Canadak1 switch to AOS???
Even if you cancel the K1, it DOES NOT disappear off the radar. USCIS still has record of your fiance visa. FYI.

Of course, at the end of the day, it is your decision but there could be a lot of trouble if they decide to question you about your prior intent at a AOS interview.

K1s are the quickest of the lot -- some have it done in 3-4 months. And Canada isn't half the world away -- say like India -- you could still vist your fiance and vice versa.

And my sincere advice to you is: Please DON'T try to play U.S. immigration. This is only for your sake.

At the end of the day, the burden of proof rests upon you. Not them. ONLY YOU.

And this is just my objective third-party opinion: for someone who had NO idea/intent about getting engaged till not even a month back, you seem to be in an awful hurry to get married all of a sudden. And I don't know too many people who visit the U.S. with a police clearance certificate.

P.S.: I could have gone the AOS route as I was on a F1/OPT (both are still valid till July 2010) but I felt like I couldn't get married without my parents/friends/family meeting my husband first. I just couldn't do it. So he came to India and we got married here. And we went with the CR1 route. Certainly AOS would have been easier and we could've avoided this painful separation. But in all honesty, I couldn't go through with something easier just for its sake and not have my husband meet everyone else I love, just as dearly as I love him.

Do I miss my husband? Of course, I do. I cry daily. Do I wish I had chosen the easier option and remained in the U.S. through this process? I won't lie. Sometimes, yes. But I believe our relationship is strong enough to make it through with us being apart from each other for a few months. After all, we have the rest of our lives to spend together.

CanadaGreat Christmas Gifts You've Gotten?
No Christmas gifts for me this year. Boo. Parents forgot. Hubby sent it last weekend but it's not here yet. Maybe next week? Mail is atrocious here.

My best Christmas present was a MP3 Sony player my husband (then boyfriend) got me. It's tiny and red and I love it. He also got me a beautiful black stone necklace and matching earrings. I bought him underwear and cologne. Hee hee.

The problem is that a lot of this is arbitrary. If you choose to take a risk, well, then it's your choice.

Logically, do you understand why it's kind of silly to apply for a Canadian PR when you're also trying to prove that you are intending to establish/already established domicile in the U.S. You can't have both even though it's NOT illegal. It's one thing if you already had it way before or plan to get it sometime in the future. But doing both of them simultaneously goes against logic.

And for the last time owning a house/property DOES NOT equal to domicile.

A lot of the comments on the article did seem to suggest that Canadians should be able to cross the border at will.

You're right in your observation that Canadians, have always viewed visiting the U.S. as visiting the 'friendly, welcoming' place because they've have been accorded special privileges (no B2, and technically no WVP either, I believe). However, that may no longer be true -- that's what I was commenting on. Because travelling to and from Canada used to be absolutely hassle-free -- especially when compared to other countries -- plenty of Canadians don't realize that things have changed. Most people still assume or adopt the mentality that just because Canada and the U.S. are friendly neighbors, and happen to share a border/same landmass, they will be allowed entry without any trouble. Mostly, because in the past, it used to be no big deal.

I admit that I also used to think that way (that Canadians could come and go as they pleased and vice-versa) till I read about the tons of cases here on VJ where Canadians where denied entry at POE.

Here's the thing: it's their country, they can deny entry to whoever they please, for whatever reason they choose. Entering the U.S. as a tourist is a privilege that is accorded to individuals at the discretion of the U.S. government -- it is not an inherent right. Canadian or not.

There's a place to change your name on the Citizenship application(I was always told that's the best time). That's what I did for my wife. Don't forget to change it with your local SSA office after your ceremony. They'll always have you as a Perm Res. until you do.

i came here thru k1 visa, i ddint know that i can get ssn before getting married so what i did is to applied for it after the wedding, applied my ssn last march 25, they said it will take 4 weeks because they need to verify at the immigration, and i still untill now, i dont have the card,


I would go down to your local office, you quite possibly will have to apply again.

Hey Guys,

We got married in China and we registered our marriage in China. Do we have to register in the US?
If so, how do we do it?

Question 2, My wife is the one applying for citizenship and I'm an natural born American I have given them so many original birth certificates over the years. Will they take a copy of one at the interview?

Question 3, We receive a yellow document telling us, on the paper to bring a current marriage certificate. That was the only thing they asked for, do we still need to follow the what to bring guidelines even if my wife has never left the country, broken any laws, etc?

(My wife missed the first one)

My wife read, "Who lives in the While House?"
Then my wife wrote, "The President Lives in the White House."



We waited an hour but the interview was only 20mins. The IO was very friendly and did not request any docs. She only gave the test and went over the application. She let me and my baby boy come in the office with my wife.

Just an update, we have emailed the consulate three times now and they have e-mailed back each time basically telling us to be patient and that it is under review. The sheet they gave us specifically said we would hear from them four weeks from when they received our papers, but four weeks passed on the 24th and still no reply. I guess they will be getting another e-mail on Monday. I don't know if any of you have seen the movie "Brazil", but I am feeling very much like Sam Lowry right now. Don't mess with Bureaucracy because Bureaucracy will mess with you! wink.gif

My husband had his interview for his CR1 visa in Montreal on June 15 and was denied because I am in Canada with him presently. They asked him to send in documents to prove my domicile within the states. I have maintained a domicile within the states and so we sent documents showing that in and our tracking number showed that it was received in Montreal on June 26. His interviewer said that he would get a reply really quickly, but we haven't heard anything yet and we're getting a little stir crazy! Has anybody else had this experience? And if so, how did it turn out for you? Thanks for any help. These last bits of waiting are brutal wacko.gif

In India, a "religious ceremony" is considered LEGAL marriage. You just need to register it and obtain a marriage certificate as proof for immigration purposes.

Why wouldn't you register the marriage or more importantly, WHY would you show pictures of a religious wedding at a K-1 interview for your fiancee? You're proving bonafide RELATIONSHIP not MARRIAGE.

What the CO meant by getting married AGAIN, was registering that marriage and then applying for CR1 or K3.

All said and done, I wonder what happened with this case. Any updates?

The only way I could see this not working out is if they ask you for pictures of the engagement ceremony and you don't have any. Or if you say that you didn't have any engagement ceremony. That might be a problem since you're petitioning for your FIANCEE. Not your lover, girlfriend, or partner. Not even the mother of your child. Fiancee in this sense, means something.

I was kind of wondering about the same thing. My husband and I met in college and dated through junior and senior year. We literally spent every minute together from dawn till dusk but didn't think to document it since obviously we had no idea we'd end up married. We have pictures, chat-logs and support affidavits from friends and parents for evidence. It's not the post-marriage bit but the pre-marriage bit I'm thinking about.

I didn't think to save movie tickets or dinner tabs or hotel/gift receipts (I think I have a few somewhere but those are sitting in the pocket of some winter coat in some suitcase in some storage unit in MI). But I'm guessing me walking into the USEM with a copy of The Dark Knight as proof of Christmas presents exchanged with hubby (then boyfriend) isn't really going to get me very far.
