IR-1 / CR-1 Spouse Visa Process & ProceduresCalling USCIS?!

Sachinky is a good egg, truly. Sure, she was a newbie once, as well, bouncing all over the place. After some time, she settled down, dug her heels in, and 'got on with the program', learning ALL ABOUT THIS HEINOUS IMMIGRATION STUFF from reading, asking questions, studying forms, in a 'total immersion' effort. Knowledge acquisition, especially PERSONAL KNOWLEDGE ACQUISITION, can turn each and every one of you into a powerful force. It's still up to you, though, to acquire the knowledge, and put this power to use for yerself. I personally witnessed this transformation with Sachinky - and would recommend ANYONE and EVERYONE to follow her path for knowledge acquisition. Truly.

Gee, Darnell, you flatter me terribly. :luv:

Kruz is not my friend. 3 IDIOTS is a recent funny Hindi film--I assume he was referring to that. Your comment of me and him being idiots is clearly name-calling. While I cannot speak for Kruz since I don't know him, I can assure you that I am not one.

I am unaware of where I was critical or self-righteous. I laughed because your OP made me laugh. I thought it was funny. It's as simple as that. You thought I was rude. Well, that's your opinion.

You referred to me as 'he' before so I clarified. But you instead called me a 'jerk.' Nice going.

Your OP made me laugh because it was so naive. I wasn't being rude, that was certainly not my intention. Your OP simply amused me. You took me to be rude. Fine, that is your prerogative, not mine.

You already had the answer to your question in a post above mine.

I have no problems with you. You are already in for a long, stressful journey trying to bring your husband over from Egypt. And I understand, noobs will post noobish threads -- I have had my own fair share of that.

What I do have a problem with is people who jump in and feel the need to get critical, self-righteous and tell me what I can and cannot post.

And I'm the female beneficiary, just to clarify.

This is a free public forum open to all, in case you were not aware.

If you post here, you are bound to get replies/advice you may not like or appreciate. Take it with a grain of salt or shrug it off.

For such sensitivity, I'd recommend a personal lawyer to answer your complex and intricate questions.

There is no need to call names. May I remind you that, that is in fact a TOS violation.

G'day.

I don't care how much irony, innocence, or how much naivety you saw in the opening post.
There was no reason to post what you did and the same goes for kruz.
This entire immigration process is a highly emotional one and sometimes you just want to hear what others think. That is all my wife wanted. I take great offense for the general lack of tact that you displayed, along with kruz.
Anonymity is such a wonderful thing when you're the keyboard warrior , sitting behind your monitor, and feeling no repercussions for your actions, isn't it?

Last time I checked, this was a free country. Who died and made you the forum police, dictating what is appropriate content and what is not? I can post whatever I want as long as it is not a violation of the TOS. I wasn't aware that  is against the TOS.

If you wish to take offense, then go ahead and do so -- that is your right. I could ask you to lighten up, but I wouldn't want to stop you from getting all hot-and-bothered.

Precisely. It's why I heart the interwebs!

I find something funny, I laugh. I find something funny online, I 'laugh' virtually.

You can deem that 'unclassy' -- if you so wish. How you hold me in your esteem, is frankly, none of my concern. I don't troll these forums waiting for your or anyone else's approval, respect or validation. I have enough of that in my 'real life.'

The irony, sheer innocence and naivete in the opening post is outstanding. You'd have to be missing a sense of humor to not acknowledge that.

IR-1 / CR-1 Spouse Visa Process & ProceduresOF COURSE! The local Indian police department wants something that is RANDOM!!
This is ridiculous. I can't believe you guys are getting the usual BS run-around.

Man.

My local PS PCC took 3 weeks. All they needed was my class 10 certificate, marriage certificate, copy of my passport and copy of my USC husband's passport.

I did the RPO PCC through an agent--took exactly 7 days. They needed the form, two pictures, a copy of the local PCC, and my passport. Obviously.

The only time I had to deal with the RPO is getting my husband's name listed under 'SPOUSE'S NAME' -- took 24 hours and that's only because my dad knows some high-up officials in the West Bengal government. They (the folk at the RPO) were ready to be immensely rude to me until I started throwing some names around. THEN the whole thing took less than 10 minutes. It was bloody ridiculous.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved I-485 denied!????
I thought one couldn't appeal a denied AOS off the VWP?

