As long as your fiance answers honestly, he shouldn't have a problem.

I'd say the OP's immigration issues seem to stem directly from his relationship troubles, which is why I didn't think my previous comment was "off-topic." He had a prior K-1 in the works that didn't work out either because that relationship fizzled out as well. I don't think that asking him to slow down/get to know someone/let the relationship grow/see where it's headed before rushing to file fiancee petitions, was bad advice. Whatevs. *shrug*

Nevertheless, I've been sufficiently rebuked. :P

If you're prepared, the only time difference between a K-1 and a CR-1 is the NVC stage, which can be gotten through in about 3-4 weeks, barring any RFEs.

The problem is, in India, a 'religious wedding' -- when held in accordance with the laws of the particular religion to which the bride and groom belong to -- is deemed to be a 'legal marriage'. So if you walk around a fire seven times and exchange garlands in front of a priest, you're married. No court would ever overturn that.

And moreover, a marriage certificate is DEFINITE PROOF of marriage -- religious or legal, it doesn't really matter at this point.

Married people are NOT eligible for fiance visas.

A religious marriage in India IS a legal and binding marriage. Irrespective of whether you register it or not. For example, my aunt and uncle just registered their marriage and got their marriage certificate last year but they've been married for the past 25 years.

If family/social norms is a concern, marry her in India and then apply for the CR-1. It is a much superior visa anyway and the waiting time is only 3-4 weeks more if you're prepared for the NVC stage. Good luck!

It will take anywhere from 6-8 months.

I can't answer #2 and #3 as there is no 'right or wrong' answer. Just the truth -- whatever that may be in your case.

As for #1, you can always go to the Consulate with your fiancee to provide moral support but Mumbai doesn't let the USC petitioner in. Only the beneficiary is allowed to attend the interview. She can always show your passport to demonstrate that you're waiting outside for her.

Dude, my husband and I were in the same situation.

After we went through NVC, he got a new job that put him over the guidelines. However, the joint sponsor was still kept on record. The pre-screener seemed to imply that the jobs were "too recent" to be considered. Besides, his taxes didn't look so hot as he was in college the previous 3 years.

Really not worth the risk. Why not go back after you've filed for AOS and have the GC/AP in hand and have a big blowout? You could just have a civil ceremony in the USA.

I don't know the rules for Ukraine. But the US recognizes any marriage as 'legal' as long as it was done in accordance with the laws of the country in which the wedding took place. Our Ukrainian members will be able to provide more information.

In India, for example, a religious wedding IS a legal marriage. Whether you register it or not. Exchange garlands and take seven rings around the fire--voila, you're married! No court is going to overturn that.

Notify the embassy and tell them you no longer wish to continue with the relationship. This way the visa will get flagged if she should try to use it in order to enter the U.S.

I have read a few cases where the beneficiary got the visa, told the petitioner that he/she changed her mind, then entered the U.S. anyway and stayed with friends/family. They were just looking for an ticket to get to the U.S. and the relationship was the means to that end. Once the visa has been obtained, there is no reason for them to continue with the relationship so they let them down easily and tell them that they've had a change of heart.

Depending on that, he will face a ban.

Your visa will be denied at the interview.

You can file for a hardship waiver but please be advised that those are notoriously hard to obtain.

You need to retain legal counsel if you haven't already.

I can see why the language barrier was perceived to be a problem. You speak no Khmer. According to the CO, your fiancee doesn't have a strong grasp of the English language. Coupled with the family introduction and that she had no knowledge of what your work position entails, I can see why the CO would deny the case.

File for a CR-1 and front-load the petition with overwhelming evidence.

Being introduced by someone you know is very common (I met my husband in college through his roommate who was a friend of mine) but being a introduced by a family member of the beneficiary is a 'red flag.' I assume that's what the OP meant -- that his co-worker is a member of his fiancee's family. It may not be in the U.K. but it is in high-fraud consulates.

I need some inputs from the community. I had my consulate interview with my fiancee back in Feb 9th, 2010 and the response we got was it's a "Sham" in return was denied. I am a US citizen and my fiancee is Cambodian. I was introduced to her by my co-workers (family member). Has anyone else gotten a "sham" and received a second chance with the same petition or did you do something otherwise?

The consulate officer deemed it not a bona fide due to the fact that she didn't speak enough english, didn't know what a COO (Chief Operating Officer) does at work, couldn't name my golfing buddies names. She anwswered everyone of those baseline questions with the correct answer, but couldn't go into details, due to the fact that he conducted the interview in english through a 2 inch glass window with a horrible mic that was no better than a drive through McD's. I need some insights into this. I've spoken with many attorney's and they have no clear answers. it's been going on 4 months since the interview and no letter back from the embassy and NVC as to what I can do. HELP. thanks people

Others more experienced with denials and how to deal with returned cases will chime in.

Depending on the service center, the petition might just be allowed to expire.

This is basically the only requirement of the 129f petition and there is no hope of getting that waiver approved, not even with severe hardship.

I'm from India and therefore, I could not travel to the US while my spousal visa was pending as I would require a separate tourist visa.

But other Canadian members have had a relatively high rate of success in crossing the border while their CR-1/K-1s were pending. I'm sure some of them will shortly stop by to offer their personal experiences. This is also a VERY common question on the forums so a quick search should confirm what I'm telling you is, in fact, correct.

Your K-1 application will not be affected even if you are denied entry as a visitor based on 'lack of sufficient ties.'

Entry is at the discretion of the CBP at POE but yes, your chances of entry are stronger if you are able to prove strong ties to Canada.
