2. The send you a RFE -- request for more evidence -- and once you meet that request, the process continues.

If somebody can afford the extra costs and waiting for work authorization on a K3, then more power to you.

We personally can't. And quite frankly, I don't wish to deal with USCIS more than it is absolutely necessary. I know I will have to in two years, but two years is a long time away.

Logically, the CR1 is a BETTER visa. The K3 will, at the most, save you the 3-4 weeks time at NVC. It's up to you to decide whether it's worth the hassle.

I just wish they'd revoke the K3, and utilize the people working on those visas for the K1/CR1/IR1.

From what it looks like, you have two choices:
--Go for the CR1/K3. Hope for the best that it goes smoothly. This might be risky since if it is found out that your marriage is invalid in the country in which it is performed, it is not acceptable for U.S. visa purposes.
--Have your marriage annulled and petition for a K-1. When in the U.S., marry in a state that recognizes first-cousin-marriage.

Have you filed anything yet?

And also, to those who keep referring to India as a country where first cousin marriages are allowed/abundant. NOT true. India has complicated laws and each community -- Hindu, Muslims, Sikhs, Christians -- have their own marriage board. Only Muslims can marry their first cousin or other relatives according to their religious laws. Some Hindus won't marry others with their same last name, let alone their relatives. This stems from the belief that those with the same last name descended from the same tribe or clan. If such a marriage does take place (people with the same last name) -- you have to go trace back SEVEN GENERATIONS of lineage to ensure that the ancestors were not related. Sorry for the digression, but just wanted to stick this out as a FYI.

What you've done so far is NOT illegal. It's perfectly legal to enter the U.S. on a tourist visa and get married and then LEAVE. Which you did. [Most of these weddings have to be spontaneous because I can't see a tourist visa being issued when the answer to the question "what is the purpose of your visit" is "to get married" or even at POE unless you can show overwhelming ties to your homeland that would compel you to return after the wedding. The CO needs to be convinced of this.]

However, entering on a B2 with prior immigrant intent and attempting to AOS is immigration fraud as you're trying to circumvent the proper laws that are in place.

Have your husband file a I-130 if you're going for a CR-1. Which is what I'd reccomend instead of a K-3.

I would like to ask a question of you if I might? First of all let me say that I saw you are from York, PA, I went to YCP during the 1980's, great little area to grow up. Now for my question... It is not for me but for my brother who has met and since MARRIED a woman from Lima, Peru and has been trying to get a Visa for her to move to the US for more than a year now. Supposedly he keeps getting told it can take up to 3 years to get her a Visa, something does not sound right with this. According to her, she cannot even get a visitor Visa to come here. This does not sound right either. I am beginning to think she is doing nothing more than scamming him as he is now sending her money every month to supposedly pay for the Visa processing.


It does not seem like it took very long for you or others here on this website to get your paperwork processed. Am I just being paranoid?

I could see a K-Visa taking a while in some cases....but do you know what he filed? Actually, I should say, if he is the US Citizen HE has to have filed for his wife to come. For the visitor Visa, it is very likely that she has been unable to get one, it is a little difficult in Peru.

Hopefully things are on the up and up but there is nothing wrong with paranoia whistling.gif (I think it is nice that you look out for you bro)

I didn't know you HAD to be born on U.S. soil to become the President. U.S. citizenship is based on "jus sanguine" (due to blood) AND jus soli (on soil).

I know it's moot if you naturalized, but okay as long as you're a natural born citizen, then that's okay.

For example, an American couple could hypothetically have a child in Geneva while on vacation there. That child would derive U.S. citizenship due to "jus sanguine" -- blood relationship to USC parents, making him a natural born citizen AND potentially could be eligible for the post of President.

For example, no matter where Obama was born, and I can't remember where he was born right now at the top off my head, his USC mother grants him United States citizenship. It's why I didn't get the "controversy" regarding his citizenship.

Can anyone confirm/repudiate this? This really interests me, so I'm curious to learn/know more.

To me it seems like the CO is just doing their JOB. Is it fair? Probably not. I'd say it's borderline unethical. But please remember that they've also had years of experience with unethical, unscrupulous scammers. It's just the nature of the beast.

Now if you've done YOUR job and your SO is well aware of who you are and any past "red flags" that might come up during the interview, well, then you've got no problem. Unless the CO is able to provide hard concrete evidence to the contrary, the SO should be able to call BS on it. It's a reflection of how intimately you both are aware of each other's history.

As for the "how many men did you meet?" -- that too seems like a reasonable question. I was on a five year F-1 visa when I met my husband at a college in NY through a common friend. I'd fully expect a question along the lines of "And how many American men did you date in college?" or "How many American boyfriends did you have previously?" Answer: "I went on several dates with some nice guys who turned out to be great friends but nothing really serious until I met my husband in junior year."

It's natural to be nervous but if you've been honest with each other then there is no need to get rattled. Be calm and don't get offended. Keep your cool and there's no need to get defensive.
