactly what name he should use. As with most Latin Americans, he has two last names. When I filed the I129f petition, I used only his first last name. When asked if he ever went by another name, I said no. So his second last name is nowhere on our paperwork (though we obviously DID show his mother's name, which is also his second last name). So my question is, when he gets his new passport (which he will need for the next phase of our visa process), should he use only his first last name, or should he use both (as I believe is the norm in Peru)?

When Elias got his passport he HAD to use both last names because that is how it is listed on his D.N.I. and his Birth Certificate.

I hope to be corrected here if I am wrong and someone knows different, but I believe the Visa is issued by the name listed on the passport (not the info on the petition) so.....

Not that that all helps much but....let me know how you guys decide.

I have everything together for my original submission I-129F package for K1 visa, which I plan to mail off tomorrow.

I'm just stuck on how to present my photos...

I've labeled them all on the back of each photo with names, dates and locations. Should I put all of them in 1 plastic baggie? Should I buy photo sleeves? Should I paper clip them?

Please let me know how you included your photos in your package.

I know it's minor, but thanks for your help!

I placed ourphotos on a piece of paper and used scrapbooking photo corners to hold them in place. Then after I had like 4 on each page I slid them in a clear plastic sleeve. Also, I wrote a note of the dates locations and names in the margin next to the photos...

I think almost any method is ok as long as they have the info...

A touch is regisered on the USCIS website. You need to be loged in to the website (they ask you for case number, and you create a username and a password- that way you can see if they are even reading your case at the moment- or doing almost anything).
After NOA2 you should be gathering papers right away- like the proof of relationship, police certificates etc. You will need them for the interview. You don't send them.
After NOA2 your case will be forwarded to the embassy in your counry and the embassy sends you a packet (3). The instructions will tell you what to do.
You don't send the affidavit of support or the documents supporting it, but take it to the interview. Just read the instructions carefully!
Right now it's tme to gather documents like; birth certificate, police certificate, evidence of relationship, affidavit of support, and get ready for the interview!
Good luck good.gif

Her fiance will be taking these items to his interview. Only Mayo will get a copy of packet 3 (and packet 4, the interview letter, will be included in Peru) and parts of it will need to be mailed back before his interview date. Everything else he will present in the interview.

But everything she has she will need to send to him. (Or take to the Interview if attending....)

I am getting everything ready to send to Elias this week. I'm mostly waiting for the hard copy of the NOA2 to come in the mail so I can include a copy of that too. For the Interview date he will need the financial papers with him.

I talk to another couple that is going through Peru right now and they said they just received the packet 3 & 4 by mail and their interview is the 20th.....luckily they had already called the embassy and had the date so they are prepared but they advised to call in and stay on top of things just in case....

Now I'm waiting for the last packet (4) with the interview date, and had a touch last week. First I started to worry! Then someone on the forum has said that if there was anything wrong they would notify you (e-mail).
Everything is ok. They register a touch even if they move your files from one cabinet to another!
Good luck.

PS I noticed that after a while of dealing with USCIS we all freak out!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Good point. I guess after months of wanting touches and not seeing them....the reverse is a little scarey, jejejeje

K-1 Fiance(e) Visa Process & ProceduresAdvice needed
Call the NVC:

Hours:
Monday through Friday from 7:30 AM to 12:00 AM (EST)
Tel: (603 334-0700).

Press 1 for English
Then 5 for a live person.

You will need your receipt number from NOA2 (or NOA1 it's the same number) and your fiance's Date of birth.
They can tell you if they have received it from USCIS and they are easier to talk to (very friendly usually) thoughj you may need to call a few times to get through.

I would bet they have already received it and forwarded it to your embassy. But they can tell you for sure.... I know my case was updated online 3 days before I received the NOA2 and 3 days before NVC said they received it so it's not a matter of waiting until they forward it to update, more likely that they failed to update it. I have read others comments that USCIS still shows pending and they already have completed the process.....completely, like Visa in hand completed.

Best of luck.

I think it would be VERY unlikely to be denied based on that. Best of luck.

Hi guys Please help me.

October 18, 2007 submitted K1

February 27, 2008 RFE sent

MY RFE states the following word for word:

CIRCUMSTANCE OF MEETING: submit information regarding the circumstances under which the petitioner and beficiary met to establish the relationship

LAST MEETING: submit evidence of meeting the beneficiary in person within the two-year period immediately preceding the filing of the petition. Such evidence may include photographs of the petitioner and beneficiary together, airline ticket stubs and receipts (that indicate the month, day, and year), copies of passport pages that show admission stamps,
miliatary order(s), letter from Commanding Officer, and any other evidence that you feel will help the USCIS to determine that the petitioner has personally met the beneficiary within two years. If the petitioner and beneficiary have not met in person during the two-years immediately preceding the filing of this petition, please refer to the instructions above, relating to the "Requirement that Petitioner and Beneficiary Have Met."

That's it word for word. have any of you received this? how did you handle it? please respond how you dealt with this.

Thank you guys.

Hey there. Welcome to VJ. Don't stress too much on this, just give them what they ask for and move past it. I think you have made a wise choice not to continue with this attorney. The info and support on this site is great so check out the Guides section and if you have questions still feel free to ask.

Suerte!

K-1 Fiance(e) Visa Process & ProceduresFiled for K1 in october, getting married in India in April, is it wise?
Well I think I would wait it out. (And hold off on the April thing). There are October filers getting approvals so you probably are not too far off from hearing something....and God willing your explanation was enough to show you are not legally married.
