IR-1 / CR-1 Spouse Visa Process & ProceduresIR1 interview, does the US citizen needs to be present?
Only certain consulates process immigrant visas. Although I live in Calcutta, I have to interview in Bombay.

Ok, I just did a little research. Ecuador is one of the hardest consulates to please. Talk to Tbone. Given the lack of evidence and the secrecy of your marriage, I'd definitely urge you to be there at the consulate.

IR-1 / CR-1 Spouse Visa Process & ProceduresIR1 interview, does the US citizen needs to be present?
It is not REQUIRED for the USC petitioner to be there but it is always recommended, if nothing for moral support. I'd ask in the regional forums as I am not to certain about the requirements or how easy/difficult Ecuador is.

Also, just as a FYI: using money/wire transfers as a proof of bonafide relationship/marriage is generally unfavorable.

Do you have phone bills? Chat logs? Emails? Bank account? Support affidavits? Those are other things that can be used for bonafide evidence.

Doesn't matter. Although typing it out and saving the pdf is obviously easier as you can print out one copy for the interview as well, as a backup.

You can add anything that you think shows a bonafide relationship/marriage between you and your wife.

I485 is submitted with the Adjustment of Status. Different thing.

There is a lot on Vj debating the merits of front loading/back loading the petition. You can read up on it. Where will you be interviewing? If it's Delhi, which is a difficult consulate, I'd recommend front-loading. If nothing, it assures you that the CO will get a look at the evidence before you enter the interview room.

For a CR-1, USCIS's job is to make sure:
The USC is, in fact, a USC.
You and your wife were free and able to get married when you did get married.
That you have a legal, valid marriage.
And that the petitioner doesn't fall under the Adam Walsh Act.

Beyond this, they don't care much. The rest of the evidence is evaluated at the embassy. My point is: it is up to you solely to submit a reasonable package with the I-130. It does not have to be a five inches long. Unless you have red flags that need to be addressed. Do you?

The K-3 visa is now officially obsolete, post 2/1.

You only need send in the I-130 with the appropriate forms and relationship evidence. Depending on the consulate and your personal case situation, overloading the petition is a good idea. For others, you can take the additional proofs for the interview.

You can use those affidavits from your father and sister. I had two from his parents who weren't present at the wedding but had met me before and knew about our engagement/wedding etc. We plan to have another ceremony in the U.S. once I return for his family and friends. I have about six affidavits for the interview from our common college friends (we both studied in New York). I have two from my family and two from wedding guests. This is for the interview, though. Better to use more from the USCs side/or by people who are USCs.

Yes, a copy of the beneficiary's passport is also needed. Number 6.

I would definitely write a "timeline/evolution of relationship/petitioner's affidavit" outlying some of the major points of your relationship and add it there. Sign it and date it.

Good luck. Don't stress too much about it. The I-130 is an easy form. The waiting is a killer though. So send it off as soon as you can.

For the I-130 basic info is enough. I don't think you need anything else. Throw in a phone bill with her number highlighted or a few copies of your chats together if you want to. Always a good idea to have the petitioner write a timeline of the affidavit and sign it.

6-8 months for a CR-1 visa. Some manage it in 4-5.

You can get from both parties. Best to have more from the USC side.

I have 10 support affidavits. 8 are USCs and 2 from my mom and my uncle.

I think $19,000 is the 2010 poverty limit, so if you're making $23,000 you should be okay, in my opinion.

RFE = Request for more Evidence.

Yes, she will be interviewing at Chennai then.

Don't worry about the financials now. Then come into play at the NVC stage. If you don't qualify as a sponsor, get a joint sponsor. It can be anyone, relative or not, as long as he or she is a LPR or a USC.

W2s and tax returns.

Or IRS tax transcripts.

Congrats on the wedding.

For now, just file the I-130. With the required documents like the forms and marriage certificates, and a few basic bonafide relationship evidence. We used six pictures (3 from the wedding, 3 non-wedding), 3 support affidavits (his dad, my mom and my uncle), our wedding invitation card, and our joint bank account statement. I think that was about it. Ours was approved in 118 days without an RFE. Which consulate will you be interviewing at?
