Your sarcasm is misplaced. For one, as the mother of a US citizen she would not be available for an immediate visa number, which means after the petition is apporved you will wait a period measured in years for a visa. Apply for and receiving an immigrant visa is not the same as overstaying a non-immigrant visa. For whatever reason she was not able to satisfy them she was not a risk.


Nah, mothers of USC are considered to be immediate relatives and thus do not have to wait for a visa number to become available. It's category IR-5 and it's the same amount of waiting time as a CR-1/IR-1.

Interestingly enough, the 14th Amendment to the U.S. Constitution was designed to grant citizenship to slaves and their offspring.

However, as Bob pointed out, this isn't all encompassing. Children born to foreign diplomats are not considered to be USCs since they are outside U.S. jurisdiction.

I can't even imagine what this would feel like. I'd heard of APs occuring after the applicant had already been told that the visa was approved. But to have to return your passport after the visa has been issued and then be in AP for months is just terrible.

I'm so sorry it happened to you. Hang in there and keep up with the enquiries.

I wish you all the best. It probably has to do with some mix-up, I think. Maybe the CO missed it and the supervisor caught it. Could be a name/address issue. Maybe they're checking his immigration history? Any discrepancies (in basic biographic details) with your current petition/visa and his previous ones? I'd suggest you go over all the paperwork in great detail.

They will need SIGNIFICANT and OVERWHELMING ties to their home country in order to convince the CO that they will not overstay their welcome in the U.S.

Glad to hear that she's okay. It's frightful to get 'that' phone-call, I know. Right after we moved to NM, Mr. Sachinky was involved in a car crash and our (Honda CRV) car was totaled. But thank God, he was ok, minor bruises and a burnt arm from the burst air-bag. I still remember my two hour walk back to the hotel from the mall (where he was supposed to pick me up from on his way back from work). I was half-crying, half in a daze. It was literally our second day in town and we had no one to turn to. His employers were very helpful though and eventually we ended up getting a new Corolla Sport on our first anniversary.

I am sure some people from outside the RUB forum do not understand. Her "boyfriend" is our son, Sergey. Sergey and Dasha attend the same school in Moscow. She does not need a visa to see her boyfriend, she sees him every day in Moscow. Sergey is coming home for the winter break and she would like to come with him. We have met her in Russia and she has been to our home in Donetsk, Ukraine. Now she wants to come here for a vacation and go skiing.


She is not coming to the USA by herself to "see her boyfriend" she is coming to visit the home and parents of her boyfriend.
We believe that the fact that her boyfriend is going with her AND has a reason to return just as she does, would be in her favor.

I'd go with Slim's advice. A perceived air of nonchalance would be my advice.

It would depend on how he entered the U.S.--from the OP it seems like it was EWI--which would then mean that your fiance has to leave the U.S. and have you petition for him. Be prepared for a denial.

Last month some people didn't make it who got their case completes close to the cut off date. It was the month MsSheka's husband's interview was scheduled during--Feb/March?

The I-864 is evaluated at the consulate level so technically the CO can ask for a joint sponsor if he/she feels that it is a borderline case. They don't go by 'minimum requirements' but rather, the 'totality of circumstances.'

Presumably, once you turn in the new PCC and the joint sponsor's documents, your visa will be issued.

If he entered the U.S. on the B-2 with the prior intention of staying and adjusting his status, that's committing visa fraud. In that case, it would be best to file for a CR1 and have him return to his country after his B2 expires.

If you are, infact, getting married then put "getting married and leaving post-marriage to file for CR-1/K3."

Since you have the prior intent to get married, you should declare that. She should not overstay her visa (assuming it is given) and then you can file a I-130 for your spouse as soon as you're married. She will attend the interview in China and wait out the rest of the processing time there.

I applied for the local PCC from Calcutta. They just wanted passport size pictures, a form, an application cover letter and Rs. 300 or thereabouts. A copy of my passport, a copy of my school leaving certificate and a copy of my birth certificate. I stated it was for immigration purposes but they didn't ask for any interview letter or NOA2 copy. Not yet, at least. They accepted it about a week ago.

Just for someone's future reference: If you need a local PCC go to Bhavani Bhavan near New Alipore. There you will need to present an application letter and they will give you a form to fill out. You will need to deposit the money in an RBI account.
