This sounds like NVC. Pay attention, non-EP NVC noobs. Here's Christeen's time tested formula to get you through NVC in one piece alive:
Petitioner: Get NVC # + give operator your email IDs + receive AOS fee bill + pay 70$ online + wait to show paid + print cover sheet + send I-864 AOS with all documents and case # written on each page.

Beneficiary: Get NVC# + receive DS3032 + send DS3032+ DS3032 accepted + IV fee bill available to be paid + pay & wait to show paid + print IV cover sheet + mail DS230 package with all original/certified documents

= wait for case complete + wait for interview to be scheduled.

Suggestions:
1) Have the beneficiary mail SIGNED extra DS230s to you so that you have them handy in case something goes wrong. Or you get hit by a dreaded RFE.

2) If you just received your NOA2, THIS is the time to get your tax stuff and police certificates sorted out. Don't waste time on this.

3) Double check the PCC requirements in the regional forums as they are country specific.

Currently the # of business days NVC is taking:
3-4 days for NVC to receive your case and assign a case #.
3-4 days to receive emailed links after case # has been assigned and email addresses been given to NVC operator.
1-2 days for the AOS bill to show as PAID.
1-3 days for DS3032 to be accepted.
1-2 days for IV bill to be PAID.
8-11 days for case complete after all your documents have been sent in.

Why did you send those things in with the I-130? They are NOT required for USCIS. You will probably have to submit all of those things again for the NVC process.

You now have a new case number that was assigned to you by NVC. Probably start with the letters MTL for Montreal or something similar. Call the AVR, listen to the whole message--it will say "NVC received this case on...The case number assigned is..."

Okay. So that sentence -- On September 14, 2009, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN -- means that your I-130 was approved often also referred to as the NOA2. You just never received the hardcopy.

CALL NVC NOW.

I'm confused--your profile says K-1 but the USCIS blurb says I-130.

Could you PLEASE clarify once and for all so that people can actually help you instead of trying to beat information outta you?

Check the AVR. With your USCIS case number. It'll tell you if NVC has your case and when it was assigned a case #.

The hardcopy NOA2 is not important in the grand scheme of things for the CR-1, from what I understand.

Sign in to the USCIS website. And enter your case number. Where it says POST DECISION ACTIVITY -- does it say anywhere below that this I-130 petition was APPROVED on September 14?

This is old news.

If the 129f and I130 is approved at the same time and reaches NVC on the same day, the K-3 will be administratively closed and the applicant will have to follow the CR-1 route. Which is ultimately, a superior visa.

The latter is visa fraud if you enter on VWP with prior intent to stay and adjust your status. It is not a recommended course of action as it carries a lifetime ban due to misrepresentation if the AOS is denied. It is also against the VJ terms of service to encourage illegal immigration activities. There is no appeal for a denied AOS from VWP.

If you both live in the UK together, DCF would be the best, cheapest and easiest option for you. You will be granted a 10 year GC (IR-1 visa) since you've been married for more than 2 years.

If it's been more than 6 months since your NOA1, I'd definitely give them a call.

The K-3s were quicker once upon a time when CR-1/IR-1 used to take years. Since that's no longer the case and there's only 3-4 weeks or so separating both, the K-3s have now been administratively closed.

Well, there are logical issues like how/where are you going to live, pay the bills etc which the CO might very well touch upon. It's one thing if you don't meet the poverty line but are hovering around it and another thing not to have a job/source of income at all. Do you have any assets that you could show?

I'd talk to some of the Canadian members. They might be able to better guide you. Montreal, from all accounts, is not a tough consulate.

You have about 6-8 months. Redouble your efforts to find a job. ANY job.

Oh, I thought you were still living in Canada and filing for DCF.

Yes, being in the US and having an apartment/job is sufficient domicile.

You can use the parent who has more income.

Remember, the USC petitioner will file a I-864 regardless of income. If your joint sponsor lives in the same household as the petitioner, then they will use I-864A. If they live in a separate residence, then they will fill in another I-864.
For your joint sponsor you will need proof of their citizenship/residency. For household member, you will need proof of relationship and same household/residence.
