This is the part that would apply to you if you do decide to have a child outside of the U.S. in the near future--

Jus sanguinis
Under certain circumstances, US citizenship can be acquired via jus sanguinis from one's parents. The following conditions affect children born outside the US and its outlying possessions to married parents (special conditions affect children born out of wedlock).

If both parents are US citizens, the child is a citizen if either of the parents has ever lived in the US prior to the child's birth.
If one parent is a US citizen and the other parent is a US national, the child is a citizen if the US citizen parent has lived in the US for a continuous period of at least one year prior to the child's birth.
If one parent is a US citizen and the other parent is not, the child is a citizen if
the US citizen parent has been "physically present" in the US before the child's birth for a total period of at least five years, and
at least two of those five years were after the US citizen parent's fourteenth birthday.

India, for example, follows both in granting Indian citizenship. Germany, on the other hand, only allows one, can't remember which one, though.

The United States of America grants natural-born citizenship status based on the political concepts on jus sanguine or jus solis.

The former is by blood (sanguine)--one USC parent is sufficient to grant the child USC, no matter which country the child is born in.

The latter is by soil (solis)--if you're born on U.S. soil you are a USC, even if neither one of your parents are. Thus, the popularity of anchor babies.

Some USCs are considered to be natural born by meeting both criteria, others are deemed to be natural born USCs by meeting either ONE criteria.

The problem with people hoping and wishing their K-3s will go through in this current era is that when NVC closes the 129f and proceeds with the I-130, the petitioner and the beneficiary are caught totally unprepared for the NVC stage. What could have technically been completed in 3-4 weeks now takes much longer as they need to sort out their PCCs, civil documents and tax information.

This comes from another VJ member. Her Brazilian friend was in line to get a K-3 for herself and K-4 for her kids. Because their I-130 and I-129f petitions were approved post-02/01, she tried to get USCIS to hold on to the I-130 and forward only the I-129f. Unfortunately, both were forwarded and NVC administratively closed the I-129f. Despite her many pleas to consider her case as a special one, she was told that her husband would have to file separate I-130s for the kids.

You cannot adjust your status from EWI because you have no 'status' to speak of. To AOS, you need lawful entry into the U.S.

You will have to file for CR-1/IR-1 through your husband which will also be denied at the interview due to your illegal entry. You will incur a 10 year ban which can only be waived by your USC husband if he is able to prove sufficient hardship.

I believe they do. I'm trying to think of the member's name but there were two for certain. Sometime back in January. They were RFE'd for something missing with the 129f but since they wanted to continue to with the CR-1, they ignored it and the I-130s were approved.

A I-551 stamp is a temporary GC so yes, theoretically, you are eligible to start working the next day.

Most job applications will not process without a SSN so you can't really start the job-search till you get your SSN.

I already had one, due to my previous F-1 visa, so I just requested for the annotation on the card to be removed.

I started applying for jobs two weeks after I got here and got hired within two weeks of that.

Zero, and I do mean, zero chance of this visa being approved. Let alone from Pakistan.

If I were you, I'd stop worrying about pictures and focus my energies on meeting somewhere in person, however difficult it might be.

Proxy marriages are not considered valid for immigration purposes unless there is proof that the marriage has been subsequently consummated.

If you don't believe us, you can always call a lawyer.

Are you both of Indian origin?

Did you meet on a wedding website? Or was it a dating site?

Do you both belong to the same religion?

If by small ceremony, you mean fire, priest and mangalsutra--you're married in the eyes of our multiple Hindu gods and goddesses and Indian law. You should have your husband obtain a marriage certificate and start preparing for the CR-1. If you're well prepared, you can go through the CR-1 process in 8 months or so. Do NOT do anything as foolish as lying to the US government about your marriage ceremony.

Personal opinion: I find it terribly odd when people talk about how they can't live without the other person given that they've known them for a few months and met only once in real life. You'll survive a few months apart. We all did.

All of the packets we received once our paperwork went to El Salvador was in Spanish. We never got anything in English. Having said that, packet 4 directed us to a website which had both English and Spanish versions as do many of the forms for packet 3.

I was in the Peace Corps in El Salvador and during our training a guy from the department of State came to speak to us. He said that something like 98% of first time tourist visa applicants are denied in El Salvador. That isn't to say that the same person with the same qualifications gets denied and then has to keep trying, it is just that they are really strict on their requirements and tons of people who don't meet them apply. Having said that, for the K visa, as long as you have everything you need you shouldn't have a problem.



Same is true for Peru with tourist Visas. Denied Denied Denied...Maybe if your lucky (and prove strong enough ties, which is the hard part) and approval. But K-1's a different. No real reason to prove ties to return, haha. With a legit relationship most are approvals.

I'm not too sure about what you heard from your friend. I wonder if he/she is speaking more along the lines of a tourist visa....

1.A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).2.Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy. 3.Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).4.I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.5.You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form. 6.A copy of the NOA2 that you received in the mail.7.Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

Congrats!! kicking.gif Round-trip or one-way...either is fine, see which is priced better. E ticket matching the name on his Visa and Passport will be perfect...and there is a section here on VJ that has reviews of many POEs. I have read that JFK may be one of the only POEs where he can get the stamp for work authorization if he is seeking that..... (even then it is not a guarantee he will get it there and still is only good for the 90 days the visa is good for.)

Thers no way we can get a police certificate from Mexico since he would have to request it in person, I think its irrelevant to ask for that. I always thought that it was always important to bring a police certificate for the place of residency within the last 10 years!
