My Fiance got his packet 3, for visa K1 and we are pondering on the police certificate. They say he needs a police certificate from the places he has lived since he is 16..
he know lives in Peru. He is 30 years old, but at the age of 16 thru 18 years old he lived in Mexico.
Thers no way we can get a police certificate from Mexico since he would have to request it in person, I think its irrelevant to ask for that. I always thought that it was always important to bring a police certificate for the place of residency within the last 10 years!
Help! whistling.gif if anyone nows what they are really asking at the day of the interview!

The following information was posted by another VJ member, It is clear and very helpful. The three certificates are as follows:
(the statement of 5 days for the certificado de antecedentes judiciales WILL vary for some people, depending on where the fiance has lived. I have heard of it taking anywhere from 5-15 days.)


CERTIFICADO JUDICIAL DE ANTECEDENTES PENALES

-Poder Judicial: Av. Abancay en Lima.
-Copia y original del boucher de pago al Banco de La Nacion.

I sent 12 months of bank statements because that is the only way the bank officer would issue the letter. With statements attached supporting the written statement of how much was deposited in the last year. The statement of deposits in the letter from the bank by the way, is a requirement of the Affidavit.

I included a co-sponsor because I changed jobs, and make less (though still sufficient) than I ever have. My income at this point is considered a stipend. And I do not receive a W-2 because it is non taxable. I assumed it would be questioned. And in truth still think it may be.

I am sure your post was meant to be helpful but I don't need to hear what I may have done wrong. It does not help.

I figured I would post info about our interview since I know many are interested in how things went.

Elias Interviewed at 8 am. He was there for about two hours and spent about 30 minutes talking with the consecular officer. She was an American woman with very limited Spanish (he speaks very little English). He said she was grumpy and irritated but was still kind to him. Telling him "everything is ok son. Just a few more things to do". One we were expecting.....Our certificado de antecedentes judiciales a nivel nacional had not come in time for the interview so they told him as soon as he has it to send it back to the embassy with his passport via DHL and all would be okay. Then the strange part.......She reviewed my 1-134 (affidavit of Support) along with all of the supporting documents (bank letter, current job stuff, I even included 12 months of bank statements, IRS tax transcripts for 2007, 2006, 2005 and 2004) Then gave it all back. When she gave him the yellow slip she marked that they needed the certificado de antecedentes judiciales, my I-134, a copy of my 2007 tax return and my W-2 for 2007. He asked her if what he had shown was sufficient and she said that he needed to give exactly what they asked for. I have now sent electronic copies of my tax return and W-2 but I am sitting here thinking WHAT THE HECK!

I am confused first how they can even ask for 2007 taxes since many people have not even filed. And even more confused by the fact that the 2007 tax transcripts from the IRS (that I included) are not sufficient!

I am okay on my income level but still included a co-sponsor just so ALL bases would be covered. I can not believe that now even after all of the preperation they still want something else.

It has been a rough day for us. Elias is still gathering the stuff to send back via DHL. Please keep us in your prayers as we continue on through our rough day....All will be well in the end, it just feels so taxing after all we have been through.

Just one single thing I don't get =( On http://www.uscis.gov.../form/I-134.pdf for the affidavit of support, it says:

So, they claim you ought to present the tax return filed just if the petitioner is self-employed!

You are correct that the affidavit states that, it is an older and general form. Other countries may not care, however the embassy makes it a specific requirement in Peru. I 100% believe that the embasy will hold up issuing the visa without the tax info included.

As for the medical it is $95.00. If you need vaccinations the Doctor will be the only person who can tell you which ones you need. I recently heard that the different Doctors in Lima will charge different prices for the vaccinations so I would recommend calling them once you have your packet and making your appointment with the one you think is the best! Sorry I don't have more info.

As for the tax return, Make sure that at the very least you HAVE A COPY OF his 2007 Taxes at the Interview. Everyone I know (from Lima) here on VJ has provided copies at the Interview and even though we had a copy of my 2007 tax transcripts at Elias' Interview they embassy asked for my 2007 tax return, and my W-2. We received a yellow slip to send back the additional tax papers and the VISA is on hold until they receive it.

Jared can get a tax transcripts (free of charge, takes 10-15 days) from the IRS by calling 1-800-829-1040.

There are a few people who have interviewed in Lima that have been asked for 3 years of returns.

Peru has been known to ask for 3 years of taxes....My last year looked better that my current year because I am working with a non profit and my income is actually a stipind. At our interview all of our financial info was returned (including a co-sponsor and all of that info) and they requested that we send back ONLY the affidavit of support, my last year return and my W-2. No bank letter, no employer letter nothing else... (don't get me wrong, I am not saying they are unnecessary, they are very important)

However, all that said, I think you will be just fine at your current amount.

If you wanted to prepare a co sponsor you could have everything ready then only submit if it is needed.

In theory a Dr. would drawn blood and run a titer to see what immunities he has....in reality he will probably need to be re-vaccinated (not likely for everything though, only the things the Dr. sees as necessary.)

