Yes, once NVC receives your case, the USC spouse will provide the I864 package and the intending immigrant -- DS3032 and once that is accepted, the DS230.

The K3 might save you 3-4 weeks but that is upto you to decide whether its worth the pain/cost/time of AOS later.

I'm not sure about the residence requirement for DCF - Direct Consular Filing - but if you do fulfil them, then yes, go ahead and file.
There might be a 6 month requirement. And proving domicile also becomes a big issue.

Just to add: What are you going for? The CR1 or the K3?

Those steps I mentioned above is for the CR1. Not the K3. I'm not sure about the latter process. But I think it goes through NVC quicker and might save you 3-4 weeks in the process. It's up to you to decide whether the cost/time of AOS from a K3 is worth it.

I'm sorry it won't be before Christmas. Wait for a week before calling NVC to make sure they've received and uploaded your case into the system. Give them your email addresses.

Going through NVC will take 4 weeks AT THE VERY LEAST. Quite possibly 6. And then it's another month for the interview.

You will need the I864 package.
Your wife will complete DS 3032 and DS 230.

Get all your papers ready for smooth sailing through NVC. Read the guides.

Indian marriages are complex because of the whole civil/religious aspect to it.

I'm a Hindu, my husband is not, so we did not have an elaborate Hindu wedding with rituals. Neither of us are particularly religous or fond of traditional rituals. We signed the marriage certificate in front of guests and the district marriage registrar, exchanged gold rings and rose garlands, followed by a dinner reception. Our marriage was registered under the Special Marriage Act (unlike the Hindu or Muslim Marriage Acts) of India, 1954 since we don't belong to the same religion. All rules regarding waiting time period were followed as specified under the act.

Once the payment is accepted, it's absolutely alright to go ahead and send your package in. There's no need to wait for the NVC to send you anything because as far as I understand, they don't.

That sounds about right. His household is him, his wife, you -- the intending immigrant and if he has any other dependents. And his income alone should be able to support his household size at 125% above the poverty line. So he will put his individual income in the household income section as he is NOT combining incomes with anyone else in his household.

This is what I'm doing: My cousin is filling the I-864 based on his sole income as is demonstrated on his W2. Not the income stated on the tax form, which is a clearly combined income. That's what will go to the NVC along with the other financial documents.

If all goes well, then that's that. For the interview, I will have a copy of his wife's I-864A, just in case a CO is interested.

TECHNICALLY as is stated on the form, the I864A is not required if the joint sponsor makes enough individual income.

Now because I'm in a similar situation, I'll give you what was told to me.

If your uncle's INDIVIDUAL income is enough, "only the one joint sponsor is needed even if they file taxes jointly. The tax return with W2 forms will indicate which income belongs to the sponsor. In this case, add up the W2 income for the one person rather than using line 22 of the 1040 which would show joint income."

If her income is being included on the I864, then yes, a I864A is most definitely required. IMO, even if it's not included, I can't imagine it would hurt to have that extra form in the package. Lately, a few consulates have been asking for the I864A to ensure that the spouse of the joint sponsor is aware of the commitment made. So, if you're paranoid like me, it'd be best to try and get a I864A from your aunt/his wife.

I'm curious. Pushbrk -- I'm following your instructions with regards to the joint sponsor I864, but I'm also getting a I864A. Just as a back-up. Do I still need the supporting documents from the spouse's side (employment letter, paystubs etc) even the joint sponsor's individual income/assets are way above the required lines?

Or is the I864A just enough to show the spouse's awareness/acknowledgement?
