Yes, in practice, things work otherwise.

When does your fiancee turn 18? She might be 18 by the time her interview rolls around if you haven't filed for her yet.

Oh, I didn't realize the OP had already applied. What I got from from the OP is that he was GOING to apply for the K-1. So yeah, moot point.

Jim -- thanks for listing out the points. I wasn't aware of those distinctions regarding children.

And by "superior" I just meant the a CR-1 is a greencard on arrival whereas with a K-1 you have to go through AOS, and can't work till you have the EAD etc. More costly.

OP--Can I ask what community/religion you belong to? You're a naturalized USC -- Indian-American, I'm guessing?

I've never heard of a can't-meet-in-person religious custom despite having been born and brought up in India. Most arranged marriages allow the prospective bride and groom to meet in a chaperoned environment.

Go ahead and refile a K-1. Read the guides carefully.

The I129F is if you're also filing for a K-3.

Once the visa is issued, you have 6 months to use it before it expires. The visa is endorsed at the border.

It is, in fact, best to think of a K1 as a single entry tourist visa given for the express purpose of entering the U.S. and marrying the USC petitioner within 90 days. Without the AOS, the foreign beneficiary has no rights so do not put that off.

Yeah. As Kathyrn pointed out--it is possible. Do your research first, eh, V&T?

Instead of AOS based on a K-1 marriage to the original USC petitioner, the AOS is now done as an immediate relative (sort of like AOS from a tourist visa with a slight overstay). BOTH the I-130 and I-485 must be submitted if wedded outside the 90 days time limit. Submitting only the I-485 WILL cause it to be denied.

What I don't understand is why having diabetes would cause the mother and the child to leave the U.S.?

To me that is unfathomable. Firstly, diabetes isn't some life-threatening disease. Secondly, Ukraine isn't exactly known for it's medical expertise.

What was preventing you from getting married and filing for AOS with a I485 and I-130 even if you did end up getting married outside the 90 day window?

Agree with everything Gary said.

Not to rub salt into your wounds, but this is exactly the sort of reason why one should be prepared to marry ASAP. A lot of things can happen in 90 days, as you unfortunately found out. The K-1 isn't a test drive visa, no matter who tries to tell you that, it is for your fiancee. Meaning you have already made the decision to get married and are fully committed to it, and have been since you got engaged/filed the petition/signed the intent to marry form. All the "making sure this is right for us" and "testing things out" should have been sorted out before the petition was filed, IMO.

Again, sorry this happened to you.

Mumbai doesn't allow petitioners inside for the interview. I don't think it's really worth it for my husband to fly 30 hours and spend a thousand dollars to stand outside in the heat. I've applied and received both U.S. tourist and student visas before so I'm not concerned with the emotional aspect of it. I think I'd be able to handle it fairly well on my own. While it can never hurt and only help, you have to evaluate your case and decide if it's worth it. If you can take time off work -- sure go ahead and attend the interview. It's not required but is always encouraged. If your case has any red flags, I'd recommend you go for the interview.

Actually, consulates often ask for proof that a wedding has been planned such as a booked venue, guest list, caterer's receipt etc. Seems silly because you can't really plan a wedding until you know the date for sure and if the intending groom/bride will be there for certain. But that's what they want. And you give them what they want.

The child will require her biological father's permission in a strongly worded letter that he is allowing her to permanently locate to the U.S. with her mother.

As for tourist visas, the daughter would have to qualify for that on her own and would most likely need permission from her father to leave the country, if she is quite young. Tourist visas are granted when the applicant can demonstrate significant and overwhelming ties to the homeland that would compel him/her to return.

As Gary said, figure this out before moving any further.

Actually, your emotional relationship/ties means nothing to them. They want hard proof for "bonafide evidence" such as joint bank accounts, pictures, joint taxes, life insurance, boarding passes and passport stamps. Try crying at the interview and waxing eloquent about how much you love your husband, and see how much they care and if you can melt their cold hardened heart. For example, plenty of arranged marriages from India get approved. There's nothing emotional there, not yet, at least, no "hunny bunny" and "sweetums." Presumably there's not much talking/chatting/emailing before the marriage.

And also PLEASE, husband/wife are NOT terms of endearment. Where do people get this idea from? They are legal terms which specify a very particular relationship. For example, when I talk, I call a lot of my friends "honey," "sweetheart" or "darling." Needless to say, I don't refer to my friends as my "husband."

Anyway, OP: At this point there's not much you CAN do considering it's already been sent in. Wait and watch and be prepared at the interview, assuming your petition IS approved. Good luck. :)