If he does have to have them redone, is he going to have to have them redone by the docs in Lima? With the approved docs or can he get them redone where he lives now?

I would say if he can get them done there (with the docs in lima) better. It will cost a whole lot less than the US and although he supposedly does not "need them" to enter as you will see this appears to be required in Lima. None the less, he will need a record for AOS. It will need to be a record (form specific) by a civil surgeon. And you guys can pay to have just your record transfered onto the correct form instead of paying for a new medical in the US.

2) What's the name of the certificate that we have to get from the polic in Peru? Where do I find this info? Is it now in the Department of State's website?

You will be fine as long as the date on the Visa does not pass (6 months from date of issuance). It is smarter to wait on the entry than to count on him having the ability to travel out of the US and actually be able to return in such a short time. Since the K-1 only allows for the initial entry. It is unlikely that he would have completed AOS or have received advanced parole in time....

I'm getting extremely worried, because the interview date is approaching, and there are all the normal stresses of getting the paperwork done in time and so on.

My best friend owes me a lot of money and he is apparently going back on his word about paying me back on time as he promised, so my fears are currently being compounded.

Since you surpass the poverty guidelines. Give only the info that the I-134 requires. My savings account was basically used up in the whole process of seeing each other as much as possible but my income and deposits to the bank well exceeded the poverty guidelines. The embassy didn't even question it or my low savings account balance. They just want to make sure you make enough money to support you, your dependents and your fiancee soon to be wife or husband. Don't sweat it and be truthful. No worries. good.gif

Just wanted to update this thread. I did get his name endorsed on my passport (one of the inner pages). Took about 24 hours.

No questions asked at the interview.

I called VFS today, they said it's not problem since we have the PCCs with his name on it and of course, the marriage certificate.

I really don't want to take a chance this late in the game dealing with Indian governmental agencies.

I already have a SSN and all that jazz so I'm not worried about that.

I might have it updated/changed later once all of this is done and over with.

Yeah, my passport was issued in 1997 when I was ten years old. It's valid till 2017.

I spoke to another agent this morning. He said it could be done in 7 days. However, both my PCCs are issued against this current passport. And he also said, that I would be issued a new updated passport which would render the passport clearance stamped in my current passport as effectively cancelled.

Aw, fuggit. I'm just going to take a chance with this. I doubt it's a big deal.

Yes, I did get my Passport Clearance stamped in the current passport that I hold. But why would they reissue a new one for THAT? It's just a notification on one of the inner pages.

The spouse's name is on the laminated page which leads me to believe that they'd have to issue a new one as there is no way to add that in, in pen. Or I guess they could make a notation on one of the inner pages.

For example, my expiry date is incorrect on the laminated biographic page. It is corrected inside with a notation attached. I wonder if they could do the same with the spouse's name.

I'll make a few more calls tomorrow morning as well.

The thing is I have to submit my stuff to VFS next Monday. They will require the original passport. So 27th is the earliest I could submit the application to have my husband's name added. 10-12 days from that would be cutting too short as well. It is my understanding that doing so would cancel my current passport and a new one will be issued -- yes?

I've read a few reviews where the applicant has been questioned as to why the spouse's name is missing. However, it was a one-off question and they weren't hassled about it.

I hope it's no big issue.

I did call an agent today. They said it would take 20-25 days at the very earliest.

Hi all,

Our CR-1 visa interview is coming up on May 12, 2010 at Mumbai and I'm beginning to freak out about any and every little thing.

I retained my maiden name after marriage. I haven't had the time to get my husband's name added to my passport as we were told it would take at least a month to do so. We didn't want to wait around and prefered to get started on the paperwork right away. A copy of the passport has been required at every stage (USCIS, NVC, medical, VFS) and we didn't want to NOT have it in our possession and potentially lose a lot of time. With our interview just 3 weeks away, I don't think we'll have enough time to get it changed now and besides my passport is valid till 2017.

Could this potentially be a problem? Has anyone encountered any questions during their interview? Any experience regarding this issue?
I'd appreciate any advice/thoughts/opinions regarding this.

They took my medical, DS230 Part I & II, photocopy of all passport pages, and Rs. 387 for the DHL courier fee. And three passport pictures. I also submitted my husband's new I-864 and accompanying documentation. They also asked to see some pictures of us together which I thought was strange but I have a bunch stored on my phone so I switched it back on and showed them our best lovey-dovey pictures.

The guy at the helpdesk was very helpful and informative and did a lot to calm down my nerves. I was in and out within an hour.

All those IV fees don't apply to K-1s since it's technically not an immigrant visa.

That's weird. I have had no issues getting through to them on the phone. But they've been VERY slow to respond to emails. Took them about 3 weeks to respond to a query.

I have to submit my documents to VFS anytime during the week of Apr 19-26.

My husband's courier packet should get here by tomorrow evening. I will then use this coming week to sort out our interview stuff and then submit the documents to VFS the following week.
