K-1 Fiance(e) Visa Process & ProceduresPCC from Reg Passport Office Kolkata, India
When I had my interview, Mumbai required a Police Clearance Certificate and a Passport Clearance from the RPO. I don't know if the rules have changed or not. If your passport is less than 6 months old, I know one of them is NOT required. But I can't remember which one off the top of my head. I got the passport clearance done through the travel agency and took care of the police clearance on my own. They are basically both clearances, and comes from different sources. Once I got the passport office clearance, I submitted a copy of that so that the second clearance didn't take too long either. Both combined were about 21 days. A police officer came to my house to verify the address and place of residence and asked a bunch of dumb questions, drank tea and took the Rs. 500 note my mom gave him happily to speed up the process. Hope this helps!

PCCs for Mumbai are for one year, I think. Mine was over 6 months when I had my interview and I didn't have any trouble. You might want to check with the Consulate-General. I know they changed some of the rules over the last year. Good luck!

If you don't feel like dealing with the stuff yourself, you can get it done through a travel agency. Mine was done in 7 days and I paid around Rs. 1000.

K-1 Fiance(e) Visa Process & ProceduresHow can a K-1 misrepresentation denial be overturned?

Ha, it figures you would pick up on my "subtle" reference to Goa. Posted Image

VERY true of India though! Things like this that no American would bat an eye at can be heavily scrutinized in India. I recall reading a thread a while ago about an Indian couple going through the K-1 and being denied because they took a trip together alone and the CO thought they must be married because as you said, no Indian parent would allow their unmarried son or daughter to do this.

Eee, Mr. Sachinky and I took a trip to Puri a couple of days before our wedding since he was scheduled to fly out right after our wedding and there wasn't any time for a honey-moon, per se. While my parents, of course, knew about it and so did my close, immediate family, I was advised by mother not to mention it to extended family/elderly relatives/village-cousins for fear of outright disapproval. Of course, she should know better than that. Things like that just make me mad so I told all and sundry during the wedding that our lovely tan was from sun-bathing at the Puri beaches. Oh, the horror!

K-1 Fiance(e) Visa Process & ProceduresHow can a K-1 misrepresentation denial be overturned?

The CO believed them to be married because of an online photo album that was discovered after the beneficiary was instructed to open his and the USC petitioner's Facebook accounts. The album was entitled our "wedding".
In addition, the beneficiary provided photos as evidence of a trip they took together to a popular touristy beach town (trip was taken after their engagement) and the CO interpreted the trip as their "honeymoon" after their "wedding".

Good unmarried Indian boys and girls don't take trips to Goa. Chances are most Indian parents wouldn't approve of an overnight trip prior to marriage, even if the couple is engaged. Things like that, it looks bad.

K-1 Fiance(e) Visa Process & ProceduresHow can a K-1 misrepresentation denial be overturned?

You're saying that the K-1 will be denied for having pet names for each other as husband and wife? What should I do with all of my proof of relationship correspondence which includes these references then? My fiancee has enjoyed this playing and so we've referred to each other a lot in this way? These correspondences need to be tossed then, are you saying? Should I go through and blacken out all these references? I mean to refuse a visa on this grounds seems absurd. How about when we call each other baby? Will it be denied because we're underage?

"Husband" and "Wife" are LEGAL terms, implying an ongoing legal relationship unlike pet names or referring to each other as 'baby' which are clearly, terms of endearment.

I understand your desire to be married but you have to be careful when dealing with high-fraud consulates.

K-1 Fiance(e) Visa Process & ProceduresHK packet 3
It took a little more digging but I found it. They issue the Medical in packet 4. They schedule the interview in packet 4, and only then does the doc see the patient. Seems slightly out of sync to me, but it's almost over so more bending and less frustrating I guess.

K-1 Fiance(e) Visa Process & ProceduresHK packet 3
Hi everyone,

My honey went to embassy in HK to pick up her packet 3 and I am worried something is missing. Just a little background first. She is from the Philippines, but she has worked in Bahrain from 01-03 and 04-06, and presently in HK from 08 until now.

The packet IS NOT asking for a GCC from Bahrain, which we had already requested 3 months ago, and due to the unrest there we advised a wait time of up to 18 weeks!

Also the packet DOES NOT ask for a medical from HK. She did need to get one when she first arrived in HK to work. Now I can maybe understand no request for GCC due to the unrest in Bahrain, but I am not too sure about the medical. I would not think that the US embassy would have access to her medical, or if HK would even allow this to be shared with the US. Besides, the medical would be 3 years old, which I would think is beyond an acceptable time range for her visa app.

After waiting this long for this process I am trying to avoid any further delays. As it is, the embassy originally mailed the packet over 2 weeks ago, and they sent it to the wrong address. The address had “block 2” typed on all our forms, but they sent it to “block c”. This was after first claiming that is was mailed on 25 May, and when we did not receive it they replied in a follow up email that they did not even have the forms from the NVC! Which was the first error on their part.

I know I can contact the embassy and ask about the forms, but I guess the real question is, and is ALWAYS stated here, just follow the directions and give them what they ask for. We are too close to completion on this now, and to avoid any delays is always a good thing.

Anything similar happen to anyone out there, or suggestions? Thanks.

Greg

K-1 Fiance(e) Visa Process & ProceduresTwo different stories, one ruined wedding.
Your options are to get married in Canada and file for a CR1 or K3 (would suggest the former).

Or you can file for a K-1 and enter the U.S. as a a fiance and get married within 90 days.

You cannot enter on a tourist visa with the intent to get married.

I'm sorry this happened to you but you've found a great resource and people willing to help with advice.

Good luck with your journey!