So is USCIS now denying AOS-es based on prior intent to immigrate at time of non-immigrant entry at POE?

OP--What exactly went on during the interview? Can you elaborate? How soon after his entry into the US did you get married?

Technically, there is case law that prohibits the denial of AOS of spouses of USCs based solely on their preconceived immigrant intent. I'm thinking there must be something else going on here.

OP, I suggest you get a lawyer. You don't want your SO to be slapped with a material misrepresentation charge.

Your I-130 will still remain in play as he is an immediate relative of a USC.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow much is your phone bill?
My husband's bills have been amounting to nearly $500 for the last couple of months.
We also stay in contact throughout the entire day via AIM, Skype, Facebook and text messages.
We've been trying to cut down on his phone bills. Managed to get it to $300 this month.
I've been urging him to get a Mother India account which is $10 for 500 minutes. Or Skype which is unlimited for $8 monthly.

Anyone know if there are special rates or such for Verizon?

IR-1 / CR-1 Spouse Visa Process & ProceduresProof of bonafide marriage
I took an entire suitcase full of 'evidence.' I kid you not. I had copies and photocopies and blank forms, in the event that they asked for something. Anything that I could possibly think of. Extra pictures. I had documents from TWO BACKUP JOINT SPONSORS, 'just in case,' there were any problems with the original one. I took movie stubs from our date-nights. My interview lasted for 3 minutes and not one single thing was asked for. Not even after I offered to show them our wedding pictures and/or phone-bills. But that 'suitcase full of evidence' provided me the much-needed 'peace of mind' that was essential to me being fully confident and facing the interview with minimal stress. Anything they could think of or request, I knew I could provide it instantly.

I would always, always recommend that each and everyone be over-prepared, rather than under-prepared, especially when dealing with a high-fraud consulate. And make no mistake, Pakistan is one such consulate. Give them no reason to question your case.

At the end of the day, it's just paper. You can always shred it later on.

If they DO complete your case, then yes, the original PCC can be submitted to VFS.

IR-1 / CR-1 Spouse Visa Process & Procedures(India) Great news!!!!! but, i dont want to get your hopes up, but i do, cuz mine are up!
Both my PCCs were just over 6 months by the time I had my interview.

I got it while I was waiting for my NOA2 in early November and I didn't have my interview till mid-May.

Chennai and Delhi seem to be strict on the 6 month rule thingie--Mumbai not so much, at least, in my experience.

PCCs for immigration purposes are supposed to be valid for 1 year.

A VJ member personally called up all 3 consulates. Delhi and Chennai said 6 months while Mumbai said 1 year.

This ain't gonna fly and you better be nowhere in the scene when the sh!t does hit the fan.

He is risking his own residency, a permanent ban from the US and honestly, he sounds stupid if he thinks it's that easy.

This isn't gonna work. Not if he is from a relatively high-fraud country and I'd say any country in Caribbean is probably on that list.

If I were you, I'd report his 'strategy' to ICE if he seriously plans to go through with this.

It's wrong, illegal and immoral and there's no way in hell I'd ever be in a relationship with someone who'd engage in such deplorable (even if well-intentioned) activity.

Glad you got that worked out, Zeban.

For me it's not such a big deal, I just suck it up--I've had male doctors examine me in the US while I was in college, at the end of the day, they're just doctors -- but I can understand why it would or can be a big deal for other woman so I'm glad you were able to ensure your wife's comfort and privacy.

My physical examination was done by a male doctor as well. They don't make you get 'naked' per se, (I had to wear one of those hideous surgery gowns) but yes, there is an examination of private parts. Which is never comfortable, if you ask me, irrespective of the gender of the doctor. There is also a female nurse present during the entire examination, if that helps. I don't know if you can request for another doctor -- as far as I know US immigration requires the medical to be completed by a certified Panel Physician.

For India, you can only complete the medical after your interview date has been assigned.

NVC will not complete a IR1/CR1 case without the PCC being submitted, most of the time.

Some time back a few folks were able to get around this requirement and produce the PCC at the time of the interview but I don't think this is true anymore.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan my husband get a tourist visa and visit?
REPOST -- Chances of securing a tourist visa while your immigrant visa case is pending are rather slim. To get a tourist visa you have to demonstrate strong non-immigrant intent. Which is kind of hard to do as you are planning to immigrate. One cannot possess dual (immigrant and non-immigrant intent) at the same time.
