You can file for ROC even if you're divorced. However, the divorce would need to be final and you'd need to be able to prove that you married your husband in good faith.

If I were you, I wouldn't be worried about the bonafide evidence. Sounds like you got that covered.

Your two concerns are:

1) Being let into the U.S. without a re-entry permit -- If denied, my best guess is that you would have to file for an IR-1. So yes, you'd have to go through the whole process again.

2) Say they let you in with a serious warning. Your next concern would be to file for ROC. This could possibly go eitherway. You could be approved because of your strong evidence. Or it might be denied based on the fact that you were out of the U.S. for nearly 18 months of your two year conditional GC--a sign that USCIS sees as you not being really serious about being a U.S. PR. In that case, my guess is that you could file for AOS.

Can anyone confirm this?

Again, when are you planning on entering the U.S.? Until you do so, you won't know for sure which way to go.

Until you are allowed entry at POE, assuming the CBP doesn't consider you to have abandoned your LPR status, all of this is conjecture at this point.

Your USC SO can come and go as they like.

Build up your bonafides/evidence but also consider the possibility that you might have to go for a IR-1.

I'm going to have to agree with the previous posters. Sorry. Just don't buy it. Of course, being the upper forums and all we'll be shortly chastised for passing 'judgemental comments'. But again, I can't help it. I see this far, far too often and I'm not buying it.

You got to the U.S. in May. It is now June. You have your GC. You're living separately already and from your OP, I see no indication that you've even lived a single day together. You're also already thinking about divorce, 'Removal of Conditions' and how to stay in the U.S. Wouldn't it be easier to move back to Japan where you have friends and family to support you in this very difficult time of your marriage ending? Doesn't sound like 'love,' 'bona-fide' or 'good-faith' to me. And honestly, I can't see USCIS buying it either.

There. I'm done.

Your best bet is to file for divorce and then file on your own as Bob has outlined above. What kind of proof would you even provide with your I-751?
And no, ROC is not granted on whether the applicant has a large house or a high-paying job.

Things like joint tax returns, both names on a lease for a house... that's strongest. Whatever shows a comingling of financial and personal lives.

We were able to enclose the "birth facts" sheet (from the hospital) for newborn Mini-Bone, plus a photo of him and the bleary-but-happy Papa & Mama T-B. after surviving the very first night in the hospital. Fortunately, I had put the rest of the ROC package together in advance, or we NEVER would have gotten it off. Things have gotten a bit less hectic now that Mini-B. is 4.5 months old -- those first 3 months were an experience, si man. :)


I didn't know there was a mini-Bone, congrats on his arrival!

If the above described scenario were true, then you wouldn't be filing for ROC jointly, claiming that you are a happily married couple in a bonafide relationship, would you? You'd have to obtain a divorce (claiming abandonment/absent spouse or whatever) and file with a waiver. :star:

Your list looks good to me, but like JustBob said, looks like we need to focus on very relevant evidence of a bona fide marriage. My husband doesn't drive either, but our IDs have the same address.

Quick question: is it mandatory to include 2011 tax transcripts if you are a January or February filer?or 2009 and 2010 tax transcripts would be enough?

The list looks good, just keep adding more statements as you keep getting them.

I would like suggest you get a state ID if you don't want to get a drivers license as I have noticed a lot of people getting RFE's for drivers license. This would also show proof of same address and would also save you as having a government ID instead of carrying your gc and/or passport as identification.

2010 IRS Tax Transcripts
2011 IRS Tax Transcript (hopefully by then)

Copy of Mr. Sachinky's driver's license
Explain that Sachinky doesn't have a license and doesn't wish to drive because NM drivers are d-bags.

Cards/Invitations addressed to the both of us (6)
Photographs (15)
Car loan/payment with both our names on it
Verizon phone-bill with both of us on the same family plan.

A Netflix flap with both our names on it.

How does this list look? Anything that I should be adding? What's redundant? How many bills per item should I be sending? Is this sufficient or should I be getting creative?

What I did is have the credit card company send us a letter that stated that we were authorized users on each other's credit card. For example, Mr. Sachinky is an authorized user on account number 01948830. Sachinky is the primary account holder. Vice-versa. Highlight that information. Contact your CC company -- they should be able to do that for you. Easy enough.


We also have one credit card on which we are joint holders. All the statements are in both names.

Hi, I have a quick question and was wondering if anyone knew the answer since I am still not clear on it.

When can you apply for citizenship? By that I mean, when can you send off the papers? AFTER the "resident since" date on your greencard or is it 90days prior to that window like it was for the ROC?

For example, I have been a LPR since May 20, 2010. When can I send off my N400 papers? Will it be only on/after May 20, 2013 or can I mail the package out sometime in February (90 days before)?

I would make an infopass and see if they can redo your biometrics.

This worries me as they had a lot of difficulty getting my fingerprints as well. Took a while and finally the man overrode the system manually.