My husband and I got married in India in August. His parents were unable to make it. So it was just for my friends and family. If your cousin's mind is made up, then there's really nothing you can do. I'd say stay out of it unless you have HARD PROOF. Not liking the fiancee is not reason enough.

K-1 Fiance(e) Visa Process & ProceduresMarrying outside US but still coming in K-1 Visa - Possible?
A religious wedding in India is considered to be a legal marriage. So you can go to a temple in front a priest and exchange garlands and sindoor and you are married. No court in India will overturn it. However, the Supreme Court of India has recently ruled that all couples should have their marriages registered under the appropriate district authorities. My aunt and uncle have been married for 25 years and they didn't have a marriage certificate until recently after the directive was passed.

You can try if you have a valid B2. However, there's a chance that they may deny you at POE. Carry strong proof of ties to your home-land.

K-1 Fiance(e) Visa Process & ProceduresK-1 with a Caveat
I don't think it's immoral or THAT big of deal, if it is NOT illegal. He's 21, and 5 years older than the girl. Far more okay, IMO, than 17 year olds with 48 year old men. THAT's far more creepy. At least according to me.

What I'd say to you is to be absolutely sure that this is what you and your fiancee wants. Might sound a little hypocritical coming from me since I'm 22-going-on-23, but 16 IS too young to know what you're going to do with the rest of your life, let alone knowing if you're 100% ready, committed and dedicated to marriage.

Having said that, I wish you luck in whichever path you choose to take.

K-1 Fiance(e) Visa Process & Proceduresdivorce decrees
Nigeriaorbust -- If your ex-husband remarried while he had not completed divorce proceedings with you and had the divorce decree, then legally, that second marriage could be declared as null and void in a court of law in most countries that don't allow polygamy. To marry again, he would need that divorce certificate to show the dissolution of his prior marriage, making him eligible for remarriage. Technically, in this case, he was still married to you. But separated and living with another woman. They might have been living together as man and "wife" in the eyes of society. But not in the eyes of the law. This is my limited understanding of marriage/divorce laws that operate in most countries. Someone, please feel to correct me if I'm wrong.

And OP, please read the form.

Most people lack basic comprehension skills these days. Plenty of people have been RFEd or given a 221g after the interview for incomplete divorce documentation. If you want to take a chance, then please feel free to go ahead.

K-1 Fiance(e) Visa Process & Proceduresdivorce decrees
They want documentation noting the dissolution of each and all previous marriages to ensure the applicant is free to marry.

The instructions are clear in this regard--EACH marriage. You've been married five times previously? You'll need the corresponding divorce certificates.

I would assume this is done to ensure that marriage #2 was properly dissolved in order to lead to marriage #3 or #4.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa - Overseas Wedding???
If you don't want to wait, then get married and file for a CR1.

A K-1 is to bring your fiance over to the U.S. and marry her there. If you've already married her then why would you bring her over as your fiancee? Makes no sense to me.

Also, if you wish to have a ceremony check out the regional legal/religious implications of it.

And don't file for a K-1 if you are going to get married anyway. You can't CONVERT a visa to anything else. So you will not be saving time by filing for a K-1 and then changing to a K3. Instead you will be wasting time and will have to file anew for the K3/CR1. I'd reccomend the CR-1.

And no, it's not that easy to marry in Portugal and show your marriage certificate to bring your wife over. You have to pass through the immigration/visa channels. If the former case were true, all of us would've done that.

Good luck on your visa journey! smile.gif

K-1 Fiance(e) Visa Process & ProceduresTravel as a tourist after getting visa?
Where's the problem? She goes to her interview in January, attends her graduation ceremony in March, flies out the next day and you have plenty of time to get married in April.

The K-1 can be used till 180 days after its issuance.

K-1 Fiance(e) Visa Process & ProceduresWho is in control-petitioner or beneficary?
I'm the beneficiary and I'm pretty much doing the paper-work on my own.

I have a job but I'm free most of the evening whereas my husband's work is more demanding. He has been filling up the forms and getting all the required documents as and when I ask him to. We've called USCIS three times so far, all of them from him (I told him what to say/ask). When it gets to the Embassy stage, I assume I will be doing the calling.

In fairness, I think BOTH parties should take an active part in the process as it affects both of your lives.

OP: If your wife's questions are really rudimentary then ask her to read the forms or join VJ to have them answered.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa for my fiance
Arranged marriages (although declining in metropolitan or urban centers) still do take place in India. It's usually a family friend or a friend of a friend and there is definitely NO restriction on meeting prior to the marriage, under supervised conditions. Years ago when I was little, a cousin of mine was getting married and we went around visting houses of six different girls. After the customary greetings between the families, the potential bride and groom would be allowed to go to a room together for an half an hour or so, so they could get to talk about their likes/dislikes etc. It wouldn't be unchaperoned though, so obviously I would be sent with them. I'd sit around staring out of the window listening to awkward, fumbling conversation. Once outside, everyone would ask ME for the juicy details. Thankfully, he liked the sixth and last girl he saw and that was the end of that.

Nowadays, it's more of an extended dating network. So-and-so's son wants to get married--calls will be put around the neighborhood and amongst family members, looking to see if anyone knows of an eligible, educated girl. Or they end up marrying a family friend they've known since childhood but weren't in love or dated in the traditional sense. However, there is usually a courtship period to determine compatibility after the initial talks and the actual wedding day.

Sorry to go off-topic but that's just my two cents.

And as already been pointed out, this restriction goes against the logic of a K-1. Meeting isn't allowed but an unmarried girl would be allowed to fly and live with a stranger out of wedlock for 90 days? Really? USCIS isn't going to buy that. You're going to have to try harder.
