Christeen, my husband is filling in his I-864, he is currently living with his mother and father. He is not making the required income so my cousin will act as joint sponsor.

My question is: in calculating household size what figure should my husband use? 2 for the two of us? 3 just including his parents since he can't financially sponsor me? Or 4 including me and his parents? Could you please clarify this for me?

If you have the paid receipt, you can send your I864 in.

Do you live with your father? If yes, he will file a I864A. If you live separately, he will file the I864 and if your mother's income is included she will sign a I864A. And I would think it would make sense to submit a copy of their marriage certificate as well. Some one please correct me if I am wrong.

Whether he files the I864 or I864 A will depend on whether you live together and/or he claims you as a dependent on his taxes/file jointly.

Actually disregard what I say and wait for someone to clarify this.

Send your AOS package. As soon as your DS3032 is accepted you will be able to pay the $400 IV Bill. After that you can send the DS 230 package. Some people send I-864 and DS 230 together to avoid any false RFEs and so that they receive everything at the same time.

So you went to the interview and didn't have your husband's divorce decree and now your visa has been denied? Is that what you mean?

Was it outright denied or were you asked to provide the divorce certificate? If it's still at the embassy level, maybe the USC can request a second interview and provide the required evidence? Otherwise, you might have to file again. If it was denied then there may be no other choice.

You have to prove really strong ties that you're going to go back. For me, it's hard to prove because I just got married, my husband is there, I just got out of college so I can no longer say I have to return on so-and-so date for school, I am here for only a few months to wait for the visa processing so I am not working full-time. I don't really own property either. So yes, I would not apply as I cannot demonstrate sufficient cause for coming back. Even though I spoke to the US consulate and they said yes you can go, they also mentioned I might be denied at the POE.

Is the passport clearance the same as police clearance? Or do I need to get a police verification report from my local Police Station and then get a passport clearance certificate? Or should I just apply at the passport office and then they'll get a clearance from the intelligence bureau amounting to a police clearance?

Hmm. I was 14 not too long ago. Stubborn as hell. WHY does she not want to go? Does she have a specific reason? Will miss her dad? Where is her father in all of this? Has anyone spoken to him? Maybe HE can convince her? Would then make sense to get him on your side, so to speak. Does she like/dislike you? Maybe you can reach out. Try talking to her. Say hello on the phone, at least. Does she like anything in particular? You're the USC, maybe you can send her a few fun token presents? Some Hannah Montana #######? M&Ms and Seventeen magazines? Or whatever they read these days. Try and get her excited about moving to the U.S. Show her how much fun it'd be. I understand I'm advocating bribery but that may be your best option at this point.

I think that's a good start. Explain everything honestly.

1) Bolster your case and relationship. Get started on EVERYTHING that they want.

2) I would suggest talking to the 14 year old and see if you can get her to understand the situation and how important her cooperation is.

'Cause I think you have two issues -- the children and your relationship to them. And the relationship between you and your fiancee. Work on both. Before you decide to go for CR1 or refile a K1.

What was the stated reason for denial?

Did you have an engagement ceremony? Very critical. Because you're petitioning for your fiancee not your girlfriend. But make sure it's not a Bollywood style as they might think you got married instead.

Get pictures. TONS of pictures. Affidavits. From your side. And her side as well. Has it been sent back to the U.S. already? If not, try your level best to keep it at the embassy level. You, as the USC, should inquire about the status, insist on finding the exact reason for denial and then try and bolster your case. Whether it's pictures or financial documents, give them what they want.

Maybe a little more about the interview questions would be more helpful.

If the primary sponsor doesn't meet the poverty level guidelines, does he/she still need to submit supporting tax documents and employment letter etc? Will only the I864 be sufficient? And the joint sponsor will fulfil the rest?

It has a lot to do with timing. Maybe you filed during an off-week and it got approved quickly. Or maybe your file fell to the floor and got kicked under the desk and is recovered after four months when somebody comes in to sweep. Mostly has to do with luck. Or maybe they are sleeping on the job. Hard to tell.

My cousin in MD will file another I864 as joint sponsor. His income is enough to cover his family (him, wife, and daughter and me, the intending immigrant). Now hypothetical question: Say his income wasn't enough, and he was using his wife's income as well. Would that mean the wife would then have to file a I864A?

You should get started on the PCCs. The good thing about NVC is that you can control the flow and pace. If you have everything ready, it might take 3-4 weeks. The only thing taking time is the acceptance of DS3032.

However, Montreal has a terrible backlog currently so you might have to wait 2-3 months to get an interview.

You need to call NVC and ask for a case number and give them both your email addresses. At this point of time it's taking 2 weeks for NVC to receive and update your case into the system so I would suggest calling after a week at least.

Also, please fill up your timeline so we can all stay updated.

If you really want, file for both together. Then continue with whichever one seems to be processing faster.

The K3 might save you a week or two. But the IR1 has other advantages on arrival. However, if cost/working is not an issue for you, go ahead and file for the K3 and IR1/CR1.
